Thanks for your kind help. Me and my familiy got into the US right before our visa expired. We didn’t face any issue to get it stamped and become LPR. For other readers, we got our SS number just 2 weeks after entering the country, and received our Green Card 3 weeks after entering. We’re just missing the SS and GC for our of our children, we’re hoping we’ll receive it soon.
We’re back into our home country for a few months, and are planning to move definetely to the US during summer time.
Because of my job, I’ll need to travel a few times to the US before moving there definetely with my familiy. Can this be seen that I’m only using my Green Card to travel or they consider normal that during the first year one may need to get in and out of the country before really being stablished and reside in the US?

My husband has the police certificate from his country of chargeability, but he does not currently live there and he has not traveled there last year. On the certificate it is written that is valid for 6 months. By the time we attend the interview, the 6 months will pass. Does he need to get the new police certificate?

CN: 2023AF46k . Good evening. During my dv2023 registration, I registered with my adoptive. The child is in March 2021 I adopted Him. My Friends tell me I will be refused the Visa. That I shouldn’t play with the kid because it hasn’t been two years since I adopted Him. For him from adoption to my dv2023 registration, he should be 2 years old. Is this true?

We are winners of dv23 and we got visas.
in 6 days we come to America.
We plan to sit there for 1 month, then return to our home country to complete some medical procedures.
If the green card and social security number have not yet been sent to us, could there be a problem?
At the address that we will give to the immigration officer, it would be okay for us to receive the documents at that address even if we are not there at that moment.
They would stay in our country for a maximum of 2-3 months.

Should a 12 week coding bootcamp be listed under the ‘education’ section in ds-260, even though it is not accredited, it is not an ‘educational institution’/’vocational school’ and not geared towards a degree.

2023EU22xxx waiting for a 2nl from my embassy(Albania) however no luck yet.
Seeing the dv charts on xarthisius’s site, I noticed that there was a case scheduled on the 26k range, but there’s no luck from 12k to 26k from what we can see.
Does this mean anything?
My ds-260 was submitted in May, and I have confirmation from KCC since August that my ds-260 is also processed so now I’m just waiting for my 2nl.
I’m also a single derivative and 20yrs old so I don’t think there is anything that can cause my case to have any delays.

First of all, thank you so much for your valuable guidelines. My status is a bit complex so I need your experience and point of view to have a better understanding of my own case 🙂
1) I live in US and I am on H1B but I have approved I-140 via EB1 category. With my employer, I-485 application is completed as of 07/2022 and we provided our fingerprints as of 08/2022. It is still in progress and we are still waiting our green card.
2) I have also approved EB2-NIW I-140 too. But did not start i485 for this category yet.
3) During this time, my spouse was picked in DV2023. It is EU34XXXX. Based on the visa bulletin, EU numbers are not there yet. We still did not do anything other than filling the DS260.
Based on these three facts, in order not to miss our changes, do you think that we should pursue DV2023 option? Can we pursue two or maybe three simultaneous i485 together? Would it hurt to my existing i485 application? What would be the best and clear option for us?
Please help us cause this drives us crazy, we want to make sure that we are taking the right steps.

We won the DV2023 lottery while staying in the USA. Therefore, we will do the AOS process through the Immigration Court.
After looking at your blog and Sm1smom blog, we realized that submitting the DS-260 form is recommended even if we do the AOS. Our problem is that one family member has an expired passport, and for some reason, he cannot get a new one in time. So, does he need to submit DS-260 indicating an expired passport? If not, do other family members need to submit DS-260?

You will be considered to have abandoned your LPR status and they might parole you into the country but refer your case to an immigration judge. You would then have to prove to the judge why you should be allowed to keep your LPR status. They might also ask you to sign a form renouncing your GC status, in exchange for admitting you as a tourist (don’t agree to that option).
You could avoid this random outcome by applying for an SB-1 – or discussing the matter with an immigration attorney.

In yesterday live with Jesse you mentioned the changing address method to transfer the case but Jesse came up with the idea of contacting the destination embassy, so I got a bit confused.
I’m AS14K from Iran stuck in Ankara. According to your recent video of checking embassy queue I picked up Oman which is performing right to the VB cut offs. Then I realized I need a residency there to be interviewed. I try to find a way, then find some companies that give you working visas and you then apply for a residency card but the job is nothing to do with mine (I’ve always been a sport tv producer) they offer me seller/driver/accountant.
So the question is if I get the residency which my job is mentioned on that (Driver at Google for example) and I show up at the interview what is the answer to the question of how a sport producer become a driver/accountant in Oman?

I am in bit of a trouble. I am DV2023 AS4K and submitted the DS260 in 1st week Nov 2022. According to KCC I have been processed by 27th Jan 2023. I have not received my 2NL yet.
At the time of DS260 submission, there was some confusion as to the addresses where my husband lived during his school years 12-20, He was in boarding school and was in rented houses in the same town. However after that, he moved to his parent’s house, again in the same town.
So when filling out the DS260 we only filled in the address of his parent’s house for simplicity (he could not remember the address of the rented place etc).
However when obtaining police certificates, we managed to find out the previous addresses and entered them accurately as the embassy recommended certificate from birth.
The Sri Lankan police certificate does not indicate the exact addresses but only the time slots in the police report, which does not exactly map with the time slots entered in his DS260
Is this a grave mistake and should I ask KCC to unlock my DS260 now and change it as per the addresses put forward to the police certificate which is the accurate one?
Or can this be explained at the interview?
I have heard of you always telling to unlock for important updates, did not consider this to be much of an issue till I realised it now.

1. Case number AF37650, DS260 processed, I lastly submitted on the 26th of October after requesting to open for some corrections. My CN is current in March but I haven’t yet receive the interview letter (2NL). My embassy is Kinshasa DRCONGO. Do you know if my embassy is doing alright with visa processing ?
2. After my successful GC interview I’d like to visit South Africa before coming to USA as I lived there before and I am a permanent resident there and currently living in USA on J1 visa for work which expires in two months. Will it be okay if I go to South Africa before coming to USA after my visa approval?

Currently, I am on stage 3/letter 3. my question is normally how long it takes to pass from stage 3/letter3 to stage 4letter4? and am I at risk of missing out on an interview slot since they processed my forms late? Does the green card process start from the date of the payment of the USCIS immigrant fees or the date of the first entry in the US.
For eg: If I pay my immigrant fees in March and my first entry is planned to be in June, the 90 days average process for getting the green card, will start on March or in June ?
This will really help me to plan my relocation process within my company.

You become an LPR upon your first entry. But your other points show that you are very confused. You only pay a fee to USCIS if adjusting status in the USA, but if you are in the USA, there is no “first entry”. So then if you are outside the USA doing consular processing, you pay the fee at the interview, and there is no “90 day average process”.

Hey Simon, I am here to say the BIGGEST THANK YOU for all your help. My family of 4, just got our visas issued. We are Kenyans based in Abidjan, Cote D’Ivoire and our number is AF16***. Our interview was Wednesday last week, and went quite well. Yesterday we checked the status it said issued and today the Embassy has called us to pick our passports (I must say we are lucky to have been here in Abidjan). The process was very easy and friendly. We could not have done it without your support. The information and guidance that you give is incredible. My case is over EU 13K from Uzbekistan.
As you see VB cut off is frozen at 8500 for 4 months for Uzbekistan. I am afraid that my CN is at the risk zone.
So I’d like to know If i transfer my case to another country, can I get the interview scheduled earlier, will this improve my chances?
Or other country embassies won’t accept me until my case becomes current in Uzbekistan ? Is it worth it transferring the case? Can you advise on this?

Hi Simon, our case no. was AF16*** visas just issued in Abidjan. So my husband who is the principal will leave right away with our daughter that is going back to school. He intends to come back after a week. I have a work related trip in March 2023. Will it be fine for me to enter alone if he is back in Abidjan? Hello, Sir! I am trying to undersnad what they mean by: Do you have any specialized skills or training, including firearms, explosives, nuclear, biological, or chemical experience? Do they mean real military trainings, or does it include those for kids, where they learn how to protect themselves?
I am the main applicant, EU2023CN30xxx. My husband never served in military and we answered NO to the above question in his DS-260. Today, I was cheking our docs and noticed that in his old college diploma, he has this subject: Elementary military training. But the thing is that he didn’t learn anything about any explosives, weapons, etc. In our country, kids in school and, later in college/universities, have trainings on how to protect themselves if something happens. They learn how to wear protective equipment, hide in air raid shelters, etc. I think that those trainings can vary a bit (depending on school/university), maybe some kids get to see some weapons (not real of course), but that was not the case for us.
I am super stressed, we’ve unlock twice already.
1. Should we unlock DS-260?
2. If we say YES to the above question, is tahre a chance to get in trouble? What if they think that he had a real military training?
3. If we don’t unlock but they notice Elemantary military training in his diploma, what should we tell them?

If the applicant doesn’t have any own assets or a job offer in the U.S., he/she may find a sponsor in the U.S. (U.S. citizen or lawful permanent resident) who completes form I-134 and mail the signed form along with his/her IRS tax return transcript for the most recent tax year and proof of current U.S. income (income proof is usually provided it the form of most recent pay stubs and employment letter) along with proof of status in the U.S. Form I-134 can be accessed at http://www.uscis.gov

You could show your own savings, but otherwise an I-134 with supporting documents from the sponsor such as their wage slips, W2/1040 and photo ID.

I got my passport back with the visa. But my registration I had chosen by mistake mali instead of Senegal but the day of my interview the consul did not ask questions about it and everything was ok it is afterwards he approved. When I went to get my visa I read an error on my country of birth (Mali instead of Senegal) and then I went back to the embassy for rectification.
Do you think the mistake could be corrected?

I received an email from the embassy asking me to fill out a ds5535 form. I immediately filled it out and submitted it. Within 24 hours of submitting the form, I received a call from the embassy telling me to come by next Tuesday to pick up my passport. Could this be a good sign to rectify my mistake?

Asking on behalf of my cousin who won the lottery from Ghana. It seems Ghana embassy has not had DV interviews since the lockdown. (from around May of 2020)
1.Is there any particular reason why embassies in surrounding countries like Abidjan are having interviews but Accra embassy not.?
2. Can one ask KCC to change location of interview to the nearest embassy in a nearby country if one can legally go for such interview appointment.

1. First, your understanding is incorrect. Ghana have been doing DV interviews since early 2022.

hello Simon, i was selected for dv2023, EU case number 29k. I sent the ds 260 in May 2022, since then i did not receive a confirmation that it was processed. I wrote to Kentucky consular center a couple of times(even today) to ask when it will be processed since my case number will become current in April and they keep replying with some copy/paste links only that do not have this info. I tried also calling but the robot tells you to send an email and closes the call. What should I do?

Hope you are well. We were a family of 3 and have had our application completed since last year September. However my wife gave birth 2 weeks ago. While I have added my child on the application w. We don’t have a passport yet. On the form I ticked other travel documents to skip entering the passport. Is there a problem with this? Our case number is really close. Will it affect our interview date or processing. Ideally when she is 3 months we will like to apply for the passport.

I am DV2023 AS14k from Nepal. I did my schooling from Darjeeling, India (Grade 8 – 12, Year 1999-2003 ,Age 13 till 17,) and I was studying in boarding school in Darjeeling.
During my schooling days in Darjeeling I used to come back home (Nepal) for holidays in June, October and winter holidays. And after finishing my school in 2003, i was back in Nepal.
So what I want to know is that… do I need to get police clearance from Darjeeling, India ?? or will the character certificate given from my school will work ??

DV 2023 EU case number 29k, which is current in April. My ds-260 has a “at NVC” status, is that a good sign or it has to have another status in order for me to receive interview appointment?

at NVC is the starting status for every case – so it does not indicate anything.

Our Case Number: 2023AS6###
Chargeability Country: Sri Lanka
Interview Location: Abu Dhabi
We inquired from KCC on January 25th about the status of our case and they replied to us,
“Your case number is now current for interview processing. Once the interview date has been scheduled, you will receive notification via email to check https://dvprogram.state.gov. If you need to make changes to your DS-260 you should contact the consular section where you will be interviewed, or bring the information about your changes to your interview appointment. Because your case is ready to be scheduled, KCC can no longer unlock your application.”
When we checked the CEAC data in DV charts, on February 17th Abu Dhabi embassy have already sent 18 2NLs for case numbers upto 15000. We also checked our case number range and there has not been a change in the number of cases in “Ready” status.
However, we have not yet received our 2NL. Is that something we should worry about? Sorry for asking this question. It’s just that our anxiety level is too high waiting for the interview to be scheduled.

1. If someone miss the interview date what happens to his case can he reschedule new interview date
2. If someone does not send his DS260 how his status appear in ceac data “as at nvc or none or what”
3. When someone change his interview location to anther country if he got visa is counted as visa for his country of eligibility or country of interview
4. Whats the maximum number of green cards issued to any given country i know its 7% of the total diversity visas but which total is it 50.000 or 55.000
5. Whats if someone have new baby after he got his visa with his wife
6. Whats number under ready in ceac data is it mean derivative numbers which are ready

1. Rescheduling might be possible, but what on earth would cause you to miss a life changing interview.
2. All cases start at NVC. You cannot identify cases that have not submitted.
3. Country of chargeability.

5. There is a process to give the baby a greencard at the arrival airport. Read the FAQ

Me and my wife receive 2NL and we have interview scheduled on April 6th. She is the principal applicant
My wife is pregnant at this moment. if everything goes well on the interview and we get a visa, her due date and our visa expiry date will be very close.
We want and we are planning to have our baby in our home country and we plan after we get our passports from the embassy to flight right away to USA.
My question is: Is it possible immediately after arrival to apply for a re-entry permit, how long the procedure for re-entry permit last and what options do we have if we cannot apply for a re-entry?
Is it advisable if only one of us get a re-entry, because we don’t want to risk my wife pregnancy, so until the end of her sixth month she will fly to our home country.
Can you give any advise on this?

You probably won’t have time to wait in the USA while the re-entry process starts. But that is no problem really – you can enter and activate, then leave for up to 12 months, without the need for a re-entry permit. When you re-enter you travel with the baby and the baby will be processed for a GC.

I’m a 2022 DV winner and I’ve been to USA last August to activate my status. Now I’m back in my home country to finalize selling off my assets for permanent migration to USA.
My GC has already arrived back in September but my SSN did not arrive yet and we’re in Feb 2023. I’m planning to go back to USA for a week just to go to SSN office and follow up on my status as they don’t entertain phone calls from outside USA, nor someone else physically checking up on behalf of me. I need my SSN to prepare for tax payment and also looking for a job in US is easier with it.
My question is, why is it taking this long despite that I asked for SSN in my ds-260 form? Do I have to go to US just to physically check up or is there a cheaper way?

Sometimes they just screw up applying for the SSN. You will have to apply in person when you are back in the USA.

1. It seems like excluding 2022, they have never issued the maximum 55k visas available. What is the reason behind this? Does it mean that there genuinely were less than 55k people out of all the selectees who happened to go through with the process or be found eligible for a visa in the interview?
2. If they do not reach the maximum visas, does this mean that no one missed out on interviews in those years due to having a high CN?

1. They generally do not hit the cap, even though there are often people left without visas. The cap was 50K until recently.
2. About half the years are over selected. In overselected years, people miss out. DV2023 is an overselected year.

I would like to ask a question about the DS-260 form. In the education section, I indicated that I have a diploma, even though I am still studying. In case I don’t receive my diploma before the interview day, will that disqualify me from getting a visa?
By the way, I already have a high school degree.
