Quick question, why do they say “until at least September 30, 2023.’
Does this mean there are many draws made and that if today, 7th of May, some pwople check and get not selected message, does this mean there is still chance for these peoole to be selected?

In some years they select a low amount of winners to start with, and then reveal some more later (around September/October). It doesn’t happen every year.

Winning is difficult that’s why after winning they should try and issue the Visas to all the winners.
I won the dv2021 with a case number of 35k254 but was not scheduled.
I rather stay in Africa than to be applying in the name of America.

Hi Simon – two quick questions mate!
I am in a domestic partnership/civil union with my girlfriend (not legally married). I read that this is NOT recognised as a spouse/being married by the USA, and I put that I was unmarried on the application.
1. Firstly, am I correct in my above assumptions or am I disqualified?
2. If not disqualified, I want to include her as a partner and it looks like we need to get formally married. Can you confirm that is correct, and if so, is this necessary before the interview or BEFORE even filling out the DS-260?
Any advice will be greatly appreciated!

1. You chose correctly.
2. Earlier the better. You could submit the DS260 as single, then add her later, but whether that is worth it or not depends on your case number and when you would get married.

I applied for the 2023 DV Lottery and got selected. However, I only included my wife and 15 year old son in my application. I have four kids aged 25, 23, 19 and 15. I only included my youngest in my application and my other kids applied for an entry on their own. Will this affect my application and interview? Also my wife has been staying in the USA for over 5 years now as a non immigrant. Are there any violation of immigration laws that can affect my application as a primary entrant? Can I enter my other children on my DS260 form? I don’t really know how to go about this and I would appreciate any help.

You broke the rules by not entering the 19 year old. That mistake is fatal to your case. You will be disqualified. Additionally if you wife is living in the USA without correct immigration status, then she will have a bar, and that would also be a problem. I recommend you do not proceed with the case, because the only way to do so would be committing immigration fraud with a lifetime ban as a consequence. I’m sorry.

My dear Simon,
I am currently an international student in Canada, now that they have won the DV 2023 program and I went to Canada by scholarship and this is my first year in Canada so the scholarship says i should study for four years.
However, my birth country Sierra Leone is eligible for DV.
So, my questions are:
1) now that I have won DV2023 can I still proceed the DV process here in Canada even though I have 3 more years of studying and when Canada isn’t eligible for DV?
2) I mean will I be allowed to leave my studies and travel from Canada to the U.S ?
3)and if none of the two questions is no, what is the safest way to grab this long time American dream opportunity through DV2023?

3. Well you will go through the process of DV2023. Depending on your case number that might take up to 18 months (minumum 6 months). So in that time, continue on the present path, then switch your studies to USA when you have the DV visa.

Thank you for all the really useful material. I was selected for DV2023 OC24xx. I know this number is “at risk” because it is above 2,000.
Is my understanding correct that for the past few years the Oceania region has gone “CURRENT” which means that effectively all selectees can be called for interview (assuming their DS260 is in order)?
Does this mean 24xx is a slightly better chance given how the last few years has gone?

Congratulations. Yeah, that is a high number. DV2020, DV2021 and DV2022 were very dysfunctional. Embassy closures, messed up processing by KCC, Trump bans and so on. That dysfunction contributed toward the regions going current. So – you can’t really compare those years. I hope DV2023 will run more normally, but then if it does, we will have to apply the math that predicts the cutoffs. But right now we don’t have the data we need for that. So – for now, enjoy the news, and over the coming weeks and months we will know more.

Submitting the DS260 is a declaration of immigrant intent – so that can make future non immigrant applications a little harder. Because of that, you might want to wait for a while to know more before you submit, but you would not be able to wait too many months.

Numbering questions works best.
1. Yes you can marry and be added. She can submit now, or get married then submit. With that case number there is time for either way.
2. All numbers seem high this year. THat either means a high selection year OR it might mean more holes. But we don’t know the number of selectees yet, nor the max case numbers in each region, so it is FAR too soon to be speculating about chances for any case numbers.

I am one of those still waiting for the DV2020 reserved visas and now got another chance or another bloody period of years 😀

Yes they have access to the previous form, BUT it is understandable that you changed your work. However, be sure you can meet the education requirement, because being a boxer won’t meet the requirement.

In normal years (pre-2020), did the visa bulletin going “current” mean that those with high Case Numbers were no longer at a disadvantage and were called for interviews as long as they were document qualified? Is the fact that Europe went current for June for DV 2022 mean that those with high CNs for DV 2022 should no longer worry?

Yes that is how it is supposed to work. DV2022 is a mess, and lots of cases will miss out, especially some high case numbers.

Hello Brit – Just discovered you on YouTube after my stepdaughter was selected in the 2023 lottery. We immediately jumped and filed her DS-260 yesterday (despite the site repeatedly crashing) and felt like we were in good shape. Our initial excitement over her selection became a bit more measured after learning more about the process and how the government can run out of visas before all eligible parties have been issued one. My stepdaughter’s case number is 2023EU32XXX – which appears to put her in the pretty-darn-high end of the EU allocation.
Following on the question above, if next year’s VB also goes “current” for EU around mid-year, would that mean that my stepdaughter would be called for an interview? I know you can’t make promises or predictions – we’re just looking for some reassurance that her high number doesn’t nullify her chances of being called for an interview.

The Visa bulletin is supposed to control the movement of the number in a logical way to achieve a couple of things.
1. Spread the workload out over the full year
2. Allow the visa office to calculate remaining demand and measure that against remaining supply of visas.
In theory, when the visa bulletin shows current, it means that remaining demand can be satisfied by remaining visa ability. So – if they have over selected this year, and operate the processing and scheduling correctly, then that could mean that we don’t see current. On the other hand, if they mismanage the processing, the demand is underreported to the visa office, so the VB is moved (incorrectly) to current. In that scenario, people who are current miss out.
That scenario is playing out right now in DV2022. Regions are current, but many cases will be left without interviews. So – it is too early to make predictions about DV2023 as we don’t have the number of selectees, nor the highest case numbers. So all I can say at the moment is “wait and see”. I will post a video hopefully tomorrow to explain some of that in more detail.

Brit, Thanks for the time you take to reply. Can you speak to why 2022 is going Current in June for most regions – but you’ve stated that “they have mismanaged the processing and demand is underreported at the visa office”. Do you have any details on what has happened there, exactly?
There was (in EU, at least) a huge jump in the cutoff number one month, then, no change the next month and now are expecting “Current in June. If this isn’t really what’s going on at KCC, if you know, what actually *is* happening… and why do you think they’re mis-reporting?
Those watching this process would like to understand how it goes off the rails so that we can know if it happens again in subsequent years.

The visa office is supposed to take in to account the number of visas left, and the cases that “want” visas. IN DV2019, DV2020 and DV2021, KCC under reported the demand because they introduced the document procedure which caused delays and backlogs in processing. So – since they were reporting cases that were ready for scheduling, and they were being too slow with processing cases to that point, they were giving the visa office the impression that not many people were applying for the visas. So – that is what underreporting does – it confuses the VO.
Now, in DV2022 they “tore up” the manual and introduced a pilot program which removed the requirement to submit documents (the process that screwed up DV2019 onwards). That meant cases could be processed faster, but there were also lots of embassies that were not opening and if they were open they had deprioritized DV visas compared to other visa types. So again, they looked at this mess and said – of screw it, make everyone current, and let the embassies do the best they can. It isn’t correct or fair, because it removed the priority for case number, but it has allowed them to partially recover to a place where they will issue most of the available visas.
There are loads of ways this can go off the rails. I’ll spot that and discuss it on my videos. You’ll pick it up over time.

So, I’m curious (and ignorant) about what happens when they throw everything open for all case numbers by calling the cutoff “current”. There are still only 50K-ish visas – so who gets invited to interview for the remaining visas when they’ve basically turned things into a free-for-all?
As I understand it, KCC is the body that determines which specific people in each region receive an invitation to interview… are they just working their way up through the case numbers as fast as they can (without any upper limits) until they get to 50K-ish invitations offered?
If you don’t have the time or the will to explain their internal workings, that’s fine… I’m just trying to understand, now that I’ve got a player in the game.

with your CN (mine is EU30XXX) at least we gonna keep ourselves (or the creative part of our brains) busy and in state of hope (or desperation). I say that after playing this game for such a long time the mere notion of winning was pretty dope. A lottery is a form of gambling that involves the drawing of numbers at random for a prize. We have been selected but there is another chapter opening (lots of uncertainty). We gotta stay calm and trust it will turn out okay.

That did NOT happen in DV2022 – so the story you heard was nonsense. It would only happen in an underselected year – so we don’t know yet about DV2023.

My father one of the winners in the DV US lottery, he has experience more than 30 years in banking and finance, but he lost his high school certificate. We checked his job profession and we found it within the range 7 and higher so it is a qualifying job.
What does he need to submit during interview for the qualifying job? are they only the experience certificates from the banks?

He should be prepared to prove his current role through a CV/resume, employment confirmation, salary details and so on to establish the role and the time he has been in the role (at least 2 years)

Dear Mister Simon, thank you so much for your videos. I have been randomely selected at the DV lottery, and my case is a bit special. I was supposed to go study in the US in 3 months, and I have my F-1 visa interview next Friday. I wanted to know if you would be able to tell me if I can carry on the 2 applications and go study in the US, or if I have to delay my studies, cancel my F-1 appointment and follow the whole DV process?

You could proceed with both applications. Your DV case won’t be current until late this year (2022). If you get the F1 you could even enter the USA foirst, then process via adjustment of status when your number becomes current.

Filing a DS260 is a factor that the officer might consider for the F1 application. But it’s a factor, not a certain denial.
Yes you need to remove the leading zeroes on the CEAC site for DS260 submission.

The rule that required people to use a valid passport was blocked by a Judge earlier this year, so it won’t matter. You will of course need a passport for the process and the interview – so get that now.

I’m a selectee for 2023 DV lottery , I have a valid 10 yr multiple tourist US visa , the last time I was there I was allowed 6 months stay , I ended up staying an extra 10 months. I now am a resident of NZ. Will any of this affect my visa application? Thank you in advance for any advice.

The passport rule was blocked, so you can continue your process with no risk. I know EBM Scholars is saying otherwise, but he is incorrect.

You might want to consider adjustment of status, but it is critical that you have never been out of status. If you have then you are safer to leave the USA and process in another country.

Hi Simon! My spouse has just won the DV lottery and we are currently proceeding with the DS 260 form, and I have a quick question. We are currently residing in Canada to complete my higher studies and my spouse is on a work visa. Yet, our born country is Sri Lanka. So please advise us when filling out the DS 260 form, if we mention the Canadian Residential address as the present address, does it mean that our interview would be held in the U.S embassy in Canada or held in the country of origin, which is Sri Lanka? Hello Brit, I am 19 years of age and winner of DV23 as I am still under 21 can my parents apply with me ? how does it work do I go alone ?
As I am on F1 and if I go for CP will the visits to my home country cause any complications between DS261 filling and F1 status traveling ?

If you are the winner you cannot take your parents through the DV program. It would take years to bring them later.
You can process CP, OR process adjustment of status in the USA. Filing the DS260 could make future F1 or other non immigrant visas more difficult.

Just one more clarification: as you said future NIV would be difficult, but as I already have F1, if I do CP would the travel to and from US also get impacted ? can they stop me at the immigration when entering US ?

Brit now I am now confused, in Sm1smom threads there was a mention if we travel on F1 and our Ds260 is filled then at the CBP officer may block entry to US … is it a possibility ?
Also one more question my room number or dorm change every semester so from the time of application of DV23 it has changed and will change again will that cause any issues ?

Nathaniel, it means that you were not selected in this year’s lottery. You can apply again in October for 2024.

Hi Simon,
For a selectee who doesn’t have the passport document for their kid, would you advice on the DS 260 they choose “OTHER TRAVEL DOCUMENT” and submit the 260 as they try and get the Passport and then later request for UNLOCKING Ds 260 to update the same information once they finally have the document? Or is it better to wait and fill when you have the document? CN AF19K

Hey brit , this too had for me ,my wife is a winner dv 2023 by a good case number which can even be called in the second visa bulletin because it’s AF 2565 but I was a winner before in 2019 though wasn’t scheduled but she was indicated on my form that’ she is married to me , she is a winner 2023 but all of a sudden she applied saying she is single .brit we so stuck really stuck .what’ do we do plz I need your help , what step can we take , how can we bring back this to us
