My CN2022AS6*** and it is current for February. I have not yet received DQ or interview dates. My current location is Colombo – Sri Lanka.
I have a plan to move to Canada for studies and I am participating for that online now because my interview location is Colombo.
As I have valid visa to Canada, do you think it is a wise idea to move to Canada and change the interview location or is it better to leave the interview location as Colombo and wait for the 2NL?

The US embassy here in Addis Ababa is not processing DV Cases right now. I have 2 questions for you Mr Simon..

Dear Simon, I am from Ethiopia, my case will be current in February. I have requested KCC on [email protected] to reassign my case to Nairobi, but they responded ” once the ds 260 of the principal applicant is submitted only KCC can change interview location. write to KCC on [email protected] “. I already did what they said. I know i did it right because i have unlocked twice and my message was clear. Is KCC requesting Nairobi and replying this because Nairobi refused to accept my case or are they deliberately ignoring my request . what will be our hope, Ethiopian dv winners, KCC is not reassigning our cases and embassy remaining closed?

They are simply saying that only they (KCC) can update the embassy. It’s just a standard email.

Hi, am a 2022DV. firstly thank you for your great help. I would like to ask you. For some one who have been selected but who is currently in US since 8 years ago but who is not a US citizen. What is next after submitting DS260 ? will i get interviewed too? if yes where? Cause by the time of completing DS i have chosen my case to be processed in US as my current address and i even completed in my SSN number. Do i have to send my documents to KCC too?

I can’t predict what will happen with case numbers.
Regarding lawsuits they could be good for some people, but it is a personal decision of the cost and whether you want to take that route or not. You need to decide for yourself.

I am DV2022 Winner EU25xxx. It seems my case number won’t be current for a while. Is there a rush to submit my DS-260? At what point does it become risky not submitting?
I’m a little concerned as my wife is currently changing her last name in her passport and its taking a bit longer than expected. I expect her primary passport which she would use to enter the US will have her new last name early in March. Only then can we begin changing her second passport due to the dual citizen rules.
Would it be okay if the maiden name in her second passport, doesn’t match her new last name at the time of the interview and we just change it after September?

This is going to be a wierd year. Your case number is high anyway, so I don’t know whether you will have a chance or not.
You could change her name during the DV process.

Hi Brit,
I am DV-2020 winner and I activated my Green Card during my trip to NYC on March 15-26th 2021. Since then I haven’t moved to or even been to the US due to personal reasons (family and covid related). It is unlikely that I can relocate in the next 1-2 months but hopefully later in the year.
1) Is it 100% that my Green Card will expire after a year of absence in the US (I’ve heard about people who were away for 1.5 years and could keep their status)? How would I know it expired?
2) Is there a chance at all to keep the Green Card after March and what would you recommend?
E.g. is it a realistic scenario to travel to the USA before March 26th (or should it be before March 15th), return to my home country and relocate later in 2022? Do I need to apply for re-entry permit then?
3) What can I expect if I travel to the US in February, after 11 months of absence? (detailed questioning on the border control or is there some worst case scenario like denied entry)
Not an easy situation. Appreciate any hints and many thanks for all your help!

Ask for a re-entry permit if you cannot permanently move to the US within a year.

Blanka, the process to apply for a re-entry permist takes a few months and you have to remain in country for probably 6 to 8weeks. So – keeping the status alive by revisting is much easier.

Hi Simon, thank you for your reply. I didn’t know a visit would be enough to keep permanent residency. I have asked the officer at the border and he said if I move within months is okay after a year they might ask questions. He said I have about a year and a half to move given the visa is valid for a year and the GC will arrive in the mail in 6-months which is confusing. He also said because we are DV category once we enter with the card we can’t be out of the country for more than 6-months. Wouldn’t they expect us to settle in order to keep LPR status? I will move this year but I live abroad and it complicates things a bit. I have activated the visa end of December, so if I fly back again before end of December should be okay then. I have not received my ssn yet but would like to start talking to employers and my contacts before I move. Shall I call social security if I don’t get the ssn within a month. Some people got it after 10 days. Can I start working only with the ssn or do I need the card as well.

1. The card doesn’t “expire” like that – it’s not to do with the card. But after 1 year of absence they can consider your LPR status as abandoned. To fix that you would normally appliy for an SB1, but that process is not a certain outcome.
2. A quick visit to the USA before the 12 month deadline would avoid all the drama.
3. Nope. They know covid is a problem. So – you just explain (if asked) that you delayed plans to make the “big move” until later because of covid. Not a big deal if you take my advice in 2.

2. If I understood correctly, no specific written proof why I couldn’t come earlier would be required (as I don’t have any in fact)?

1. Doesn’t matter.
2. Correct. It’s just a conversation, and it might not even be that.
3. Every absence is the same. 6 months absence or less is slightly less risky, 60 to 12 months is technically fine, 12+ months needs a re-entry permit.

Got it. But don’t they track that I spend at least 6 months per year in the US to maintain my LPR status? I’ve read that some time ago some people did this but since several years traveling to the US once every 5-6 months to maintain status doesn’t work anymore…

There is not a technical requirement to stay at least 6 months of each year. However, someone that just visits the USA for some years would eventually be challenged that they are not actually living in the USA.

Hi Simon, I hope you are doing well.
My CN EU3k and it is current since November, but my ds260 filled date is 8th of July.
I already wrote to my embassy (Sofia, Bulgaria) to ask them if I have an interview. They replied that they still had nothing and to write to KCC, but to keep in mind that they work with reduced capacity. I of course sent an email to KCC to ask when I can expect an interview, as my CN has been current for several months. Their answer is that my ds260 is still being processed, ie it has not been processed yet.
My embassy has only 1 interview scheduled since the beginning of the new year. In other embassies the date of filling the ds260 form is not important and there are people who, despite the late filling in of ds260, their form has been processed, ie their embassy requires cases from KCC as I understand.
Can i somehow ask my embassy if they can request my case and basically what can i do? Selected in our country are not many (much less than 100 cases).

The embassy only advise KCC of their capacity. The choice of which cases to schedule is up to KCC, and they won’t do that until they have processed your DS260. So – you can only wait.

Hi Simon, I submitted DS 260 in May and changed my interview location from Abudhabi to Nairobi embassy. They replied in Aug that they have moved my embassy and i should update ds 260 with new adress which i did also in Aug. The DS 260 still shows ABD. should i ask them just to reconfirm it was changed? Yes you can email them, BUT they may not actually change what is shown in the DS260 – even though they have noted the switch.

I m checking xarthisius data for 2022 , the embassy which my interview should be set ready cases number is 143 from 1 to 12000.
However my cn is EU11XX and ceac status still at NVC. Does it mean ready cases will be interviewed first ? Or they already scheduled ?
Is there any possibility they skip my case ?
Because i check data which provide savediversityvisa they set interview cases 1 before mine and 1 after my case.

The ready status means those cases are already scheduled. They don’t have to schedule in a strict case number order. If another case is DQ before you at the same embassy it will be scheduled before you even though the number could be higher.

DQ is a STATUS or being ready for interview. It is no longer about the documents other than the DS260 itself, but as a status it still exists.

I am a DV22 Winner CN EU26XXX from France- My wife and I completed our DS260 last August but my wife gave birth to our first child in December. We will have to unlock the DS260 to add our baby girl to the process.
– Do we need to wait that she has a valid passport to unlock and add her or can we do it without the passport first?
I am asking as passport process is very very slow currently in France (long wait to get an appointment and then the delay to actually get the passport) and we might not have a passport ready for her before end of March.

Dear Simon, Thank you so much for your time and assistance with answering all our questions.
My question pertains to the 260 and immigrant intent. I have lodged the ds260 hastily after being selected with a high number. I realized in the process that my b1b2 visa has expired and i need to renew it. If i understood how lodging the ds260 would show immigration intent i for sure would have done this application first, but i am only now finding out about you and the immigration forums you post on so helpfully.
I have unlocked the ds260 as i had a few errors, so my question is this:
Has the us embassy already seen my immigration intent just by me being selected for further processing, or my previous ds260 submission?
If it is now in unlocked state, and i never resubmit it, will they know i have applied for an immigrant visa?
Or does it only get lodged in the system when it is lodged and not in an unlocked state?
I have gone through hours of research on all the forums you post on and in your website, facebook, and twitter and i cannot find the answer.

Immigrant intent is created the moment you submitted an application for an immigrant visa (the DS260). It doesn’t matter whether the for is processed or not. You showed that you “want” to emigrate.
It does not mean you can’t get a non immigrant visa, you just have to be more careful to show ties to your home country to address the concern that you will try and stay in the USA.

Just forgot to confirm, that the form had NOT been processed yet at time of unlocking. is the 260 form submission thus not in the system for the purpose of lodging a b1b2 and showing immigration intent?

This is a special email. It is only sent to a selectee when that case is current, DQ AND already “allocated” to an embassy. If the embassy is working and has capacity, you can expect the 2NL within a short period, probably the next 2 to 3 weeks.

The embassy won’t know anything about your case until it is *sent* to them (not just allocated). The period of time between the allocation and sending is “normally” short. BUT if the embassy does not have sufficient capacity for all the cases allocated to them at some point in time, then the cases will wait until a later month. So – in your case it will be a limitation of Montreal embassy (who have only accepted 7 cases up to now).

Hi Simon, my case number is 2022AS79** and my case status is “READY”. I have received an email from the U.S embassy in Jerusalem (I’m an Israeli) that askes me to register my case.
They are asking for a few details there – one of them is ds260 number.
Where can i find it? I’ve searched everywhere and i can’t find any “ds260 number”. Google search didn’t help me much.
Do you have any YouTube video that explains what my next steps should be? I’m getting to the critical moments and I don’t want to make mistakes.

That is tricky. Once you have changed (which may not be easy or instant) you might find yourself worse off than before. You might be able to switch back, but again, that won’t be easy or instant. So – don’t do that on a whim.

As a DV2020 winner with a reactivation trip in March 2021 and no relocation/further trip since due to personal reasons – is it possible to retain the Green Card at this stage? E.g. if I travel in February, i.e. after 11 months of absence.
What do you think I can expect to happen at POE? I am a bit afraid that something bad like entry denial or deportation can happen. Is it worth trying to retain the Green Card like that or is the risk too high?

The cases marked as ready that are not current yet were a mistake that happened in December/early January. I don’t think that will happen again as it was a mistake.

Now I’m trying to submit my DS260 but now there is a trouble.
Initially, I was planning to choose AOS. So on the first page of DS260, I chose the interview’s location is USA. But now, I need to apply as CP so I tried to edit the location but I couldn’t because it’s locked. I can edit other part of DS260 like address or something but not interview location.
How can I change the location? Is it better to submit first and ask KCC?

Now I’m concerning about my I94 renewal. In Ds260, I’ve been asked US visit and length of stay. Now, I’m staying USA over 28 months and waiting for approval of extension of I94. Do you think is it ok to submit with this situation? Or is it better to wait until I94 approval? It should be approved by next month as long as they won’t delay any more.

1. You have to decide for yourself about whether to be on a lawsuit or not. I can’t predict whether your number will become current or not.
2. Case number is the first way to prioritize cases. It is not (and never has been) the DS260 submission date that is the next priority, it is the DQ date. That now means the date the DS260 is processed. That distinction is important since not all DS260s submitted on a given day will be finished processing at the same time.
3. I don’t know.

I am a 2022 dv-lottery winner from Iran, with the case number of 4000.
Recently we have realised that the councils are working really slow and all we can do is wait and see what happens.
I have few questions,
First of all, is there anything that I can do to proceed my case faster than usual, as if sending my docs (which I have done) without receiving any email?
I mean we have tried everything that we could.
I would appreciate, if you could help me on this matter.
The second question is, how do people get visa interviews without being current? Is there anything behind this? The trouble in Afghanistan? Or the new pandemic?
The final question is, do you think getting an attorney would help us?

1. Nothing you can do to speed it up, no. The documents are no longer required by KCC, so unfortunately that won’t help. Nopw it is simply a matter of embassy capacity.
2. In late December/early January a handful of cases were scheduled before being current. That was a mistake by KCC, and hasn’t happened again since. Those cases should not be issued. ONe case has. THat is another mistake and the lawyers will use that to show the government is screwing up.
3. Having an attorney might help. You really only know whether that helps or not after the fact, so you have to decide for yourself based on your budget and so on.

Hi Simon,
My number is AS 22xxx from Malaysia, I am currently in the US and am considering to apply for an AOS. is it better if I leave the country and get in on a visa instead of going through the AOS route? would there be a better chance for me to get the visa? I am worry that USCIS won’t be able to have enough time before September to finish processing my application, I was hoping can you give me some advice on this?

AOS is a good option. However, your case number is high so if you do become current you will have to move as fast as possible including using the early filing option. More info here:

Hello Brit,
I would like to ask about the i-134 form. I know you have talked about it in details in many occasions but I need to clarify one confusion so my apologies if this question is repetitive.
I would like to know what are the W2 and the 1040 forms and when do they come in the process. I am yet to receive the i-134 from my sponsor but while doing some research I came across (even on this blog) those two other forms I mentioned above. Do we need all 3 forms at the interview?

The W2, 1040, payslips and photo ID are all supporting document you should have from the sponsor when you show the I-134

I hope you’re well.
I had my interview at the embassy. I was put on administrative processing due to a glitch/issue with our birth certificates. The consular said all our documents including three police certificates from two different countries were okay but our birth certificates were not. They returned our passports too and gave us the yellow paper of administrative processing.
Immediately after the interview, I went straight with a scanned copy of my birth certificate to verify with the authorities and indeed the reference on the birth certificates I submitted was not matching with the information in the register.
The authorities agreed to process a new birth certificate for me because they have my information on their record. I have also verified that the information on our scanned birth certificates is all consistent with the information on the register. They just don’t have the security features which I didn’t know about.
It’s possible that the agent who worked on my birth certificate hoodwinked us and took a lot of money from us and gave us certificates without security features.
I am now wondering about what to do next. I am actually panicking. I am thinking of emailing the embassy telling them all that I have told you and let them know I will send them the valid birth certificate which will be issued within a week.
Do you think that will help or should I just wait and see?
Also, the consular retained all authentic original documents like police certificates and marriage certificate.
I need direction on what to do. I am so in panick and confused. I really need help.

i will send to ur email a form u have to fill it n send it back asap
she did not give me a letter or told me u have been rejected ! (at that moment i was unable to ask or even think lol )
only she gove me my passport n visa payment bill
..is this action say its soft denial or ultimate refuse or AP ?
cuz they sent me to my email a form ds5535 and after i sent it to them they told me “pending ap” !
while in ceac track its still appear refused ! n no update still

It’s a soft refusal (AP). Fill in the form they gave you and once that has been cleared you can be approved.

You can either attend the interview there OR ask for a transfer back to Cameroon. However, transferring will probably cause a delay.

2022AS20***. I was born in Saudi Arabia but I have an Egyptian citizenship only and my interview is in Cairo, Egypt. I submitted my ds 260 on May 9, 2021 and I was DQ’d on September 28, 2021.
1) Given how Cairo embassy isn’t processing very quickly, my high case number, and the visa bulletin, would it be worth it to join the lawsuit?
2) I have a b1/b2 visa, would I be allowed to switch my interview location to USA?

1. Maybe – you need to decide based on your circumstances.
2. There are complications with that, you have to be careful not to cause problems. You have to stay in the USA for months without working while you file and process.

My wife and I have been provided with section 221(g) on our visa application for edv 2022.
We could not provide our medical documents before the interview schedule. The embassy has asked our medical examination and vaccination related documents plus some documents to prove her academic studies. As we are informed with failure in section 221(g) but our passport is still at the embassy, and asking us extra documents to submit, is there still a chance that our application result turns out to be positive, provided that all the documents asked for are properly submitted?

I would like to pay (for myself) the immigrant fee online before arriving.
1) Payer contact information. Here I would input my current address, as I am still abroad and my credit card is also from here. Correct?
2) After that step the user arrives at another page, there it says..”provide your information for on of the two billing options: U.S. credit card or U.S. bank account
What do they mean by U.S. credit card? I have Master Card, but it is from my bank here abroad. Does that work? I am afraid to just try it, since I read somewhere on the USCIS website that don’t try to collect more than once etc.
