July 3, 2022 at 06:43
hello Simon,
Thank you for your efforts and dedication. I was selected for the 2023 DV lottery; I added my husband and my stepchildren to my initial DV application. Since I’m from a country that allows polygamy, my husband has another wife, and he is still married to her and we know the USA doesn’t allow polygamy. I have a couple of questions regarding the DS 260.
1- when filling my husband’s DS 260 in the spouse section, he added me as his spouse since I’m the winner of the lottery but what about his second wife should he put her as his previous spouse? or just don’t mention her on the application since there is no place for her and then explain the situation at the interview?
2- I have 5 step-children from my husband’s second wife. All of them are younger than 21, and one of them is a USA citizen by birth. For that reason, I didn’t put her name on my initial DV application. Should I list her in my DS260 in the children’s section?
3- will the polygamy matter decrease my chances of getting my visa?
July 10, 2022 at 00:20
Let’s answer Q3 first. You have problems because American immigration law won’t recognize your marriage if they know it was the second marriage. They will probably know that because the step children make that clear. So – they will expect divorce papers for the biological mother of your step children. I think that will probably ruin your case.
So – I don’t think you should proceed, but in case you do, here are the other answers.
1. I can only advise telling the truth, but the truth is a problem for you.
2. No
July 11, 2022 at 00:48
Thank you for answering my questions. I just wanted to clarify that im the first wife, the children are from the second marriage. Will that make a difference?
also if I proceed with the application, where should I mention the second marriage on my husband’s DS260 since they only ask about the pervious marriages and there is no place for a current second marriage?
July 15, 2022 at 03:21
OK, so yes that makes a difference. Your marriage would be considered genuine, and since you listed your step children, that should be OK. In terms of the second marriage, you can discuss that in relation to the children, but the second marriage won’t be considered real.
July 3, 2022 at 08:00
Hi Simon
If my fathers older marriage was annulled will they need this cert. Even if my mom is the main applicant? They have a certificate from the church too with the marriage info and the church wouldn’t have allowed my parents to be married if the previous wasn’t annulled. So would they still need a specific annulment certificate?
Thanks
July 10, 2022 at 00:23
Yes
July 3, 2022 at 11:16
Hi Sir,
I’m a DV 2023 winner.
I entered an expired passport number during entry. Should I go ahead with the DS 260. I’m I safe with the passport requirement rule that has been annulled.
I don’t want to waste my time n resources to be refused visa later
July 10, 2022 at 19:15
Safe

Hi Brit,
2022EU107xx here again. Unfortunately they have passed my Cousin case 3x since April when they put him in AV status. For unknown reasons they won’t grant him an interview and numbers more than 2x his case numbers gets interviews. I emailed them and their reply you are currently processed and ready for interview. I’m the US sponsor. I can’t find any reason besides he is 60, retired doing odd jobs to keep busy. My question is what month interview are they giving nowadays and should we called it over. It seems they are doing this to his case on purpose.
July 10, 2022 at 19:20
I don’t know anything about specific cases – but the final interviews will be scheduled by early August.
July 3, 2022 at 14:25
Hi Mr. Simon,
My husband is a winner of dv 2023. We complited ds 260. There was a question regarding the us visas. My husband had one visa from us embassy in 2016, with which hr travelled there and he was issued onother one 2021 but he has not use it yet. It is valid until 2024. We didn’t mention the second visal. Is it a problem? Should we unlock or we can mention it at the embassy if we ever get an interview? Thanks!
July 10, 2022 at 19:20
I would unlock to add that.
July 4, 2022 at 01:32
Hi Brit,
For the affidavit of support form I-134, what I downloaded says “form i-134, Declaration of financial support”
The latter is the most updated on the uscis website but contains irrelevant questions to DV cases like date of return from the US,…
Should we keep using this i-134 or the i-864?
Thanks
July 10, 2022 at 19:30
I-134 is the only form DV cases can use.
July 4, 2022 at 07:58
Hi Brit,
I’am from Srilanka (AS4xxx) and I visited India very frequiently from 2018 to 2020 for some official perposes (for the employer) on a Visit visa. Didn’t stay more than a moth for each visit (Stayed in a hotel). I might have gone about 10 times during that time. Do you think I need to get a police report from India?
July 10, 2022 at 19:31
You need to read the reciprocity page for India, and read the instructions.
July 4, 2022 at 10:18
Hi brit
My name is mai Allam, female Egyptian and i was born in Egypt in 1978
My husband is a dv23 winner
I used to live in Oman ???????? from 1979 till i got my high school diploma in1995, and I was 17 years old in1995 ..
Now one of the required documents from me is the police certificate from oman..
The problem here that I left oman from 1995 and I have no relatives there and my father died in 2021 so we don’t have connection with his old friends there..
So I can’t issue police certificate from oman authorities, but I can issue one from Egyptian authorities is that would be sufficient?
July 10, 2022 at 19:32
Have you read and followed the instructions on the reciprocity page for Oman?
July 4, 2022 at 12:28
Hey Brit,
I’m the winner of DV2023 with EU9k case number and i’m planning to get married now and after my girlfriend’s documents are updated with the new surname (ID, passport [1]…) i will fill the application for both of us.
In meantime she will get another passport [2] (from another nationality that she has), but that passport will be with her old surname & probably will need to be updated in that country later.
The question is: that won’t affect anything right? The application will be with passport [1] that has the correct/current information and even if they see the passport [2] on their computers – that shouldn’t be an issue?
Thanks in advance for your opinion here, and thanks for all the information until now!
July 10, 2022 at 19:33
No problem.
July 4, 2022 at 12:45
Hello Simon, thank you for your quick response. Please I have some questions. My police certificate which is in chinese and also a translated copy. Do I need to submit just the translated copy to KCC or I have to submit both the Chinese version and the translated copies? Secondly, I want to confirm about the Subject line upon submission. Case number_Names_ DoB_Certificate.pdf. Do i need to also list all the documents on the subject line? Thanks you
July 10, 2022 at 19:34
Documents are not being requested in DV2023 as of now.
July 4, 2022 at 15:34
Hello Simon
Just a question, what is the last date they will release 2NL & what is the last date they can interview 2022 DV lottery, are they going to schedule interviews till last day of September ?
July 10, 2022 at 19:35
September interviews will continue up to the last day – but those will be scheduled in the next three to 4 weeks.
July 4, 2022 at 15:43
Hello Brit ,
I have a concern.
To know, for those who are waiting for their visa,
Is it possible for a visa to be issued after 30 September 2022, if the interview was done before 30 September?
Or do all visas have to be issued by 30 September 2022 at the latest?
July 10, 2022 at 19:36
The deadline is on visa issuance.
July 4, 2022 at 17:30
Hi Simon,
I won the DV lottery 2023, I’m a physician in my country. I responded NO to 2 questions of DS-260 , the first one is: Are you a graduate of a foreign medical school seeking to perform medical services in the United States but have not yet passed the National Board of Medical Examiners examination or its equivalent? and the second one is: Are you a health care worker seeking to perform such work in the United States but have not yet received certification from the Commission on Graduates of Foreign Nursing Schools or from an equivalent approved independent credentialing organization?. So, If I obtain the GC I want to study for get that certifications in USA and I won’t work like a physician at the beginning.I don’t know if I responded it in a best way or It’s necessary to unlock de DS 260 for explain it choosing the asnwer YES.
July 10, 2022 at 19:36
It doesn’t really matter. No need to overthink this question.
July 4, 2022 at 20:13
Hello Simon
My case number is 2022AF179xx and I have submitted ds260 since Dec 2021 but I haven’t got an interview scheduled yet,
1) Is it possible that I may not have an interview?
2) And if got it correctly the last date for sending 2NLs is mid July for
Sept interviews, so if I didn’t get it mid July then that’s it?!
July 4, 2022 at 21:50
I completed ds260 earlier and had it unlocked and resubmitted it in Dec but changed the parents surnames and the embassy.
July 5, 2022 at 02:06
Hi Brit my case number is 2022AF25**** from Ghana and it seems Ghana embassy is not working I need your concern please is it advicable to transfer my interview to ouagadougou since the time left is less?
July 10, 2022 at 19:38
There is almost no time left and if you are in AV status (current for interview processing), they won’t let you change.
July 10, 2022 at 19:37
1. Yes of course. Many thousands of people will lose their chance.
2. The final interviews will probably go out in early August.
July 5, 2022 at 06:56
Hello Mr. Simon, I entered the dv lottery from the AS region (I’m a citizen there) but now I’m temporarily residing in the EU region. As my interview location, I entered the country of residence (in the EU region). When they start processing my case for an interview, will it have an impact because I am from another region or will my case be processed only based on my case number just like any other case number from the EU region irrespective of the region i applied from?
July 10, 2022 at 22:07
They will process you as normal, your interview date being based on the AS region numbers.
July 5, 2022 at 07:05
Dear Simon
I have a Twitter account that was suspended for a stupid reason
(I posted a video form a tv show, copy rights)
I didn’t add it into my ds260
And at the same time I cannot delete it or activate it and i still do have access to it
Would it be a problem
July 10, 2022 at 22:08
Probably not.
July 5, 2022 at 07:26
Hello. I am a Dv2023 winner. To be honest, I have been registering in Dv since 2016 and only this year I had read the instructions about photos. So I uploaded my and my husband’s photos correctly. After I registered with these same photos in 2017,2018 and for DV 2023. I forget the instructions about photos. Another problem, this year I took my 7-month-old baby picture at home with no white background (it is the slightly yellow back of the bed)Do we have a chance to get a visa? Or it is not meant to go to the interview? Thank you in advance.
July 10, 2022 at 22:08
You have a chance.
July 5, 2022 at 09:15
Dear Mr. Simon, Hope you are good and thanks for your comments from which I learnt a lot on the DV process. Also thanks for your tolerance and replying these questions. Please tell me who decides a candidate’s eligibility whether on “education” or “profession”? On DS 260, there was no place to choose it by the candidate, right? (Only to list the educational and job experiences?
July 10, 2022 at 22:09
The CO will normally assume education, if you don’t meet that requirement they will ask about work experience.
July 5, 2022 at 11:38
Hi. Brit. You are such a great person and thank you for the great work you are doing. I am an 2023AF33*** I have 3 questions: (1) Are USCIS fees paid for derivatives as well or it just for the principal applicant? (2) Can the selectees including principal applicant also apply for DV entry 2024? (3) I had a customary marriage in 2021 February and you advised that I should do the gvt one which I did June 24th 2023 and we have a marriage certificate now. Is there need to change my spouse surname on passport, it takes time for passports to be processed down here in Zimbabwe or I will just take our marriage cert to the interview if we are scheduled? Thank you.
July 10, 2022 at 22:10
1. Each person.
2. Yes
3. She doesn’t have to take your name, but if her legal name changed, then she should get a new passport.
July 5, 2022 at 15:12
Hi. Brit. You are such a great person and thank you.
I am winner 2022, that time I was in Ukraine. Already I attended the interview, I got 221g letter administration process letting, also I sent all the documents they asked me. Then I sent email to embassy Frankfurt, they said ” Our Immigrant Visa Unit has not received your documents yet. There is no need to come to the Embassy as it will not help to deliver your documents.
Please note that your case is still in the administrative processing anyway, it takes time, and we will not be able to issue your visa until this processing is finalized. ”
What should I do?
July 10, 2022 at 22:21
Wait at least a week, then You need to email again to see if they have now received your documents.
July 5, 2022 at 18:19
Hi Mr Brit. I got through the random phase of 2023 lottery and now filling out the DS260 form. What I would like to know is, if the host address is something that I should carefully consider when choosing a state ? Does it matter in which state I have the host address? Because I have a friend in a state where I would not consider living because of less job opportunities in my field.
Please advise me what to do in this case
July 10, 2022 at 22:22
The address you list is simply where you want the GC sent. You can live anywhere.
July 6, 2022 at 02:32
Hello Mr.Simon,
1) My sponsor’s last year income was below the poverty level on W2 because of a pregnancy. But she had a good income previous years and currently she’s working normally. Is this will be an issue?
2) I’ve heard that I can have two different sponsors to match the poverty guidelines. Is this true? If yes, how can I do this? Do I have to just collect I-134s and supporting documents from the sponsors?
Thank you.
2023AS6xxx
July 10, 2022 at 22:24
1. Yes, get another sponsor.
2. Only one sponsor that meets the requirements.
July 6, 2022 at 06:26
Hello Mr. Simon,
My sponsor is a retired permanent resident in USA. He has around 60000$ annual income via social security income. As social security income is nontaxable in USA. Can he sponsor me and my wife using that income? He only has his wife in his family. So all members collectively are four.

1. Can I fill the DS 260 form for my spouse with Eritrean ID?
2. Since my country of chargeability is in Kenya, what other options do I have?
3. When do you think my interview will be scheduled?
July 10, 2022 at 22:25
1. Yes
2. I don’t know.
3. I don’t know.
July 6, 2022 at 08:46
Good day Britsimon!
2023AF4XXX
I got married at the end of last month and intend to complete my DS260 this weekend.
We are considering to keep her last name, and not take my last name to save some time and complexity, but if we could find a way to do it we would like to change it.
When we apply to get the Police Clearance Certificate, Marriage Certificate and Unabridged, does her new last name need to reflect? Or can we apply for the documents so long, and change her last name in the meantime (Get new ID document, Passport, etc.)
Also, what surname should I use when I complete the DS260? Her current surname before changing all the documents, or my surname (which will not be the same as on the police clearance for instance.
July 10, 2022 at 22:42
On the DS260 you use the new legal name, and use the section that is for “other names” – which then ties to her old documents.
July 6, 2022 at 11:30
DV2022. I got my green card a few weeks back and my wife is waiting. We went back to our home country as we discovered my wife is pregnant while in the US. Would you please let me how long can we be away without being considered abandoning the LPR status?
July 10, 2022 at 22:49
12 months. Babies are born in the USA as well you know…
July 6, 2022 at 18:31
Hello Brit hope you doing well
My ceac status shows refused with short text description (U.S. consular officer has adjudicated and refused your visa application. Please see the letter you received at the interview. ) however i got 221 g at the interview and 3 times i ask consular they say it is still On AP and also they send public charge questionnaire i responded.
But the people whose case also on AP status ceac display refused but long text description and they all got ds 5535
Only my case not similar like them
What should I understand from this ?
Have you faced case like mine ?
Do you think is it completely refused or not?
Thanks
July 10, 2022 at 22:48
You are on AP. That is technically a refusal – but it is a temporary status.
July 7, 2022 at 04:19
Hi Simon
The fear was to secure an interview before September 30. I’ve been lucky to be able to do that. Now, the fear is that embassies will close again due to the new rising wave of COVID19. Do you think that’s a possibility within the next month or 2, based on how the embassies reacted to waves 1,2 and 3?
July 10, 2022 at 22:53
I can’t see the future.
July 7, 2022 at 08:40
Hello Simon ,
Am 2022 selectee and received my interview appointment in Aug and I was completing my documents .
Hopefully this msg finds you well , a quick question :
My friend is sponsoring me and filling the I-134 form , she have filled the 1040 and I saw that she have 3 dependants under her , she and her husband make a 90 k per year and she have her own business, will that be OK to add me and my husband too or its too much for her to uptake and we should look for other sponser.
Highly appreciate your support ????
July 7, 2022 at 08:46
We have more the 20 k in our saving account too .
July 10, 2022 at 22:55
That is fine.
July 7, 2022 at 09:18
Hello Simon.
A kids was below 21 when we participated in the DV23, and before the results on May, he got married, does this mean he will not participate in our interview? We still hasn’t closed his ds260, and now we shall say he is married.
July 10, 2022 at 22:56
Yes he cannot proceed as your derivative as he is now married.
July 7, 2022 at 10:35
Hi Brit sir,
I have mailed KDU regarding, if we need Affidavit of Support from a U.S. while interview
here is the reply from KDU, Consular, Kathmandu
“An Affidavit of Support from a U.S. is not mandatory for your DV2022. ”
Could not attach the screenshot as there is no option.
Thank you
Prem
July 10, 2022 at 22:57
Every selectee (especially those interviewing at the end of the year) should think about how to demonstrate they will not become a public charge.
July 7, 2022 at 12:14
I heard you in your previous videos mention I do not need to wait for child’s passport before submitting DS-260. On travel document page for my child should I select passport and use my details or I can select ‘Other travel document’?
July 10, 2022 at 23:07
Either way.
July 7, 2022 at 18:58
Hi Brit, by the time I’ll be going for my interview, my pcc will already be 10 months old. Also, from the time it was issued, i returned to the issuing country ones. Now, i know according to kcc, my pcc is still valid for the interview, but does the fact that i returned back to the country that issued it makes the certificate invalid, thus requiring me to make a new one for my interview? a bit confused here. Worth also noting that, by the time i’ll be interviewing, i wont be a resident of the said country anymore. dv22 winner. so appreciate your response Sir.
July 10, 2022 at 23:16
PCs are valid for up to 2 years.
July 11, 2022 at 12:01
Thank you Sir for your response. PCs are valid for up to 2 years regardless of whether you returned back to the country that issued it?
July 15, 2022 at 03:29
Yes
July 8, 2022 at 00:21
Hi Mr. Brit Simon,
I have a question about your video of filling out form I-134.
In 19:52 of the video (part 3, point 15, page 6) you mentioned that the sponsor needs to write down his/her annual income.
However, my sponsor who is a US citizen is a bit confused about it because what he understood from the point written in the form which is “Income Contribution to the Beneficiary Annually” is a certain amount the sponser is willing to give out from his income to the beneficiary and not to write down his entire annual income. Could you please elaborate more on this point? Thank you!
July 8, 2022 at 10:36
My sponsor also had raised the same concern on this q.15 of 134. I did not know the correct answer!
July 10, 2022 at 23:18
Entire income. Think of it as contribution to the calculation, not that he will give you all his income.
July 11, 2022 at 14:13
Thank you Mr. Simon, I do not know what I have done without your guidance along this tiresome process. I will let my sponsor know this. God bless you.
July 8, 2022 at 12:53
Hi Mr Simon, Hope you are well
I’m DV 2022 AF41XXX
When gathering document for the interview, the affidavit of support, does the host in USA fill a letter confirming that they will be hosting the applicant or they have to fill in Form-I864?
Thanks
July 10, 2022 at 23:19
I-134
July 8, 2022 at 14:48
HI SIMON
It has been more than a year when i followed your blog. I’m DV2022 winner from Addis Ababa Ethiopia. I am one the plaintiffs Joined Jesse even if still no body picked from the Ethiopia. Here is my question Simon, when you compare the current government status vs the damage & ignorance made by Addis Ababa consulate, do you think that we can win the case?
July 10, 2022 at 23:19
I don’t know. The embassy seem determined to ruin the chances of many people.
July 8, 2022 at 16:16
Dear sir, if I want to change the address after signing DS-260 form, how can I di that?
July 10, 2022 at 23:20
You would unlock to do that.
July 8, 2022 at 18:39
Hay simon is it normal for AP to last more then 5 bloody months??is there anything I can do like getting a lawyer?
July 10, 2022 at 23:23
You can engage a lawyer for an individual mandamus case. It’s expensive and cannot guarantee success.
July 8, 2022 at 19:14
Hi Brit,
I’m DV 2023 Winner From Sri Lanka. As per the Data in your Site there have 2019 selectees from Sri Lanka, Highest in History,
As per my understanding Highest reported Cn in Sri Lanka will be 26xxx. (only that i found)
Do you get any information about the highest CN in Asian Region ?
July 10, 2022 at 23:23
Not yet
July 8, 2022 at 19:30
Good day Brit
As mentioned in an earlier question, my wife and I got married at the end of last month. However we still have two separate addresses. I have an apartment that I am sharing with two other people and she is living alone.
I am at her place 99% of the time, but I still pay my share for the apartment as I couldn’t find another tenant.
My concern is that they may pick up that I am still paying a large amount of mortgage (and only receive 50% of that in physical rent), and all my accounts are linked to this address.
Should I use her address for the DS260? Or mine?
July 8, 2022 at 19:41
AF20234XXX
Maybe just to add context, we married in secret for the DV. Hence the reason why everything is still a bit of a mess in regards to living together.
July 10, 2022 at 23:24
Use one address.
July 8, 2022 at 19:42
Hey BritSimon. I am a greencard holder currently in the US. I recently got married and my husband joined me via F1 visa. I would like to adjust the status to greencard. Can we file form I-130 and I-485 ( work authorization ]at the same time?
July 10, 2022 at 23:24
I only answer DV questions.
July 8, 2022 at 21:54
Hi Sir,
thanks for your usual help, the police certificate dosnt have the current adress mentoined , its empty field.
is that ok ? or the certificate current address should be filed to match the ds260 current address ?
July 10, 2022 at 23:25
It depends on local procedures.
July 8, 2022 at 22:56
I am from Ethiopia and I want the dv2022, my number is 5501, so do I get chance to be interviewed in November or December?
July 10, 2022 at 23:25
DV2022 interviews will end in September.

Hi,
My first interview location was Montreal then I transferred it to Ankara,I wanted to take it back, and Montreal accepted my case like 3 weeks ago. The funny thing is that, I sent an email to Ankara to ask if Montreal wanted my case or not, they responded ‘we don’t have your case, please contact with KCC’ then I sent email to KCC asking my case and interview location , they responded ‘Ankara’ and Montreal says ‘ we haven’t received your case yet’ , so I am assuming it shouldn’t take 3 weeks to transfer, not sure about the process but what do you think about it? Is this something you’ve heard before? I thought at this step it is only between consulates. Thank you!

Sounds like you were never scheduled in the first place.

Dear Mr Simon,
I can’t thank you enough for the support you have given to dv winners. I previously also got answers from you as well. But the more I read into the comments I start to worry about my DS260.So I have three questions. Please answer these.
–CN AS22*** and already unlocked once.–
1.Education background: I included 3 institutes considering high school, B.Sc. & M.Sc. but I did study at another school up to age 10.I didn’t include it as it was asking about the high school .
2.When it comes to high school also I included (2007-2010) the days I got my results from grade 11 and the day I got results of the advanced level exams.(my leaving certificate has a different date same year ) and the day I entered my school is 2001 .
3.I included my current job which I have been at for 4+ years and the previous job which I was at for 1 year. But there was another job(my 1st job) which didn’t last for more than two months as a financial analyst. more like a trainee
Should I unlock again and correct these??Or can I correct them at the interview if I got called for the interview. Please help. Looking forward to get a reply from you. Thank you very much sir

Always quote the year. If you are DV2023 you have lots of time to wait so you may as well correct it.

2023 winner!is it important to correct these?won’t it be an issue if I unlock it twice?

Hi Mr. Simon,
I’m Dv winner 2023 AF, I have submitted my Ds260. I travel to Brazil in 2014 to watch the World Cup. But I didn’t include it in my ds260. Should I open my ds260? Because it’s been 8years. I spent 2weeks in Brazil.
Thanks so much for your attention. God richly bless you.
Regards,
Kwabena
