DoS have now issued an extremely clear statement explaining exactly what can and can’t be done for DV 2020 cases. It is saying almost exactly everything I have been explained since Friday – so it’s great to see it clarified and posted so fast. The statement will also be matched by cables to the embassies to explain how they are to be handled.
The one thing I do not see in the statement, that I would have preferred to see is the wording relating to mission critical processing. However, the statement says the following “that the Department must make good-faith efforts to expeditiously process and adjudicate DV-2020 diversity visa applications by September 30, 2020″ – the emphasis added by me. This should be enough to wake up any resistant embassies.
Update: they confirmed the cases are mission critical.

However, the more damaging aspect of the statement (and also an email sent to the legal team regarding named plaintiffs), is the statement regarding the five Covid travel restrictions (China, Iran, the Schengen Area, the UK, Ireland, or Brazil). The statement says the restrictions remain in force, that is correct and not challenged by the order. However, the policy (and email) say that people at embassies in those areas will not be issued visas because of the travel restriction. I believe Judge Mehta covered this under his ruling showing the no-visa policy as being unlawful, and point 1 of the order (in my opinion) was crafted in a way that should allow issuance of visas including within the five restricted regions (as listed). I have reached out to the lawyers to get their insight into that, and will report back anything I hear. I have further suggested they seek clarity from Judge Mehta on this point. However until that clarity is received, people within the five listed areas will still be blocked by the policy, so I hope the policy will quickly be changed, one way or another.
So – now you should start to see some movement from the embassies, but remember all the things I have explained in my updates about how each group should behave. Once KCC opens later today, they should be aware of this policy change and start to make their efforts to help where they can.
The statement does make clear the following (does not apply to people in the restricted areas of China, Iran, the Schengen Area, the UK, Ireland, or Brazil):
- Embassies could process re-issuances (group 1) immediately but new medicals will be required to ensure the validity period is useful.
- AP cases (group 2) can be adjudicated (assuming the AP is completed), but again a new medical will be required.
- Cancelled interview cases can be scheduled by the embassies if local conditions allow – embassies should do this expeditiously – so make sure you stress that to the embassies and get emergency/mission critical appointments. Again, get a new medical.
- People ready for scheduling (group 4) need to contact KCC and possibly the embassy. As I explain in the video below, you can speak to KCC and the embassy at the same time – try to book your appointment with the embassy and then all KCC have to do is send the case electronically to the embassy, that might speed things up, especially in embassies where there are a small number of cases.
- Group 5 people have the greatest risk still – so by all means push KCC, but the chances are small to none without an extension.
- Travel will not be possible while the proclamation is in force, which is why people should get new medicals to allow travel into early 2021.
- September 30th is still the current deadline so all of what is said above assumes that deadline will remain firm. If an extension is granted, things will obviously change, but don’t bank on that, as it is unlikely (not impossible, but unlikely) to happen.
- I reached out to the legal team this morning and whilst they are taking different approaches, they are all working on this. YOu can choose to participate in Curtis’ DV3.0 lawsuit BUT you can also get help from the AILA team as they will be giving Judge Mehta as much information as possible where the government has not used best efforts to help ALL selectees. My spouse is in the US on L1, and I am with him on B1. If the Embassy re-schedules our interview, we go back to our country. Let’s assume they issue visa. We can’t enter and activate our DV visa till December 30.But can I enter the US on my B1, and my spouse on his L1?
I mean once we get our DV visas, does this mean automatically we are deprived of our other existing visas, such as B1 and L1?

He has a job in the US… So if he travels to homecountry to get DV visa, but I assume it would be possible for him to enter the US on his L1. Because the DV visa will not be active anyway.

Hi Simon, the court order seems to show effect: I received my “Ready for Scheduling” email today. As if KCC had it in the drawer but didn’t act on it. Contemplating the options for three alternative embassies, I have further questions:
1) Is it possible to schedule the interview in a Non-Schengen country, but have the medical here in Germany? Or is the medical linked to the location of the interview?
2) Would it help to immediately travel to the US from the Non-Schengen interview country to activate the LPR status upon entry? Or is this not possible until my recipient address receives the greencard? Because if it helps, I would consider to just travel there right after the interview and get it over with. And if the Greencard takes 4 months by mail, just pick it up sometime next year… making sense?
3) MOST IMPORTANTLY: Today travel.state.gov has stated that the named plaintiffs are getting priority processing. Frankfurt has few cases left, so I do see a chance to get an interview. If I stick to Frankfurt and dont transfer the case, I understand that my greencard application could be approved at the interview, but an “immigrant travel visa” (DV visa?) denied, therefore blocking me from travelling and activating the LPR. What is my option then regardless of lawsuits? Can I not get the travel visa after Sept 30th? If this puts me in a dead-end, the transfer of the case is really the only reasonable move I see here.

1. DoS doesn’t seem to challenge Judge Mehta’s ruling. Also, Judge Mehta has not given TRO on PP. Does it mean that DV2021 process will proceed further without any stagnancy? Will visas be issued to DV2021 winners in spite of immigration & travel ban only thing is that beneficiaries won’t be able to enter US until bans are lifted?
2. Does it also mean that DV2021 winners lost only one month of processing i.e. October 2020 apart from that business is as usual?

I have one question. I knew some Japanese DV winners went to Guam to activate their visas on their passport in June and July and they succeeded to activate them. I saw their passports and they got stamps from immigration. I believed that we already had the immigration ban at the time. I wonder how it could ever happen. We’re in group 3 (Russian, but live in China). I’ve got a rejection letter yesterday citing the proclamations. Then this morning the consulate called me, and we have medical and interview scheduled. And then in about two more hours I get an e-mail telling me about DoS guidance and asking me to consider giving up that interview slot. Frustrating, to say the least… No plans to give up, of course and hoping that will be rectified – i.e. visa issued but no entry unless spent more than 14 day in the areas not covered under the proclamation.

Brit, that’s what I’ve been pondering since yesterday. Without losing Chinese visa and losing my job – nope, not possible. And possibly we won’t be able to get out of China at all in time anyway… Most of the neighboring countries won’t let us in or would require visas, Russian borders are closed and there are no flights… It’s a bit of a conundrum, I’d say. At least a couple of named plaintiffs on one of the cases are in the exact same situation (Russians in Chna), far as I can remember. So I filled out the form and hope for the best…
That’s what you get for trying to comply. Was it not for my efforts to get all those police records from all around China, would’ve had our interview long ago…

Hello Simon, pardon the message, but very urgent. I have followed up with the US Consulate by phone and they have escalated my case. On a practical ‘numbers’ issue, I have contacted the 2 medical centers designated for the visa checkup. One takes 7-10 working days(exclude Sat and Sunday) and the other takes 14 working days to process the medical results. The second clinic is almost certainly not an option due to time, unless I can get a Visa Interview scheduled on 29th/30th by today. I called the Medical Center and was advised to attend the interview tomorrow, and I’ll be given some form to follow up with the medical exam next week- something along those lines. Honestly, I have nothing to lose as there is no guarantee of another time slot. Folks, please prepare your documents beforehand- I had to rush this afternoon to have my visa photo taken. I can’t decide for you, but the only thing you can control right now is your location. So – I would get out of the Schengen area to an area where there is an embassy that could interview me. Don’t forget you may need translations of documents and a medical in that country.

Brit, yesterday I called to KCC and the lady told me that my documents have been processed and they will send me confirmation as soon as possible. After few hours when Morrison’s plaintiffs received confirmation letters I decided to double-check. It’s amazing that the same girl answered me but at this time she told me that my documents haven’t been processed, as they told me they received it in July, which is nonsense. I told them that I have saved their mails and auto replies and I would use them as proof. What should I do? How at first time she could see that they were processed? Am in the same situation or even worse called kcc and was told they cant see my documents, I have sent these documents 5 times and recieved an auto reply at all times that my documents are recieved and are being processed. Followed up a couple of times and was always told to wait until the ban was put in place and the response changed to we are no longer processing dv2020 cases. After the judge’s order I call to follow up again I get told that they don’t see my documents. I resent them yesterday but as I can say it’s just humble. I can just pray for an extension. I sent documents on Jan 17, April 25, April 27, May 2nd and May 14 and these guys still tell me they don’t see the documents. I did everything the right way and surely am also now saving their auto replies as proof just incase I need it. Am really frustrated.

If you were not one of the 7 on the AILA cases and not named on the other cases (Charles Kuck/Curtis Morrison), then you are not one of the named plaintiffs.

i response as above from US embassy Nepal. I am unclear that named plaintiffs means both whose name on Gomez V. Trump case complain file document on court and all who fill up the form in past for plaintiffs. could you explain little more?

This is the reply I got from US Embassy Nepal. To clarify, I am not a named plaintiff and my visa interview was schedule for 22 April. I wrote them an email asking for special consideration as my wife is 35 week pregnant and we reside outside of capital city where the embassy and medical authorities for visa is not located.
Dear DV applicant,
Unfortunately, we must schedule interviews in accordance with Department of State guidelines. All immigrant visa medical examinations must be completed at the designated panel physician location. For Nepal, this means that all immigrant visa medical exams must be completed at IOM in Kathmandu. Additionally, per U.S. Immigration Law, visa applicants are required to appear for an interview in person.
Interview cases will be prioritized in accordance with the guidance cited in our email below. Given the limited numbers of days remaining in September and Post’s limited processing capacity, we are hopeful that we can interview the cases which were originally scheduled in March. However, we cannot guarantee how many visa interviews we will be able to conduct. Therefore, it is essential that we follow the visa scheduling guidelines.
We thank you for your understanding and regret we cannot give a more positive reply.

As per my interpretation, the embassy made it clear that unnamed plaintiff whose visa was perilously appointed after March have no chance at all. So I think I have the only option left to join Curti’s DV 3.0 ..

US Embassy Nepal just updated their site
Consular Operations:
The consular section is currently only scheduling emergency citizen services. If you have an urgent need, please contact the consular section by email at [email protected] or through the Embassy main phone number at (01) 423-4000.
At this time, the consular section is only able to process emergency cases, official visa cases, and a very limited number of cases that do not require interviews.
Additionally, the consular section has authorization to process mission critical immigrant visa cases whose beneficiaries are spouses and children of U.S. citizens

Hi Brit,
My spouse is a DV2020 selectee AS12xxx. Her interview was scheduled in March, however, her x-ray result required further investigation so that interview was postponed. She got the medical cleared after 2 months, then COVID situation and ban made the interview impossible.
Now she got an email from the embassy, for interview appointment next Friday. After a few email exchange with embassy, they said we need not present medical result in the interview, however, CO mentioned that she may require the same medical examination process which include sputum test (which lasted 2 months in previous exam). CO also indicated the medical result including these further test must reach the embassy by 30 Sep. Sounds bad.
I am not expecting an answer but any advice or comment from you is helpful indeed.

Dear Brit thank you for your efforts really appreciated. I had an interview and got canceled in April from Egypt and I call them everyday and they say that they do not do interviews for lottery visas and they do not respond on emails. Really don’t know what to do in such case.

Technically I (main applicant )am in Group 2 as visa was not issued after interview in March but My Spouse was in Medical Hold and her Interveiw was cancelled , so she is in Group 3 category.
In this case, I have already send an e-mail to emabassy regarding my case but Do i need to send a another e-mail from my Spouse ID regarding re-scheduling her cancelled Interview ?

Hello Simon,
I am one of Fonjong plaintiffs, I am Italian but based in UK. I am speaking here on behalf of a larger group of people (some still at KCC, some waiting for the 2NL, some with an embassy appointment date scheduled then cancelled), no matter the phase we’re in, we are being refused progression and issuance due to us being in the Shengen area.
We’ve tried to ask assistance to our lawyers (Mohamed/Fonjong) because we agree with you on what you said, (quoting) “Judge Mehta covered this under his ruling showing the no-visa policy as being unlawful, and point 1 of the order (in my opinion) was crafted in a way that should allow issuance of visas including within the five restricted regions (as listed)”, but they just don’t want to listen.
They keep pushing up to leave our homes (where some of us are trying to shield from the coronavirus), leave our pets, even worse leave our jobs on the spot (who has employers that accept such short notice to take time off or resign? And if for any reason we don’t get a visa after all this mess, who is going to help us find another job in the middle of a worldwide pandemic?????), take our families possibly including children on a flight to a random location which might not be the final one that will (maybe) accept to process us and seize our passports until the paperwork is finalised, and wait, for days, for weeks. Nobody has idea, and once you come back, another 14 days quarantine for coming from outside Shengen.
We know that Charles Kuck is being amazing in this moment and he seems strongly willing to take this issue to the Judge but at the end of the day, he’s not our lawyer.
Do you please have any suggestion for our group, what could we do to put some sense back into our lawyers’ mind before it’s too late?
They tell us is the the only solution given by DOS and “rest assured the fight for extension is not over”.
We DON’T need an extension past the FY when it’s unsure visas will be issued as it’s in contrast with the law (Almaqrami limbo nightmare). We need our lawyers to show the Judge – NOW – that DOS is putting us at risk and making it IMPOSSIBLE for us to go on in the process, contrarily to what he clearly ordered.
We feel completely dismissed in favour of the research for an extension which is secondary in this exact moment.
Should you have any suggestion for us, it’d be much appreciated. Thanks for your precious help.

Actually you are being foolish, and if you really want to make a smart choice you would travel outside the blocked area right now. The lawyers will fight the UK/Schengen decision, but winning is not certain, and there is little/no time. You don’t like Curtis’ answer, but he is making sense. In a few days the opportunity to start a 14 day clock will be gone. You are wasting valuable hours and days, because you think the advice is bad or uncomfortable. Get out of UK/Schengen, and in a few days if the lawyers overturn the Schengen bans you could return, but if you don’t get out now, you will be screwed. Take all documents with you, be prepared to get translations if needed and make sure you have proof that you entered the other country.

I received my “Ready for Scheduling” email today. I’m plaintiff in Mohamed lawsuit and I’m not in Schengen area. (Bulgaria )
“Congratulations! Our records indicate that you have submitted all documentation required by the Kentucky Consular Center and are ready to be scheduled for an interview when your case number becomes current. Interviews are scheduled numerically based on case numbers that have completed processing.
Interviews for the DV 2020 program are currently suspended. You can find out more about this suspension at travel.state.gov. All DV 2020 interviews must be concluded by September 30, 2020. Please refer to the visa bulletin at travel.state.gov to locate the current numbers being processed. This bulletin is updated after the 15th day of each month. Once an interview date has been scheduled, you will receive notification via email listed on your DS-260 to check dvlottery.state.gov.”
I wrote them to forward my case to the embassy.
What can I do more? I can’t make appointment for medical before to have date for interview.

I’ve already called the KCC and the lady said that if we are not the named plaintiffs we are not going to be scheduled anymore and we should try again in DV 2022… I told her that our embassy has such a capacity to handle our interview and that we are in a group 4 of the categories published on the DoS website. It didn’t change anything and she still said that they’re not going to do anything else if we’re not the named plaintiffs. What should we do now? We have our documents confirmed and just are waiting for the interview.

And Ugandan embassy doesn’t handle DV visas.

It is totally unfair considering I live in Chile a country that has few cases and we should fall in Category 4! Called KCC and they confirmed they will process only Gomez vs Trump cases. They said they have never received any documents for my case number. I told them about the several followup mails as well as calls in previous months, the lady said she can’t do anything about it.
Going to keep calling them everyday until Sept. 30 !

In group 5 your only chance is an extension. Please don’t waste their time calling every day. They need that time to help other people who can be helped.
