Dear Mr. Simon,
If I find a lawyer who will agree to initiate an individual lawsuit for DV2021, will this be treated by the Judge in the same way as a bigger “Rosales lawsuit” of Curtis Morrison? Or will this lawsuit compete with one of Curtis Morrison and will not be considered seriously, because it would be an individual case? Or maybe, the opposite, the Judge will be forced to treat the individual lawsuit in the same way as “a bigger one” of Curtis Morrison?
Could you please share your thoughts?

In order to get any traction on another lawsuit, it would need to be filed before the September 30th deadline. I don’t think there is time, not is there interest from the two groups I would consider.

I work professionally and my bank statement proves our good financial stability. Our interview location is Ankara, our CN is ~16k for Africa region. Do I need to submit police certificates from these two countries?

Hello, just to let everyone know :
Our case number is 2022AS32XX. We’re a family of three. My husband is the main applicant and my little son and myself are derivatives.
– We submitted DS260 on May 10, 2022.
– We sent the documents without being asked on July 22,2021.
– KCC sent us a request to send the documents on August 11, 2021. We sent all the required documents again to them on the same day (August 11)
– Our number is current for November bulletin 2021.
A couple of hours ago, we received an email from KCC saying “Congratulations. Our records indicate that your case is ready to be scheduled for an interview when your case number becomes current and appointments are available …”
My question is:
Is this email the Document Qualified one?

Yes that is the “ready for scheduling” email which means DQ.
You are not current in November though and depending on embassy capacity you probably won’t get an interview until January, even if you become current for December.

Hello! I had my interview this morning and was approved, and my CEAC status has now updated to ‘Issued’. However, underneath the CEAC ‘Issued’ status, there is some writing that says it is going through AP. Is this just because it has not yet been printed because the interview was only this morning? Renewing the passport takes around a month.
I plan to renew it before the interview and take the old and new passports to interview?

Interviews are scheduled numerically based on case numbers that have completed processing….” I think I am DQ qualified,
Q1. I want to get VISA to the spouse with me at the interview therefore, I want to change DS 260 “Is your spouse immigrating to US with you” to the “YES” position as I filled “NO” position before. Can I change it now ?
Q2 If can not, how can I do it?

You can’t change that now. Once processing restarts, if you get an interview you would try and include your spouse by discussion with the embassy.

You need to be clear about how much later. If you mean within a few months, then they should be included in your processing still. If you mean years later, then they would not go to the interview and you would have to start a family based process some time later when you are living in the USA. That other process is slower, more expensive and more complex.

I’m a dv2022 winner. AF31***. I submitted my ds260 early and got a mail on the 24th of august to submit my documents. Prior to the email I had already submitted my documents before they asked the the birth certificate I included was an old one since I was still waiting for a reprint of it. Just a few days after receiving the new birth certificate I received a mail to submit my documents after I had already submitted them so I replaced the old birth certificate with the new one and sent them.
Just yesterday I received another email from Kcc with this message…
“ Thank you for submitting your Diversity Visa documents to the Kentucky Consular Center (KCC). After reviewing your documents, KCC has determined that there are additional documents that you must send in order to proceed. Please see the required documents listed below and submit all required documents.”
Meanwhile my birth certificate, my passport and my police certificate are the only documents I’m required to submit but they are asking me to send additional documents.
For the birth certificate both the old and the new has the same details with the exception of date of issue which changes according to the date they reprint it.
Could it be because of that or it’s normal for Kcc to request for additional documents even though the others are not applicable to me?
Need I send an email to Kcc explaining to them that those three are the only documents I’m required to submit?

They review your DS260 and decide what documents they expect. So it seems they believe you need to give them something else. Did you renew the passport since entering the lottery? Did you travel to more countries? Are you a citizen of another country? Think.

No please. I used the same passport to enter and to fill my ds260. It was the same passport I sent and I haven’t been to any other country as well. I am a Ghanaian citizen by birth with a Ghanaian ancestry. Never married, no kids whatsoever. The millitary certificate, court certificate, marriage certificate, divorce certificate all don’t apply to me. I wish I could email you the pdfs of my saved ds260 to see what really I’m missing.

We are planning to move to USA in December.
We have taken two dose of Sinopharm Covid Vaccine. With this upcoming changes to the travel requirement and based on the below citation will there be a quarantine requirement on our arrival?

Foreign nationals will need to present proof of vaccination before travel and will not be required to quarantine on arrival.The White House said the final decision on what vaccines would be accepted is up to the U.S. Centers for Disease Control and Prevention (CDC).

With everything going around, I think its very likely that judge will preserve DV-21 visas. And if he does, he should preserve more than (9095) what he did for DV2020
because we are still behind the number of visas issued (probably somewhere around 20k I think) at this point last year! What do you think?

My son was born in Kenya and lived there till the age of 9 and thereafter moved with me to Ghana where we have since been. He is now 18. Does he need a police clearance certificate from Kenya?
I watched a video of yours where you said someone in this case needs a PCC from country of birth and i also saw your response on the blog that he doesn’t.

You can adjust status in the USA as long as you are in status and have never been out of status or violated the terms of your visa (like worked without permission).

I sent an unlock request to KCC on 9 Aug, received the email 6 weeks later to make the changes and resubmit, which I have done. Am I supposed to receive an email from KCC again after resubmitting to confirm that (I didn’t) or is the fact that it again states “Completed” next to the specific DS260 online, enough? I did print the new confirmation page which shows the same confirmation number and a different date of completion.

I WANT TO SEND MY DOCUMETS NOW BECAUSE IN MY COUNTRY (SIERRA LEONE) THE POLICE CERTIFICATE ONLY VALID FOR 6 MONTHS AFTER THAT YOU HAVE TO TAKE ANOTHER ONE.
NOW, I WANT TO SEND MY DOCUMENTS BEFORE IT GET INVALID.
NOTE: I TOOK THE POLICE CERTIFICATE ON THE 12TH OF MAY 2021. IT GET INVALID ON THE 12TH OF OCTOBER 2021.

a couple more questions:
1. Regarding My AFP (australia) check i’ll be getting this week, and the UK police check should be coming in one weeks time. Just wanted to check once i’ve acquired both police checks I should be able to send in my documents. That’s because I checked on the reciprocity page for Australia and it says you only need to submit your passport bio page, birth cert, and police checks of your home country and country you’ve lived in over a year. I’ve never married or served in the military, so I believe I should be sweet once I get my police checks back, though ifs there anything else I should be submitting like High School Cert or anything?
2.I submitted my DS D260 on 11/9/21 and then emailed KCC on 19/9/21 as there one country I forgot to add in for countries I’ve visited in the last 5 years. Should I wait for KCC to unlock and submit D260 and then submit documents, OR should I just submit documents before KCC unlocks my D260?
3. in my original submission of D260 I answered yes to if I’ve got vaccinations according to US law. should I be changing that to no, since there’s only been a few vaccinations that I’ve got according to US law, Measles, Mumps, Rubella. I think I saw someone on the immigration forum saying it doesn’t matter as when you go for your medical they will sort you out.

suppose the interviews and processing papers are done numerically. However, there are several cases, with numbers way behind my case number, that have received “required documents” emails and even “Interview appointment” , while I got nothing. For example: case number 2021AF000309** and several more. Please note that these cases have exact circumstances like mine (Egyptians and residents of the state of Qatar). I am just wondering if there is a mistake or if there is a reason for skipping my number.or because my initial post when i apply for lottery was egypt but in DS260 i mention the interview location will be in doha -qatar ?
now shall i send to them to check where they consider my interview location or they know already from the ds ?

The year is about to end, so if you don’t have an interview scheduled now, you won’t get one. In May I told you to improve your chance with joining the lawsuit. I hope you took that advice, because if not, you will lose your chance of getting the visa in a few days. Also, did you send documents?

The interview took place on August 18, with a surprise date on August 17.
The consul asked me to conduct a medical examination and bring the financial cover data.
The case was a rejection of the system.
The medical examination was completed on September 10 and the case was updated to a refusal also on September 14.
Today, 22nd, a job offer was sent in US, as well as Form I-134. The status has been updated with today’s date, and they keep it as refuse as well.
Can I see something different over the next couple of days? Or is it the end of the road? Can something different be done? What do you recommend?

DV2021 will end in a few days. At that point your case will be over. It sounds like you did not submit documents, and you don’t mention joining the lawsuit so you are at risk.

My interview was held today morning. In Sri lanka embassy. They informed us day before yesterday. They asked about the police clearance. I submitted 2 I got. One is missing for I was in italy 10 years back. I gave an explanation letter kcc. When I checked with home country they wont issues from here. You have to get it from italy .because of this reason visa was denied. I said I ll try to get give us time. They said they got only 2 days. After that we were back.
Please tell me any other option to get the chance.
Can I get another date for the interview. If we got everything one police report unavailability can they refuse.

You will not be approved and you won’t get a new interview. You have cost yourself the Greencard.

Hello brit,
I passed my interview today successfully and the consular told me that my visa has been approved, but when I check my status on the ceac website it say Refused, I emailed them and they told me to Recheck my status in about a week that’s when it should switch to “Issued”.
what do you think? is this normal?

the weirdest thing just happened. Literally an hour ago I received a DV interview invite for Sept 28th in US Embassy in Bern, Switzerland. The funny thing is i was never asked for, neither submitted the documents excluding DS260 almost a year ago. Did they changed something recently?
Anyway there is no chance I would get the medical exams or other documents (police certificate) in time for the interview – I only have expired once that i never submitted.
Any thoughts about the process and how to deal with med checks and missing documents? I will call the embassy for sure but your advice is very welcome.

JUst a few days ago they stated that they were going to invite non DQ people for interviews. It’s a ploy to impress the Judge that they have done as much as they can. Of course people that haven’t submitted documents probably won’t have documents ready such as police certs and so on, and may not be able to get medicals in time, but the government can point at that interview and say “they tried”, and its not their fault the candidate didn’t show up. You cannot be approved without the required documents and medical – so attend the interview if you want, but it will cost you $330.

If you actually have the documents, and if you can get the medical report before Sept 30 (picking it up by hand) you could try and attend the interview. Your choice.

Wanted to give you an update on my DV2022 experience so far.
EU8XXX single applicant
Submitted DS260 a few days after the results were announced in May.
Documents submitted end July.
Request from KCC to submit documents end august. Resubmitted documents same day
Received email from KCC 3 weeks later to say DQ and ready for scheduling when case no is current.

A friend told me yesterday he’s a DV2021 selectee and he’s currently in the United States. I asked him to file the AOS but knowing that the fiscal year (September 30th) is almost over I asked him to hold on so I make some enquiries.
1. Considering that visas have been reserved for DV2021 selectees, do you think he can still go ahead with the AOS
2. If answer to number 1 is NO, what would you advice?

I have sent my DS-260 on 5/11/2021, got it unlocked/sent again on 8/2/2021, then sent my documents on 9/1/2021. My question is, would KCC send me a DQ e-mail based on the FIRST date (5/11) or the SECOND (8/2).

It’s based on when they finish the documents, not the date you send things.
