Hectic days, my number is 2024EU52xx (Bellow 6k) on the Montreal (MTL) Consulate with an Spouse, No 2NL yet. doing analysis on the xarthisius excellent site I see they have scheduled cases over the EU20k on the MTL consulate. Sent the DS260 on May 15th 23 and it was reopened on 28 Aug 23 for a change of address What is your take on the chances?. Thanks in advance.

MTL have taken cases today, possibly the last for the year.
Why have you left this so long before asking for input? I would have advised emailing KCC to check that your case isn’t assigned somewhere else by accident. In fact you should still email them (pointing out that you appear to have been “skipped”, but there is a high chance that it is too late to fix the problem.

I have been emailing them once a month after February getting the generic response that the case is scheduled based on numeric order and they have confirmed in 3 occasions that the Post is MTL. Have contacted the consulate directly which told me to contact KCC since they have not received the case. will send them another saying skipped explicitly.

Do you have a verified list of embassys who sent a 2nl for September? Perhaps someone sent you a proof. In the telegram group there is a lot of talking but you can’t believe everything they are talking there.

People who are in transit already know when their interview is ? Meaning their DV page has been updated, but the embassy has not marked them ready and that’s why we can’t know which embassy they are at. At I correct ?

Generally in one batch per embassy. Sometimes they take another batch, mostly they don’t.

2NLs are being sent now, usually one batch per embassy although it is not impossible that an embassy could receive a send batch.

Hello Simon, I remember in one of your videos that you talked about taking photocopies of things for the interview. Could you please expand on that. Should I be taking copies of every document I am taking with me? If so how many.

Take copies of any official document that you would want to keep the original. Then you show the original and let them keep the copy. This goes for documents such as birth cert, marriage cert etc, because those documents are not easily replaced if the CO keeps them.

I understand. I have watched this process for years. There is always someone who misses out just above the scheduled numbers.
I will say this, the data shows FRN took 4 AF cases, 17 AS cases, and 4 EU cases. Bizarre that they would only take 4 from EU. So – maybe there could be more coming – but I have no way to be sure.

I attended a follow up 221g interview today, and my application was refused.
The refusal letter reads as follows
This is to inform you that have been found ineligible for a diversity visa pursuant to section 203c and/section 204(a)1 of the Immigration and Nationality Act. The information contained in the following paragraphs marked with X pertain to your Diversity Visa application –
Section 204(a)(1)(I)(iii). Failure to comply with DV entry regulations.
Failure to list properly your spouse and/children on the DV entry
I’m taking a long shot here, but i saw your reply on one of the questions that in rare cases embassies have reconsidered their decision.
I attended the initial interview on 3 April, and was put on 221g, as the CO wanted further proof that i was unmarried.
I have 2 kids with my partner, 1st child born in October 2019 and i submitted my entry with her listed as a dependant. I entered as single on the application. DS260 was submitted on 2 August 2023.
2nd child was born December 2023. I emailed KCC on 4 January 2024 to ask that she be added to my case.
I got married to my partner on 11 May 2024.
The CO questioned why my child was not listed on my entry, but i explained to him the child was born in December 2023, after my DS260 was submitted, and i then requested KCC to unlock in January 2024 so i can add the 2nd child. However, he said the adding of the child was suspicious to him.
I then got married after i had atended the initial interview.
I might be wrong but surely i followed instructions to the tee, and the reasons for refusal of my application is incorrect.
Is there any way to appeal, or is the CO’s decision final and nothing can be done??

My case number was 2024AF29XXXX. Interview attended at JHN embassy. I’m from Zimbabwe and wife and children are South African citizens. I’ve been living in South Africa since 2007.
The timeline of events is as follows:
8 November 2022 – Submitted my entry as single with Child 1, born 2019, as derivative.
May 2023 – Was selected as a winner
2 August 2023 – Submited DS260 for me and Child 1.
7 December 2023 – Child 2 is born.
2 January 2024 – emailed KCC to request to add Child 2.
3 January 2024 – KCC emailed to say information entered is invalid
3 January 2024 – emailed KCC again, with correct DOB format
4 January 2024 – Unlock request granted
20 february 2024 – 2NL is received
22 Feb 2024 – Completed Child 2’s DS260. Delay was due to waiting for passport. I didnt know i could complete it without the passport
Started gathering dcocumentations required for marriage.( Stupid to leave it this late i know)
27 February 2024 – emailed embassy to request to add my partner.
The emailed back to say they cannot add fiances, only married partners can be added to my case.
3 April 2024 – Embassy calls to request for copy of Child 2’s passport. I informed them it has not been issued yet. They then ask that i email copy of her birth certificate, which i did.
4 April 2024. I attend the interview alone. My reasoning was i would not be issued the visa if we’re not yet married, they would require custody documentation of the kids which i did not have. In any case, i intended to emigrate with the kids only if my partner also got a visa, otherwise i was wiliing to go alone and petition for them later.
I got 221g refusal, with the consular officer not convinced that i had 2 kids with the same artner but we are not married.I was also asked why we were not married yet during the interview, and i gave my reasons.( Mostly financial, and e had a traditional process to go through)
21 April i did my medical.
23 April 2024. I attended marriage interview at local Home Affairs, and got approval to get married.
11 May 2024. We got married
I sent the documentation to the embassy that proved as at 20 April i was not married, as well as the subsequent marriage certificate to the embassy, with marriage date clearly stated 11/05/2024. I also sent a note to ask to add my wife to the case if there is still time.
I subsequently received email to schedule follow on 221g interview, which is where i was refused the visa.
The same CO took birth certificates of the kids , and questioned again why i did not add my kids to the case. I explained to him the timeline of events, and he said the constant back and forth and adding was supicious to him. He sated i should have added my child to the case, but igave him the sequence of events and that the 2nd child was not born when i submitted the DS260. He then asked that i want to add my partner to my application, and i stated if there was still time this year i would like to add her. He then consulted with other CO’s, and then denied my visa.
I understand the CO’s decision is probably final, but i’m positive i’ve followed instructions correctly and the basis of denial is inaccurate.

As I have previously said, they will sometimes reconsider, but it is not a formal appeal process. If I were you I would have a lawyer explain the exact circumstances as you have done here, and see if they will reconsider.

How do you know or predict when the 2NLs most likely to be sent in different embassies? Is there a way to check it myself besides the Xarthisius website? My case number is EU34XXX (Russia, interview embassy is set for Taipei), and according to the historic data of 2NLs sent to Taipei, dates have no any logical pattern, that’s why I am asking if there is another way to understand the possible 2NL date for that embassy.

No there is no way to know exactly when 2NLs will be sent other than saying it is in the window from when the VB is published, to the first few days of the following month.

My case number is AF202442336 from Egypt, and the August Visa Bulletin shows that Cairo is current. However, I haven’t received my 2NL yet. Isn’t it too late? When I checked the FY2024 CEAC data from July 20th, I noticed my case number was skipped. What should I do? Please note that I requested to relocate my interview to Abu Dhabi since I moved there a year ago. Could this relocation request be causing the delay in scheduling my interview?

Algiers had so far sent only a few 2NL´progressing from 65.5K to 66.4K CN, that´s really strange for such a good embassy (compared to last years) that showed much bigger numbers earlier this year, what would be a possible reason of such a change in your opinion? they don´t seem to have a big backlog when checking the CEAC data.

If you already have a non immigrant visa for the USA, then you could try to enter the USA and adjust status. Other than that, there is nothing else you can do if KC don’t schedule your case because of embassy backlog/capacity.

I have one question regarding DS260. I live in Nice, France. It’s like our every day life to go to Monaco. It’s actually in the middle of French city Menton and Nice. Sometimes we are going to Monaco with friends. Is it considered travelling?
In the travel information I didn’t put Monaco in DS 260, because it’s not like separate country for people living in Nice. Most of people work there. Even on the US government websites France and Monaco are always mentioned together.
Should I unlock my DS form because of this? I already unlocked it once, but this thought never crossed my mind before.

I have a strange story. One of my friend (Thailand citizen with Bangkok interview location)got 2NL this evening,but the interview location is not in Bangkok, Thailand. It shows as Bishkek
, Kyrgyzstan. I checked his DS260, everything was fine no mistake and nothing related to Kyrgyzstan. Meanwhile, Bangkok is still no 2NL. Do you have a similar experience like this? By the way, I can send you the photo of 2NL and his DS260.

Good morning, a quick question. I know that there are two ways to qualify for DV Lottery (Education and work experience). My wife is the main applicant, she complies with the education requirement but on DS-260 she filled her work experience and marked that her current job requieres 2 years of experience (Coordination role on a University on my country). Is there a problem with this? Or this application will be reviewed first with education criteria in mind? Or job experience criteria because we selected that option.

I don’t know the meaning of a yellow slip in your particular embassy.
DS5535 is an additional background check, the processing time for those can vary from a couple of weeks to several months.

I hope everything is well with you. Thanks so much for the information you’ve shared with us. I would greatly appreciate your guidance regarding some concerns I have.
1) In the DS-260 form, it is asked to provide information about the social media that have been used within the last five years. I’ve deleted many of social medias like tumbler, instagram, etc about a month ago. Should I also write those IDs down? If I should, wouldn’t it cause a problem since they’re deleted and therefore invisible to public? I’m afraid that they might have the misunderstanding of me lying or something. And within the lat five years I deleted many accounts I can’t even remember. I’d appreciate it if you could guide me whether I should repoert those deleted accounts.
2) We currently listed our house for sale, but I don’t know when it will sell. However, it’s very likely that by the time I go for the interview, our house will have been sold. If I provide the address of this house on the DS form, during the interview or before that, at the medical appointment when they ask for my current address, can I still give the previous address even though my address has changed? I’m worried that providing the new address might cause issues because it conflicts with the DS form.

we have seen that cases in the AS region have received the 2nls, ranging from 17xx to 20xx, and it’s true now they are ready when checking the status of these CN at CEAC web,
I am slightly confused as I thought that KCC started to send the 2NLs from lower case number to higher case number and of course, given the circumstances of both Embassy capacity and how early ds-260 was summited and processed.
I wonder about my Case Number AS150XX at the Jerusalem Embassy which has an excellent capacity as it doesn’t receive a large number of applicants, i submitted ds-260 in early May 23, so what’s going on.

I am eagerly waiting for my 2nl, DV2024AS16k, Tokyo post. I discovered that there was a mismatch on the information on my high school graduation certificate and the one I put in my DS-260.
#1, I put “xxx high school” in the DS-260 but the certificate says “xxx state senior high school”
#2, I put “31st March” as the date of attendance to, but the certificate says I graduated on 1st March
It’s too late to update DS-260, and my wishful thinking is that it’s trivial and nothing to worry about. Should I bring up this at the beginning of the interview?

I’m that one guy who was pestering you about DS-5535 questions during your latest live.
Me any my wife had our interview in July at BLG and are under 221g. They only asked my wife (who is a derivative) to fill out the 5535 and submit her CV. However, I as the principal applicant have not been approved as well and so we are hoping for for the end of my wife’s AP before the end of the FY. We know that since our AP started late in the year, our chances of being cleared are slim.
However, I noticed there seemed to be a general push in clearing APs late last year in DV23 and I was wondering if that kind of push happens most years?
Additionally, we know that 5535s are processed at Washington, and if that push does tend to happen, does D.C. also try to clear them late in the Fiscal Year?

We’re not counting on it since there’s only been a single case that got their 5535 cleared in BLG – and even that took 8 months. No other 5535 case we know had theirs cleared.
So our only Hail Mary is a massive 221g clearing which we’re unsure happens every year.

And my last email they respond exactly like the first one
I am to worried and confused i dont know what to do becase were getting close to end of the fisal year and it s been 2 months now there is not any news or new invitation from embassys

I desperately need advice on the possibility of appealing the DV visa refusal decision that I received yesterday at my interview, US embassy Kigali consular, case 2024AF239XX.
I attended the interview with my wife, whom I had been requesting to be added to the case (consular agreed to do that in an email but they didn’t activate her DS-260 accompany application until yesterday before my interview). At the interview, the interviewer mentioned that I dont have the required work experience for the DV visa (although I have got a degree and have been working part-time for 6 years in the field) but then rushed to give me the refusal letter with a mention which has nothing to do with work experience. The letter mentioned:
This is to inform you that you have been found ineligible for a diversity visa pursuant to section 203 (c) and/ or section 2049(a)(1)(I) of the immigration and Nationality Act. The information contained in the following paragraph pertains to your Diversity Visa application:
Section 204(a)(1)(I)(ii): Unable to establish eligibility for a DV before the end of the fiscal year in which you were selected.
There is no clarity on what this means and I sent an email requesting if I can appeal but no answer so far. Can I appeal against this decision? What is the standard process of appeal? I would appreciate any guidance into this situation.

There is no standard appeal process. The COs decision is generally final, although there have been a few cases where the embassy have reconsidered.
For your education, did you not complete High school with satisfactory grades in the core subjects? Did you not prove that? Was your education from some other country?
The fact that you achieved a higher degree does NOT mean you satisfied the secondary education requirement. You could have entered the University course after a “make up” course or test of some sort. So – what do you think is the concern?

Hi Simon, Thank you so much for taking your precious time to respond to my questions.
I have completed my secondary education in Rwanda and tertiary (University) in UGANDA. The consular officer who interviewed me mentioned that he thinks i dont have the required work experience and didnt provide further explanations despite having have handed in my employment evidences.
Also in the refusal letter he gave me marked ” Section 204(a)(1)(I)(ii): Unable to establish eligibility for a DV before the end of the fiscal year in which you were selected” as the reason of ineligibility Instead of mentioning Section 203 (c): failure to fulfil either the education or the work experience requirement” which was also an option on the letter template they gave me.
This leaves me without any clarity on the real reason i was found ineligible.

Well it means this.
The CO was not satisfied that you met the education requirement. I don’t know why of course, but you may know.
Further the CO considered your job, but decided that you don’t meet the alternative requirement of 2 years of experience in a job which requires 2 years of training or education.

Hey Simon. I’ve won the DV 2025 lottery with a case number of Asia AS27000 (not exactly this number) ,quite high.
Is there any point in applying for the 2025 DV as the Asia cutoffs this year were lower than my rank.
I’m also an F1 student already residing in the US. I don’t want to show intent of immigration or do anything that will make me lose my student visa. I will not need to renew my student visa though.

So there is no need to do anything yet. If you think you will still be in the USA next year, then you could consider AOS, and that does not rely on the submission of the DS260.
We will have more idea of selectee numbers in 2 or 3 weeks.
