Dear Simon I am posting here to update people on my contact with Kameli and Associates in Chicago, particularly those from Australia. Kameli are filing petitions in next three days by Sept 27th 2021 for DV2021 winners at a cost of $15k approximately each for anyone not a plaintiff in other cases ( cost for the whole court process). I am in Sydney Australia and after discussion with John Floss, decided to not go ahead. This is because given Australian government probably could be argued to have caused the slow down due to closing the Sydney consulate if I put a case in it could be set aside on that basis as have other cases such as one from Nepal. Big cost therefore not worth it to me but it might be for others whose consulates were open but not processing due to deprioritisation. Paid $250 for 30 minutes consultation and useful as I found out about other potential routes to a green card given my background that hadn’t known about.

As always, thank you for all you do and for the help you’ve given me.
I have been issued the visa which expires end of February 2022. I am currently in my final year of University and will graduate in June. I am wondering what your advise is in this scenario.
– If I activate in October or November, that would mean approx 8-9 months outside of US as an LPR until i’ve graduated and can move. It seems there is a bit of mixed statements out of staying under 6 months to be safe, but trips up to 12 months is also safe. From your experience with other DV winners that you have helped, can I consider myself to normally be OK to be allowed to enter again after 8-9 months given that I was completing my studies?
– Do you recommend waiting closer to the expiration date of the visa instead and then activate, now that restrictions seem to be lifting?
I am aware it is completely up to me, I am just poking around for various perspective on which approach would be most sensible in my situation. I will appreciate any advise you will give me, and I promise to still make my decision out of my own gut feeling 🙂

I’m not going to be at the given address to take delivery of my SSN and my green card either. I know for the green card I need to actually be there to sign for it, not sure if it’s the same for SSN, but I’m wondering if I can designate one of my relatives who lives at that address to take delivery of it. I remember you mentioning somewhere on here that you personally had it done that way as you weren’t present either.
Do I arrange it with the US Postal Service beforehand somehow?

Hi Linda. I’m a DV winner now living in the States. I was originally going to live in Florida, so that’s what I put in my DS-260. Both my Green Card and SSN got mailed to Florida, my uncle got them both in the mail(no signature required) and shipped to my current adress in Arizona. So, as long as someone you know lives at that adress, you’ll be fine

Neither thing is signed for, but it has to be a real address. They will send documents to the address you gave in the DS260 and your last chance to change that is at the POE.

EU27XXX/DV2021/Amsterdam consulate
I want to share my overall experience as today I gave the Amsterdam consulate my passport for visa issuance. What a roller coaster months this was. Everything had to be done at the last minute.
Timeline
Selected last year
Submit ds260: 27th April
Document Request: 29th of July(sent docs before too, still got the requeat again)
DQ Notification/2NL(4 hours apart): 13th August
Interview at the Amsterdam consulate: 26th August
(Originally 24th August)
Medical: 14th of September/ go back to get another vaccine on 20th of September
Passport Request: 22nd of September
Passport Submission to Consulate: 23rd of September
Waiting for my visa and immigration package.
My interview was great, short and efficient. It took me overall 36 minutes from entering the building to exiting after teh interview. Lady CO asked only for birth certificate, police certificates, passport, photos, and bachelor’s degree(highest qualification). They had a checklist and I had to provide all papers and translations. Paid the fee, said the oath. Only question was where I will live in the US and what do I do. The rest was chatting, she was very nice. No questions on financials or sponsor. (I am a management consultant/business analyst). Medical lasted an hour plus had to go back to get another vaccine.
Now waiting for final package.
I am stressed, overwhelmed, excited and happy at the same time.
Thank you Simon for all you do. I couldn’t have done this without you. If all goes well see you all in the US.

Numbers are current since April meaning any of the case numbers can move forward. A lot depends on country, consulate and the case itself. I am sorry you haven’t got an interview.

No I was asked for documents end of July, but did send my documents way before multiple times. I got the DQ email and the 2NL 4 hours apart. The interview was in a week’s time and I had all the docs but still was some hussle with last minute translations. Then the medical done afterwards. This is just how this embassy works, they all works differently. Here they worked with a clinic that produced results very fast. It’s strange that you got an interview without DQ.

I played dv 2022 for my mom and other relatives children who lives with her and they were successful 2022AF72 then I submitted the ds 260 application a week ago already. She is in the process of getting the adoption papers for the children but my question is.
1. Can she get a new birth certificate and passports for the children when they are adopted?
2. Can she change their last name or they can just keep their original biological parents last name?
3. If name change then I’ve to contact kcc to unlock the ds260 for corrections, will it not be a problem for the entire process?
4. If the process will be complicated or an issue, can she contact kcc to just remove the children’s name from the ds260 then my mother can travel alone? Will this also be a problem?
Note: the children already have birth certificates and passports which has their birth names on it.

I was married in 2014 in London and got divorced in 2019 through the Australian Federal Circuit Court. I have sent all documentation to the KCC. I am Australian and have dual citizenship, my second nationality being Italian, which I acquired in 2019.
I am currently in the process of getting my marriage /divorce certificates translated and apostille stamped to send to the Italian Embassy so they have record of the events (I know, I should have done it much earlier). Will my lateness in this matter affect my DV case? I gather that the KCC look into everything regarding your history and I wonder how it will look that I haven’t registered these documents with the Italian Embassy yet.
My CN is OC3**, I filled out my DV-260 honestly and accurately and sent my complete documents (following all of your advice regarding labelling) without request in mid August but haven’t heard anything back yet. I lived in the UK for 6 years in multiple residences and have travelled quite extensively. I hope that it is only these factors that is causing delay as I know simpler cases can be DQ quicker than complicated cases.

We already filed DS-260. Does she also get a NL2 or she should submit it when I as principle applicant is notified to submit the scanned documents and NL2? There is not such an ability. She should attend the interview with you, otherwise your process will not be DV and will be harder, longer and more expensive.

Thank you Mr. Simon. I am bit confused here. Since she is legally there as F1, in DS-260 I have indicated that she will face the interview in the US, filing an “adjustment of Status” application. I thought it would be ok given the hazzle and costs in traveling during the current pandemic period. Also in USCIS website it said as long as somebody is in the US legally, he/she can submit “adjustment of status” (Form 485). Please give me your advise on the following.
1. Since the DS-260 already submitted, and chosen the US as her place of interview, is it possible to change it?
2. Should I email them?
3. When I applied in 2020, my daughter was below 21. She turned 21 April 2021. Could she still have the chance? We are at AS24k.

OK a couple of things. No she would not have been able to adjust status in the way that you believed was possible. She would have needed to be with you at the interview.
However, the point is moot because of her age. There is some protection afforded by the CSPA and I have an article that explains the calculation, but I will also link the video. The point is, your daughter will have aged out before your case is current. You cannot include her in the DV case. You will have to get your GC, move to the USA then sponsor her via an I-130 process. Times for that are long, so it might not be possible for her to stay in the USA while she waits.

Hi All,
If you were lucky to get an US immigrant visa and to enter the country please advise did you get a Social Security number hassle free?
I am still struggling to get it although a LPR status has been obtained almost 3 months ago. The SSN was supposed to be issued automatically, I mentioned it in the DS-260 forms for my entire family (just checked it). But it never happened, as per SSA specialist feedback our files don’t exist in their system. BTW, I didn’t have any problem with my Green card issuance, it took 1 month only.
The purpose for my question is to understand if it is systematic problem or not.

I have a facebook account from 2011 under my name that has no content, just a profile pic. I have never used it and have emailed facebook to remove it numerous times as I can’t access it anymore. Many cases still require an I-134 – and if you read the comments you will see that at least some cases will be losing their greencard chance because they did not prepare an I-134 and will run out of time.

I am a DV2021 selectee still waiting to see if by a miracle I can be scheduled for an interview on 30 Sept. Do you think there is a possibility?
I’m almost sure I can get the medical and already have the documents if I am notified on Monday.
My case is also a bit particular as I had the option to do an AOS, but due to my high rank number decided to opt for CP and the fact that I live in NY where the USCIS office is one of the busiest and due to COVID backlogs I determined way too risky. However, it seems my bet for CP will not work either.
There is also something particular about my case because I provided the documents to KCC for processing 6 October 2020. It took me a few months to gather everything as I lived in a few countries and due to Covid I was unable to obtain many certificates in time. However, I have never been arrested or have no police records, but the passport that I had applied to the lottery and currently had valid at the time of submitting my documents expired 05 August 2021. There was no legal way even if I wanted to obtain a new passport from my country of citizenship before it had 6 months of left of validity. This passport had 303 days left of validity when I submitted it. I received an email response from the KCC 316 days later on 18 August 2021 requesting to provide further documentation to be exact a copy of my new passport as the one initially provided had expired and a change explanation. I provided that immediately on the same day 18 August 2021.
As of now I haven’t received any email that I am DQ and my local U.S. embassy has tried to help me schedule my interview and they have told me that KCC has told them my case was still not DQ as of 15 Sep 2021.
Please let me know your thoughts and comments. Unfortunately, I recently bumped into your website and was unaware of the existence of it and the amazing info available. I would also like to thank you for the support you give to people who are selectees.

Clearly there is something going on behind closed doors at the KCC. After reading this thread I see people are already DQ for DV2022, but selectees for DV2021 have not been DQ as of now? That’s just a little disturbing.

There is a small chance that the lawsuits achieve some benefit for some non plaintiffs.
Of course DV2022 cases are getting DQ’d. Nothing unusual about that. DV2021 scheduling should have finished by the end of July – the fact that it is still going on is because of lawsuits. But with less than a week before the deadline, it shouldn’t be a surprise that things are pretty much over. Nothing mysterious.

I do find it a little mysterious that KCC will ask for supporting documents and not even process them. They are clearly not doing their job and it seems its on purpose. I will see what happens with the lawsuits.

In dv selectee website it is written that the “certified translation, the translator will write he is competent, translation is accurate”
Does this mean that the noterization of the translations is not necessary? The translators expression and signature is enough?

Technically there is a risk of that since you are entering the USA with a plan to adjust status. That is a violation of the terms of your visa, and I have seen cases refused for that. However, I have also seen cases succeed.
But there is another problem. You cannot arrive and file the same day – you have to wait a while. Then you have to stay in the USA for as long as it takes to process your case, which will take months. That is difficult for most people, and if you work, that can certainly get you disqualified.
So – right now I would NOT suggest anyone does that.

Hi. I’m a dual citizen. However I don’t hold a valid passport from my country of birth. Can I apply for the DV lottery as a national of my birth place but submit the details of my valid passport, which belongs to the country I’m now a citizen?

Dear “Sir Simon”.
I was looking to get additional PCC from another country I lived before and I was sent different emails for different consular’s of the Saudi embassy and after a while they replied different answers. Some of them warned me that I have to get my PCC by any means but others said I don’t need it. My question is: Do all US consulates don’t have the same understanding of reciprocity rules?

The reciprocity page is the circumstances for each country. Any other embassy is going to refer to that page to understand the rules for another country (as with SA in your example).

The place of birth in your passport should match your birth cert. If it doesn’t, I would question why.

Last Thursday, my husband and I had our interview at the Brussels embassy and we got approved. Thank you so much for your help.
We are planning on going to the States a first time in Feb. 2022 for 4-5 days just to activate the green card.
I was wondering whether we could already apply for a social security number in February – by using our immigration visas as proof – and ask them to mail it to our host (so she could send it to us along with the green cards)? Do you know if this is possible?

I said yes. So I guess the social security cards will be sent to the address I gave them, together with our green cards? Meaning I don’t have to do anything else to get them, except for setting foot on American soil?

That’s how it is “supposed” to work. It sometimes goes wrong, and in that case you have to apply yourself, but usually the SSN arrives automatically (usually faster than the GC).

Your birth in Kampala should be proven by a birth certificate from the local authority – Uganda.

Hi Simon,
I was selected for DV2021 and live in New York under a G4 visa. When notified of selection similar to a case below I opted for Consular Processing instead of adjustment of status. My rank number was SA 37XX pretty high and considering that the 55k visas would run out before my Adjustment or that it would take too long and I couldn’t adjust in time due to COVID I thought Consular Processing was more secure. I knew my embassy wouldn’t have issues in scheduling an appointment because I’m from a small country that didn’t have more than 50 selectees. In May of 2021 I realized due to the embassy closures and KCC not DQ’ing my case I had probably made the wrong the decision not to try and adjust. I haven’t been scheduled for an interview nor DQ’d. I’m losing my mind thinking I made the wrong choice. Do you think I messed up?

Yes. You could have switched to AOS months ago and been done by now. It is now too late to do that. Your only chance now is if a Judge in the 2021 cases somehow reserves visas for everyone (unlikely), or the Meng amendment currently in the reconciliation bill becomes law.

Hi congratulations! I got approved too a few days ago. Are you planning to come back with the visa after activating the green card? The embassy here(Amsterdam) said to wait for the card before coming back which could take 90 days. Can you let me know how you plan? I need to move out of the Netherlands and can take some time(not my native country) and wondering how others plan. I would target February too. Thank you and all the best!

Hello, I don’t know if you were replying to my message but if so, thank you, and congrats to you too! Brit Simon says we don’t have to wait for the GC, which our embassy confirmed. I asked them if we could stay there for a few days just to activate it and then come back, and they said yes. We just need to make sure we move within a year and that “it’s better to activate it a bit later in those 6 months if you want to have more time to move” (quoting the lady at the embassy).

So do we (plus mortgage, etc.), but we have approx. 1 year to move, not 2-3 months. 😉 If you activate it in Feb. 2022, you need to move before Feb. 2023. That’s how they explained it to us.

I am a Winner of DV2022 and my case number is 2022AF00002xxx,I am from Ghana I submitted my DS-260 in June, 25 but I did not get a notice regarding documents submission.
Not withstanding I send my documents the to KCC on the August 26th, but I only received the automatic email from KCC indicating, they have received the documents and will be working on the documents between 3 to 6 weeks, I am already in the fourth week but have not received any email from KCC.
Also I have not received any email to send documents to kcc.
And I have not yet received any email prompt for 2NL.
I don’t also even know whether did really receive my documents. Or
Can I also send the documents again to KCC?
I need your counsel and advice Mr. Simon
