The AILA is the professional body for immigration lawyers in the USA). They have started the process to challenge the immigration ban in a class action lawsuit. The obvjective would be to get a Federal court to block the ban, and I think there is a pretty good chance to do that, given how unfair the ban actually is, and the irreparable harm it does to people around the world.
I have agreed with the AILA to gather some willing DV participants to the suit. They would like a good sampling of participants from around the world, and different visa types, so that they can demonstrate the broad impact and affected people. There is no cost to become a plaintiff – they are doing this work without fees.
So – I have created a simple online form where you can record your details to be considered as a participant on the lawsuit. Your information will be viewable by me, and made fully available to the team of lawyers at the AILA – so it you are not comfortable with that, please don’t complete the form.
They will not use everyone from the form – they need a good sampling of cases. If they win, the benefit will be for all – not just those that participate in the suit.
So – it’s a simple form – please take 5 minutes to fill it out and the AILA team will reach out in due course.
To be clear the READY for scheduling email is the one that starts like this:
“Congratulations! Our records indicate that you have submitted all required documentation to the Kentucky Consular Center and are ready to be scheduled for an interview when your case number becomes current. Interviews are scheduled numerically based on case numbers that have completed processing.”

I had my interview March the 3rd, every went well. Except for a celibacy certificate.
The officer told me everything is alright, you only need to send us by mail your celibacy certificate.
I sent them my passport with the celibacy certificate and the translation a couple of days before they were closed.
I still haven’t heard anything of them, except for a status update 2 times on the status check website, showing refused.
I know refused dosen’t mean anything.
– Am I concerned by the ban? I know the the Visa gets issued starting from the interview date?
-And If so, can I complete the form, or I’m not concerned?

Hello BritSimon, we appreciate your effort in a decent lawful way of trying to resolve the problem with the ban to the US.
My question is my country(Kyrgyzstan) was banned with proclamation 9465 by the Department of Homeland Security in January 31 of this year, I am a winner of Diversity Visa 2021, and I feel unfairness giving this opportunity and at the same time taking away restricting our country from this, representing myself as a law-abiding citizen, with good intention in a broad life aspects to achieve a certain level of personal and professional development I would be happy to use this opportunity and to be a key part of that environment where I wanted to be.
This lawsuit is it eligible in my case to be a legitimate participant taking note that this proclamation 9465 which was implemented way before this immigration bans?

The best idea for you would be to wait until the presidential election happens. If Trump loses, we will hopefully see a dismantling of the bans in January and beyond. That is your best bet.

the important thing is , by law by book “{bec many dv 2020 selectees have benefited from this lottery and they got their visas so this , will be a strong point for you in the court} , so i thing the lawyers will have a big chance at least to get a verdict that includes ” issuing visas but not entering during the ban “.
As in most countries, an order can not cancel a law approved by the senate ,it can delay the implementation of this law but not canceled and especially this program is restricted by time , so i think the result will be to issue the visas and delay the entry to USA until the ban finishes.

Hello Brit! Very thankful of your work here, i learned a lot through your website. I hope everyone contributes with donations as you are very helpful.
I have a few questions and hope its not a repeated one even though i couldnt find it anywhere.
1.If the ban is not successfully challenged then it mean its over for DV2020. I read somewhere here that its not legally possible to extend the deadline of 30 September for interviews. Well with that in mind, how its possible that they delayed DV2021 answers? Was that legally possible? Does the law that regulates DV lottery state the number of visas issued in a year? (The point is to understand if they can do something about changing the rules as this year is so unusual)
2.The process has not been cancelled but suspended. Has there been any precedent year where visas meant to be issued were not? I mean around 50,000
3. Doesn’t make much sense to me that someone selected loses his chance because of running out of time instead of a completed number of issued visas. Doesn’t make much sense either that they can’t postpone the process deadlines and on the other hand start another DV year with other selectees without dealing with the ones of previous year. (Always in the case of not completing the total number of Visas of the current year)

1. Not sure I fully understand the question. Are you asking why they are allowed to delay DV2021, but cannot extend the deadline. Well there is nothing that forces them to give out all the visas, or perform some number of interviews each month. So – they can have a slow start, or in this case stop interviews for the first three months, but in any case they cannot extend the end date without changing the law.
2. As said in 1 – there is no law that states they have to use all the visas.
3. Sometimes the laws don’t take into account what we think is sensible.

No one here has said DV2020 is cancelled. It will continue for cases of people already in the USA. But almost all DV cases are blocked by the ban.

1. We have enough plaintiffs now and I will shortly be closing the form. The AILA team are staggered and impressed by the response – we have over 1100 willing participants in less than 24 hours. It is clear that many are impacted by this ban, and AILA wanted me to tell people they have been heard and will be fought for.
2. We don’t go direct to the supreme court. The ban was implemented as of midnight last night – how could we have been any faster??
3. I cannot predict the likelihood of success as a percentage.

I feel so empty now and very unfairly treated. My case was at the embassy ready for interview. I understand DV lottery is not a right, it’s a privilege. But if I was interviewed and rejected, that would be fair. But in fact I won the lottery, I prepared everything and they scheduled me. I think now they have some sort of obligation to interview me. And if it’s emergency situation all over the world, they should give me and others alike the possibility to be interviewed at a later date, albeit the September 30 deadline. That’s common sense. And I hope lawyers will do something.
Also, if the ageing-out thing of 21 years old was mentioned in the Proclamation, why don’t they also consider the September 30 deadline? It’s some sort of discrimination. If 21 year old are not affected because they will loose the possibility, why don’t they include us as well? We are also losing our chances. So there needs to be some equality, right?

But Curtis said that one of the outcomes of the mandamus could be that the judge would say to put the mandamus visas in “a box” to be issued after the 30th of September. Do you think Curtis is mistaken and they can’t save those visas for people after the 30th Sep?

Hi All, here an Italian guy trying to find a personal explanation to the recent events that have hit our lives worldwide! My situation: I have received the ready for scheduling, case became current in May, but no 2NL has ever arrived.

Theoretically speaking Visa issuance is allowed for the cases inside USA and the proclamation is suspending the entry of new immigration visas. Also, interview could be established in any country while the applicant can have a valid residence in that country for the period of processing his visa after the interview. So,what is the problem exactly with that situation?

I don’t understand what is confusing for you. Adjusting status comes with some “catches”. One is complying with the terms of the visa when you enter the USA. With a B1/B2, the purpose of entry is defined and there is an expectation and commitment to leave the USA by a certain date. Adjusting status is allowable if circumstances truly change, but if you enter the USA and try to adjust a week later, you clearly lied when you entered the USA because you had a plan to adjust all along. Which – clearly, is your plan.

The embassy in my country literally closed the day my wife and I were having our interview. We arrived at the embassy just to be turned away and told they were not open till further notice. All that after we spent time and money to get all the documents and medical checks needed just to hear that all that would’ve been for nothing.
We pray all goes well with the lawsuit and the judge sees it fit for us to be granted this privilege.

I have an additional inquiry. I hastily filled my DS 260 form on the first day of the announcement and later on have re-opened my forms in order to make some revisions. In the meantime I sought your advice and you told me my best bet is stay till November’s election. My question is whether it’s alright to keep my DS 260 forms reopen towards the end of the year or there’s a time limit to re-submit? I should also mention that a few days after my forms were reopened I received an email asking for supporting documents.
