DoS have now issued an extremely clear statement explaining exactly what can and can’t be done for DV 2020 cases. It is saying almost exactly everything I have been explained since Friday – so it’s great to see it clarified and posted so fast. The statement will also be matched by cables to the embassies to explain how they are to be handled.
The one thing I do not see in the statement, that I would have preferred to see is the wording relating to mission critical processing. However, the statement says the following “that the Department must make good-faith efforts to expeditiously process and adjudicate DV-2020 diversity visa applications by September 30, 2020″ – the emphasis added by me. This should be enough to wake up any resistant embassies.
Update: they confirmed the cases are mission critical.
However, the more damaging aspect of the statement (and also an email sent to the legal team regarding named plaintiffs), is the statement regarding the five Covid travel restrictions (China, Iran, the Schengen Area, the UK, Ireland, or Brazil). The statement says the restrictions remain in force, that is correct and not challenged by the order. However, the policy (and email) say that people at embassies in those areas will not be issued visas because of the travel restriction. I believe Judge Mehta covered this under his ruling showing the no-visa policy as being unlawful, and point 1 of the order (in my opinion) was crafted in a way that should allow issuance of visas including within the five restricted regions (as listed). I have reached out to the lawyers to get their insight into that, and will report back anything I hear. I have further suggested they seek clarity from Judge Mehta on this point. However until that clarity is received, people within the five listed areas will still be blocked by the policy, so I hope the policy will quickly be changed, one way or another.
So – now you should start to see some movement from the embassies, but remember all the things I have explained in my updates about how each group should behave. Once KCC opens later today, they should be aware of this policy change and start to make their efforts to help where they can.
The statement does make clear the following (does not apply to people in the restricted areas of China, Iran, the Schengen Area, the UK, Ireland, or Brazil):
- Embassies could process re-issuances (group 1) immediately but new medicals will be required to ensure the validity period is useful.
- AP cases (group 2) can be adjudicated (assuming the AP is completed), but again a new medical will be required.
- Cancelled interview cases can be scheduled by the embassies if local conditions allow – embassies should do this expeditiously – so make sure you stress that to the embassies and get emergency/mission critical appointments. Again, get a new medical.
- People ready for scheduling (group 4) need to contact KCC and possibly the embassy. As I explain in the video below, you can speak to KCC and the embassy at the same time – try to book your appointment with the embassy and then all KCC have to do is send the case electronically to the embassy, that might speed things up, especially in embassies where there are a small number of cases.
- Group 5 people have the greatest risk still – so by all means push KCC, but the chances are small to none without an extension.
- Travel will not be possible while the proclamation is in force, which is why people should get new medicals to allow travel into early 2021.
- September 30th is still the current deadline so all of what is said above assumes that deadline will remain firm. If an extension is granted, things will obviously change, but don’t bank on that, as it is unlikely (not impossible, but unlikely) to happen.
- I reached out to the legal team this morning and whilst they are taking different approaches, they are all working on this. YOu can choose to participate in Curtis’ DV3.0 lawsuit BUT you can also get help from the AILA team as they will be giving Judge Mehta as much information as possible where the government has not used best efforts to help ALL selectees. Our Embassy is in London. So we are still affected by the ban. If this is due to covid, UK and Schengen areas have relatively very low covid cases compared to the other parts of the world.
September 30 deadline is very tight to do medical and interviews.

I called the Embassy in Dakar this morning to confirm and all they could tell me is that they are not processing DV2020 cases. What’s your advice on this please? Considering the time we only have 21days to go and also need to do the medicals before the interview.

Exactly, Because when I visit the designated hospital to get the medical first time. They asked for the appointment letter and the DS260 confirmation. I specifically asked about the medical over and over again in my emails to my Embassy, they did not say anything about the medical. They only told me , once they receive the instructions from DoS, they will start processing the Visas immediately.

Thanks Mr Brit. I am trying to contact my consulate (based in a Schengen country to clarify). For the affected countries (Schengen, Brazil etc.) the statement says “ …. will not be issued an immigrant visa, unless excepted under the relevant proclamation or until they have been outside the affected region for 14 days.“ So technically it seems possible if you are outside those regions for 14 days. Again, I’ll contact the consulate to clarify.

I am one of the plaintiff of Mohammed vs Trump. Yesterday DOS took someone of us , choosing a list of 100 people and said us to choose anothers three embassora instead of our because they said that we are in Schengen area or because local conditions don’t permit interviews and issuing of visas because of where we are, but this is not true Because I know that my embassy , Naples ,(I am from Italy) started again with Issuing visa students and other types from 17 of July… and this is Clearly an excuse to make all more difficult for us. Also because they said us that to give our visa issued , even if in another foreign country, we must be outside
From Schengen in the last 14 days. So what? Should I leave my country right now and stay 20 days in another country waiting that DOS choose between the three embassies that I have chosen and KCC send me my 2NL and in case, leave again the country where I am to be outside Schengen area and go to the country where I have to do my interview?
This is impossible , also we don’t know how medical procedures works in another embassy, but at the same time I am afraid because this could show to the judge that they have tried to help us but we didn’t go to the interview in a different country or we didn’t accept to spend a month in another country to do our interview. Curtis abandoned us, he didn’t care anymore , he didn’t give any help. This is unfair.. DOS is not working in the right way and they are using again a Ban to block the issuing of visa .
What should I do?
Even if I leave now my country , I will not be able to do my interview before of 25/26 of September because of the 14 days.. it seems as an impossible goal , right? Also if kcc schedule my appointment before of 25/26 of September how can I attemp my interview if it have not been passed the 14 days? Help please

Hello Simon, I had a valid DV visa on 23 April, which expired in May. On latest update it says that “DV applicants are reminded that if they were either in the United States, or held a valid immigrant visa on April 23, when Presidential Proclamation 10014 went into effect, they are exempt from the Proclamation”

I just called KCC inquiring about what is the current situation with them now that this guidance have been issued and the lady there told me that they haven’t received any communication from DOS, so there is no action been taken further… and told me to call by friday to see if there is any change…

1- KCC says:
“Currently, we have no info, and we have not received instructions to proceed with the DV cases, call next week” !!
2- Here’s the automatic reply from the Riyadh Embassy’s email:

Just hung up with KCC, day 2, still saying we have no guidance on how to proceed from state department, even when I pointed out the update that says they should proceed with scheduling.
What would be terrifying is scheduling in order of processing, high case numbers like mine would be ruled out, AS24k.
Embassy says awaiting further instructions.
Question though, how long does medical results usually take?

Medicals typically are ready in a few days.
JUst FYI – you are not safe yet. No one is – not everyone can be helped. So – keep pushing, but have your eyes open too.

Absolutely right, won’t leave a stone unturned.
I’m calling daily and pressing with options, asked the embassy if they can get me a placeholder appointment to schedule medical, cancel it if things don’t work out, if they can proactively pull my case from KCC, i asked KCC to move my case forward asap, all to no avail but will keep doing that.
On a side note, I was really frustrated with document processing, they were doing it numerically where many cases were not even being pursued by applicants but they deliberately chose the slowest method possible, and if you recall they were slowing down interviews because ‘applicants may finally pursue their applications and create backlog’ which never happened.
I’m just worried the guidance KCC receives will be similar here too, our embassy has 15 DV cases and most definitely able to take more, they’d have to wait until all other embassies accept other cases with numbers lower than mine, like Nepal, you know what I mean?
Anyway, hoping for the best for everybody.

Even though there is an update in travel.state.gov about the DV-2020, the embassy (US Embassy of the United States in Bogota); where my interview was scheduled, sent me a reply like 5 minutes ago that they are not processing any immigrant visa appointment. They made reference to the presidential proclamation again. What you recommend me to do? Should I keep emailing them everyday?

Yes – try again tomorrow – they obviously don’t have the instructions from State yet, or they have them but have not changed their responses. That’s expected – things are moving very fast.

The problem is that I must have my interview in third country, because US Embassy in my country only make nonimmigrant visa interviews. I can not go to another country because borders are clothed and flights are not available. I do not know what to do. What is your advice. How this problem can be solved. im EU34K and I m in Brits category nr 5 and just today i received the “ready for scheduling email” from KCC. Im also one the named plaintiffs in morrison first lawsuite. as for the “ready for scheduling email” dosent mean anything right now because of the five regional PP regarding COVID i just wanted to share this to let everyone know that things are happening at KCC. Firstly; a big and much praises to the Maker of all creations.
We must understand why many embassies have given negative response is due to the present situation(the proclamation they have been given to operate on) they are dealing on with. But as of now since the DoS has giving a guide lines it’ll soon be changed and will soon work with the guidelines because they’re under the command and control of the DOS. Let’s all stick to the advice of Brit and thoroughly working with it throughout.

The AILA team chose a handful of the people who responded to represent other similar cases. So no – you are not a “named” plaintiff. So – you can benefit, but don’t get the additional prioritization.

“DV applicants whose medical exam has already been conducted but will expire prior to December 31, 2020, may opt to submit a new medical exam prior to visa issuance” it means applicant medical exam has been conducted but report was expired, can submit the medical report after the interview but before 31th Dec. 2020 ?
