Hi Simon,
I have some questions about the DS-260 form.
1. In the social media field – there’s a social media provider and then a social media identifier. Is this identifier a long numrical or alfa-numerical number/code? Like for facebook it’d be for example 01234567891011 or it’s just our name and last name/nick.
2. The next interesting question is ‘Have you attended any educational institutions at a secondary level or above?’ – ‘have you attended’ means that i still may attend an educational institution. Though when I wanted to add my current school it says that I can’t add any schools which have the final date of attendance later than today. What to do with this thing now? Should I just skip it? Because I can’t leave the ‘date of attendance to’ field blank.
3.If we won in the previous lottery (DV-2020) and submitted the DS-260 we kind of applied for a Social Security Number. And now there’s a question: Have you ever applied for a Social Security number? Does it count as applying for SSN? Or I just should tick no?

DV 2022 winner: OC23XX CN. A few questions:
1. Submtted my D260 on 27/10/21. Will it take a while to get the document req email because of my high CN and because, i’ve visited 8 countries in the last 5 years. I also have a criminal charge relating to a low range DUI offence in 2009. Case was dismissed due to it being low range. I know you’ve spoken about this in the past, though thought i’d check to see what your stance is now, should i send my documents now or maybe wait a bit.
2. I selected Sydney,Aus as my interview location. I’ve been following the immigration forums and some people are saying it may be better to change this to a different location due to the backlog they have, and I think the consulate in Sydney is under construction. Should I change this to another city and if so how do I go about doing this?
3. If I somehow manage to get a interview will consular officers be suspicious since I did not initally disclose my DUI charge when I submitted my D260 in September. I did not think this charge would still be on record since it was 2009 and was dismissed and only decided to disclose after the charge came up on my AFP check. I have gathered all the court documents relating to this. If I got to the interview stage could this be a reason for denial?

1. Your submission was quite late, so you will wait because of that AND your high case number. You can expect to wait at least 6 months.
2. No – the situation could be quite different by the time you are interviewed.
3. You MUST make sure that is on your DS260.

1. Can you please confirm that I can enter the US under the new travel restrictions?
2. I have read your post of November 27th. You said those still sitting on their DV visas are not yet permanent residents and hence could still face risk of being denied entry. However from the CDC webpage, immigrants are allowed. If I have yet to activate my DV visa, am I considered as an immigrant? I am confused by the conflicting views.

Logically its the first, but uncertain of it…

we are DV2022 winners case number EU3***, submitted DS260 at the end of July and sent the documents without being asked at the end of August (we have no feedback from KCC yet). Because everything is delayed we are considering to temporarely move to Australia but we have some concerns and I would like to ask a couple questions to clear this situation.
(1) – We now live in Vilnius (Lithuania), if we moved to Sydney (Australia) would unlocking the DS260 and moving the interview to Sydney delay the scheduling of the interview for us?
(2) – If that may delay the interview then we would rather not move it and come back for the interview to Vilnius. In that case should we still unlock the DS260 and update that we’re traveling to Australia? Or would that have the same effect as moving the interview to another embassy and and we should only update about this during the interview?

2. You can (in theory) not update the address to maintain your existing embassy. However, you are creating an unwise risk. During the last few months Sydney embassy has been closed due to Covid and travel to and FROM Australia has been extremely difficult.

Sorry if this comment will come across disrespectful.
I follow your advise ever since I found out i have been selected on the dv22 lottery. Unlike many of those bloggers out there you are an exception for many obvious reasons; your’e smarter, you have more experience, and your analytical mind is a great tool for people such as I am.
That being said, I wonder if you don’t feel like by this point you don’t believe you should taken down your article in which you advise selectees to “take their time” in filing their ds260, as it is obvious by now that those who sent their applications late (no matter how low their case number is) might never get processed?
By late I mean even later then September.
Since I’m one of those who followed your advise I also wonder why this article was still on after I discovered that dv2021 was also a slow year, something you must have known way before I even cared about any of these terms.
Also, has it ever happened that KCC has not processed ds260’s that were submitted before January and cases were lost as a result?

No I don’t think I would alter the advice. What I say is that people should take their time in filling out the forms to make sure they don’t make silly mistakes. I also say that some people (with high numbers) should consider the declaration of immigrant intent before rushing to file their cases. Both those perspectives still apply and the advice is therefore the right general advice, although you have lifted the advice out of the context.
Obviously DV2022 processing was impacted by DV2021 lawsuits. There will also be continuing impacts from Covid. Those things cannot have been predicted, but again, that doesn’t alter the advice I gave.
It remains to be seen whether KCC improve their working method. Theoretically there is time to process all DS260s if they start work now.

I definitely lifted the advice out of context and for that I apologize. I’m sure your initial reasons for this advice make complete sense. This is the reason btw that I took the time to read proof 5 times the instructions before filling in October.
I’m just noticing that many people with way higher cases # than mine are already in DQ status just for filling their dv’s right after they received the results in May. I assume for some of them these results meant they got an opportunity to “run for their lives” and irrationally sent their applications right away. I don’t blame them. I believe many of them are literally “running for their lives” and I wish them success.
At the end the outcome will be that case numbers AF00080XXX or AS00030XXX will get 2nl once these regions become current at (possibly) around May/June because they filled DS260’S in May, while case numbers such as AF0000006XX or AS0000002xx will never even get DR just for filling DS260 in November.
I believe KCC couldn’t care less.

Hi! There is no official announcement that late submissions will not get processed. However from following different online groups I see that DR’s that are sent now are for late May/ beginning of June Submissions. It’s clear that KCC did mainly DV21 work during the last 6 months and the DV22 got extremely backlogged.
My statement is only an assumption based on the movement we see now. It’s very slow and no one guarantees anything will change.
I would just say that if I would have to be selected on DV23 I would process on the night of May 7th. Knowing what I know today leaves me at no doubt about it.
There are many things that can delay your interview; high case number, closed embassy, embassy backlog, covid, etc…
But if there’s anything you don’t want to be the reason for you not getting a green card is you taking your time and missing the opportunity/ overthinking stuff

There is a lot of worrying about the delay in processing. That processing should get better soon, and remember a large number of people filed in May. What is more concerning (in my opinion) is further Covid impacts to the process.

All the best with your case.
But I would suggest that you be a little patient.
I’m just saying that you are right. Things are a little out of place right now and early DS-260 submissions are getting DR earlier even with higher case numbers.
But that doesn’t necessarily impact a lot IF KCC gets their act right.
Cause Brit has explained several times that eventually when KCC processes October DS-260 Submissions AND if your case number is current you will automatically jump the queue for interviews.
You are right about the embassy closure possibilities as well.
But there’s nothing that can be done about that now can there?
I can imagine the stress you must be going through, but just hang in there.
Hopefully it will work out.

I was selected from DvLottery 2022 with CN EU3k. My number is current in the visa bulletin since November. As we found out, KCC process cases based on when you submitted your ds260 form. As I understand it, the process for my case won’t be soon as I sent mine in the first week of July. With this follow many unknowns. My number is in the VB, but I filled out the ds form later.
According to the emails of KCC if your number is present in the visa bulletin you must notify them by email. But I also see myself from other people who sent emails with a similar inquiry still don’t receive further instructions even though they are current from the first month (October).
You give advice to high case numbers to wait patiently as they are not current. What advice would you give to those who are current but still not receiving further instructions? Is it worth continuing with the inquires to KCC?

You are not correct about what I said.
DS260 processing is by date of submission. Documents are by case number BUT so few cases have gone through DS260 processing that there are impacts to the document processing. This was caused by the lengthy halt in work and there may be a lack of staffing.
But the endless speculation about this subject is not helpful. KCC are obviously in a broken state right now. I hope that will be fixed because of the Tier 4 removal – so let’s wait and see.

There is no place I can find that says you need to inform them once you are current. They know.
Right now they are processing DS260 submissions from May and very early July. You simply have to remain patient.

I pass interview three months ago and have visa in my passport next day, so next step was to pay tax for Green Card (220$) on link http://www.uscis.gov/uscis-elis, but when I put my A-number and DOS it says:

My case number is 2022SA26**, I’m from Cuba but moved and got married in Costa Rica 1 month ago. I applied as single in my initial DS260 in early May (I hadn’t found you yet 🙂 and then I unlocked my DS260 and updated it with my wife information. KCC
asked for my documents since August but I am still waiting for my marriage certificate because it came up with a mistake in my mother’s last name. The Civil Office here
says that it can take up to two months to deliver the document corrected. And we would still have to legalize it and translate it before we send it.
My question is: what would be better? to send the documents without correcting taking into account how slow KCC is working? or wait until January to send everything in order?
another question: should I send the DS-260 now or wait to have the official document in my hands ?

Is it new to this year to jump those who unlocked and not consider by KCC. Or it happened before. Now it is 6 months since I sent my DS and 4 months when they unlocked for me and I resubmitted?

They don’t “jump” cases. Some cases need reprocessing, but it depends what they had done on your case, what you changed and so on.

First of October, we sent our doc without KCC request by email.
Then in mid October, we received document request email from KCC and we immediately resent the document again.

First and foremost the case number affects which cases are current. You cannot be scheduled without being current.
You also cannot be scheduled without being DQ.
If two cases are both current at the same time, then date of DQ is the order in which the cases are scheduled.

assume that 2022eu1100 is DQ. also 2022eu9900 is DQ. which will take 2nl first? because if it goes according to the DQ date then at the end of the fiscal year we will see very high numbers that have fled to America and small numbers that did not get the chance. Explain to me more clearly please?

Well you have to add more detail to make that clear.
First – the VB.
If the VB for EU is at 9000 then only EU1100 could be scheduled. However, if the VB is at 15000 for EU – then both cases are “current”.
Assuming both cases are current – the date of DQ then becomes important.
So – assume EU9900 was DQ’d on September 1 and EU1100 was DQ’d on November 1. In that case, if both the cases were at the same embassy, then EU9900 would be scheduled first. If there were more people DQ’d for that embassy than the capacity of the embassy, then EU9900 might get an interview in one month, and EU1100 has to wait until a later month.
If the cases were at two different embassies, EU1100 could still get scheduled before EU9900 because maybe the embassy for EU1100 has capacity and the embassy for EU9900 does not have capacity.
That should be clear – as it should cover any question.

Yes that is a risk. But that is primarily what the VB is supposed to do, and of course people need to be submitting DS260s and documents in good time.

Case number is your position in line, the lower the number (which is specific to each region), the better.

Just building on your scenario and adding a hypothetical – “What if the EU1100 was DQ’s on Oct 10th, but then unlocked later for some “fair-enough” reason. That resulted in another DR and got second DQ on November 1st.”
So am I wrong in understanding that EU1100 will have a DQ November 1st officially and the October 10th DQ just gets nullified?

That depends on what was changed during the unlock. BUT I don’t think we can be 100% precise in the answer because unlocking experience will vary based on circumstances around the case.

If you only enter the USA in April, then wait the 60 days before you file, your AOS filing date would be in June or so – which is quite late for AOS. People are concerned about DS260 processing, but really people should wait a few weeks…

My wife has her full name in her Indian passport as-
Surname: *Blank*
Given Name: XXX YYY ZZZ
As per KCC guidelines, while filling DV entry we shifted her entire given name to Family Name and left first name & middle name as “No First Name” & “No Middle Name”
We are currently DQ with her application reading her name as “NFN, XXX YYY ZZZ”
Can I renew her passport and change her passport to show:
Surname: ZZZ
Given Name: XXX YYY
Will there be any consequences if I attend the interview with a passport & slightly modified name?
(Of course the new passport will have the old Passport number in the back page corroborating the legitimate name change)

If you have only one name or if your name appears in only one line in your passport, then on the visa your full name will only be printed in the surname field and “First Name Unknown”, or “FNU,” will be printed in the given name field.
So as I was filing the DV Entry I just checked the boxes No First Name and No Middle Name and shifted everything to Last Name. (There is no Check box for No Last Name in the form)
I’m also guilty of doing looking up several other websites / blogs which mentioned the same problem for applicants with this name issue. For example: https://redbus2us.com/surname-blank-in-passport-first-name-as-fnu-in-us-visa-issues-solution/.
I know I cannot pin other website advises on you Simon, but care to comment and give you’re thoughts on this?
That last link suggests change passport cause the NFN will come to annoy later “apparently”. So this has bothered me for quite some time.

Yes it will be annoying. If I were you I would be “Westernizing” the name. However, I don’t have specific advice on how to handle that and correct what you have done so far. If this is a derivative, it won’t be a big problem.

We are currently DQ and unfortunately she is the winner. I am the derivative.
Her DV Entry & DS-260 has NFN in the name.
Don’t want the NFN to stick to Visa, GC and other documents later.
The problem isn’t with the westernizing her name. Just to split her name in surname and given name so there is no blank.
New passport might not be identical to our application (just the split of names) but the new passport will reference the old passport. (Indian passports have the old Passport number in the last page showing continuity)
Will there be any serious consequences if we renew her passport and split the name to have a surname & given name and attend the interview?

Sorry about the multiple comments for the same thing but just realized that even the DS-260 has a small note on the right side which states:
Help: Surnames
Enter all surnames as listed in your passport. If only one name is listed in your passport, enter that in your Surname.
Help: Given Names
If your passport does not include a given name, please enter “FNU” in given names.
In the DV Entry form, I just checked the check box so the 1NL came with NFN, XXX YYY ZZZ.
So I just went ahead with the same in the DS-260.
Just overthinking the necessity of correction of passport.

I’m one of those lucky cases who submitted my Ds-260 mid May, sent docs without request in July and was DQ’d in late September. Received notification that my interview date has been scheduled for early January.
I am hoping to qualify through my work experience and have a few questions:
1. I am unable to schedule my medical until a few days after my interview which is down to availability of appointments-will this cause an issue?
2. Regarding the process- will I hand over my documents once I pay the visa fee and then receive a decision from the CO during the interview, or will I have to present my case to him/her like in an interview scenario?
3. I have gathered the following documents and can align my job to one/ two qualifying jobs on O*net online (job zone 4 & SVP 7-8).
..A copy of my Resume, Job description, personal specification( job usually requires a bachelors degree which I don’t have but it states I need two or more years experience) job contract, letter from HR confirming start date. Print out from governing body outlining my role, and a list of training course attended. Is there anything I’ve missed?
4. Would you advise me to use a highlighter to illustrate how the jobs align or would the CO see this as juvenile?
5. In order to prove I wont become a public charge I have savings of around $12000 and mortgage statements showing equity in excess of $50000. Do you think this is sufficient?
I am usually a very level headed individual and I know I’m overthinking things but with everything going on with DV lottery/Covid I just want to make sure my chances are good.

1. No – that will normally be OK (although clear that with the embassy). You will be on AP until the medical results are available.
2. Most embassies have a two step process. First step is handing over required documents, send step is the actual interview where you might be asked for additional documents.
3. If you are meeting the education/experience requirement through experience only, put more thought into other proof you can show of career path.
4. Anything helps (again if qualifying through experience only).
5. Maybe. It’s subjective. An I-134 is better.

Don’t forget to establish the timeline. For instance – don’t just give the YTD earnings – go back 2 or 3 years to leave no doubt that you have at least 2 years at this level (in the past 5 years).

You should have received, or will soon receive, an email from the Kentucky Consular Center giving you instructions to complete in order for your case to continue processing. If during the months of May-June thousands of selectees with high case numbers submit their DS260 and become DQ very early and way before their case numbers will become current, how do you explain the fact that the CEAC graphs from most years back have been showing highest amounts of “issued” cases at the beginning of the fiscal year with a persistent decline. Meaning, we never see sudden pyramids of “issued” cases even after most regions normally become current in June.
I’m partially using your theory in regarding to the assumption we can make about KCC work flow based on the CEAC data and I’m coming from the understanding that once a very high case number who has got to the front of the cue with DR and there are no lower case numbers in front of him KCC will DQ him regardless of his case number if this case is the lowest case number they have in front of them.
There must be thousands of cases like that and therefore once all regions become current we should see some “issued” pyramids in the CEAC data around June-July of people with very high case numbers who got DQ’d very early on because they submitted DS260’s very early and according to your explanation will be placed at the top of the cue for 2NL once all regions will become current.

You probably have little or no chance of getting a visa from the Gomez reserved visas (9095) because you are not DQ and your case number is high.
So – your only chance is the BBB bill. Wait and see if that gets passed – we should know by the end of December.

DV2022 17k selectee here. I am due to start a new job as Cabin Crew for an airline that flies to US from EU.
If I accept this job and I get my immigration Visa approved, will I be able to fly in and out of the US with no complications before I permanently move there?
Once I activate my GC, am I allowed to enter the US with B1/2 & C1/D?
My plan is to start the job, active the GC with the first trip to US and then move permanently there as soon as practicable.

Once you have activated your LPR status (the first time you enter the USA after being given the immigrant visa) you will no longer use any non immigrant visa. You have no choice about that.

No!
Once you have the LPR visa you don’t ***NEED*** the NIVs. You come and go as you please as an LPR and you can do the job you have now. The only restriction is on how long you can be out of the country (1 year) which won’t be a problem for you.

When you enter the USA your DV visa is endorsed (stamped) to show you are an LPR and that serves as a “temporary greencard” for up to one year. During that time you should get the actual greencard.
