Hi Simon, in your latest livestream you mentioned that UK applicants could theoretically be distributed amongst the missing ‘holes’ to receive our fair chance in the lottery. Can you explain this a bit more? Would we be randomly assigned to any existing hole in the EU region, and anyone who receives under e.g. 20-30k would be able to proceed alongside everyone else?
This may be early – but are we able to use your large platform to get a poll going about who would be willing to chip in for the potential lawsuit? I know that myself and several others would definitely chip in $50, and almost certainly $100 or even more. It’s a shame that we would need to pay for this error, but we would pay just for peace of mind, and knowing we did everything that we could to benefit from this great opportunity. We are eager knowing that it’s time sensitive, we don’t want it to become too late!

Considering how slow these kinds of legal processes or lawsuits usually are, and how long it takes for the administration to update their systems, if a lawsuit were initiated in one month for instance, after the crowdfunding campaign, would there be enough time for the lawsuit to succeed and for a technical solution to be implemented before the interviews start on October 1st 2025? There’s only a four-month window. :/
And if the solution involves filling the “holes” with people from one specific country after the draw, I assume that’s something that has never been done before. That would likely require developing new software functionality — something typically complex, expensive, slow, and prone to bugs.
Maybe the only viable option is to fight for a solution for DV-2027, so that UK applicants can be included in the draw as usual, right?

If we assume that GB would NOT have been included in DV2027, then your suggestion would be to include one year for another. However, that would be against another part of the law, and quite unlike the process that should have been applied.

The numbering thing is this.
1. I don’t think it would be fair to tell every other winner in EU that there is going to be a redraw, simply to accommodate the Brits. It is not a large enough error to justify that.
2. It would be pointless to allocate the Brits with case numbers from above the currently highest EU number – that would guarantee they wouldn’t get a chance. There should be a distribution of rank order, much like the original draw.
3. I don’t know for certain when the country is excluded from the draw, BUT previous events suggest that when large countries are excluded, the case number ranges go down. If correct, that means the countries are excluded BEFORE the randomizer picks the order of case numbers.
4. So – if the GB entries were somehow included, they should be given rank orders (case numbers) that simulate the draw, starting from the lowest available number, right up to the “no hope” range if such a thing exists. My suggestion to use hole numbers would simply provide case numbers for that purpose – but there are other ways they could achieve the same result.
Whilst I am now sure DV2025 was performed without including GB entries, and the evidence makes me believe DV2026 was done the same way – one strategy would be to wait until the government post the per country winners. Getting a group lawsuit going before then seems premature. I have reached out to a lawyer to figure out how to make a group suit possible at low per capita cost, but it’s not easy to do at even the money were are discussing. Previous group lawsuits have been 1k to 2k per capita – which is too much for a 100 to 1 chance…

1. what are the documents needed from the sponsor can you please help me. and if i want to change the sponsor than from what i had put in the DS260 after the 2NL what should be done? should i inform the embassy or whats the process. or is it better to not change the sponsor now?
2. What kind of tax clearance is needed from the sponsor? or any other documents that i have to fulfill?
3. I had not finished my bachelors degree and had put it as running in ds260 but now i have completed it but have not received my certificate yet, should i present it in the interview or the high school degree is enough? i can show the digital transcript of the bachelors degree though.

1. The DS260 doesn’t have a question about your sponsor. The address you give is not necessarily the sponsor. So – the embassy doesn’t know who the sponsor is until you show them in the interview. The documents needed are the I-134, photo ID, recent payslip from the current year and a 1040 from the last tax year.

Hi Brit,
In my national identification (ID) it says that I were born in one city, but my birth certificate says I was born in another. This is because in Spain, when a kid is born, in the birth certificate it says the actual birth place, but parents can choose another city as the legal place of birth to use for all kinds of legal issues (both cities are in the same country, in Spain)
When I sent my DV application I indicate my legal city of birth, like I’m used to do, but know, looking at my birth certificate, I’ve remembered that it tells the actual city in which I was born, that is another.
I’m already a selectee.
Will I have problems with this? What do I put in the DS-260?

My passport also states that I was born in the same city I listed on the lottery entry, but I will use the city shown on my birth certificate in the DS-260, as recommended.

It says that: “The place of birth for the Spanish authorities is the place where the child was registered and not where the child was born.”
So, in Spain, whenever you have to fill in your place of birth in any public document, we basically put the place of birth that’s on our ID, not the the one of the Birth Certificate.
That’s why I made my mistake :/

And the Birth Certificate is itself a document issued by the local registry of the city of my ID, Madrid for instance.
So the Birth Certificate says something like this: “This child, that was borm on the hospital X from Barcelona, is being registered here, in Madrid”
And after that, whenever a public authority ask me about my Birth place, I just put Madrid, and that’s why when they issued my passport for instance, I indicated Madrid, and Madrid is what it says on my passport…

The spanish law in effect when I was born specifically said: “Notwithstanding the provisions of the previous section, births occurring in Spanish territory, when their registration is requested within the term, may be registered in the Municipal Civil Registry corresponding to the domicile of the legally known parent or parents.
In the birth registrations issued as a consequence of what is established in this section, it will be considered for all legal purposes that the place of birth of the registered person is the municipality in which the entry has been made. The certificates in extract will only mention this municipality.”

I am from Latvia and at the time when I filled out DS-260 I obviously picked the interview location in US embassy Riga, Latvia (the system even suggested it). Now I have found out that starting from this year US embassy in Riga will no longer handle immigrant visa cases and instead they will processed in Sweden, Stockholm.
Were I supposed to pick Stockholm in DS-260?

Hi Brit,
I have a case number of 2026OC24XX, which I understand is on the higher end, but may or may not become current close to September 2026 (if at all). The complicated part is I already live in the U.S. with a job on a current E-3 visa (expiring September ’26).
I’m trying to decide if I should go through with applying for the greencard or not, and if so whether I should do adjustment of status or ask KCC to change to consular processing in Sydney. I’ve heard if you have a high case number adjustment of status can be tricky due to USCIS processing delays. But I’m also wary of leaving the U.S. for consulate processing in the sense of if I don’t get the visa in time whether that will affect my ability to apply for another E-3 due to immigrant intent.
I’m currently working in the U.S., so I’m wondering what you would do in my shoes? The greencard is the ultimate goal, so if there was a straightforward way to move to the greencard while keeping my current job I will do it, but I also don’t want to risk my ability to remain in the U.S. in my current job by applying and it falling through. The high case number seems to complicate things timing wise, so I’m curious if you have any advice?
Separately, if you know of any U.S. based immigration lawyers with DV lottery experience (particularly for people already living in the U.S.), I’d really appreciate any recommendations.

Your number might be too high – we won’t know for a few months.
Because of that I would NOT file the DS260 if I were you (because of the downside of immigrant intent). In the AOS process you have an ability to file “early”, meaning that if the final VB for DV2026 (published in July 2026) makes you current, you could then immediately file (in July) and that gives enough time to get AOS done. They treat DV cases differently.

Hi, I’m wondering about two things. Firstly i changed my name (first and last) many years ago, how will this affect me should i still bring evidence of this change? My parent’s names are both different to mine on my birth certificate. It was due to family dispute and not to conceal or evade anyone it was pure personal choice. But it is a part of my past that i try not to relive.
Secondly i never formally completed high school but my job requires a lot of skill and training but has an insultingly low on O-Net online Job Zone and SVP score not high enough to use the work experience option on my DV application. I’ve been looking at completing my “year 11-12” “High School certificate” whatever else people may know it as, for my own satisfaction for a while. Is that really enough to satisfy for a visa? Do i really need to produce a certificate? I read a success story about a woman from my city that had bachelors degrees but she didn’t really mention if this was ever checked against a database or verified all i recall is that she was just asked by the officer at the consulate when doing the interview. I’m not a stupid person i just dropped out at end of year 11 at 18 years old and started working. It says equivalent tests such as the GED are not accepted. Does that also apply to different countries (I’m over 18 and wanna finish school as an adult option)

1. You will need documentation to prove the name change.
2. So it is not sounding good. Work experience is not an option given the SVP range, and to meet the requirement via education they will want evidence that you passed high school to the level required to enter university. Taking adult courses might not satisfy the officer either, so you need to decide whether that is worth the risk.

“Processing” refers to DS260 processing. Changing the embassy doesn’t change processing time, but might affect when the embassy will take you.
When you quote your case number without a year & region, an angel dies.

It really hasn’t been slow progress in terms of issuance. They have issued about 60% of the EU quota already, and the final months are usually the busiest for issuance.
You still have a chance, all you can do is wait and hope.

I think what Klesti is trying to ask is why the Visa Bulletin cut-off for Europe is moving so slowly this year.
In previous years, the European cut-off for June has always been at least 20,000—or even “Current”—but this is the first time in a long time that it hasn’t reached 20,000 by June.
It seems like something unusual is happening with Europe this year, and we don’t really understand why.
I’d also like to ask: Is this something we should expect to see again in DV-2026?
And one more question that comes to mind: Why was it common before 2023 for Europe to be “Current” by June, but that’s no longer the case recently? Could this tough situation for higher case numbers continue into DV-2026 as well?

I understood her question and my answer was actually the point I wanted her to note. If the issuance numbers are high but the VB numbers are low, then you need to consider how they have issued so many without increasing the numbers – hence my reply.
You are applying an assumption that case numbers are the same year to year – they aren’t. It depends on the density of cases to holes, and the distribution of those holes. This probably doesn’t make much sense to you right now, but if you watch my videos you will understand better. I’ll address this on the live session this morning.

I filled out DS-260 and rather than moving my case to another countries’ location via an email to KCC, since I was able to select the location while filling out DS-260 form, I selected another country’s location instead of the country I am citizen of and my current location. And submitted the form. Later I realized that this is not correct and I’ve had to put in my own country’s consulate rather than somewhere I dont have any permanent residence. Is it fixable or I ruined up everything? I think I am going to write to KCC about my mistake but not sure if I should request an unlock on DS-260 file to fix my interview location to my home country or should I request them to change my interview location to my current country if possible? These are possibilities only if they wont reject my case right away:/ if I have a chance to communicate things out, I might also confirm my interview location as the selected one if they say that it is possible if I provide the place I will stay at selected interview location rather than moving it to my home country. Do I have any chance that my case wouldnt be rejected and can be recovered after this dumbest action ever?

1. could having a pending DV lottery ds260 form in with KCC reduce my chances to enter the Usa on my current b1/b2 that I hold? I heard that immigration officers can see that on their computer when entering and they may question your intent.
2.if I am not married currently but I do intend to marry if and when I get my green card, how long roughly is it to get my spouse into the Usa once I have my green card in hand. I don’t want to marry before getting my green card as we are not ready for that yet.

1. No, if you hold the visa already then there is not a problem. The intent becomes an additional concern when applying for, not using, a non immigrant visa.
2. Bringing a spouse later can take years. It is far better to marry before the DV interview.

I am told this is a high number.

There is always a risk of not getting through the process, so it is wise to keep your business to yourself. Also, many people talk without knowing much. Ignore fools.
Now, when you give your number you should quote the year, region and number range without the exact number – so for you it is 2026AS14XXX. This number is not bad, and although it is a bit early to be sure, I am pretty confident you will become current with that number. So yes, go ahead and complete the DS260.
Interviews start in October for the lowest numbers. Yours is not that low, so you won’t get an interview until mid 2026. By then your baby will be born, and you will unlock the DS260 and add the baby immediately upon birth. At the interview you will need the passport and birth cert for the baby.

I am a Diversity Visa Lottery selectee, and I would like to clarify a few important details regarding my DS-260 application.
I was born in Mogadishu, Somalia, but I left the country at a very young age due to civil conflict. Since then, I have not returned to Somalia and, because of the ongoing security situation, I have been unable to obtain any Somali identification documents, including a passport or proof of Somali citizenship.
Both of my parents are originally from Ethiopia and are Ethiopian citizens. I currently hold Ethiopian citizenship and reside in Jigjiga, Ethiopia.
I was selected for the DV Lottery under Somalia as my country of chargeability, based on my place of birth.
My questions are as follows:
1. Will it cause any issues in my DS-260 application if I indicate that I was born in Somalia but do not hold Somali citizenship?
2. Will the absence of Somali documents (such as a passport or national ID) cause any problems, considering I am unable to safely travel to Somalia to obtain them?
I am willing to provide all supporting documents related to my Ethiopian citizenship and my parents’ identities.

I have two questions regarding current employment/job and employment history for the DS260: I read in your blog (and elsewhere) that having been unemployed for some time might lead to problems in the interview because they can think one might become a public charge in the USA. According to the information I read, this can in some cases lead to greencard denial or to sponsor requirement (or other requirements). I have two (related) questions about it:
1) Do you have any experience / knowledge that this has happened to a selectee from Western Europe with long unemployment history? I’m asking because, as a citizen of a Western European country, it generally wouldn’t make sense to rely on U.S. social security benefits. Western European systems are usually much more generous, so anyone from there seeking such support would likely stay in or return to their home country. 1. I understand your reasoning, but it is a self defeating argument. The greencard assumes you will live in America. So – the issue of public charge will be considered.

While I was unemployed, I didn’t receive any social security benefits from my home country – I relied solely on personal savings. I considered mentioning in the DS-260 or at the interview that I never received social security benefits, but I can’t prove it since my country’s agencies don’t issue confirmation for not receiving benefits. I’m unsure whether it’s better to proactively explain this or only address it if asked (on the one hand it might be good to let them know proactively that I never received social security benefits so that they will consider it more unlikely that I will become a public charge in the U.S., but on the other hand they might not believe me since I cannot prove it).
Do you think it’s wise to bring this up in advance, or should I wait? Have you heard of similar cases? I am aware that this might be tricky, so it’s totally fine if you have no suggestion on that.

I am a 2025 DV winner with case number EU34K, and I have been waiting to see the progress on processing the DS-260 given my high case number.
While I am aware that the only option for me would be the Visa Bulletin going current, do I still have time to process my DS-260, or am I already too late? I am not exactly sure about the processing times for the DS-260, but I understand it might take 3 to 4 months.
Additionally, have you seen any non-immigrant visa applications being impacted due to the submission of a DS-260, thereby indicating an intent to immigrate to the USA?

There was an error on my school certificate “23/03/2000” and the actual date of birth is 22/02/2000
Due to this error I went to the court for an affidavit of support and gazetted it for correction but unfortunately my visa was denied due to this situation
My passport, birth certificate and Ds260 all have same date with the exception of the school certificate

My birth certificate was issued last year because I wasn’t having one . I was born in Bawku in the year 2000 and due to the fight there wasn’t these issuance of both certificates bcos most of these entities had closed down
His main reason was how did I realized my school certificate had an incorrect day of birth whiles I wasn having a birth certificate during the time my school certificate was issued
