Interview documentation question. Apologies for the long message but I wanted to provide context for clarity.
Last week I received a 2NL for a London interview scheduled for the first week of August. On my DS-260 I stated that I lived in Germany between Sept 20xx and Aug the following year (a 12-month student work placement). This was my best recollection at the time as it was many years ago. I sent my application for a Germany police certificate on the day I received my 2NL but it looks unlikely to arrive in time for the interview (online reports indicate anything between 5-9 weeks after arrival at the Germany office).
I have now found a HR personnel document and pay slips showing that my placement ended on the 31st July and a letter from my German bank dated 1st August confirming closure of the account and transfer of funds back to my UK bank account. This shows my placement was 11 months (plus I expect another day or two afterwards until I left but I have no flight records to show my exact entry/exit dates).
What is the best course of action?
1. Update my DS-260 with the embassy before the interview or not? (Gemini and Claude gave me conflicting advice on this action and whether it triggers a fatal delay on processing and/or interview scheduling). Is the 12 month threshold a hard line or is this action irrelevant as a 11 month + days residence still warrants a police certificate?
2. I’ll take originals and certified translations of the above documents to the interview but (DV pause aside) is a 221g inevitable? How much time should I factor in to overcome it once I receive my Germany police certificate and what will be the process to submit it and my passport. I’m aware DV-2026’s deadline will be a factor and I’d like to be prepared. I estimate 12 full weeks between my police certificate application’s arrival in Germany and the 30th September.
3. Thanks to your advice I’m a round 1 Immpact plaintiff. Gemini suggested this could come to my aid (given a favourable outcome) to expedite processing in the final weeks as long as demonstrate I have acted in good faith (present appropriate documentation) and keep Immpact informed?

1. It is pointless to change. You could try and argue that you left – but the proof you mention is NOT proof you left. So – in that case the CO could simply insist on a police cert anyway.
2. If they want the police cert, you would be on 221g until you provide it (or the deadline times you out).
3. Immpact won’t take action to expedite an individual case of a group plaintiff. And even if they did you still don’t get a pass on the police cert.

If a PI drops in late August, there simply will not be enough working days left on the calendar for the embassy to receive new medicals, print the visa foil, and clear the 221(g) before the fiscal year permanently closes on September 30.
You know how the embassies are working, slow…
It seems that if we will not get the PI in the next few days it would be almost impossible to get the visa.

Our lawyers are trying to get the pause lifted as soon as possible. However, the government is doing the opposite by delaying the decision and the process as much as they can, so that eventually nobody gets a visa.

Its not good or bad position, its the reality.
People here who won are putting their lives on pause because they are waiting for good news. The odds of winning the PI in a decent time that will leave enough time to get the visa is getting smaller as the days goes by.
We need to prepare our mind to the true – the chances are not high and we will might not get the visa, and plan our life accordingly.
If it will turn out that we win, that would be great, but lets not count on it.

I’m a DV-2026 selectee from Russia, case number EU41XXX. My DS-260s are already submitted, and the interview post currently shown in CEAC is Warsaw.
Because obtaining Schengen visas for Russian citizens is currently difficult and unpredictable, I’m considering asking KCC to transfer my interview from Warsaw to Almaty, Kazakhstan.
In your experience, when is the best time to request such a transfer: before the case becomes current, once it becomes current, or only after an interview has been scheduled?
Also, have you seen KCC/Almaty accept DV transfers for Russian DV cases where the applicants are not residents of Kazakhstan?

Your chance of getting reallocated is MUCH higher BEFORE you become current. Change now if you can, but KCC will want proof of residency.

Some have, but not many. Up to last Friday, 289 AF cases have been scheduled so far for August interviews. Some of them would have been in AF region embassies. To give an idea, AF would normally get around 1500 to 2000 interviews in a month.

Hey, I’m originally from Lebanon. I came to the U.S. in 2021 on an F-1 visa, completed my master’s degree, and I’m currently working under OPT.
I was selected for the DV-2026 lottery with a case number around 6,000. I filed my Adjustment of Status application in November and completed my biometrics in March.
With everything that’s happening now, do you think my case could become more complicated? Also, how are cases like mine currently being treated in the U.S.? At the moment there is an administrative pause on all DV cases, including those doing AOS. That pause is the subject of several lawsuits. Some people have achieved approvals from individual lawsuits against USCIS. There may be time to start such a lawsuit (contact Jesse Bless to ask), or you can just hope that the pause is removed before the deadline of September 30th.

Hi Simon, my case number is 2026EU19XXX, and I’m from Albania. I’m still waiting for my 2NL, even though my case became current in April. I submitted my DS-260 in May 2025. I understand there’s no guarantee I’ll get an interview, but do you think the delay could be because Albania is affected by the 75-country immigrant visa pause? According to the government instructions, yes – but in practice, in the past, it did not stop an ESTA approval. There is no guarantee though as this administration moves the goalposts.

My wife is the principle winner and she is from morocco, our case was first in Abu Dhabi where we are resident then we moved it to morocco back since Abu Dhabi embassy was closed. We became current in January but no 2 nd email so far. We plan go to canada for long time vacation, can we move our case to canada or it can only be in country that principle person either resident or citizen?

If you are now current, it will be difficult to get KCC to switch your interview, and yes they would expect proof of residency in that country, even if they were prepared to move your case (which they almost certainly won’t).
I don’t know when the court will decide – we just have to wait and see.

I received my 2NL with my interview date and time, and I followed the instructions for my country to register on the U.S. Visa Scheduling website (https://www.usvisascheduling.com/en-US/).
I completed the registration successfully and received a “Transaction Confirmation” for document delivery. However, when I log into my account, the page still says “No Appointment Scheduled.”
Is this normal for DV cases, or is there anything else I need to do? I just want to make sure everything is in order before my interview.

I am a DV-2026 selectee with case number EU24XXX. I am a Turkish citizen and currently a temporary resident in Germany.
I transferred my case from Ankara to Vienna through KCC in May 2025. As you may know, my case became current this month for August interviews. However, it has been about 15 days and I still have not received my 2NL for an interview in Vienna.
Do you think there could be a problem with Vienna similar to what we have seen with Ankara or Warsaw? Would it be a smart move to transfer my case from Vienna to a U.S. embassy in Germany that processes DV cases, or should I be patient and wait for Vienna?
Lastly, in your opinion, where would I have a higher chance of being scheduled: Frankfurt or Vienna?

Vienna in previous years have been a safe option.
However, this year there are some waiting for Vienna, whilst Ankara has done exceptionally well and seems to have scheduled cases right up to 28XXX. I’m not as clear about Frankfurt.
So – as it turns out, your switch to Vienna caused some delay – but I can’t be sure that they won’t fix it for September interviews.
As for moving now – well it is a lot harder to move a case once you are current.

Yes, I finally received my 2NL about an hour ago. There are also five other Turkish applicants with similar situations, and they most likely received theirs as well.
By the way, I would like to make a small correction regarding Ankara. Ankara has not scheduled any interviews for cases above EU19K that originally belonged to Ankara. The applicants with case numbers above EU19K who received interviews in Ankara are people who were first scheduled elsewhere, for example Bangkok or Hong Kong, and then transferred their cases back to Ankara afterward.
So it seems Ankara is currently only accepting or scheduling transferred cases, which is quite strange.

Dear Simon; I got reply from Vienna embassy stating that they didnt receive my case file yet and once they receive it they will send the instructions. Also they says that KCC is organising the interviews. Then I contacted with KCC asking why they didnt send the case , got same stage 4 reply .
If embassy has capacity problem or any other issues , why they dont mention that. It seems like KCC is not sending the cases but I dont think it is the issue here. What do you think?

Both answers are technically correct. What they are not saying is that it is the embassy that sets the capacity, and then KCC use that capacity. However, that won’t change in time for August interviews. So – now you hope that they have made capacity available for September.

We don’t have exact CEAC data anymore, so I can’t give any precise idea of their backlog, if any. Yes – the latest 2NLs (sent in the last two weeks) would be August interviews. There is a chance of more being sent in the next few days.

I’ve seen DV lotteries from 15-20 yrs ago that had EU jumps in their final month to current that were similar to this years penultimate number. I know we can’t draw conclusions from past years since they’re all different, but considering the dv lotteries that were a while ago, were there any systematic differences that made them go current more often. Was it just that less people applied overall?

Each year is different, but with the last minute current scenario, it still isn’t great news because some embassies don’t schedule up to the highest numbers. So – it becomes a false benefit for most people.

I was selected in the DV-2025 Lottery from Sri Lanka with a case number in the 23XXX range. Based on previous years, I expected the Asia cutoff to exceed 25,000, but the final cutoff for DV-2025 was only 14,500. This was very disappointing for many qualified selectees.
I have no resentment toward those who received visas—they were fortunate, and I wish them all the best. My concern is that DV-2025 processing was unusually slow, and many visas appeared to remain unused. If there were unused visa numbers, it would have been fair to give eligible DV-2025 selectees another opportunity rather than letting those visas go to waste.
Would it be possible for KCC or the U.S. government to reconsider the cases of DV-2025 selectees who were unable to receive interviews because of the unusually low cutoff numbers? A second chance would mean a great deal to many qualified applicants who genuinely hoped to build a future in the United States.

I hope this message finds you well. I am writing to ask for clarification regarding the U.S. Diversity Visa Lottery for 2027 and 2028.
If the State Department decides not to open registration, what is the correct path to force them to comply with the law? Should a lawsuit be filed in federal court to compel action, or is it Congress that has the authority to intervene?
From my perspective,95%) that the lottery will not be opened in 2027 or 2028, since this administration is strongly opposed to immigration. In one of your videos, you mentioned being optimistic that the lottery would open, but President Trump and his government seem completely indifferent to this issue.
My question is: what is the practical way to obligate the government to open registration? Is it through the U.S. courts, which would mean once again raising funds, hiring lawyers, and waiting for lengthy proceedings? Or is it through Congress, even though so far they have shown no interest in questioning the State Department?

I think that number is unlikely to become current – and the fact that you haven’t submitted the DS260 means it is probably too late to do so. I can’t be 100% sure – but I would probably say this is not your year. But chances of reselection in OC region are high.

If President Trump’s administration decides not to open registration for the U.S. Diversity Visa Lottery in 2027 and 2028, who will force the State Department to open it? Even though the Diversity Visa Lottery is protected by a law passed by Congress, we have not seen any member of Congress ask the State Department why registration has not been opened. This shows that they have absolutely no interest. That is why I believe the Diversity Visa Lottery should be forgotten until Trump leaves office on January 20, 2029, and we pray for a Democratic president. I am very afraid that Marco Rubio or J.D. Vance might win the presidency and continue Trump’s same immigration policies.
My question is: how will the State Department be forced to open registration for the 2027 and 2028 Diversity Visa Lotteries, when Congress has not spoken about the lottery at all—as if it does not exist—and has not even spoken about the ban on family reunification for Americans from 72 countries? Right now, there are people who want to bring their wife or fiancée, but they must wait until Trump leaves office.

Hi Simon, at what point should we realistically conclude that things are truly bad and the chances have become extremely low in the Ivanov no-decision case?
We’re already approaching the end of June. There are only about 70 working days left before the end of the visa year. Many people still haven’t had their interviews, many haven’t even received their 2NLs, and a large number of applicants remain stuck in 221(g). For some, their medical exams are about to expire or have already expired.
Which group do you think is currently in the safest position among those covered by the lawsuit?
I’m generally optimistic, but it’s hard to ignore the fact that time is running out, and this has been an incredibly difficult DV lottery year.

I’m hoping to be a DV-2027 entrant from the UK. I was caught speeding (90mph in a 50mph zone), attended court, paid a fine and received 6 penalty points on my licence. There was no custodial sentence, no drugs or alcohol involved, and no harm caused to any person or property.
Will this court conviction affect my DS-260 application or interview outcome if I am selected? And should I answer ‘yes’ to the criminal history question on the DS-260, even though it’s a road traffic offence rather than a criminal conviction in the traditional sense?

I am a DV‑2026 lottery winner. I passed my interview in February, but the officer told me she could not issue my visa due to the DV pause and the suspension affecting 75 countries. Last month, my country (the Democratic Republic of the Congo) received an additional entry suspension because of an Ebola outbreak—anyone who has been in the country within 21 days prior to arrival in the U.S. is affected, and all visa processing at the U.S. Embassy in Kinshasa has also been suspended.
My question is: if both the DV pause and the 75‑country suspension are lifted, would it be possible to transfer my case to another embassy in the region? If so, would I need to redo the interview? I really need to know the next steps if both pauses are removed but the Ebola‑related suspension remains in place.

I can’t predict exactly how that will work – although typically the disease entry suspension is overcome by staying in some other country for that three week period prior to entering the USA.

Hello Simon, thank you for your support I have been following you on YouTube for a year now since I became a DV winner. Am a Gambian my country is in the 39 country ban. Am AF41K I already received my 2nl and my interview is scheduled for 13 of august at Dakar embassy. But I have the opportunity to have a passport of another country that is not under the ban, not through the right way though. But in my DS260 I didn’t mention anything like dual citizenship. Just because of this ban and now am trying to get another country passport instead of Gambia.. and already everything on my DS260 is about Gambia, my passport everything.. please I need your advice on this before proceeding with it. When you say not the right way, that means some fake process. Don’t do that. Fake documents will earn a lifetime ban.

I’ve given up on the dv lottery. I still want to holiday there but I’m on 221g. Does this mean I wont get an esta and cant travel there anymore?

No – you can apply for the ESTA – and in most cases it would still be granted.

Hello Simon. My case#AF56xxx has been current with he June VB. I have been scheduled an interview in Kigali on 24August (received the 2NL on Thursday this week). Would you recommend to go for the interview or it’s a waste of time and money?

Depends on your chargeability country. If it is affected by the 39 country 212F ban – then no – I would not recommend attending the interview.

I have a question about contacting the embassy. We’re part of Ivanov case. My wife and I are in 221(g). The interview went well months ago, and we’re now waiting for the outcome. What concerns me is that we haven’t received any email from the embassy so far. I had to check the 1NL and 2NL statuses on government websites myself. There was no signal or notification from the embassy to our email inbox. I’m worried that even if we “win” the case, the contact from the embassy might be zero. Is it possible that sometimes the embassy doesn’t send email notifications at all, and everything has to be checked only through their official websites?

There is no reason so far that the embassy would have had to contact you. There is no news. Not sure why you were expecting an email.

Hi Simon, I was happy to become current in the last VB (very low EU25k) but I have not received my 2NL (Frankfurt embassy). I am so sad.
I unlocked my DS260 in September so I sent them an email about the status of DS260 and they sent me below. What does it mean?

If you need to make changes to your DS-260 you should contact the consular section where you will be interviewed, or bring the information about your changes to your interview appointment. Because your case is ready to be scheduled, KCC can no longer unlock your application.
In order for the Kentucky Consular Center to assist with inquiries regarding a specific Diversity Visa (DV) case, you must provide the Principal Applicant’s full name, complete case number, and date of birth in the following format (MMDDYYYY) as entered on the original entry. Please remember that the Kentucky Consular Center does not have the authority to tell you whether or not your specific case will be disqualified. After my interview I got a letter that says “ this office regrets to inform you that it is unable to issue a visa to you because you have been found ineligible to receive a visa under 221g of the immigration and nationality act which prohibits the issuance of a visa to issued pursuant thereto. Please be advised that for a us visa purposes including esta this decision constitutes a denial of a visa. The following remarks apply in your case : additional administrative processing is required – we will contact you when this is completed. “ does this mean I will have issues traveling on esta this summer and am I able to join the lawsuit? Thank you

You can travel on an ESTA you already have, no problem. You can join a lawsuit, but the Immpact case closes in 2 days.

Thanks for all your support so far, i would have never expected this process to be so stressful and emotionally demanding when we found out we were selectees over a year ago. Your support during all this time really means the world to us.
We did not make the cut this VB but it’s very very close so we hope we will be current with the last bulletins (26EU 298XX). Our embassy is Vienna and so far I heard only good things about them. I am currently planning for the medical and wonder around what time would you expect the interview to be scheduled if we become current with the last VB?
