Simon, I don’t really have any clue what Judge Davila might say at (or after) the hearing tomorrow, given the government’s apparent lack of progress, but at this point we really need embassies to prioritise DV cases, given the looming statutory deadline. Is there scope for REL to request that specifically? Can we ask the judge to make that part of any subsequent order?
September 10, 2026 at 11:27
We will see soon I guess…
September 9, 2026 at 10:49
Hi Simon, Since today is September 9th, do you think there is any realistic chance that Judge Leon will issue a new order forcing the Department of State/KCC to send out a new batch of 2NLs? Or do you think at this point in the fiscal year there is simply no time left logistically to schedule new interviews before September 30th?I would appreciate your thoughts on whether plaintiffs still have any hope or if the window has effectively closed.Thank you for everything you do!
September 10, 2026 at 11:26
The chance for new 2NLs is diminishing rapidly. They haven’t even rescheduled the cancelled ones yet, not started the 221g issuances
September 9, 2026 at 10:48
Hey Simon,
I am on 221g and have a appointment for the medical on Sept 10 or Sept 22 available, do you recommend to wait until the hearing is over or to just take the medical appointment tomorrow?
I dont want to waste another 500€ but I also am scared that the government might not process my case if the medical is expired and they need to request documents….
September 10, 2026 at 11:25
This is really a decision you must make yourself. Sept 22 might work if the physician can do the report in time.
September 9, 2026 at 05:12
Hi Simon! I wanted to share an update about my case. I’m a DV-2026 applicant from Ukraine, interviewed at the U.S. Embassy in Kyiv, and my case is still in Administrative Processing. I sent my repeat medical exam to the embassy on August 31, and on the same day the CEAC “Last Updated” date changed to August 31 for all applicants in my case. Yesterday, September 8, the date changed again, but only for me as the principal applicant — my derivatives’ dates are still August 31. Do you think this could indicate that they are actively processing my case?
September 9, 2026 at 09:42
We cannot know the reason for the status update, so I always tell people not to try and infer meaning to the updates.
September 9, 2026 at 12:24
Hello Simon
i saw some reports about CLINIC v. Rubio
courts order dose this apply to dv case or for us that did not get a 2nl
or is this something else and i got it all wrong
September 10, 2026 at 11:28
CLINIC is somewhat impactful on DV cases, and helps the Ivanov and Medani cases
September 9, 2026 at 04:04
Hi BritSimon,
Do you expect the 221(g) cases to be processed this week?
Thanks!
September 9, 2026 at 09:42
I hope so, but so far the government have done nothing.
September 9, 2026 at 02:43
I am from Fiji Islands (OC8XX) with pending medicals and just noticed my CEAC status still says refused but was last updated today (9/09/2026). Lets hope we have something concrete soon. I have booked a medical appointment for next week. Hope all goes well. Could the status report from Pacer be shared from the IVANOV case. Thanks
September 9, 2026 at 09:41
The status report says they did basically nothing.
We cannot know the reason for the status update, so I always tell people not to try and infer meaning to the updates.
September 9, 2026 at 01:17
I’m so sad about the situation especially because yesterday was useless. What’s gonna happen now?
September 9, 2026 at 09:41
There is a hearing tomorrow in Medani
September 8, 2026 at 20:52
Hi Brit,
I am a DV-2026 selectee from Fiji. My case is current for September, and KCC has confirmed that our DS-260s are complete and valid. However, we have still not received our 2NL.
Given the recent court developments, do you think there is still a realistic possibility that KCC could issue additional 2NLs later in September for interviews at posts such as Suva?
Also, if an interview cannot be scheduled before September 30 because of the delays this year, is there any legal possibility for DV-2026 processing to continue after September 30, for example through further court relief or reservation of visas?
Finally, could the delayed DV-2027 registration have any effect on this, or are DV-2026 and DV-2027 legally completely separate for this purpose?
Thank you for your guidance.
September 9, 2026 at 00:09
Further 2NLs become less and less likely as time passes. So – there is risk.
I normally tell people that the deadline is firm. However, Curtis might be able to persuade Judge Davila otherwise since the government are obviously trying to play out the clock. But – it’s a longshot!
DV2027 and DV2026 are not linked.
September 8, 2026 at 20:30
There are only 16 working days left. We haven’t even received a status report. No movement whatsoever.
Seriously, is there anything that can actually force them to comply with the court order? 22 days in total. I’m on 221(g), and I have all documents ready, and honestly, I’m terrified.
It’s really heartbreaking. I just have no words. This is unbelievable.
September 9, 2026 at 00:06
The status reports were filed this evening. Basically – they have done nothing useful – and nothing in volume.
September 8, 2026 at 19:30
Hi Uncle Simon, in the Ivanov case, I noticed that a new lawyer is involved and he specialize in appellate litigation. Does that mean the government is planning to appeal?
September 9, 2026 at 00:06
I don’t know.
September 8, 2026 at 18:29
Hi Brit 👋
Just wanted to inform and check-in
My ceac case status got updated yesterday (8 Sept) and then i checked again today, there was another update (9th Sept) but still under the refusal status.
Can this be a some indication that embassies are getting ready to adjusticate cases ? (my case is on 221G)
Thanks 🙂
September 9, 2026 at 00:05
We cannot know the reason for the status update, so I always tell people not to try and infer meaning to the updates.
September 9, 2026 at 06:27
I just experienced the same. My case was first updated on August 31st then yesterday (September 8th) and then again today. I’m hopeful that this means the consular staff are accessing our files. I’m looking at this in a positive way – if your files are accessed and updated then that’s progress (even though it’s slow).
September 8, 2026 at 16:53
Would there be a possibility that the government is trying hard for minimum compliance by issuing mostly the AOS cases? Is that they have directed embassies not to issue visas to consular cases until much later towards the end so that interview’s can’t be rescheduled? Is this a strategy?
September 8, 2026 at 17:26
They are two different agencies, and AOS numbers are a small fraction of the overall case – so no Judge would be impressed by AOS activity and nothing from DoS
September 8, 2026 at 18:05
I see so it’s the DoS that’s lagging behind on cabling issuances.
Thanks for Q clarifying.
September 8, 2026 at 09:11
Hi Simon! Would it be okay to email the consulate requesting an urgent rescheduling of an appointment canceled in September, mentioning the Medani-Trump ruling?
September 8, 2026 at 09:25
It won’t harm you, but they won’t do it until they have had the instructions from DoS.
September 8, 2026 at 09:54
Curtis filed a motion today, but the judge gave the government a week to respond and then Curtis another two days to strengthen the motion before making a ruling…it’s a long time to…We have to wait because after September 30th we lose all opportunity! Please let things change and let the embassies start taking action 🙏
September 8, 2026 at 08:26
Do you think the motion to enforce in Medani would also help the Ivanov plaintiffs? I’m a little worried about the pace of Leon’s work.
September 8, 2026 at 09:23
I don’t know how everything will play out.
September 8, 2026 at 13:28
Judge Davila has ordered the government to respond to REL’s Motion to Enforce by 3pm PDT tomorrow, and has set a hearing for 9am PDT Thursday. Sounds like he’s a little more aware of the time pressure here.
September 8, 2026 at 14:18
Hi! Where is that information stated? Today’s motion states that the government has until September 14th to respond, and Rel has two days’ notice to respond if applicable. And the hearing In person on October 9th! That’s why I’m asking where you saw that information, because it will be interesting!
September 8, 2026 at 15:00
Curtis published that info and you can see the motion notice on Pacer
September 8, 2026 at 15:55
Thank you! That’s great news!
September 8, 2026 at 05:30
There are 20 days left until September 30th. What do you think, is there a chance that 2NL will come?
September 8, 2026 at 09:22
You know my answer.
September 8, 2026 at 15:33
I don’t know anything. I only know one thing, that today is September 8th. Nothing happened.
September 8, 2026 at 04:17
London DV-2026 selectee here. Missed my July interview due to medical exam timing, was told to let it lapse and rebook. Since the August 28 Medani ruling and the DOS page confirming the pause is lifted, I still can’t get a new appointment shows ‘System is busy’ every time, and when I call, they say no appointments and to keep checking. The embassy also confirmed by phone they have no manual ability to book everything’s online-only.
A few questions:
1. Is there a known backlog/timeline for booking systems to catch up post-Medani?
2. For someone who missed and needs to rebook (not a first-time booking), is there a different process or contact than the standard online system?
3. Given ~4 weeks left, is there a point at which it becomes genuinely too late?
Thanks kindly
September 8, 2026 at 09:21
1. I don’t know embassy specifics.
2. I don’t know
3. September 30th
September 8, 2026 at 00:35
Hi Simon,
I’m on approved 221g and had to redo medical.
Just informing that the Clinic sent Tokyo embassy the new medical reports and soon after that also emailed me. This afternoon I saw
Case updated: September 8th, 2026.
Would this indicate the embassy has received it and updated my case file?
Thanks
September 8, 2026 at 09:20
Maybe. We can’t know for sure what the updates mean.
September 7, 2026 at 16:08
Hi Simon,
I’m a DV 2026 selectee. I should have had my final interview on the 1st September, but they emailed me on the 30th August saying it had been rescheduled. Do you think there is a possibility that I will get my rescheduled interview before the September 30th deadline. Thanks
September 7, 2026 at 22:16
I hope so, but obviously I have no idea about specific cases.
September 8, 2026 at 08:30
Hello and thank you so much foryour advice on DV-2026 cases.
I’m a French citizen but a resident of Mexico, so my case is handled by Ciudad Juárez. I had my interview in December and everything was approved, but my visa was placed on hold solely because of the DV pause.
I’m currently in France, and my previous medical has now expired. I understand I would need to return to Mexico and redo it, but the medical center won’t even schedule an appointment without an official request from the Consulate. So far, Ciudad Juárez hasn’t responded to my emails or calls.
Given the September 30 deadline, do you think it is worth booking flights back to Mexico now in the hope that the situation moves quickly enough, or would you wait for some confirmation from the Consulate first?
Thank you so much to share your views !
September 8, 2026 at 09:24
Given the expense/hassle I would probably wait – but you have to decide what YOU want to do.
September 7, 2026 at 13:31
Do you expect things to shake up during this week? What’s the latest possible date the government could send new 2nls if they choose to do so? What was the latest in similar situations in the past? Thanks.
September 7, 2026 at 22:16
Yes I hope to see movement this week – but we’ll see.
September 7, 2026 at 10:56
Hi Mr. Simon,
The Nepal embassy is not responding at all and it’s already 7th September. So, is there still hope that they will issue visa to 221g?
September 7, 2026 at 12:56
Yes
September 7, 2026 at 09:27
Dear Simon,
Do I need explicit permission from the embassy to do the remedical (i.e., update the medical)? The embassy has not replied to any of my emails, but the approved physician has allowed me to update the medical.
In this case, is it fine to do the remedical if the medical is near its expiration date without embassy explicit permission (they also do not oppose it)?
September 7, 2026 at 12:56
Different embassies have different rules, but you should decide what gives you the best chance.
September 7, 2026 at 08:01
Hi
Is it likely that the opening of the DV-2028 registration will be postponed?
September 7, 2026 at 12:54
It would not surprise me.
September 7, 2026 at 06:18
Hi, I think your site got hacked. Sometimes (maybe around 20–30% of time) when I open your website, it shows a page asking me to prove I’m not a robot. When I click verify, it asks me to run a malicious script on my computer. When I refresh the page, the verification page disappears and the site works normally.
I noticed this only happens on a Windows desktop, not on mobile (probably also not on macOS).
September 7, 2026 at 12:54
Some plugins seem to have vulnerabilities as this has been happening for a while. My domain hosting service is working on it.
September 7, 2026 at 05:28
Hi Simon, I asked you about this case on 20 and 25 February. Jerusalem, DV-2026, refused 19 Feb under 203(c) plus a separate 212(f) letter. You told me that if Bagrut is routinely required for university entry I might have an uphill battle. I took that seriously and I am not asking you to re-argue it.
Two things have changed and both are in your area rather than mine.
1. The 212(f) letter cites dead law. It says my mother was found ineligible under 212(f) “pursuant to Presidential Proclamation 10014 and Presidential Proclamation 10052.” Both were revoked by Proclamation 10149 on 24 February 2021. They were the 2020 COVID labour-market orders and never applied to Israel. Israel is not designated under 10949 or 10998 either. 22 CFR 42.81(a) does not list 212(f) as a refusal ground, and Sooknanan held in August 2025 that 212(f) does not authorise visa refusals. It looks to me like Jerusalem papered the DV pause with a five-year-old template.
2. Medani. The 28 August order directs DOS to reconsider applications “refused solely under the DOS DV Pause or the DOS 75-Country Pause.” Ours was refused on education as well, so I assume “solely” puts us outside it. I would rather hear you say it than guess.
On the education point, briefly, so you can weigh it. She holds the 12-year completion diploma, no Bagrut. In 1995, aged 21, she was admitted to and completed a course at a CHE-accredited academic college, co-certified by the College of Management, both accredited by Israel’s Council for Higher Education (che.org.il), with no Bagrut and no mechina. The honest weakness is that it was a 320-hour certificate programme, not degree-track matriculation. In 1993 only about a third of the 12th-grade cohort held a Bagrut, so this was the majority pathway.
Three questions:
1. Does Medani reach a case refused on education grounds, or does “solely” exclude us?
2. Have you ever seen a post reverse a 203(c) education refusal on supervisory reconsideration?
3. Have you seen 212(f) letters citing PP 10014/10052 at any other post this year? If Jerusalem used a 2020 template to paper the pause, that seems like something Curtis would want for an enforcement motion.
23 days left. Worth filing, or is it over?
September 7, 2026 at 12:53
1. You would not be covered by Medani.
2. Yes, but there is no chance of that with the chaos that is about to happen, and nothing has changed about the refusal.
3. 212f is being used for the current 39 country ban and is not being challenged. Immpact challenged the non issuance aspect, but that won’t be any help in your case.
September 7, 2026 at 02:48
Hi Simon!
I got married on Friday (04.09)and requested KCC to unlock my DS-260 to add my spouse. I believe this will require his background check and may cause a delay. Just wondering if there is still a tiny chance to get scheduled before September 30 with such update?no 2NL yet, and quite high case no. EU39xxx. I have a feeling that we are done now :/.
Cheers!
September 7, 2026 at 12:43
You are at risk, not so much about the derivative but just the lack of 2nl.
September 6, 2026 at 14:10
Hi Brits, I am from Fiji and our case number is current for September. We haven’t received our 2NL. When do selectee for case number for September are expect to receive 2NL?
September 6, 2026 at 18:43
They should have been sent before now. So you have a risk that they won’t schedule an interview. All you can do is hope they send some more 2nls.
September 8, 2026 at 04:21
Thank you Brits.. you have been so helpful this past few months.
September 6, 2026 at 13:43
Hi Simon, greetings from Bolivia! I am a DV-2026 selectee and a Medani plaintiff, currently on 221(g) since April. My medical examination expires on October 10th. Would you recommend that I renew my medical exam, or do you think there will be enough time for them to issue the visa? Honestly, I’m hoping to receive the visa before it expires and travel to the U.S. immediately. Thanks a Lot!
September 6, 2026 at 18:41
Yeah you don’t need to renew as you will have time.
September 6, 2026 at 23:32
I’m in a similar situation, mine expires on the 8th. However it says on the embassay website that it takes 3-5 working days to print out the visa, so I’m worried about the time if I get approved closer to the end of the month. What do you think? Or am I misunderstanding the printing part?
September 7, 2026 at 12:40
Relax about the printing.
September 8, 2026 at 00:17
I’m thinking the same thing. If I get approved/issued closer to the end of the month, and they need those lets say 5 days to print it and mail passports back to me, having the medical expire around 7-8th is very close. Can you explain how you see it? Maybe we misunderstand it?
September 6, 2026 at 06:48
Hello Simon,
As with DV27 we are now waiting for hearing on 24th, I was wondering if there is anything that government can use to postpone opening of DV28 which should normally happen in october.
September 6, 2026 at 09:09
Yes of course. Same exact thing they did in 27.
September 5, 2026 at 20:18
Hello sir Simon,
My medical expired so I booked my medical on 8th sep but there is no any info from embassy till now. What should I do? Like should I do it on my own or reschedule it and wait for the info from embassy?
September 5, 2026 at 21:04
It’s a choice you need to make for yourself. There is no “right” position.
September 5, 2026 at 15:23
Simon, today I spent the whole day gathering the documents that might be needed for the interview. But to be honest, I’m preparing all these documents without knowing whether I’ll ever get to use them. If you were in my position, what would you do? Would you keep preparing them, or would you give up?
September 5, 2026 at 21:00
Of course I would not give up.
September 5, 2026 at 14:50
Hello Simon. Most grateful for your relentless efforts to help others on DV lottery issues. Most grateful.
I am a Saito and Chersak Plaintiffs. I’ve so far sent 4 emails to my embassy with the court order, among other useful documents hopefully get them to start working on my case or start process on DV cases since they never scheduled any case for Ghana thus far. But as usual U.S embassy in Ghana has decided not to get to work on DV issues. My case number is AF3000. Can you kindly advise on what approach to use as time is far gone for DV 26 program.
Many thanks Boss.
September 5, 2026 at 20:59
Accra is going to be tough. I think you have done All you can for now, let’s see if things change once DoS gives the embassies guidance.
September 5, 2026 at 11:52
1-
Will the 2028 US lottery open normally without obstacles? I’m talking about 2028, not 2027.
2-
For a new immigrant, which city in California would you recommend, or would you recommend another state?
3-
What profession would you recommend I study in America that offers a very good income?
4-
Is 7 months enough to learn English? B2 Level
5- What mistakes did you make in America that you wouldn’t make again and would like to share with others?
6-
What car would you recommend an immigrant buy in the first few months? I don’t like buying a car with a bank loan.
7- Which European country would you recommend I immigrate to if I don’t win the American lottery, and what profession would you recommend in that European country? I don’t like university education.
thank you
September 5, 2026 at 20:57
Great questions, but I will have to answer 2 onwards in a couple of days.
1 I don’t know.
September 5, 2026 at 08:42
Hi Simon,
Our interview is booked for 8th September! In London we got the reschedule email last week as everyone else did. Medicals already done document all checked and processed….. I have been emailing the embassy and visa info daily and have had the same automated almost scripted non personable email replies of :
“Your Immigrant Visa appointment has been rescheduled. You will receive email confirmation of your new appointment date and time. Please do not appear at the consular section until directed to do so with a rescheduled appointment. We apologize in advance for any inconvenience that this may cause.”
I keep replying back in hope they might just give in (I’m doing everything!) … Same automated response comes.
Now my interview shows status “attend appt” on the visa registration and shows as ready on CEAC… I don’t know whether it’s worth the chance in hope before Tuesday at 8am my interview could be reinstated that quickly or rescheduled! (I could be clutching at straws now I know).
Could the judge, dos, embassies etc work over the weekend to be notified of any immediate change? (Especially as I know is a holiday weekend in USA?)
Plaintiff with Ivanov also.
I know you cant give a prediction and sorry to even ask (maybe I’m trying to seek comfort or reassurance!) but do you have any advice about the motion that was put in last week, how quickly the judge may move or the embassies may move after the judges response .. …
Or maybe whether you feel me going to the actual appt Tuesday 8th is even worth the chance? Knowing the “do not attend at the consular section on the email reply”.
(From a very anxious, holding on to every piece of hope and positivity possible family here in the UK!) 🫣
Thank you as always (and sorry for the long post!)
September 5, 2026 at 20:25
You can certainly keep checking for updates until a Tuesday. Maybe the cable goes out and the embassy has time to adjust its procedures. Slim chance given Monday is a holiday…
You could also pretend to have not received the cancellation and turn up, but that would likely be a wasted journey.
Frustratingly we will probably see a change midweek ..
September 4, 2026 at 14:21
Hi Simon!
In comparison to DV2020 (I know it foolish to draw conclusions especially during COVID), how long did it take from the court order to visa issuances? Many people are relying on AI to give them the info (albeit false).
I see US visa news and USCIS have updated their DV guidance but the cable to embassies still seems to lack behind…
September 4, 2026 at 17:44
It was fast – and they scheduled 7k interviews. The response we have seen thus far is poor – but hopefully that will change very soon.
September 4, 2026 at 13:55
Do you think it’s pointless to attend the interview on the original date? Should I wait for it to be rescheduled?
September 4, 2026 at 17:43
It’s a very fluid situation. At some point they will start interviewing – so keep doing whatever you think helps you.
September 4, 2026 at 11:24
Hi Simon, really hoping you can help me.
I am a DV Lottery selectee 2026 (non- plantiff) who had an interview scheduled for the 3rd of September which was then rescheduled to the 27th of August and rescheduled again however no final date was confirmed, and then the appointment was cancelled on Sunday. My original appointment is still registered on the https://ais.usvisa-info.com website as being on the 3rd of September. There is an option on this website to select missed my appointment which states “Submit a request to the consular section to schedule a new appointment. Only use this option if you did not attend your previously scheduled appointment.” Should I select that I have missed my appointment or should I wait and see if I get another rescheulded appointment from the embassy in the coming days (If I select missed my appointment I am worried I may get removed from the rescheduled system)? Would you advise me to do anything else in the meantime besides this to get an appointment with the embassy in Dublin, Ireland.
I really appretiate your help thus far, thank you in advance.
Megan
September 4, 2026 at 17:42
I imagine they would not accept the rescheduling at this time, but hopefully that position will change within a few days. But do whatever you think helps.
September 4, 2026 at 10:14
Hello Mr. Simon,
I am on 221g and the plaintiff of Medani lawsuit.
I sent an email as per the template provided by Mr. Curtis Morission to kathmandu embassy. However, they didn’t send any response. Do you think they will grant us visa?
September 4, 2026 at 10:37
I hope so – but we have to wait and see.
September 4, 2026 at 08:12
It’s foolish to sue the State Department to force them to open registration for the 2027 US Diversity Visa Lottery. I’m certain the State Department will win; they’ll simply justify it with technicalities like adding a dollar amount, passports, or website glitches, among other excuses. They’ll also claim the fiscal year has ended, making it illogical to open registration for the 2027 lottery. Attorney Curtis Morrison should have been prepared to file a lawsuit against the State Department only if they didn’t open the 2028 lottery, as the State Department would then have no valid excuses to offer the judge. In my opinion, Morrison should have waited until November 1, 2026, and then filed the lawsuit immediately. He would have won 100% of the case because the lottery is mandated by a congressional law, and the State Department is obligated to open it.
September 4, 2026 at 09:08
Yeah, it seems you have an opinion, but no understanding. Let’s leave the lawyering to people that have that qualification…
September 4, 2026 at 04:28
H Hi Simon! Has Curtis filed a motion with Judge Davila to pressure the State Department to reschedule the canceled September appointments?
September 4, 2026 at 09:06
Not that I know of.
September 4, 2026 at 03:45
Hello Simon,
ALBANIA CN 16 I DON’T HAVE 2NL
PLAINTIFFS IVANOV.
IS THERE ANY HOP
September 4, 2026 at 09:06
I don’t know what each embassy will do for each circumstance.
September 4, 2026 at 01:36
Hi Britsimon,
It’s 4th September still there is no green card issuance. Since 221g cases are mostly affected by 75country pause and dv pause.
Pause is also officially lifted still no visa is being approved.
What are the chances of getting green card for them now?

Hello Simon,
Could you please explain the Motions to Enforce in the Ivanov and Medani cases?
After the judge takes action, what will the process be for the named plaintiffs? Specifically, in the Medani case, how will the relief apply to the named plaintiffs, and what steps will follow?
Also, once the judge issues an order, will the government be required to take action immediately, and what can we expect the government to do next?
Thank you for your help and clarification.

The motion is a request to the Judge to get him to increase the strength of the order to compel the government to act. The Judge may or may not agree, but if he does, I am not sure how exactly he would word the strengthened order. We have to wait and see.

That mean cruits did not wait for sep 24. Cruits will refine agreement with in 2 week and judge will give the decision is am right . If yes when will cruits refine..?

There is another hearing on the 24th – so I guess Curtis will work on his case between now and then.

Is it even legally possible for the DOS to simply ignore the court’s orders in the Ivanov case, even after September 8? Charles Kuck says he has never seen anything like this in his 36 years of practice.
Can they really just ignore Leon’s ruling/order and drag this out until September 30? Does Leon have the tools and authority to force them to act, even if the DOS simply refuses to cooperate?

We are in uncharted waters. You ask if is legally possible – no. But the question is how far are the government willing to go to refuse to take action. There could be consequences – but who knows whether they care about that. I guess we will see over the coming days.

What would the consequences be for them?

Let’s hope we don’t have to find out.

Why judge denied for DV 2027.? Is they are waiting for state dos will announced entry period before sep 30
September 3, 2026 at 17:25
Before a Judge will consider the arguments there is some technical stuff to see if the plaintiff has the right to sue. That is the bit that the Judge did not accept, but he has given Curtis three weeks to refine the arguments.

Hi Simon,
Whats your thoughts on the TRO being denied for DV2027? Seems like the gov has won this which is pretty unbelievable with them breaking their own laws but getting away with it.
September 3, 2026 at 17:23
Curtis has to fix the standing issues to even be able to get into the arguments. Hopefully he can fix that. The PI timeline is nice and fast.

Will the non plaintiffs also benefit from the release of the pauses or the P.I?
September 3, 2026 at 17:22
Yes – the Medani case covers the classes, which are plaintiffs and non plaintiffs.
