Hey Simon
Thanks for your help with my first question. I am curious and I want to learn more from you.
I have already sent my documents to KCC 2 months ago. Do you know when they reply? They estimated 3-6 weeks and they have not replied yet. Do you think that the corona virus makes the process slower and longer?
Cheers mate

Ignore the 3-6 weeks. It depends on their workload and your case number.

Hi Simon, I’m 2022OC12XX. Unfortunately I hadn’t come across your website before submitting our docs to KCC. So in the email subject line I included the words “Case Number: 2022OC12XX” in the subject line 🙁
Q1: Should I resend the email again to bump us up so we can DQ?
Q2: Currently in NZ but am considering moving temporarily to Taiwan for at least 6-12 months (not a citizen there, just for work). How difficult is it to change the interview location to a different region and are my chances better if I come back to NZ just for the interview? It would be difficult and expensive with quarantine, but if it’s the best way then will have to find a way to make it work.
Thank you in advance.
September 11, 2021 at 19:33
1. Yes
2. Your interview won’t be for a few months – so maybe things are different by then. If you change address to Taiwan, update that in your DS260 and KCC will schedule you in Taiwan.

Hello simon,
I’m 2021 winner and my case number is around 6900, I’ve submitted my ds260 too late (13th of August), due to recent news, do I still have chance? I mean is there any hope for me to wait?
September 11, 2021 at 19:34
You might have a chance.

Goodday Brit
Shout out in SA . I asked you about the DV LOTTERY PROGRAM if I have a criminal record thank you for the response to say it depends on my conviction. But I am interested to enter the 2023 program despite my record can I continue to enter and what are the procedures to follow interms of immigration lawyer’s or wait to be selected if possible then, what would be the next step to follow in order to have a waiver or so.
Thank you for your help and enlightening some of us who doesnt understand the immigration laws.
Thank you in advance.
Yours truly
Califomia
September 12, 2021 at 13:58
It’s just a lottery with a chance of selection of once in 100 years. So enter, if selected, then you can think about the process.
September 13, 2021 at 04:25
Hello Sir. I hope you are doing well. Sir I have stated in my DS260 that I have worked two organizations, but I don’t have any testimonials to prove that I have worked there. So will it cause any problems sir? FYI : I applied the lottery with bachelor degree sir.
September 17, 2021 at 00:37
No problem.
September 10, 2021 at 12:50
Dear Brit I have a question
DV 2021 won the lawsuit as I understand.
I didn’t join the lawsuit
So I benefit from the win?
September 11, 2021 at 19:38
Maybe yes – wait and see.
September 10, 2021 at 13:10
Hi brit
I got married after results were announced and after submission of ds 260, then i unlocked it and add my husband,
Will that be cause of denial?
Me and my husband were in living relationships for almost 4 years before we got married. As result were announced and i dont want to move usa alone so i got married
Thank you
September 11, 2021 at 19:41
No problem, but be prepared in the interview to show evidence of the relationship existing prior to the lottery win.
September 10, 2021 at 13:18
Hi Simon,
I really need your help. I’m Dv 2022 winner cn Af4####. I started filling my ds-260 and after filling in most of my personal information, to move to the next step, I keep receiving this message: Application Error
You have encountered an application error. Please try again later. And sent me back to the beginning. I keep trying so many times and days to weeks and still no way I can pass by that stage. My questions:
1, What might be the problem?
2, What you recommend I should do?
Thank so much for your help.
September 11, 2021 at 19:42
I don’t know what you are doing wrong, but try a different computer, different browser.
September 12, 2021 at 10:07
Hello Simon,
Thank you for your immense support and advice.
I am a DV2022 candidate from Guinea and requested my police certificate and received it today.
The report does not have my passport number although I requested with the passport number. Instead, they mentioned my birth certificate number.
*** Is it good ? To use this number different from that of my passport.
Please provide your thoughts. Thank you
September 12, 2021 at 13:59
It’s fine.
September 12, 2021 at 09:40
I struggled so much as well, then someone said to save my work every few minutes, especially where you have to input your previous addresses. Once I started saving every few minutes, I was able to complete the whole form. Good luck
September 10, 2021 at 13:35
Hi Simon,
Thanks for your immense support and guidance.
I’m a DV2022 selectee from Sri Lanka and I have requested my police cert and received by today.
The report is not having my passport number though I have requested with passport number. Instead of that they have mentioned my National ID card number which is the identification number for all the Sri Lankans.
1. Is that fine? Same ID number is mentioned in passport as well.
2. Do I need to provide any affidavit / justification letter when submitting my documents
Kindly provide your thoughts. Thank you
September 11, 2021 at 19:42
1. Yes
2. Not for the police cert issue.
September 10, 2021 at 13:59
Hi, Simon! At the question: Have you lived anywhere other than this adress since the age of sixteen, if I forgot to mention the adress in America where I have lived for 5 month, will it affect my interview? I have a low case number, 2022EU00001XXX
September 10, 2021 at 16:28
I want to mention that I have not lived at the same adress in those 5 months. I stayed in several locations.
September 11, 2021 at 21:18
Hi Alice i also did not mention previous address when stayed with my visitor Status in USA 5 month. I asked some people they told me does not need unlock and add so I did not to be honest still worry about it not sure should i have or not however i mention that trip for before US travel question.
Did you asked unlock ? Your that trip was visit purpose ?My case number current in October
September 11, 2021 at 21:41
Hi! No, I did not ask them to unlock. My case number is also current in October. Yes it was visit purpose, and I stayed in severel locations not just one. Hope it will be fine for both of us!
September 12, 2021 at 02:22
Hope it will be fine. Also i asked from Brit few weeks ago he said it is ok no need unlock. you did not mention as a visitor probably thats why he recommended unlock and correct.
By the way i have not asked send documents. Still waiting.
September 11, 2021 at 19:43
Unlock and correct the DS260.
September 10, 2021 at 14:28
Hello,
For a non-DQ’d applicant, would you advise to cc the consulate when emailing KCC? In previous exchanges, the consulate just replies there’s nothing they can do until KCC sends the file. The lawyers have been saying to copy the consulate, but not sure if it will make a difference/ just frustrate the officers.
September 11, 2021 at 19:46
No
September 10, 2021 at 14:42
Hi, Simon! If KCC has sent me the documents request and I submitted all the documents, but after that I realised that I need my DS-260 to be unlocked, and they unlock the form, after submitting again the DS-260 will I need to send them the documents again?
Also, will this thing-unlocking the DS-delay my case? Thank you!
September 11, 2021 at 19:47
Only resend the documents if they have changed.
Usually no delay, but it depends what you are changing. It’s in the FAQ
September 10, 2021 at 16:54
Hi Simon,
Does all applicants on the same profile has to go to the same embassy for interview together?
Thank you
September 11, 2021 at 19:47
Normally, yes
September 10, 2021 at 17:45
Hey brit! Hope your doing well! I’m from DV2022 AS69XX. I submitted my DS 260 form… should I wait for an email from KCC requesting my documents for me to send them or shall I send my documents before I receive an email?
September 11, 2021 at 19:48
Send them.
September 10, 2021 at 19:26
Hello Simon;
I have three questions, first I am 2022AF16XXX my interview will be in Guangzhou, my questions are as follows:
1- First question, if the Judge reserves visas for DV21 next year do you think the fiscal year will be the same with DV22? this important to me because I have sponsor but he can’t sponsor more than two and he already sponsoring for two DV21.
2- Second question, regarding visa bulletin, are these numbers announced fixed every year or also got affected by covid?
3- Last question, according to my CN above, when do you think I’m gonna get my interview in Guangzhou knowing that I have sent my DS-260 on 9th of June and also I have sent my documents?
September 11, 2021 at 19:49
1. I don’t know.
2. The VB numbers move based on factors individual to each year.
3. Probably.
September 10, 2021 at 20:19
Hi, I am a palestinian man with a palestinian passport however i was born in kuwait, should I use Palestine or Kuwait in order to fill the country of eligibility?
September 11, 2021 at 19:49
Country of birth!
September 10, 2021 at 20:52
Hi Brit, Apologies for the long comment.
2022AS11k from Iran. I’m “fortunate” enough to reside in a small EU country with a well-staffed very-quiet embassy which processes DVs normally (i.e. Hopefully no problem with getting an interview) and I don’t have the unique issue faced by male applicants from Iran.
—(i) If, the three embassies interviewing the majority of Iranians(and Asia as a whole) don’t interview them or do so at a very slow pace, will the possible backlog of cases waiting for an interview affect me? (e.g. They’ll stop the numbers going current beyond a certain number in March/April as they have more than enough Iranian lower cases that can be interviewed at the three designated embassies for the remainder of 2022FY).
—(ii) Any idea why they are processing the DS260 by the date of submission and not case numbers? (I know the processing of docs is by the ascension of CNs in the subject line as you’ve hypothesised before) That doesn’t seem “logical”. Will they change it to case-number based processing or should I send the DS260 now by end of the week and then the docs in early October which is when I’m done with collecting all the docs?
Am I being late now? since they have to process all the DSs submitted in May,June,July,August before me.
I was planning on to send DS and the docs after the release of November or December numbers, since I may wanna do further studies in 2023 or later, and filling the DS will mean I should cross out a US NIV for life.
Thank you for your time and effort, it must be draining doing all this.
September 11, 2021 at 19:52
1. Possibly.
2. It’s by case number, but obviously only for cases where DS260s and documents are submitted. Submit as soon as you can.
“filling the DS will mean I should cross out a US NIV for life.”
No that is not correct. The DS260 can make NIV harder, not impossible.
September 10, 2021 at 22:07
Hi Simon, do you happen to know by any chance what is the average response time to email from KCC?
I submitted recently a request to unlock my DS 260 (DV2022) and I’m curious just to know what to expect, as i’ve read that it can take some time (weeks).
Thank you!
September 11, 2021 at 19:55
No “average” is valid at the moment due to backlog.
September 10, 2021 at 23:52
Hello, as DV-2021 selectees should we email to KCC to speed up our document reviewing process after winning lawsuit? If yes what should we include in email? Thanks
September 11, 2021 at 19:59
That email won’t be read for some weeks.
September 11, 2021 at 04:48
Hi Simon,
DV 2021 winner, AS 22xxx, DQ, Good luck plaintiff, had a scheduled interview on 14th September at Colombo Embassy, Sri Lanka, however the interview was cancelled last month. Really worried of our chances of migrating can slip away unless relief given by the lawsuit. Do you have any update on US embassy Sri Lanka???
Thanks a lot
September 11, 2021 at 20:01
No
September 11, 2021 at 06:09
Hi Mr. Simon
First, congrats for all DV 2020 and 2021 lawsuits, and thanks for all the efforts that made for all of us
I’m Iranian 2021 DV lottery winner 2021AS12XX
here are my questions with considering three facts.
1-I’m an Iranian winner, so there will be processing the background, and it takes too much time.
2-I choose Ankara for my interview, and you know better currently they do nothing about dv winners.
3-I’m DQ, but my case is still in KCC.
So here are my questions:
despite my case is processed and my application is closed and put in queue for the interview, is it a good deed or a logical decision to ask for changing embassy
Or should I wait?
September 11, 2021 at 20:03
I don’t know. You will have to decide for yourself.
September 11, 2021 at 07:01
Hello BritSimon, thanks for the amazing job for DV family. CN 2021 AF32***. Ds 260 sent more than a year ago. No request from KCC to send documents but proactively sent the documents about 6months ago, yet no response from KCC. Sent emails to KCC few times to enquire about my case but will wait for 1 month and KCC will reply me email with a generic email. Quite sad for me ?
You indicated in your live video that the judge Mehta appears to be towing the lines similar to his order last September 2020.
My question is, if the Judge preserves visa for 2021 winners, is it also going to take a year before the judge finally gives the order for the preserves visas to be issued just like we have seen in DV 2020 and await from the judge the timelines for when those 9095 be issued to DV 2020. Thank you
September 11, 2021 at 20:02
I don’t know.
September 11, 2021 at 08:08
Hi Brit,greetings from Kenya.
when in the CEAC they indicate that your case is currently at KCC,what does it mean?
do cases start at NVC and later sent to KCC?
September 11, 2021 at 08:28
i forgot to say a goodluck plaintiff
AF2153***
September 11, 2021 at 20:04
No, it’s just the starting status for all cases.
September 11, 2021 at 08:10
hello Dear,
thank you for your effort really appreciated. I am DV 2022 AS 2xxx. my wife gave birth a couple of weeks ago, therefore i sent an email to KCC to unlock DS260 in order to update it. now it is already 12 days and still no email from KCC. it is normal to take so long? moreover i received the email to send the documents 2 weeks ago. should i send them (including the documents of the baby)? or i should wait to unlock DS260 to update it and then send the documents? please advise.
thank you
September 11, 2021 at 20:05
They are very backlogged, so its normal. Update the DS260 first.
September 11, 2021 at 09:03
Good day Brit us califonia here south Africa
I would really like yo know whether are you good to go or enter DV lottery program when you have criminal record or shouldn’t I waste my money to start the process, your assistant in this case will be highly appreciated. Thank you
Kindly Regards
California
September 11, 2021 at 20:06
It depends on the nature of the crimes.
September 11, 2021 at 09:04
Hello sir,
Most DV2022 winners with high case numbers tend to wait for KCC to request for docs before sending. Please from the way things are going, must each of us wait for document request before send with regards to high case numbers even though documents are ready?
September 11, 2021 at 20:07
No – send them.
September 11, 2021 at 09:07
Hi Brit, 22eu19xxx here, signle applicant, been to US three times, working as a lawyer, travelled only across Europe and Bahamas. According to your previous statements, I’d have a relatively simple case to process. Here’s my timeline of taking action after the selection:
– May 8th – Submitted my ds260 (the very first day winners were announced)
– May 13th – Asked KCC to unlock my form
– June 16th – Sent my docs without them asking (did everything by the book – your docs modification instruction video)
– July 27th – Got my form unlocked, fixed it, then resubmitted the same day
– in August I asked KCC if they’re satisfied with my documents, then a few weeks later got their generic response: “Your forms have been received and are currently processing …”
– to this day, I haven’t received the docs request email.
Qs:
1) Would you advise me to take some further action except for being patient?
2) Since everyone is talking about how KCC issues doc request emails based on the ds submission date how come, in my case, May 8th in not early enough? Or they just take my case by the date of ds resubmission on July 27th?
3) Earlier you mentioned that in Dv21, some people that sent their docs proactively went straight to receive DQ email without ever getting the docs request email, given my timeline, could this happen to me?
Cheers
September 11, 2021 at 20:09
1. No. Your case number means you have months to wait anyway.
2. I can’t guess the reason for specific cases.
3. Maybe.
Don’t overthink this – you have to wait anyway.
September 11, 2021 at 09:29
Greetings , I am a 16 year old planning to enter for DV2023 . I as of now have have 11 years of high school education , however , by 2022 August I would have completed it and in 2023 be in college . Is it okay for me to apply as I meet the standards by 2023 ?
Thank you !
September 11, 2021 at 20:10
Yes
September 11, 2021 at 09:51
Hello Brit,
I am 2021AS28xxx, not yet DQ although i have sent the documents 4 months back as per their request and following the proper formats and full documents, i heard from one source that i need your advise on, in case you have tire 1 relatives in the US. they can approach an immigration lawyer or a senator intervention to prioritize an interview for specific family support related cases, is that true?will that work?
Thanks for the clarification Brit
September 11, 2021 at 20:10
No.
September 11, 2021 at 10:28
Hello. How long does the embassy normally retain passport after successful interview? I need to travel immediately after interview, so will need my passport back to travel. Is that possible?
September 11, 2021 at 20:11
Discuss it with the CO.
September 11, 2021 at 11:03
Advice needed!!!
my birth certificate has my right order of names. While my passport has the wrong order of names but thesame spelling. On my passport, they made a mistake and put my surname under the given name section and given name under the surname section. It’s just the name interchange that is my problem.
when entering the dv lottery, I used the right order of names as in my birth certificate and I also used my passport number and expiry date since my passport is still valid.
on the ds260, the instructions says, data on this page should match that of the passport. I followed suit and put my details as it is in my passport.
What can I do in this case, can I get a legal Afidavit to state that the name on my passport is thesame person as the birth certificate.
thank you
September 11, 2021 at 20:13
Sounds like you need to correct the passport and then correct the DS260.
September 12, 2021 at 13:56
Correct the passport like getting a new passport? In this case an affidavit of names can’t work? Passport in my country during Covid takes 8-12 months.
September 12, 2021 at 14:06
Your passport is incorrect!
September 11, 2021 at 12:39
Hello

I haven’t received 2NL.
What’s the problem? and what should I do?
Thanks.
September 11, 2021 at 22:43
What makes you think you were DQ? What email did you get?
September 11, 2021 at 16:47
Hi Brit.
My sponsor little bit hesitated to fill I134 form. Is there any issues when he gives that form. What else have to furnished in the sponsor related. Advise me please
September 11, 2021 at 22:44
The I-134 is not legally enforceable.
September 12, 2021 at 03:18
Hi Brit ,
Only the letter from sponsor sufficient for the interview or more than that

September 11, 2021 at 18:13
Hi Brit,
Please advice me about the answer to the question from DS 260: “Have you ever been arrested..etc.”
Namely, 14 years ago I was arrested with a group of 20 people for multiple crimes. The criminal charges against me were rejected, so I was not even prosecuted. There is no information in the criminal records of the Ministry of Justice, but the police file described the event and the information about my arrest. Given that I am innocent and given the passage of time, I have the right to request the deletion of data still remaining in the police file. Given that I have never committed a crime or been prosecuted for the same, should I answer the above question with YES or NO?
September 11, 2021 at 22:48
“Have you ever been arrested”
You said ” I was arrested”.
Do you really need me to answer you?
September 11, 2021 at 21:04
Hi Simon, I’ve got a question relating to finances. I am a DV2022 winner (AF3K) currently residing in UK. I used my husband’s country of chargeability as UK not on the eligible list. My husband still holds his bank account from his country of birth (chargeable country) and we have some money/savings in there. In addition, our home is also rented out and this bank account is where the tenants pay their rent into.
Getting to the point, my questions are:
1) Aside from the UK bank accounts, can we also show this other international bank account as a savings as well?
2) Does the fact that we still own the house make any difference to our case in any way, good or bad?
3) I watched your video the other day and just wanted to clarify something with you. If I understand correctly, once you are DQ’d then you’re in line for the interview and this will then depend on the date of your DQ?
September 11, 2021 at 22:52
1. Yes
2. No
3. It depends on case number first and foremost. BUT if the whole region is current, then date of DQ is important.
September 11, 2021 at 23:14
Dear Brit,
I had my appointment at August 24th. It went very well. The CO kept my passport and said that they will issue the visa in a few days after they will get my medical exam results. The hospital sent my medical exam results to the embassy at September 1st. Also the CO didn’t give me any note or letter for administrative processing.
The whole time my visa status stated “refused” on the CEAC website. 2 days ago I asked the embassy for an update and they said my case is pending administrative processing!
I am DV21 selectee and a member of Goodluck-vs-Biden lawsuit. I am Iranian and living in Europe.
Q1: If the judge reserves visa for DV21 selectees and if my case will be still in AP mode by the end of September, does that help me or my case will be automatically closed?
Q2: since the CO didn’t give me any letter for AP, can they send my case for that process without letting me know by a letter?
Q3: based on this information do you think this AP mode is because of not processing my medical exam? Or this is the security check?
Sorry for the long message, I am just anxious and nerves about the deadline September 30th.
Thank you for all your efforts.
Best regards,
September 12, 2021 at 00:08
1. It would depend on the terms of the reservation, but most likely you would be helped.
2. Yes
3. Could be either. Or both.
September 12, 2021 at 05:12
Hi sir,
In ds260 form I made mistakes in persons name. I wrote his nickname. I knew he have different legal name this time only. So do I have to change/ correct his name at the beginning of interview or shall I change when they ask me abt host? Does that look suspicious?Where address is all good only the name. Please advice me as I have interview this week.
September 12, 2021 at 13:55
Well there is no time to correct this before the interview, so correct it at the interview.
September 12, 2021 at 06:09
Hello brits, how you doing.
Should I submit to kcc two marriage certificate for each one of us or one is enough ?
Thank you

September 12, 2021 at 07:11
Hi Simon
2022OC12XX here. I didn’t include my high school education in my DS260, only my bachelors degree. I’ve already sent my docs to KCC. Do you think it’s necessary to unlock my DS260 to add this in? I saw in a previous question you answered that it depends if the case number is not low…not sure if my case number would qualify as low or not low?
Thank you kindly
September 12, 2021 at 13:56
You should unlock. Your case number is not low.
September 12, 2021 at 07:24

Hi Brit
I am DV21 and can I change my sponsor details at the interview. If I submit my sponsor at the interview is it any disadvantage or how I change. Just to explain the situation is sufficient.
Ps explain me if i change my sponsor how can i do that
September 12, 2021 at 13:59
No problem, change at interview.
September 12, 2021 at 11:39

I submitted my supporting documents on 19/08 and there has been no email from kcc about the interview date should i wait or email them to enquire?

What’s ‘reservation order’ means?
Do you think that it’s low chance to set up interview for high case number AS00035XXX this time(dv2021)?

The lawsuit might achieve a reservation of visas to be issued after the fiscal year deadline. Of course a higher number has a lower chance.

Hi Simon
I’m DV22. I have submitted both my DS260 and civil documents already.
I have one question for u sir:
I was arrested by the police with some gays a couple of years ago just for a few days and later on I got my freedom b/c i didn’t do any crime. But On my DS260 there was a question that said “Have you ever been arrested” mistakely i said No. Currently I got my police clearance certificate and have already sent it to KCC..
Does this situation affect me?
Thanks

Hello brit, as in Cuba there is no access to some vaccines such as chickenpox and the approved anti covid requirement for October 1, in case the rumors of Havana embassy reopen are true, what would happen in that case? We will receive them after que enter the US? God bless you thanks on advance. SA6**2022

I don’t know how they would handle that.

Hi Brit,
Dv2022 winner. In DS-260 form the following questions appear
‘Is your spouse immigrating to the US with you?” I hope to answer “No”
afterwards, second question ’Is your spouse immigrating to the u.s. at a later date to join you?” appeared with ‘Yes/No” options.
Q1. If I put ‘Yes’ to second question, am I apply to DV visas to the spouse at the interview?
Q2, If I put ‘No’ to second question, am I not apply to DV visas to the spouse at the interview?
Q3. What is the main difference between the two options in the second question?
Thanks.

If you want to include your spouse in the DV process (answer YES on the FIRST question).

Hello, my name is Agustin Fernandez Saralegui, I am from Argentina and I was selected for the DV Lottery 2022 and currently, I am living in the United States with an F1 Visa. I have doubt where is more convenient to do the process. Here with USCIS or a consular process in my country. My selected number is close to 1300. I noticed that there is some pros and cons in both location, but I want to know which one is the more favorable and fast. USCIS for example had been delayed and time for the DV lottery is essential due I can be disqualified if I don’t have an interview before 30 September of 2022. On the other way if do the process in Argentina it can be closed like
happened this year.
Moreover, I already submit the ds260 with one error in my social security number, I need to ask for unlock? I didn’t sent the documents already, If I am living in USA I need to send police certificate of USA as well as my country if I live more than 6 months?
Thanks

If you are in the USA and have always been within status, AOS is probably the fastest, safest way forward. Full DV related AOS info at the link below.
