Hi Mr Simon, I have a question regarding the possibility of a second onboarding by any of the ongoing lawsuits.
If they wait for the judge to rule in favor of the first lawsuit and then file a brand new separate lawsuit with the new plaintiffs would that second lawsuit move faster given that the legal precedent is already established and the government would be in a much weaker position?
And more critically even if it moves faster, will it actually be fast enough? With September 30 as an immovable deadline and accounting for the time needed for interview scheduling and visa issuance after any court order, is there realistically enough runway for late-joining plaintiffs to benefit?

For context, I was doing flight training in the US under the M1 visa until recently. Given that I was one more rating to complete and a valid M1 visa, am I able to go back and complete that or will it be seen as dual intent?

Hi sevenstars, in case it’s helpful, I live in the US and I flew in for my CP consular interview in my home country, got 221g’d, and was able to come back in with no issues on a non-dual-intent work visa. I did get warned that renewing the visa might be tricky, but as long as your current visa is valid and you can make it clear that you are just going in for the job/training you were already doing, it seems to be OK.

If they didn’t cancel the M1 visa, then you could still use it.
The dual intent issue is only a problem if you were to enter and then try to adjust status. But that isn’t what you are asking about – so no problem.

Just Sharing my experience, me and my spouse had our interview today, we are in oceania region in Fiji.
Everyone who was there for the interview was advised that we have two options
– Opt1- Dont do the interview as the pause uplifting date is not certain and don’t risk wasting our money, you can reschedule if you want but its subject to the embassy schedule later on.
– Opt 2 – Carry on with the interview, pay the fee but it will not be refundable if the pause dont life and time runs out on 30th September.
Our civil documents were taken and we paid our fees.
After sometime, we were called for our interview by the CO, questions were simple
– what we plan on doing in the states, any crimes committed and past marriages.
We were not asked of our financial savings, insurance, public charges questions.
In the end , all our documents were given and the CO told us we were on 221g and if the pauses lift then we can proceed and wished us the best.

I had mine as well on the 20th of May 2026 (2026OC8XX). The same was conveyed by the CO. Hopefully the pauses are lifted soon. In my case, the medicals were optional as per the email from the embassy. If the pauses are lifted, it would be a tight schedule to finish up medicals as well as a second round of interviews but fingers crossed.

I’m still not sure what will happen after the interview, but at least it seems like AOS interviews are starting to be scheduled. All I can do now is pray and stay hopeful.

1- Regarding the DV-2027 lottery, it has not opened for registration yet, and it is evident that the Trump administration is using administrative delays to soft-kill the program. In your opinion, will the U.S. Congress or the federal judiciary step in to compel the administration to open the DV-2027 registration? Even if a court order forces it open later, do you think there will be enough time left in the fiscal year clock to handle registration, select winners, and process the visas before the strict statutory deadline?
2 – Given the current administrative gridlock, would it be a viable strategy to coordinate with an accredited White House correspondent (such as from CNN) to directly question Secretary of State Antony Rubio during a press briefing regarding the indefinite delay of the DV lottery? Hello britsimon, probably you have been asked this question multiple times i apologies, i have been current for months now AF45k & with the backlog that Nairobi embassy i doubt if i will receive any 2nl,my qtn if i joined any follow up law suit would i still benefit even if i didn’t receive my 2nl for an interview if the law suits were to benefit only plaintiffs. It’s very hard to predict exactly what will happen. There are scenarios where being a plaintiff might be very advantageous at a backlogged embassy like NRB. But, I can’t be sure it will work out that way.

I’ve been thinking about what the DoS had said about DV-27: “We will announce the start date for the DV-2027 registration period as soon as practicable”. I know that by law the government is required to open the registration and conduct the lottery, but what would really happen in practice if the government thinks the program never becomes practicable? There is no automatic penalty. Ivanov v. Trump could save DV-26, but I’m starting to think there is a world DV program is suspended in practice until the administration changes in January 2029. I know you’re generally optimistic when it comes to the DV program, but I think what I’m describing here is reasonably within the realm of possibilities. What do you think?

There is significant risk that even if the pauses are lifted, you still would not be scheduled. You will need to decide for yourself whether it makes sense to join a lawsuit in such a difficult position.

Thank you uncle b, I equally contacted Curtis with this same question, to get his point of view as an attorney which as well has some experience in dv lawsuit. but he responded that I should consider joining the lawsuit now. so I don’t really know what to do because when I checked xarthisis it shows 21k active current cases before me and currently the embassy in Yaoundé is at 6k only. so I think there can be a miracle and I get an interview 2nl before or in early September. so what would you advice me as an expert in dv lottery

My case number for DV lotto is 47*** and I am a plaintiff of the ivanof case, I also have a eb2a i140 waiting for adjudication (25 month wait it has been filed 11 month ago) but my priority date is current on that visa bulletin table.
if we succeed in the lawsuit and the visa bulletin does not progress past 48000 is there anyway of using my priority date from the other pending visa as my DV number ?

I thought about J-1 visa job in US this summer I’m a Romanian university student in UK. But I know there’s a 2 year rule that prevents getting permanent residence after J-1. Suppose the DV lottery opens soon, I apply and within this 2 year period after J-1 summer job I win the lottery. Would I be unable to get the green card?
In other words would going for a J-1 summer job possibly make me lose the green card I win in the DV lottery?

There is a chance that the pauses are dropped before the year end for all people BUT if you want the best chance possible and can afford it, then being on a group lawsuit is a wise choice. Red Eagle and Immpact are shortly to announce their follow on lawsuit options.

Curtis mentioned they will file the second DV suit in June. He mentioned on his most recent live (last question, 43 mins in) that this second case is less likely to have a successful outcome compared to the Ivanov case.
Why do you think this, could you please clarify with him and talk about this during your weekend live?
This doesn’t make sense to me, I would think it would make it more likely to have a successful outcome especially if the first suit is a win – it gives precedent and there is already an existing judge who provided their positive judgement (if this does happen).

My worry is this: in the las years, the last 2 Europe bulletins often move by about 4k or more combined, which would likely make my number current. However, this year there are active lawsuits. If a court order requires consulates to prioritize plaintiffs and they spend resources reprogramming or adjudicating plaintiffs’ cases, could that temporarily slow down the Europe cutoff for everyone else? in other words, could EU23,000 get stuck for a while because consulates are busy processing plaintiffs’ 221(g) cases, even if the historical pattern suggests a bigger move? does that scenario make sense, or am i misunderstanding how the court order would work? I would like to ask for your general opinion about my situation. I am from one of the 39 affected countries. I am currently on F-1 status, and my family members are on F-2 status. I am also waiting for my OPT EAD.
At the same time, I am a DV-2026 selectee with a submitted/pending I-485 adjustment of status case. I am not sure whether I should join the Red Eagle Law class/group lawsuit challenging PM-602-0192/PM-602-0194 holds, including motions for preliminary injunction and class certification. However, they mentioned that the 39-country lawsuit may not directly challenge the DV hold.
In your view, for someone in my situation, would it be better to join this class/group lawsuit, wait for a DV-specific lawsuit, or consider another strategy? I am also concerned about whether participating in this lawsuit could negatively affect my future immigration options.

When the 39 country ban was introduced, it exempted people already in the USA with a valid visa (as of the effective date of the proclamation). Assuming that is true in your case then you should be able to be processed, and a lawsuit against the hold would be a wise move. You could choose an individual suit, or hope to get on a group lawsuit (check with Red Eagle Law).
Filing a lawsuit does not affect your future immigration options.

The new Visa Bulletin for Europe has been published, and it only moved up to 3000. My case number is EU24500, so I still need around 1500 numbers to become current. Because of this situation, I feel like I am losing my chances and my hope.
I am also an attendee of the Real Suite, but my family is under very high emotional stress. We are living in the USA under investor status, and after winning the DV lottery, all our plans, dreams, and efforts were focused on making this opportunity real. But with today’s Visa Bulletin update, it feels like we have lost all hope.
What do you think about this situation? I know it is impossible to predict, but I would really appreciate your advice and suggestions.

You are confusing two different things.
4262 is the number of selectees in the region, including the derivatives on each case.
4696 is the case number of the highest case in the region.
So – not all case numbers are real cases, and each case contains, on average, about 2 people.

State unemployment insurance is something that was paid by your employer on your behalf. Claiming that does not normally affect your current or duture immigration status. However, please make further enquiries to be sure of that in your particular circumstances.

I just wanted to share my experience of my dv interview which i had last week in Frankfurt. It went well for both me and my wife, we had no problems and got approved but because of the situation the consular put us on 221 (g) and she asked if we want to leave the passport in the embassy so if the pause is lifted they can print the visa. But because we need our passports for taveling we decided te keep the passports and send them again when the pause is lifted.
She asked us basic questions like :
What you are working?
Where you will stay in US?
How much savings ?
When and where we got married?

I did not join the first one and may consider for second one if they accept. so the question I have what benefits I may get from that? no much time left as you know and mine is in 75 banned country as well. so truly it will be appreciated your suggestions.

People join the lawsuit because they hope the lawsuit will improve their chance of getting the visa. There are no guarantees of course so you should consider your case number, your embassy and so on…

Hi Simon, When I attended my interview on 19 Feb 2026 at Nairobi Embassy, the consular officer refused to take the copy of my high school certificate, she needed an original copy for verification because they wanted to verified my South Sudan certificate if it was original or fake document. She promised to return it through an agent called DHL, but they didn’t call me untill today. What should I do now?

You can’t join the lawsuits already running, so you have to wait to see if any additional lawsuits become available – which I expect to happen within a few weeks from now.

I think that is unlikely, but even then no case is “safe” because of the embassy backlog and behavior.

So are you saying that even if we win the lawsuit, the embassies still may refuse to interview us?
Because if that is the case, then it seems the government can simply instruct embassies not to schedule DV interviews, and whether we win or lose the case, the final result would still be the same for us.
In that situation, we would still end up losing this once-in-a-lifetime opportunity despite winning in court.

Hope you and your family is doing well, I have a question regarding the courier system. We got 221g this week and we still didn’t setup the courier service because when I try to add myself as dependent it gives the error saying there is a mismatch with the number of dependents in the case number probably as we got married after winning the lottery. Is this a big problem and what happens if we just setup the account only with the primary selectee’s info without adding dependents? I’m thinking maybe as our case is already internally connected at the embassy, docs and visas would come at the same time anyways to the postal office.

There is a clear indication that the government has no intention of lifting the DV pause for everyone during the DV 26 period, otherwise they would not be requesting the judge to provide relief to plaintiffs only.
The largest proportion of DV winners by a significant margin, are the non plaintiffs. Why are REL and Immpact not in the process of launching the second batch of DV lawsuits? This would make their existing cases even stronger.
Time is running out quickly and nothing is going to change for non plaintiffs, we need help from REL and Immpact in providing another opportunity to join DV lawsuits asap. Why are they stalling on this?
