Hi Brit Simon.. saw your recent upload re government data update declaration. Thank you for that. A big takeaway for me from that was that they (KCC, state department , embassies US Government etc ) need to work harder at scheduling cases every month throughout the year!! Some months can be a insignificant and other months can be huge numbers. Pick a target every month and work to that. I suppose the problems are maybe lack of staffing after covid or KCC processing ds260 etc which is why maybe the cases each month can be so haphazard. Any insight into that.

Hi Simon, I won the dv 2024 and I provided the wrong email on ds-260 this resulted in me not receiving any notification despite being sent by KCC.My case status was showing ‘Ready’ and it was true that I did not show up for the interview since I provided the wrong email in the ds-260. My interview was on June 12th and missed it. I reached out to Nairobi embassy and got an email that they added me to the scheduling list and they will send me an email when any is available. I have no idea how is gonna go.
What do u think of this situation of missed interview

Our interview is in 5 days in the Riyadh embass, and our host in the U.S just finished completing the i-134 and all the other documents needed. Is it required to have the original documents sent to us or are we allowed to print it via email as the host suggested? since if they were sent with any shipping company its very likely we won’t be able to receive them before the interview date. Hi Brit, we submitted our DS260 since my wife won the dv2025 lottery but we had a pending US tourist visa application which we had applied in June 2023. We went to the interview today the consular asked about the DS260 application and apparently she wasn’t convinced about our explanation. Our visa was refused under 214b. Where do we go from here?

Guys I’ve been commenting for MONTHS that it’s a terrible idea to submit the DS260 when you’re still in the process of applying for a tourist visa.
Tourist visas are basically the ”most non-immigrant” of all the non-immigrant visas and have the highest burden of showing strong ties to country of origin (as opposed to a non-immigrant student visa for example, which can allow you to stay up to 4 years or even more in the US).
In order to grant a tourist visa a CO *must* find that you have strong ties to another country (it is written in the LAW); if you have a *pending* IV application /submitted a DS260, you OBVIOUSLY don’t have strong ties to your country.

Joel, as I have already explained the DS260 is one factor. It cannot, repeat *cannot* be the only reason a NIV is denied. So if people fail to show ties, they could be denied. But 214b denials are extremely common with or without a DS260. Please don’t give people a false impression unless you have solid data to backk it up.

Everything was going smoothly until she asked why we had submitted a DS-260 application. We tried to explain that it’s a separate process, we don’t know how long will it take and that we aren’t even sure if we’ll actually get it, especially since we’re applying from Ankara, which has its challenges. My wife and I both have stable, well-paying jobs. She noticed that I had worked on an H1B visa about 12 years ago, and I could sense a shift in her attitude almost immediately after she brought up the DS-260. While I can’t say for certain that this was the only issue, I’m confident it was the main one. We thought we could sneak by but we screwed it up.

Well a B1/B2 after an H1 is already a red flag. You clearly would have had experience of living in the USA, and not only that but skills education and work experience that made you highly likely to find work there. To be frank, I would have thought that was at least as big a factor as the DS260, but in combination, there is obvious immigrant intent, couple with USA living and work history. The denial should not have been a surprise.

I see. My H1B ended voluntarily in 2012 when I quit my job and returned to Turkey, and I haven’t been to the U.S. ever since. Honestly, I never thought it would create a problem(combined with DS260) after so many years. Apparently, I was quite naive.

It’s not really a problem. The main thing is to make sure your DV process goes smoothly. Don’t get stuck in Ankara embassy.

I’m currently studying to become an immigration lawyer, so I start to kinda know what I’m talking about (not to mention that I’ve myself had an F1 then B2 and now GC).
Indeed 214b are extremely common, and the DS260 makes it much worse. But what’s your point ? Letting people submit the DS260 while they’re in the process of a tourist visa application ? This person could have avoided the hassle if he/she didn’t believe it was OK…
Most people who read this blog apply for a B1/B2 because they think their number is slightly high for CP or their embassy tends to underperform (and often legitimately have such concern) and might have a better shot at AOS, so submitting the DS260 AFTER the B1/B2 interview is the safest way at this time of the year.
Saying that you can show ties to your country when you have a pending application to leave it permanently is like saying that you can show you’re not in drug trafficking when you’re found with 5 lbs of coke in your bags. Sure, the 5 lbs alone cannot be the only factor to prove your guilt, but it puts you very much in deep water.

What you are saying is right but the difference is, I had applied for the visa almost a year before the DV lottery win. My primary intention honestly was to get the visa which I had paid for regardless the DV win. Those just coincided. We Neither lied to the consular, nor had an intention of doing AOS. I know I shouldn’t have submitted my DS260 before the NIV interview but it’s too late. We will try move to another embassy but if our DV application fails somehow I don’t know how I will get a tourist visa again.

Joel, please, enough with the melodrama. What you have studied is all well and good – I am talking from years of real world experience. But also this narrative that I am “letting” people do this (or even that I am encouraging them) is completely inaccurate. People will do what they do. I don’t have any blog or video where I have said go and submit the DS260 and then applying for an NIV. In my AOS path hail Mary videos I have clearly said people can try AOS if they already have an NIV and ability to support themselves in the USA. Then at the beginning of each year I warn people about the downsides of showing immigrant intent. So anyway – enough on this subject. Thanks.

Brit don’t take it this way. I agree with basically everything you write on your blog, except on this point. I think you somewhat downplay the downsides of showing immigrant intent *contemporaneously* to an NIV application.

Skills and education don’t help tourist visa holders to find work because skilled jobs don’t hire illegals or people with tourist visas, and COs know it. A H1B *12 years ago* is not a problem when you have a stable well-paid job in your home country …until you disclose you’re ready to quit it…by submitting a DS260.

Case number is 2025EU341XX (Yerevan). There is a fear that case number can’t get current. We have gotten B1/B2 visa as well early this year with my wife and consider the option to receive our green card through AOS.
What would be the appropriate time to go to USA for AOS? Should we set up something from Yerevan before going to USA (for example to write KCC our intent of AOS)? And if mentioning AOS “the purpose” of visit upon entry to the country, could we be disabled entry for this reason?

You cannot file AOS until your case number is less than the number shown in the VB.
So – you have a long time to wait, plenty of time to know more about the data and decide how you will process.

For example, if my case number is 2025AF12k and I am current, but my DS is yet to be processed then in other hand the visa bulletin reach 18k for my region a month after my CN became current.
1. Are the cases will be sent in numerical order at the embassy, or the first processed case number will be place before the other.
2. After being processed, my case will be sent to my embassy directly from the next visa bulletin or they will schedule all the current before coming back to my case.

From what I gather, it looks like we will have enough visas until Sep 30 and while there’s a chance that we’ll reach the quota, it might be just by a few cases so they might allow the program to go over 55k? Is that likely (of course no one can know for sure)?

That is pretty much what I have said. I think they might let the process run as long as the CP cases don’t exceed 55k.
Issuances are happening fast though. As of today, there are almost 47,000 visas issued – 2224 since last Friday.

Our case number is 2025af20k. I don’t know whether i should do adjustment of status or do the process in my home county South Africa. I am currently in the USA on a h2a visa and my wife with a h4 visa as well as my 6 year old son which will all expire on 10 December 2024.

First you should decide which process you want to use – adjustment of status or consular processing. Through the early filing policy you will be able to file AOS before your visas expire. So that might be a good method for you. CP is a method of going back to your home country, so I guess the real question is whether you would like to stay here in the USA while you process, or whether you have reason to go back to SA.

Question.I have received my PCC from Germany Today and it says No Records, but on my DS 260 I had indicated that I was deported from Germany which was back in 2001 and on the question of being arrested i said yes because for you to be deported you must be arrested first.
Now can i unlock my Ds260 and say that I was never deported nor was I arrested or I should leave it as it is? will the Embassy know if I change this now from KCC?I just wanted to be Sincere but there are no records because Germany clears one after 10 years.

My question is about document preparation. I am a DV2025 EU winner and I am due in October for interview as visa bulletin says.
The question is: does the documents need to have an apostille or is it enough to have a legalized copy? In Romania, where the magic happens for me, to apostille the university degree is a bureaucratic nightmare, which can take too much.
Another side question is if you know anything about how smooth the process is at the US embassy in Romania – any stories you know (backlog, refusals and so on).

Nothing to note about Romania. There is no backlog on month 1.

I submitted them with a request to correct the mistakes but since I submitted them through the courrier it’s has been over 10 working days and still waiting for any outcome but in vain

So sorry to re ask this question again too but if you did the enter USA activate green card/SSN and left. How long can you stay outside the USA for?
My understanding is that you need to stay at least 6 months in a year. This therefore would mean, for example:
Enter USA on DV1 visa 1st October 2024 -> Leave 2 weeks later (Your I-551? 1 year permanent residency visa activates while waiting for your actual green card)
By April 2025 you would need to enter the USA back if not you would go past the 6 months limit.

The requirement for keeping LPR status is about periods of absence, not presence. The 6 months a year thing is for the time when you can apply for citizenship. It is not a requirement to keep the greencard.

I am a DV2025 winner in Oceania with a high case number (~3,500). I am yet to submit my DS260 because I am concerned that it may show intent to immigrate and make it more difficult to get other US Visa’s down the line. Is this something that I need to be concerned about? What would be your advice? Should I submit my DS260 now and hope for the best that my case becomes current?

I think your case number is very unlikely to become current, so I think you are wise to pause before submitting. DV2025 is almost exactly as overselected as DV2024, and your number is equivalent to a DV2024number over 4000, which of course got nowhere near current. So – the reality is that there is almost no chance your number will get current.
The concern about immigrant intent is real, BUT filing a DS260 does not rule out getting a NIV later. It is a factor they consider, but only as part of the whole picture.
Bottomline is that it is up to you of course.

Hello Simon! As a dv2025 winner, I am trying to figure out which documents are needed in case a interview will be scheduled for my case, I am stuck at the education point, I can’t find the original high school diploma (but I do have a copy of it) on the other hand I do have the original University diploma. Do I need to apply for a certificate of the high school diploma or the university degree is sufficient?
2. When I compiled my DS260, my Facebook account (which I honestly barely use) was closed, I reopened it lately just to find some DV groups where people share experiences
I have nothing to hide, but should I really reopen ds260 for that?

I had my interview yesterday at the Accra embassy but at the end the consular kept on looking at my uni cert front and back and later said she’s putting me under AP and kept my University cert both the original and the copy with my passport and gave me a white sheet and ask me to create a DHL, is there something I should be scared or I will be approved base on experience.

Can you please tell me how “country of nationality” is defined in DV Visa (or immigrant visa) process? Couldn´t find this definition in the US immigration law.
I ask this because I need to know if I need a police certificate (PC) from my country of birth where I only lived for approx. 3 years (as a baby). It´s been part of the USSR, in the age of 3 I moved to another country within the USSR with my parents where I lived many years (and where I was issued a passport – I have a PC from this 2nd country). I left the USSR before its dissolution and naturalized- I now have German nationality and a German passport as my anchestors came from there.
(If country of birth = nationailty, I’d need a PC from there as I lived there more then 6 months at “any time of my life”)
I no more hold a passport or “nationality” (as understood in Germany) of my country of birth (and this one wouldn´t generally allow holding 2 nationalities today). In Germany and I think in UK too – your nationality is the one in your passport – where you´re a legal citizen (where you live, (mostly) where your passport has been issued or what is written in your passport under “nationality”). But I have read an article from an US attorney that says that in the US, your “nationality” (other then citizenship) would be defined by where you´re born and therefore cannot be changed during your lifetime ?

Nationality means “citizenship”. But the instructions make clear that a police cert if only needed (for countries where you have nationality) if you were over 16 when you lived there. So – do you have (or did you hold) citizenship of a country where you lived at age 16?

I today have German citizenship only (and of course a PC as I live there today). But yes, I was 16years & older when I lived in the 2nd state of USSR where I moved in the age of 3 (I have the PC from there).
I had an USSR passport (therefore USSR citizenship) that was issued by this 2nd state (ethnicity in my birth certificate was ‘Russian” as I was born there =state of birth), please consider: the USSR had been 1 big country (so I moved within the same country in the past, just from 1 state to the other), Now it are many independant countries (which includes my state of birth and the state where I moved to in the age of 3). I was USSR citizen (and if nationality means citizenship i did hold “USSR nationality.” I only lived in state 2 in the age of 16+, not in the country where I was born.
Furthermore, it seems to be not as clear that you only need PCs from countries you have or had been citizen of (country/ies of nationality) from the age of 16. If you check the chart of documents/PC needed at the DV website, the line country of nationality states ” if the applicant IS 16yrs..and lived there more then 6 months” (means to me: the applicant is 16 today, not when he l8ved there ?).. In other countries where you lived 1year or more is defined: ” if the applicant WAS 16yrs or older” (means in the past). The new pdf at US embassy Frankfurt (from july 29 2024) says that you need a PC of your country of nationality if you “lived there at ANY age (!) for 6 months or longer…” (which seems to make clear, even if you were younger then 16 you need one). It’s maybe a specific situation (as the USSR no.more exists) was I citizen to my state of birth or state 2 (where I lived in the age of 16).. headache 100%…

My case number is AF78k (no wife no children) my interview is supposed to be in Riyadh KSA embassy I submitted my ds260 on may 7 and I reopened it 3 times. I entered the xarthisius website to see the embassy data and it says for AF region (cases from 72001-76001) 3 cases one is issued, one is ready and one is refused. And the column for 76001-80001 is empty.
1. should I forget about it and hope for good luck next year or just wait?
2. And is it possible to have interview after 30 of September?

My egyptian friend won DV 2024 with case no 42xxx and he determined US embassy in Abu Dhabi UAE for the interview.
The embassy didn’t schedule any interviews from June 2024 , send many requests to transfer his interview location to be in Cairo Egypt instead of UAE but KCC said check with The embassy.
He send many emails to the embassy but the emails transfered to unmiontered mail as an auto reply.
He doesn’t know what to do especially the fiscal year will end by end of September.
Kindly advise us.

I’am a 2025 dv selectee AF3*** from Kenya. I have a concern that I discovered recently, i got my kids’ passports earlier even before i applied for the lottery. After being selected I noticed my kids birth certificates were not legible and were reading someone else, so i decided to apply for new ones. The problem is, on the passports they indicate the entry number of the kids’ birth certificates. On my case, the entry number on the PP is different from one on the new BC. What will i expected during the interview? Will it bring a problem? Kindly advice.

My medical report has been with medical centre for over 8 weeks now. Two months and the embassy is asking me to take urgent action because the program is ending soon. I don’t know what to do because the centre says it does not have control over the results. They told me it will take in weeks and last Friday clocked 8 weeks as I stay on 22ig since July 09.
Do I have anything to do?

Sounds like they are testing for TB, which can take 3 months. So just keep in touch with the medical center.
