Documents qualified on 3 November and interview location changed from Kabul Afghanistan to Islamabad Pakistan on 2 December.
There are some cases like my case that has been transferred from Afghanistan to Pakistan and are higher than 1000 scheduled for interview and received 2NL but I haven’t yet .

1- Most of my documents are issued and officially translated in Cuba, except for my marriage certificate that will be issued in Costa Rica, I will be attending the interview
in Costa Rica. Should I send the translations to KCC or take them only to the interview?
2- If at the time that i send the documents I haven´t been living in Costa Rica for more than six months, I should’t send my police records, instead take them with me
to the interview, is this right?

Maybe, but more likely April. The March interviews will be based on cases that are DQ by late this month. So – the question is how quickly KCC process cases between now and the end of the month – they would have to clear out May and June submissions.

Getting a little worried that i haven’t received any communication from KCC as i have a low case number and my DS-260 was submitted relatively early. Any thoughts on the matter or should i just be patient and hope and pray?

Hi, first of all thank you for your support, I have learned a lot from you, however I have three questions: 1. I am 2022 EU 17000, have send DS forms for my family and a new born baby, but have not received Documentation request, should I wait until March? 2. when submitting DS forms I entered the full DV number, did not omit zeros (instructions say Entering the full case number with zeros will generate a validation error, which I missed), however the status next to DS forms says that they are submitted, is there a possibility that they are not? Should I request the open? 3. 1. processing is delayed, but I expect they will process your documents. I don’t know if they will get to your case number.
2. The last interviews are in September, those are usually scheduled in July.
3. Filing a DS260 shows you want to live in America. So – if you were to need a non immigrant visa in the future, they would take your “immigrant intent” as an increased risk that you would overstay the non immigrant visa. That increases the chance of refusal for that NIV.

Is there any compassion or do you have to do the SB1?
What actually happens at the POE if you attempt re-entry after 12 months, even if you are a day or a few days out?

Yes you are considered to have abandoned your LPR status if you are out for more than 12 months (unless you obtained an I-131 before leaving). The compassion is the SB-1 process.
Having said that, some people have “tried” the method of just attempting an entry after a 12 month absence, but I don’t have good numbers for how often that is successful.

Even if you don’t have numbers of how often that is successful, if you happen to be successful in entering without issue / notice on their part, does that omission on their part to note absence give you the all clear and it can’t be retrospectively caught up with later on? i.e. an oversight on their part that slipped through the net, so to speak ?

Again – I don’t have the numbers – so I cannot say how often it works.
But if you are allowed to enter, there may be zero consequence. They could alternatively “parole” you in – which means they would setup a hearing in front of an immigration judge. Again – I don’t have stats on success rate.

Dear Mr. Simon, how does this affect “a derivative” who waits to do AOS, and still under this CSPA at the time of the new procedure announced? Will the derivative have to wait until the principle applicant is called for CP or when the specific number gets current for the region? I am asking this since I read that with this new procedure, all cases might go current sooner. First a derivative cannot adjust via AOS with the principal going through CP. That derivative will need to travel to the CP interview.
Second it does not mean cases will be current sooner.

Yes, by removing the artificial barrier of document submission, the decision makes it easier for people to get in a position to be scheduled. In that scenario, the large overselection in DV2022 should mean that high case numbers are at risk. What will actually happen though, remains to be seen.

I got the email from kcc that they changed my intreview location but in the email they point out that i should unlock the ds260 to change my adresse even tho i’m not this moment at country where i changed the intreview location i also told them that in my letter that i can not provide them my adresse overthere until my arrival which is likely to be before my inreview not by that much so:
1.will they consider this letter and change my intreview location or should i unlock the ds 260 and change my adresse to be completed and only then they will valid their email of changing my inteview location
2.if not can wait until the day of my intreview and then i provide them with my new adresse in the country where i changed my intreview

My CN is 2022AF38XXX. I sent an email to KCC to find out if they have processed my DS-260 and received all the documents in order and got the following reply:
“Thank you for your inquiry.
Records indicate you have submitted a complete and valid DS-260 application for each family member, and you have provided all required documentation to the Kentucky Consular Center. Interviews are scheduled numerically based on case numbers that have completed processing. Please refer to the visa bulletin at https://travel.state.gov to locate the current numbers being processed. This bulletin is updated after the 15th day of each month. Once an interview date has been scheduled, you will receive notification via email to check dvprogram.state.gov….”
Does this mean they have processed my DS260 as well as the documents and I am DQ’d? Or does this simply mean they have received my DS260 and documents but I must wait till they complete processing?

It is really wonderful to have you. You may remember my story. But let me recap: I won DV 2020 with my wife and a daughter as derivatives. We attended our interview at US Embassy in Addis Ababa, Ethiopia on March 10, 2020 and the CO approved our visa request. But, on March 13, 2020, we received a call from the Embassy and was informed that I and my wife were needed for an additional interview and rescheduled for March 17, 2020. Again, on March 16, 2020, we received a call and was informed that our interview was postponed. Since then we have not been contacted.
In the mean time, you surprised us that Jugde Metha has ordered the issuance of about 9095 reserved visas to DV2020 winners. Until today we were waiting for the Embassy to call us and hear thier final decision. As you may understand we were eagerly waiting for answers as to why our case was delayed this much time. But today we recieved a call from Ethiopian Postal Service and told us to pick up our daughter’s passport. There is nothing in her passport. Yet my and wife passport’s status is unknown. The mystery continues. My questions:
1. Isn’t the Judge’s decision applicable?
2. Shouldn’t the Embassy wait atleast for the time period the Judge ordered?
3. Shouldn’t the Embassy explain to us why we were refused?
4. What do you think we should do?

EU19xxx here – In light of current events, I have a few questions:
– how do you think the scheduling of interviews be done? By CN number or submission of DS260?
– is there a way of knowing how many cases are alotted at a certain embassy? I’ve been looking at CEAC data for past years and I saw that in my embassy, Madrid, there have been around 30-70 cases per year. Is it good or bad?That’s a really low number considering there are 184 winners in spain (that might not all live here), and who knows how many other cases from other countries living here.
– How does my number look for this year? With the DQ I was expecting to be interviewed fairly quickly, around april, since I had received the DQ in early september, but now I don’t know what to expect?

I just received the 2 Nl regarding my interview at the Riyadh embassy CN 3xxx. But under the beneficiaries, there is only my spouse’s name. My new baby born name is missing, though I added the child to my ds260 and my spouse and I created DS260 the child and i have the confirmation page. I would really appreciate your help regarding this matter. what should I do?

That is normal. Simply email the embassy and explain the child is coming to the interview and make sure you carry the DS260 for the child on hardcopy for the interview.

Hi Brit,
I’m 2022EU10XXX and I’ve been scheduled for an interview at beginning of January 2022 even if on the visa bulletin of January my number is not current (for few numbers). I registered my appointment at the site suggested by the KCC rules and everything seems ok. The only things that is confusing me is that in the automated mail received after the registration is written “Before traveling to your consular appointment, please check the Department of State Visa Bulletin to confirm that your priority date is still current. If it is not, you will need to reschedule your appointment when the priority date becomes current to continue your case processing”. What am I supposed to do? I would like to keep the appointment since in the section related to the rescheduling is highly recommended NOT to change the interview date since this could lead to no more possibility to schedule a new one. What do you suggest?

The embassy may reschedule anyway. They cannot issue the visa until you are current, and if you perform your medical for the January appointment you will “lose” some period of validity of the visa once it’s issued later (February).
So – you can choose to see what the embassy does, or speak to them and secure a February interview slot, or attend the interview and be on AP until February.

Regarding the I-134:
1. Must the sponsor be living in US? He is a citizen and can support but not living there.
2. A form for only main applicant or all family members including kids?
3. If I-134 form filed but wasnt asked by CO is it still consider active? I mean the obligations that comes undet the sponsor is still effective?

2. One form covers all the family.
3. There were never any legal obligations created by the I-134.

But i saw this in the I-134 form instruction downloaded from USCIS
“Sponsor and Beneficiary Liability:
Under section 213 of the Act, if the person you are sponsoring becomes a public charge, the agency that provides
assistance may be able to sue you to recover the cost of the assistance”
Isn’t an obligation?

No. The form was challenged and failed to hold up. So they introduced a new form I-864.
