I have been undecided about posting this. Part of me wants to wait for official corroboration, part of me says people need to know what is going on.
Over the last few days there have been a number of reports that people are being told that DV-2017 visas are exhausted. Iranians have been told that from Abu Dhabi embassy, an OC region selectee who had to reschedule his appointment was told that, and now two separate AoS cases have been told the same thing.
For consular processing cases, when the case is scheduled, KCC allocates visas for each person they expect to attend the interviews. The embassy has that visa allocated and must use it or return it by the end of each month. If the case is placed on AP, the embassy must return that allocated visa at the end of the month – meaning cases that stay on AP from one month to another need to get a new visa allocation later on when the case is finalized. If a case is refused, the embassy can re-use those visas for other people who are finishing AP, or they simply return those visas to KCC to be re-allocated.
So – there is a difference with all the cases that have been told there are no more visas. They are either:
- Adjustment of Status (AoS) cases, processed in the USA
- Cases where AP is finishing
- Cases where someone rescheduled an interview with the embassy from an earlier month.
In all of those cases, there is no pre-allocated visa – and THAT is where the problems are showing up.
I phoned KCC today. They did NOT say they were aware of this ending of visa numbers. They did confirm they cannot set any more interviews – but that is not a surprise. So, there is a small amount of doubt that this is final. But if you are in one of the three positions above (AoS, finishing AP, trying to reschedule), then there is some risk that you cannot be granted a visa.
***IMPORTANT*** If you have a September interview – ARRANGED BY KCC – then there should be a visa allocated for each person in your group. PLEASE do not ask me about that scenario. Those cases are not affected.
I am searching for a more definitive statement, but in the meantime – at least you know as much as I do…
***Update 14th September***
We now have reports from multiple people that they are being told visas have run out. This affects all regions. My comments above stand – if someone has an interview scheduled in September (not re-scheduled), that person should have an allocated visa. All uncompleted AP cases or rescheduled cases will be told there are no visas UNLESS the embassy has some visas in their allocation for the month of September (which would only be where other cases were refused).
For AoS cases, the door seems to have closed completely. Several people have now been told the visas are exhausted, and one selectee received a denial notice that says as follows:
“On Friday, September 8, 2017, the US Department of State released a memorandum effective immediately informing that no further authorizations will be made in response to requests for Diversity Visa (DV) cases for the remainder of fiscal year 2017 because the maximum level of numbers which were available for use on a worldwide basis for DV applicants during fiscal year 2017 had been reached.”

I am not sure if this is related. We were scheduled for an interview this Friday, but we received a voicemail yesterday from the district office that our interview is cancelled and we should receive a written notification in a few days. We had submitted our AOS applications in October 2016.

Thank you for all your help! My Husband is the main applicant of 2017 DV winner from ***IRAN*** .We got our visa last week after nine months on AP. We had our interview on January 05 in Montreal and since then were put on AP till August 16 when we received a call from Embassy that our AP is cleared and we need to act very fast on getting a new medical and new police clearance since it was more than six months and both were expired 1 we were told an e-mail will follow but they called us to give us a heads up! everything was done within one week and sent to the Embassy and got our Visas last weeks! We have dual citizenship and the travel ban did not effect us much! I feel very bad for others that went through all the costs and other stuff and there are no more visas left for them ! I wanted to ask you about your oppinion, i have receive today a phone call from the embassy asking me why we did not attend the interview today however I was not informed by any mean that I was meant to have the interview. They have sent me a letter on 7th september with an expired date for the interview. Then the lady from the embassy told me to call the doctors and make an appointment and to give her a call back in order to reschedule the interview. 20 min later she phoned me again and told me that thre is no need to book medicals as all the visas are gone. Then I wanted to speak to someone who cpuld explain me how come I was not informed for the interview and the gentleman over the phone told me that I am actually lucky because even I attended the interview there was no chance I can receive a visa so I actually saved some money this way. The woman over the phone told me that on they system shows that on the letter they have sent me the date was correct but when I told her that i have the letter infront of me she told me that it was a ‘technical glitch’. I have already sent an email to KCC DV explaing them what exectly happened and what I have been told by the Embassy ( the American Embassy in London which actually made so many mistakes on my application and my case was dealt so unprofessional). A ‘technical glitch’… really?! No letter stating date af time of the interview and then 20 min later it is all over. I wanted to ask you if you think the KCC will check what went wrong in the Embassy in London?

I was given interview on 8th march but i was 39 weeks pregnant so after informing the embassy they told me to inform them when the little one is born and they should let me know how to proceed further. Since then all comunication was through emails between theEmbassy and myself. My case was completed by kcc and forward to the embassy. OK – so I usually advise people to NOT reschedule – even at 39 weeks you would have been better off to attend the interview. Your visa was allocated (reserved) for you in March – but once that went into the following month, you lost that allocated visa – and also you lose the special arrangements for scheduling for DV cases. That is what created the problem. You might think the embassy handled it badly – but you put it into their hands to handle it badly.

Simon, It was really frustrating the fact that they were saying we were actually happy that we saved money from the interview. I belive somebody there has not done the job properly. I keep all the corespondency with the embassy including the information i was giving them and the information they were typing, for example saying the interview date is changed however they only changed the time,sending me 2 letters with wrong information, spelling my son’s name after having his birth certificate and all his details…

I’m winner algerian friend couple(36000) who recently(yesterday) received an email from the US consulate in Algeria saying with regret that they won’t be able to give them visas(DIV lottery) because the number of DIV 2017 visas is reached!!!
They have been refused at the first time because they asked them proof of mariage, after sending them pics and also provided them with a good affidavit of support, they still refusing them.
Before a day or so they received a call from them saying please resend more pics and another I-134(the previous one has over 54K income).
This couple was going back and forth with emails until yesterday when they told them, it’s over!!!!
Do you guys know somebody faced this situation before?? And any suggestions on how they can apply for a claim??

Max EU numbers of DV2017 are around 30,000. Speaking for Europe, if the visas ran out at 30,000 (DV2017), then 40,000 cases for DV2018 (EU) are really over selected. It’s a bit frustrating.

I am from Iran selected on DV-2017. Had the interview at Abu Dhabi along with my wife on 8th December 2016 and my case put on AP. On 21th of August passed AP but we had to do medical tests again and on 27th went to consular with my wife where we were told we must have proof of close family or job offer at US and still have time until end of September. I got a job offer and find a family of my wife and went to consular for third time on 12th September but been told that it has run out.
Is there anything I can do at all?

The status of my visa application was “issued” on 29th June but after the new law, it got back to AP as i didn’t have any family member in the US. My husband won the 2018 DV and we happened to learn about it when I was in the US with our kids and we had filled for Asylum already. We all completed the DS 260 and submitted and a response was sent to me that myself and the kids will attend our interview here in the US and that KCC Was not incharge of scheduling our interview as I should visit the closest consular office and set one up. As for my husband KCC said they will set up his interview.
I went to one and was told that they will wait on the US state dept as it was their domain. Do you have any advice to throw my way?
Can myself and the kids be interviewed before my husband who happens to be the main winner?
Do I qualify to apply for AoS ?

You should discuss this with your lawyer. But derivatives normally interview with the main selectee. If that isn’t possible (because you are not free to join your husband) then he will probably need to process the DV case on his own, move to the USA and sponsor you both through family based immigration. I don’t know if that would be faster than the asylum case or not. You cannot adjust status on the basis of his win without him here, and he cannot come here with the intention to adjust status.

Yes, it was scheduled for the first time, so i don’t know why that happened, and they didn’t even say anything till now… That day two families attended to the interview and we both were approved. We submitted our forms in early june, because i haven’t noticed that i won till may 26, 2017.
They sent me the following email:
Unfortunately, on September 7, 2017 we received notice from the Visas Office in Washington DC indicating that the maximum limit of 50,000 visas for the Diversity Program was reached, so that no other request.
We understand that this is difficult news, however, it is important to keep in mind that being randomly selected for the Visa Lottery or Diversity Program does not guarantee that the individual receives a visa, that selection only demonstrates that the individual is eligible to apply to the Program. All DV applicants are subject to the same rules and emission limitations as are codified in section 203 (c) of the National Immigration Act (INA).
We invite all those selected for DV2017 who did not receive a visa to re-enroll for the DV 2019 Program in the fall of 2017.

The same thing happened to me. I was told by the immigration officer that my visa was approved, and I got that e-mail as well. Did you get a reply from KCC? I am thinking it is some sort of glitch from the system because of the way we register to get our passport back. Please let me know if you have gotten any reply. I do not know if I should contact the embassy. Is there any way of knowing the status of the visa itself?

Well I am glad someone is saying “something” but the letter will not get any result. It is full of misunderstandings and errors, but most importantly it disregards the reality that visas have run out. Embassies and Field offices have been instructed there are no further visas available for cases where a visa is not already allocated. Given these cases are on AP, those cases cannot be issued.

Which in my opinion , the visas never ran out , it doesn’t make any sense , according to your own statistics 2017 lottery had the most visas available and the least selectees, it has to be some political bullshit behind all of this. How is possible that kcc could not predict visa availability. according to the visa bulletin they published,it is obvious that they had more visas available than all the remainder selectees. Hi Brit,
I understand that other applicants can follow the main applicant in entering the US and not the opposite.
My question is will be there any problem if the other applicants enter the US while the main applicant is not physically in the US at the time of their entry?

But that would not have happened if you had applied earlier – you would have been interviewed much earlier.

That is not true, our number became current in Oct 2016 and we sent our application in Oct 2016. After all USCIS. Is not as organized as you might think.
We placed several requests on the file and also asked for congeressional help in June after many infopasses and futile requests. They just ignored all these and scheduled us for the interview in Sep 2017!

So – you did adjustment of status. That is entirely different to 95% of DV cases. In your case the long delay was probably due to background checks.

So for eu region case number 39xxx might be impossible. Thas so weird to make it with that much gap.

Hi Brit,
I was a DV lottery winner and my appointment got canceled at the last minute after i did the finger printing. I’m wondering if it’s possible to get reimburse if I didn’t get my green card because of the memorandum. I had to pay 1140$ plus 330 $ fees before for nothing and I would at least like to get my money back. Do you know if it’s possible and where I should ask ?

Hi Brit i have been refused visa am a 2017 case number but my main problem is that i was refused based on my education qualification which i had D7 in english and E8 in Maths but i know of people who had the same results but were issued with visa in febuary and march.Thats comes to mind that i believe they have run out of visa so they start making it very tight. what do you think i should do

Hi mr simon my husband was dv2017 we had the interview in may they required additional documents we boxed them in june our case was ready after two weeks and remained ready without update until the last month they update the case on 16th and 18th of September but still ready
Until now they didn’t contact us or said that no more visas we called and emailed them but get nothing our passports and birth certificate are with them what do you think about this

They will send back your passports soon – but you will not get the visas.

My visa was issued and printed on february 17, 2017. I checked that on “cheking my visa status application”. Though I haven’ t receive my passport yet. The ambassy keep telling me that my case is still under review. The question is how can a visa be printed and under review at the same time?! Can it be an error made by the application?! Whenever I check, the notice tells me that ” your visa is printed…” am I still going to get a visa!? Does the running out affect my case?

Hi BritSimon I got the same thing happening. Interview 24 august then officer ask for extra STD test then officer was called away to help out people in Texas because of hurricane Harvey the we in FL got hit by Irma (+ office closed for 2 weeks) and then a denial letter !!!
That they ran out of freaking Green cards.
We did the AOS through winning the DV lottery.

What more can I tell you? It’s a horrible set of circumstances, but there is nothing you can do about it. It sucks.

Apologies if I’m rehashing the obvious.
My interview was OCT 4th in the UK, I had to get ten additional information which I’ve now presented this week – but are you saying that all visas are now gone so regardless I won’t get the visa?
The embassy has my passport and all other docs from the interview.
Any info appreciated.
