My wife is a DV 2023 winner and the interview is soon. However, I overstayed my F1 visa. I lived and worked in US from 2003 to 2009. I left the US voluntarily and it has been more than 10 years now. I have searched some information online about it but could not find anything reliable. Do you think I have any chance of getting a visa? What would you advise me to do?

I am dv 2023 winner CN 2023AF11k , my husband is in Europe when I fill DS260 his interview location was there in Europe , but now we plan to make the interview together as a family in our country. You cannot change the embassy selection after the first time of selecting it.
You will be given an interview based on the location of the principal applicant. Derivatives don’t have their own appointment.

Thank you for your reply. But one thing to ask you to clarify it, My husband’s interview location shown in Ds 260 is still Europe.
So do you think that it is safe to leave my husband’s ds 260 as it is showing his interview location as Europe ? My husband is a derivative FYI.
If it was as you said above, that is if derivatives do not have their own appointment, why my husband’s interview location is shown as Europe, different from mine?

I am a DV 2023 selectee with case number AS17k. Due to my case number being high, I have applied for DV2024 as well. However, I am processing my divorce as of now. The divorce case was concluded and the divorce documents are under processing. Since I have not yet received the divorce docs and don’t know what would be the exact effective date of the divorce, I have entered as married in DV2024 as well. I entered the DV2024 on 22-Oct as married and there is a possibility that the date of the divorce docs to be an earlier date than 22-Oct. I have decided to enter as married because if the document is going to contain a date after 22-Oct, I will be certainly disqualified due to not entering the eligible derivatives in my entry. If I get selected again for DV2024, how bad it would be to enter as married when I was technically divorced before entry? Will this be a forgivable offense at the interview or I will have to forget about the DV2024 entry?

Hi Brit, DV2021 winner and Goh plaintiff. Just to keep my documents ready in case if a positive outcome from appeal court, I wanted to know below.
1-I have taken police reports from my country of birth during Nov 2020 (I lived there untill I’m 25 and moved to different country) but never stayed beyond 6 months other than one or two weeks during last two years. Do I have to request for a police report again from that country?
2-This question is related to AOS. Does DV winners who are proceeding with AOS, required police reports from countries they lived previously?

Hi Brit – my husband is the principal applicant for DV 2023 and I am the derivative. When filling out the DS form I did not include 3 colleges that I attended, because I did not obtain the degree from any of them. I attened the 2 in the past and attending one at the moment. Is it going to affect the application if I leave it like that or I should unlock the form and add all 3 with University, no degree option? Your advice on this is much appreciated.

No shadows on the white background and no editing of picture , 600X600 pixels as dv site photo tool can assist with that as it is on the website. All details are self explanatory number of children includes all children including adopted and educational achievements as of the day you applied and not what you think you are going to get. For example if u are pursuing a degree do not our ur highest at degree as u have not attained the certificate as of the time of filling the form

I’m DV23 winner from Russia. And as many Russians now, I got into a closed circle:
My default interview post is Warsaw -> I need a Schengen Visa to get to the interview -> I applied for it in August, but was refused -> I left Russia after because of threats from crazy regime -> Now I can’t get the Schengen visa from abroad, and I couldn’t return to Russia (it’s too dangerous for me).
So, I have a row of questions:
1) Can I unlock my DS260 and change the interview post with a proper explanation of my situation and not asking the embassy where I want to pass the interview?
2) Or should I ask the chosen embassy first and get an official permission from it?
3) Should I tell anything to Warsaw embassy?
My case is 23EU10…, but I want to figure everything out before my interview will be appointed. I am sure that my question is really hot for thousands of Russians now. Thank you again!

This is a relatively new situation, and I don’t have a clear advice to give. If you are able to stay in the country where you are now, then you could interview there. In that case, contact KCC and update your address, and ask to be interviewed there.

1. The documents vary by case – so I suggest you read the instructions and see what you need in your case.
2. In most countries it is possibly to obtain an official replacement. Get that.
3. Typically 6 to 8 weeks.

Hey Simon. I have chosen the country of birth and not country of nationality when I applied in my entry last year in October. I put that I was born in an Asian country but in the next step of choosing the country that I want to apply with, I applied with the country of my nationality which is an African country. I thought that since I don’t have a residence or nationality from my country of birth then I have to choose the country of my nationality. But since my country of birth and nationality are both eligible for the dv, is it okay that I went with the country of my nationality?
I would like to know if I can still proceed to the interview or is it going to be an issue. And is there a way to change my region now or is it too late. My husband and parents were born in African countries but not the same as my nationality that I used. Thank you for you time.

As you were born in Asia, you should have an AS number. However, you can charge to your husbands country of birth, so at interview you will have to say that is why you chose an AF region country (along with your nationality). There is a risk of denial, but a chance of approval.

Hey simon i am a dv2023 selectee.Me and my 3 members of my family filled the ds260 with our old passport and they are expiring in 2025.but we decided to make remake those passports due to various reasons.
1)As I serve in military in my country the photo of my passport is taken with the uniform of the military.
2)my child’s face when we made his passport in 2015 has somewhat changed when compared to the photo in passport.
So simon is it okay to remake our passports and present them in the interview along with the old ones??

I have two questions :
1-I have been on several social networks years ago like facebook , but I haven’t had any activity, I don’t even remember my username. In form 260, I mentioned only the networks that I have been active in the past and now. Is this a problem for my case and if it needs to be mentioned and I am not sure about the username since it is years ago and I have not been active, what is the way?
2- I have injected my childhood vaccines in my country, but I don’t have a vaccination card. In the country where I currently live, there is no system for injecting required vaccines based on the requirements of America and issuing cards. If I don’t have a vaccination card, is it possible to get all the required vaccines at the same time at the medical center before the interview, and this does not pose a risk to my case, considering that some vaccines require multiple doses?

I have one question. You mentioned that any travel to the Middle East could result in AP for further security screening. I made a short trip to Israel and Jordan a few years ago, purely for tourist purposes and I was with a tour the entire time while I was in the two countries. My embassy is Frankfurt.
Q1. Could this trip increase my chances of being placed on AP?
Q2. If I bring details of my trip to the interview (tour booking confirmation & photos of the trip) to demonstrate what I did while I was there, could this help prevent AP?
Q3. Should I preemptively fill out DS-5535 and bring it to the interview with me?
Q4. Is there anything else I can do to decrease my chances of going on AP because of this trip?

Is that true that, in case of being selected, there are two “filter”?
In the first one they check if you have not submitted a doble entry and if your photo meets the requirements. If everything is ok about these two aspects, they put you in the real pool and when you will check the lottery results in May ’23, you appear among selected entries, am I ok?
I’m asking this considering that when you submit a DS-260 you’re declaring your immigration intention, so if you are disqualified in the consular interview just for the photo, it will be so bad and you’ll not allowed to travel in the US for many years.
PD: I know that there is a photo validator and thousand of good tips in the web, this question is just for curiosity, to understand if is true that there’s this kind of “pre-check”.

I’m not sure why some talk about these two filters, I think it’s something that EBM made up.
Entering the lottery doesn’t cause issues with future NIV applications. If you are selected and complete a DS260 – that is the point at which you have declared immigrant intent.

I am the winner. I have my husband and two kids on my application.
Last week my husband was diagnosed with a malignant tumor/ gist during a minor surgery. It was removed. He does not require chemo but needs to take some medication for life and scan once a year to ensue it does not reappear. He is fully mobile and as an IT project manager this does not impact his ability to hold a job.
In your experience would this adversely impact out medical clearance prior to the interview?

Hi Brit Simon,
I am a 2023 AS winner case range 22xxx from Sri Lanka, in our country High school certificate is call A Levels and with 4 subjects. Now here if you have passed 3 main subjects your considered passed. English although compulsory is not considered a subject for a pass. My question here is what is the US/DV minimum requirement for High school diploma/certificate, to be considered for application based on education vs work experience.
Appreciate your feedback on this as many from our country have this concern.

The requirements vary country to country and I don’t keep up with the requirements in each country – however, if you use google I believe you will find some clarification from the embassy staff from recent years.
