DoS have posted about the lawsuit, explaining that they will do their best, but won’t be cancelling any other cases in order to prioritize DV cases. They are giving instruction to all the embassies and the embassies have started updating their websites.
Some people are surprised and disheartened by the wording of the announcement (which is here) but you really shouldn’t be as it is exactly in line with the Judge’s order, and exactly as I fully explained in the first 10 minutes of my live session from a couple of days ago (below).
The point is this. We will hopefully see a few more interviews arranged in the next few days, but there won’t be many. There is no time. What we need is a good number of visas reserved by Judge Mehta, which I believe he will do at the end of this month. So – stay calm, and stay patient. Focus on the reservation of visas, not the assumption that some have made of a flood of interviews before the end of this month.

Hi Brit, First to comment in this post. Im so happy with Judge’s final order.Im from Srilanka and as all of you knows our interviews gt cancelled at the last moment. With the order we can have interviews. Colombo embassy already started scheduling.. If you can contact him.. pls inform judge that we owe him for this order and we almost gave our hopes at the moment when our interviews gt canceleld.

YEP, that’s exactly what the judge said in his order but the lawyers pretended to forget about it 😉 So that’s probably why a bunch of people are going to get disappointed. Also, contrary to what some lawyers are saying, you CAN’T push the consulates into doing anything which means that the preservation we’ll get later this month won’t likely address that either. If your consulate doesn’t want to do anything for xyz reason, you simply won’t get your visa. Pure and simple.

They must be very careful with any dates they agree for DV2021, but the tier4 won’t apply to those cases at least.

I’m a dv2021 winner (Goodluck client), and i got my 2NL few mins ago. I need your advice in order to be well prepared before the date.
I’m legally married, but for some reasons we are about to divorce. While filling the D-260, last year, I answered NO to the question « Is your husband immigrating with you or will he join you later ».
I had a baby on march of this year and in the same month i sent an email to the embassy to inform them since my ds-260 couldn’t be unlocked because I was ready for scheduling.
My first question is, since i was the one to declare my child and he bears the father’s name do i need any autorization letter from him to take to the Consular and to travel with the baby?
He actually lives in France.
My 2nd question is how much money do i need in my account and which documents should i request from my host in the USA ?

Dear Simon Thank you for all you do. I was DQd May 4th for DV2021 with OC 607 but Sydney went into lockdown as you may know and closed the Consulate now ( only one I am told by USTraveldocs that processes immigrant visas in Australia so have stalled as couldn’t leave country to transfer).
Sydney have advised no more DV2021 interviews before Seot 30th 2021 so only chance is what is happening with preservation order.
I am trying to find out about the Bill that you said might be the only hope if it’s wording does not change given class action dropped and I was not a plaintiff as only belatedly found out about them?
So any news on that Bill? Are you planning another Facebook live Q and A to update after September 23rd ( though I think you said Judge Mehta is more likely to report later now) Otherwise will just try again for DV2023.

In the lawsuit it looks likely there will be a reservation of visas, but it is looking like that would only benefit named plaintiffs.
The law change is not approved yet and faces a longer battle with an uncertain outcome.

Dear Simon Thank you for your answer. Waiting for the Bill then seems only option unless I try to file an Individual lawsuit. I wanted your advice around this latter option if you have time.
So far I have contacted a friend to find who he used as an individual to become a citizen. He was a colleague who went in on a J-1 visa for PhD study at Caltech but he ended up with a job in Baltimore and now lives there so he may have a law firm that would do it due to proximity.
There is also a Law firm called Kameli and Associates in Chicago who may be going to take a number of Individual suits. I am yet to speak to anyone in person and I received emails from two email addresses when I did a contact from their website Ad.
One email had kameli.com as the stem on the email so I think is legitimate.
They only wanted confirmation of having won the DV lottery which I sent along with my DQ email but their office hours were closed so it may have been a clerk and she has gone home. I also asked her to verify the other email from Vahid.
The one from Vahid came from a gmail address [email protected]
I asked a few questions about cost and what was required and they sent the following

Hi Mr Brit. A DQed GOH plaintiff in South Africa but current interview location Accra, Ghana.
1. Would u recommend a case transfer from Accra embassy to SA should visas be reserved and I get scheduled in Accra as I am currently residing and working in SA.
2.How long does it take for a case transfer to finalize given that both embassies are willing to facilitate the process.
3. Are there any unforseen dangers to the inter-consulate transfer process.
4. Should I decide to go to Accra for my interview, Will the 14 day restriction still be applicable to me.

1. It should be held where you live unless there is reason not to do that.
2. Not long, but it varies.
3. They can screw up the process.
4. No – you are exempt from that restriction even in SA.
