Hi Simon. Recently there was a big change to the AoS form I-485 (I reside in the US on an already adjusted status from b2 to 01A). I was wondering if you could make a video to run through the changes? They pertain mostly to being deemed a public charge. What do you say we should include in our AOC package with this new form? The process detailed by Someone’s Mom is now out of date as this form is 2 weeks old or so now. Really appreciate you! Thank you!

1) The “In-transit” status appear in the CEAC after a person receiving their 2NL or can the status change from NVC to In-transit even before receiving the 2NL? Please help to clarify.
2)Do you have any information whether the 2NLs for March were sent out as of now? My case number became current in the March VB and DS260 was also processed when I checked with KCC. I am eagerly waiting for my 2NL.

Hello Brit, I am current for March and my DSnwas processed in October. So theoretically, I should receive the TNL within the next couple of days but my embassy Colombo is touching the cases only up to 4000 even though the region is curre upto 15550 for Feb and even upto 18750 for March. This is according to Xharthusiast website. It appears to me that this embassy is all set to shatter our dreams. What’s your point of view about this situation?

I don’t normally comment on posts on Simon’s blog, but I’m making an exception in this case considering the misleading information about my provided information being out of date. It is certainly not out of date. There is an updated sample I-485 on the spreadsheet with information on how to fill out the new form.
The requirements for demonstrating one is unlikely to become a public charge are still more or less the same. The major difference is simply that of the new form adding specific public charge related questions (which the old form did not call out). The new form is basically codifying the 1999 public charge field guidance which has been in existence for over 2 decades. The supporting documents for demonstrating financial strengths are still basically the same

My CN is 2023AF11k and my case is current since 12/19/22.
I submitted my DS-260 application form for me and my derivatives on 05/13/22.
I chose the consular processing at Paris, France.
Since I have not yet received my 2nd NL, I checked my status on CEAC website and it says “ your case is currently at KCC “.
1. What does that mean exactly ?
2. Does the delayed processing time is concerning ?
3. If my case was refused for some reason, would it be notified on CEAC website ?
4. While looking at DV charts from Xarthisius website, I noticed that 15 cases with higher CN than mine were “ready” at Paris embassy, what could be the explanation ?
5. Does the DS 260 date of submission take precedence over the CN ?

1. Not much – ignore it.
2. Not really – some cases take longer than others to process. You can email KCC to check if they have processed your case now.
3. It cannot be refused without an interview. KCC cannot refuse cases, EVER.
4. They were processed before you. It’s normal. The whole world don’t wait to go in strict numerical order while they wait for your case to be processed.
5. No and yes. It’s a little complicated and I have explained it too many times…

DV 23AS176XX here. I was married when I entered the lottery with my wife and kid. However, we were processing our divorce when I filled the DS260. I filled my DS260 as married and included wife and kid but mentioned that they are not travelling with me (due to obvious reasons) and I did not fill the DS260s for them. I was just referring to one of your old blog articles regarding marriage and saw a comment from someone with a similar situation has mentioned that when they requested an update about their case via phone, KCC has mentioned that they have not received the derivatives DS260s and when he mentioned that they are not travelling and mentioned the same on his DS and didn’t fill other DSs, KCC has informed him to send an e-mail stating that the derivatives are not travelling. My DS260 got processed in October and case got current for March last week and still no 2NL. I was looking at CEAC and just saw the quote “Before we can process your Diversity Visa application, each applicant in your case must complete Form DS-260, the Online Immigrant Visa and Alien Registration Application.” and my head was spinning.
1) Do I need to inform KCC vis mail that my wife and kid are not travelling with me. Can this be a reason for me to not receive my 2NL because their DS260s are not complete and I have not informed them early? Do you recommend e-mailing them and informing it?
2) Our divorce is final now but the documents are pending. I was planning to unlock and update my divorce status in my DS as soon as the documents are on hand but since the case is current now, I thought of not doing so to avoid delaying my interview. Is it OK to show up at the interview with a divorce paper while my DS shows as married.
3) In case if my divorce papers are not ready by the time of my interview, is it OK to show up at the interview alone and face it as married or do I have to inform them that I am processing the divorce and that’s the reason my derivatives are not travelling?

and KCC didn’t process my case each I sent an email they reply the generic answer ” wait several weeks” so, is this often the case in the past? by the way, I am not a nuclear scientist or traveled to a middle east country.

I’ve just had a rather lengthy whatsapp discussion with someone who posted a reply to my comment on your most-recent YouTube video.
The person is using your YouTube channel avatar as his profile photo so it looks very much as if YOU are the person telling me to message you on WhatsApp.
After this person made a lot of lofty promises of being able to help my step-daughter get into the US on an expedited I-130, I looked again more closely at the YouTube reply and realized it wasn’t you – just someone who stole your avatar image in an attempt to lure people into his immigration business.

Is sponsorship by a US resident mandatory for a DV Lotter winner to get past the Visa interview ? There various reports saying a DV Lottery winner needs to provide documentary proof of sponsorship to the Embassy at the time of the interview. Alternatively, do I need to provide proof of savings by way of bank statement ?

I have a bit different scenario.
I currently resides in Singapore with family and I got selected for DV lottery 2023 and at the same time I got a job opportunity from a top tier Europe country.
I admire the work life balance and ethics in Europe, but at the same time I would like to secure and maintain my GreenCard status(as an investment for kids’ future) while working in Europe.
My questions are,
1) Is it possible maintain the Green Card while working in a different country?
2) What are the steps should we take to maintain the GreenCard?
3) Will there be any issues of returning to USA after sometime(before 1 year) as boarder security/officials can raise some questions about the reasons of keeping the GreenCard?
4) Do you know if anyone has done this before and successful of maintaining the GreenCard?

I am selected for DV23 and have been scheduled for an interview in February. Due to some family circumstances, my husband, who is submitted as a derivative in the application, may want to withdraw from the application. (i know you emphasised it’s a lifetime opportunity that one shouldn’t miss, but after careful consideration we think it’s best he doesn’t apply with me now.)
1. What is the best way to formally inform US authorities of this change that my derivative will no longer apply with me?
2. Will this cause any issue to me as the original applicant who wishes to proceed?
3. Will this cause any issue to him in the future? For example cannot travel to the US with ESTA, cannot apply for future US VISAs, or anything else?
We might seek advice from an immigration lawyer, but also wanted to learn from your precious experience and knowledge

The new VB shows good progress in EU region. Do you think this is a blurry statistical indicator for the side effects of Ukrain situation?
Most Cases from Russia might not have a chance getting interviewed in Moscow or at another Schengen region ambassy. For younger male Ukrainian winners it might also be challenging to get interviewed and they are still not allowed to leave the country.
Do you think there is a batch of cases from these countries being sort of on hold or skipped? The Aug 22 VB mentioned a chargeability of roundish 9000+ winners for both countries combined – or am I reading that wrong?

Hi, Simon. I know you don’t make predictions but mine is rather unusual.. I’ve checked the visa bulletin for February and noticed a huge jump in cut off for Europe. Around 26k now. My case is high case and is 32k. Now, I really don’t want to put the card before the horse. I already have a very high case number and even getting an interview is being lucky…
But I really “expected” to do it during the second half of summer or even the beginning of autumn. At least I thought so to myself that if I’m lucky enough it’ll be in that ballpark. Do you think my expectations are justified? Also if you don’t mind telling me how much time I have before the interview after KCC notifies me of one. Is it at least one month? Thank you!

I don’t want to try and predict what will happen. EU might be odd because of Russia and Ukraine.
2NLs are sent usually 6 to 8 weeks before the interview.

My daughter who is one of my derivatives, was on an O-3 visa, but had to depart the US because she turned 21 a few days ago.
1.Is she allowed to return to the US for a few days with an ESTA while we are waiting for an interview to be scheduled ?
2. Could this jeopardize her application or even the entire application for me as the applicant and my other derivatives ?
3. Is there a risk for her to be detained at the port of entry and then to be deported ?

I have checked my case number There are 915 cases before and 247 after you in the OC region. That yields approximately 1969 people before and 532 after you. You are in 79th percentile. You are saying that the system deletes the spouse details if you choose option 3. I don’t know whether that is correct or not, but I suspect it would NOT be correct.
However, that is still the central point. Was the spouse included in the entry or not. If yes – no problem. If no – then 100% disqualification.
when i first asked you i learned this from you so
in 2024 i tried to make the same mistake again to see if the spouse will be included or not and i found out the spouse isn’t included if i choose the third opition {married to us spouse )
second i keep searching in all the groups in my country and other countries to see if there is a similar mistake but i couldot find any one like this and no one could answer me and give a logical reasons but you
now what ?? do you think it would be a good idea to go for the interview alone ( only one fees ) without even having the medical tests done

We don’t have a host in the US and we have put a hotel address in our DS-260 application, would that cause an issue in our interview? We have proof of sufficient funds to support us after landing in the US. Our interview is in Montreal early Feburary. Please let me know what shall we do to avoid any delays or refusal to our applcation.
Also, I have made a minor mistake in our DS-260 in one of the questions in my 5 years old daughter’s application. We had a previous US visit visa interview and her mother was refused a visa and I believe my daughter visa was subsequently refused. I forgot to mention that my daughter visa was refused as it happend 5 years ago, do we need to mention this to the consular during the interview?

Thanks for helping us . i asked couple questions before your answers were so helpful . Our case is approved and will pick up my visa on friday. There is one more thing i read someting like i must to carry my xray to enter usa with sealed package but doctor didnt give me xray printout . I called the clinic today and asked about xray, they said they can give me copy of CD.
1. At airport , do they accept CD or i have to have physical xray print out ?

You can get the CD, but generally they do not ask for xrays or CDs at the POE.

I have two questions our CN 2023AF17K
1/ I would like to know if unlocking his DS260 affects the processing of the file, because we did it at the end of October but so far we have not received the 2NL but I know someone who also unlocked in October but who had received his 2NL since November.
2/ We have to write to KCC to change the address of our interview to Kinshasa because the consulate in Northern Cyprus is no longer operational, It won’t cause a problem because we are still at our old address or you have to go to Kinshasa and unlock the DS260 to put the new address.

1. Whether unlocking affects a case or not depends mainly on what changes are made.
2. Generally KCC only select embassies based on address, so changing your address will change the embassy selected.

The I-134 is normally supported by the sponsors 1040/W2, Payslips (1 or 2 recent months) and photo ID.

I finally received my 2NL yesterday and my appointment is scheduled for beginning of March in Naples , Italy.
Just in case it can help someone else , my case number is 2023EU10k , I submitted my DS-260 in mid June and unlocked it and resubmitted it in July.
My questions are:
1) Do I have to schedule the medical appointment by myself or will the consulate schedule it for me?
2) I checked the website of the Consulate in Naples and there is a section where you can register your visa appointment. Do I have to do it? Because on the 2NL page there isn’t written anywhere that I have to register it. I thought it was already scheduled by kCC.

1. You must do that.
2. They have set the interview, but some embassies expect you to register with a courier service. Whether that is expected or not is in the embassy specific instructions which are available from the main instructions. Now you must be an over-reader…

Actually, as mentioned I am working in the US and unfortunately I can’t take too many days off, that’s why I plan to make a first round trip to France for the medical appointment in February but I need to make sure that I’ll be allowed to return to the US with my O1 visa and later on a second trip to France to attend the interview in March.
Would you mind confirming this possibility ?
BTW, how long are the medical results valid?

There is nothing about the DV process that would stop you returning.
The visa validity is based on the medical date plus 6 months.

Hi Brit. Is there any way (beside emailing KCC) to know is my ds-260 processed by KCC? I submitted it in early may, but when I check ceac page, it is always the same status from the first day of submission of the ds-260, and it says “completed”. Btw, I am current in march 🙂

thank you for your vlog, they are all very helpful, I have a couple of questions.
1- we only received 1 email, not 2 a bout our interveiw, it directly states the date and hour for the interview. is that alright?
2- for i-134, do we just need to complete the form with the sponsor and sign the form then bring it to interview or we need to submit it somewhere (send to uscis for example or else?)
I would appreciate to get an answer asap, interview is in early february

1. Well – do you need to be told the date/time twice?

@BritSimonSay hi I’m a 2023 visa winner AS18xxx I’m from Iraq currently residing in canada , I used the tool you posted on YouTube it said my number is at a significant risk , and on the us department of state website it’s showing my case is currently at the Kcc …dose that mean its still processing?.is there any hope? when should I expect them to contact me if there is an interview? My case number is 2023EU19XXX , Iam the derivative of main applicant , we got 2nl having the interview scheduled by March 31. Our old address at the time of 260 submission was India and last month we moved to London for my work and main appluicant travelled with me with dependent visa , after which I have unlocked 260 to update adress and submited it, then infomed KCC for interbiew location change as well. So finaly got my interview scheduled at London consulate. REQUEST you to assist on below question that would help me to move ahead.
1. My current residence in london is from Dec 2022 and interview is by March 2023.Do i need to submit PCC from London (we already have got our PCC from India for the past yrs stay)?
2. Though i had unlocked and updated my new London address for all applicants , but the 2nl has the old permanant India adress mentioned. IS there any issues and to be reported to KcC now ?
3. In case we get visa approved by apr and need to travle US withing 6 mnths, can we visit US collect GC and then we all cme back UK to complete the contract of my work which is till 2024 dec? As we all mOved UK in dec 2022 for my IT work and main applicant, tat is my spouse with dependent visa would be tough to get relieved here from work and to interrupt kids studies as well ?
Is there any limitatiin with the duration we stay outside post getting the GC?
4.How long it takes to collect GC after we enter US?

2. No problem.
3. You can enter and immediately leave, no problem. You can stay outside the USA for up to 12 months, but read the FAQ that explains that.
4. It can take up to 3 or 4 months, but your visa will have been endorsed to prove your status for up to 1 year after the original entry, so of course you will have the GC by then.
