Judge Mehta has issued his order on the Gomez case. He has instructed the government to issue the DV2020 cases until the 9095 visas are used.
There will need to be some details worked out about timing and how it will work, so it will be a week or two before we know all the details, but this is awesome news!!!
Video below with some of my thoughts and answering some questions about the Judge’s order.

Hello Brit,
I am a DV winner 2020 with case number AF35xxx, since I submitted my documents to KCC, I have not yet gotten a response. I have resubmitted assuming they didn’t receive still no reply.
My question is now that the judge has reserve these visas, what’s my fate, do I stand any chance?
October 8, 2021 at 03:00
I don’t know.
September 30, 2021 at 09:06
hi brit,
winner DV2020
case number AF555xx
ready for planning
plaintiff gomez
1- the 7509 cases ready on ceac are the cases already in the embassies or the current documented cases?
2- if this is not the case how many cases has his loan ready in the DQ state
?
September 30, 2021 at 19:29
1. At the embassy.
2. I don’t know.
September 30, 2021 at 06:57
hi any update with Dv 2020 who missed interviews
September 30, 2021 at 19:28
Not yet. We are waiting for the order from the Judge.
September 29, 2021 at 22:04
hello Brit.. there is a question about DV 2020 and judge Mehta order about 9095 Visas. that if a case had interview before April and it’s status is Refusal cuz of Trump Muslim ban this cases still have chance in this 9095 reserved visas or this 9095 reserved Visas are only for Trump Covid-19 ban and those who could not get interviews ?
thanks
September 30, 2021 at 19:18
DV2020 cases denied under the Muslim ban might be able to get their cases reopened once we have the order from the Judge.
September 28, 2021 at 03:20
Hi Brit am a winner of DV 2020 n received an email the my documents has received successfully but I didn’t get my interview date as my case number is AF202032xxx, will I have a chance?
September 28, 2021 at 04:51
I don’t know.
September 25, 2021 at 04:23
Hello brit , I am a derivative of dv2020 whose interview was scheduled at April 20,2020 but could not happen in sep .My confusion is :
I am a derivative and I turned 21 at Jan2021 i .e 10 months after I received my 2nl …Now its been 8 months after I turned 21 …Would there be any kind of problem during interview or am I protected by childs act given that my case was already current before I turned 21 ?????
September 25, 2021 at 23:50
I don’t know. The lawyers are planning to check about that once processing is agreed.
September 26, 2021 at 04:31
But I thought there could be no problem because in your description about Dvs derivative potential age out …you clearly mentioned that for dv2020 after turning 21 +216 days their case has to be current ..but in mine case was current way before that….
September 26, 2021 at 06:34
Yes – but there has never been a situation like the Gomez case will create.
September 24, 2021 at 13:33
Dear Sir,
I am DV2020 with case number: AS26xxx, I did not received e-mail from KCC for interview yet, I just got ready e-mail with my documents. Will I have a chance in 9095 visas reservation?
Thanks,
September 25, 2021 at 23:44
I don’t know.
September 22, 2021 at 15:49
Hello brit ….I am a derivative of DV2020 ..whose interview was scheduled at April 20, 2020 but could not happen due to proclamation…..I turned 21 at Jan 2021…Now its been 8 months I turned 21 …If my interview reschedules and interview happens due to gomez case …Would there be a problem or am I protected under Childs act???
September 25, 2021 at 16:23
We don’t know how they will handle such cases.
September 20, 2021 at 07:59
Hello Brit
Should I resend my documents on email to KCC again in the meantime since some of them have expired?
Or should I wait for the final law order? (DV2020)
September 20, 2021 at 13:57
Wait. But do obtain new police certs if that is old.
September 12, 2021 at 12:48
Hello sir, Thanks for your help
I am DV winner of 2020. Unfortunately i was not calling for interview because of higher case number and pandemic. I got mail DQ form kcc in 2020, and when i checked my case it was in NVC
1.if i get chance again, may i need to resubmit my document? if yes , where?(kcc or N. embassy)
2 Before DS260 submitted date 2020 to present i got married and have small daughter also, but when i filled ds260 i was single, Q. i want to proceed as a single because of financial problem,is it possible? need your suggestion.
September 12, 2021 at 14:04
1. Probably not – but it is too early to know exactly how things will work.
2. You need to tell the truth about your marital status and child. But you can process for just you if you want.
September 11, 2021 at 17:22
Hello Brit.
I am a DV 2020 winner. I have sent my documents but I didn’t receive an email for the documents are being processed. Whats my current situation after the law-case win? I am from Egypt and my case number is in the early 70s which is a bit high. Do i have to contact the embassy here?
September 11, 2021 at 22:44
You need to wait until we have the final order.
September 11, 2021 at 04:41
Dear Mr.Brit !Hope you are doing well!
Just wanted to clarify one thing. When the final order for issuing of 9095 cases come out does the KCC ask us to re-submit the documents I mean the PC which expired or we have to send them without KCC request. ? I have already get the new PC.
I follow every your interview but unfortunately I don’t catch all your speech)))
Thank you in advance.
September 11, 2021 at 20:00
We don’t know the exact details of processing yet.
September 9, 2021 at 14:05
brit i am fromEthiopia in africa . my case was current , sent all supporting documents , but not yet received any feedback from kcc , will have chance to be intervied in those 9095 visas , ?
September 8, 2021 at 17:34
Hey Brit,
I just got my 2NL for an interview date on Sep 22. First step says to register for document delivery. Can you please advise us on this step? There is a question in there that says “priority date”.. do you have any clue what that is or where to find it?
Thanks!
September 9, 2021 at 04:05
I can’t give instructions as there are various systems being used. But try to find an option that is simply creating an account.
September 7, 2021 at 13:09
Dear Mr Brit
Hope DV 2020 final order will come out soon.
Any idea about regional Allocation of reserved 9095 visa?
Thank you
September 9, 2021 at 03:26
No
September 7, 2021 at 04:12
Hi Brit, I saw your videos and I understand that you mentioned that DV 2020 selectees can not apply to an AOS when the process starts again. But what if I have been waiting all these years living in a communist country like Venezuela, and I said no more, and now I’m living in the US with my family, since May of the current year. Technically we’re just arriving, life happens, we didn’t know that we were about to get this victory on DV 2020.
What will happen with my chance to run for a GC on the DV2020? Do I have any chance? Thoughts?
September 9, 2021 at 03:21
Again, I don’t think AOS will be possible.
September 6, 2021 at 14:51
Dear Sir, I’m dv2020winner, case number 2020AF00027281.Please i wish to ask whether will they process DV 2020 documents.Because i waited for the day of my interview till no avail after the 3-6weeks that they gave me until the shutdown occur where it was caused by COVID-19.So do I still the chance? Thanks.
September 6, 2021 at 18:22
The DV2020 lawsuit final order will come out soon. So once we have that we will know more.
September 6, 2021 at 06:00
Dear Mr. Brit.
Hope you are doing well.
Is any update regarding the DV 2020?
Thank you in advance.
September 6, 2021 at 18:17
There will be news soon
September 3, 2021 at 23:34
Hi sir, will also DV 2018 ,2019 winners be given a chance to be scheduled specifically those who were current ,scheduled and also those whoes visas were refused ?

September 3, 2021 at 09:19
Hi brit ! will we know by fall or winter if grace mengs amandament will pass or not! Should the bill be put in vote in this year 2021 or doesnt have a timeline ? thanks
September 3, 2021 at 18:59
We have to wait and see.
August 30, 2021 at 04:43
Hi Brit, i checked my status at CEAC and found that my case is at NVC whereas during the past months that page would not open blc our fiscal year is over. Am dv2020 Af48
1) Does it mean that very soon KCC will start working on the 9095visas
2) when will the judge give his final order?
Thanks
August 30, 2021 at 13:57
1. No – it just means you are checking a different part of CEAC than you checked before. It’s your mistake, not any change.
2. I don’t know.
September 4, 2021 at 14:29
Brit, BIH
How to find the different part of CEAC? When trying to log to the original one for DV2020 there is the following message: “You are attempting to access a Diversity Visa case for a program year that is not current. The case is not eligible for further processing at this time.”
September 6, 2021 at 18:02
https://ceac.state.gov/CEACStatTracker/Status.aspx
August 29, 2021 at 20:25
thanks for your reply mr. Simon. I think it’s still worth to try!
August 29, 2021 at 05:14
Mr. Britt, Thanks for all your hard work and support.
My case is 2020SA27XX, mr. Simon, due to the embassy were closed because of the pandemic I did not sent the DS-260. Do you think that I have any chance if I send it once the process starts?
Thanks in advance
August 29, 2021 at 20:21
Probably not.
August 27, 2021 at 13:17
Good afternoon brits. Some 2nls have been released and most of it in the African region was without cameroon. I wish to know whether there is any possibility for more 2nls to be released before september 15.
August 28, 2021 at 05:54
Wait and see.
August 27, 2021 at 01:53
Hi Brit
I have received the following email from kcc in aug 2020 when i inquired about my documents.
What does this mean.please advice.
Which category i belongs to 4 or 5
”
Thank you for your inquiry.
Your DS-260 has been processed. You should have received an email from the Kentucky Consular Center giving you instructions to complete in order for your case to continue processing.
”
But i have not receives an email from them
August 28, 2021 at 05:50
Group 5.
August 26, 2021 at 10:08
Hello brit
My wife one of dv2020
I am serving in military right now
Of course they’ll aske for my milittery record
The DOS said in there webside for lottery you most not leave your job or sale your hose or property until you have your visa.
Do I submit my resignation from the army and get the documents ?
What should I do in your opinion?
August 28, 2021 at 05:39
Don’t quit your job.
August 28, 2021 at 10:17
So
when they aske for record in interview what would I say and this may cause me refuse
August 28, 2021 at 16:31
You are going to have to use some judgement.
August 25, 2021 at 09:07
Addition to the previous message: I received only one email from KCC asking to send documents, so I did send all required documents..and after that I haven’t received any email from KCC. Does it mean that documents were not qualified? Can I change something now?
If my case is “at NVC”, Which of them should schedule interview KCC or NVC?
Thanks and sorry for too many questions.
I am so nervous about all this 🙁
August 26, 2021 at 11:54
My situation was same. But after I sent all the required documents after some time I recieved an email that my DS260 has been processed.
Although they asked for a scan documents after I sent the DS 260.
But I don’t understand why the below email was submitted after I sent the scanned documents.
Thank you for your inquiry.
Your DS-260 has been processed. You should have received, or will soon receive, an email from the Kentucky Consular Center giving you instructions to complete in order for your case to continue processing. Please follow the instructions in the email. Interviews are scheduled numerically based on case numbers that have completed processing. Interviews for the DV 2020 program will begin in October 2019 and conclude on September 30, 2020. Please refer to the visa bulletin at https://www.travel.state.gov to locate the current numbers being processed. This bulletin is updated after the 15th day of each month. Once an interview date has been scheduled, you will receive notification via email to check https://www.dvlottery.state.gov.
August 28, 2021 at 14:26
Dear Viktoriya, thanks for sharing with your experience. Unfortunately I have received only one letter from KCC saying “congratulations on your selection and asking for sending documents together with DS-260”. I did so and never heard back from them. I haven’t received second email saying that my “DS-260 has been processed” and haven’t received any other instructions.
I have a question. Have you received any further email from KCC with instructions after that letter? Have you received any letter from NVC (something like welcome letter)? And have you received your 2NL? Can you find your number in CEAC 2020 2NL list? (You can google it)
August 30, 2021 at 11:31
Dear Luna ,
Thank you for your feedback. I have checked the chart and found 2020EU,XXXXXX None,At NVC,None,None,0,0,0,0,0,0,1 next to my case. I really don’ t know what means the figure 1. May be this is something good me.
Dear Mr. Simon,
What does it mean?
August 30, 2021 at 14:07
It’s normal – every case has that status until it is scheduled for interview.
August 30, 2021 at 11:42
Dear Luna,
Regarding you question letter from NVC, no I didn’t recieve anything more. But I periodically asked them to update me on my status. and in relying I always got a standart letter.
September 1, 2021 at 16:08
Dear Mr.Brit Simon, why I can not find my case number in ceac data for 2020? What can be the reason for that?
Thanks
September 3, 2021 at 18:19
It might have been deleted from the database. They do that for some cases, but it does not mean there is any problem.
August 25, 2021 at 09:02
Dear Mr. Brit Simon, thanks for all your support and answers.
2020EU44*** I sent documents to KCC and my status is “at NVC”. I can not check my ceac because the year is not current.
I have never received any email neither from KCC nor from NVC. I have not received Welcome letter from NVC. Also I can not
Find my case number in CEAC data for 2020. Why My case number was not included in CEAC? What can I do now in order to increase my chances to get scheduled? Should I contact KCC or NVC in this case? Can they schedule an interview or it’s too late?
August 28, 2021 at 05:17
Right now, you can’t do anything – wait for the final court order. However, your case number is very high, so you obviously have more risk.
August 24, 2021 at 15:32
any thoughts of moving DV cases of the scheduled interviews and then canceled from one embassy to another because of COVID lockdown?
Currently, our interview was scheduled in Moscow, Russia in Mar 2020 but then canceled when COVID hit everyone. case number is 13XXX; I assume our case is still pending to schedule a new interview and issue a visa (out of reserved 9k visas), but we are afraid US embassy in Moscow will not open. Do we have to contact them and move the case?
August 28, 2021 at 01:06
The lawyers are trying to get clarification of how that could be handled.
August 24, 2021 at 12:22
Hello Brit. Its tricky, on one hand it would be unfair for dv2020 to wait any longer but the if they infact get processed this year many selectees of DV2022 wouldn’t get there visas worsening an already bad situation rather than just being frustrated and yes waiting until fiscal year 2023 would be the same if the judge doesn’t cancel or postpone which could be illegal BUT UNTIL THEN kcc would be better than current capacity and maybe even be capable to finish both dv 2023 and dv2020 bc its impossible at current stare which doesnt show improvement.
August 28, 2021 at 01:04
It will remain a mess if we don’t get a better prioritization, first for DV2020, and then for all DV.
August 30, 2021 at 11:57
This will be fair since the most affected were DV 2020.
I have already apply for the new Police Certificate and I hope for the best, although my case is super big ))).
August 24, 2021 at 06:12
Hi Brit, As a DV 2020 selectee that has never receive any email of documents and now police certificate has expired . I am worried because I am in South Africa and it takes more than two months for police certificate to come out so what do I do ? Please advise
August 28, 2021 at 00:57
Apply for a new one.
August 24, 2021 at 05:01
Good day Brit, am DV2020 winner. Kindly help me to know the following below bcus I have sent it twice I did see my post or your response sir.
1. All the documents for my interview are in the year 2019 including the ones of my sponsor. It is okay to ask him for 2020 n 2021 1040 forms n some few payment slips with d W2 for these years?
2. The previous i-134 is in the year 2019 is it necessary to ask for new i-134 in the years of 2020 or 2021?
Thanks for your patience n time sir.
August 28, 2021 at 00:56
If you get an interview, get a new I-134 with updated records.
August 24, 2021 at 02:52
Hi Brit, I am 2020 DV winner and my case number is 2020AS12XXX.
And also my I’m documenterly qualified since I had already received an email from KCC that you are ready for an schedule but recently I got married. So, do I need to contact KCC to unlock my DS-260 to enter new information regarding my spouse once they resume 9095 visa adjudication or I have to contact US consulate here at Kathmandu.
Your suggestions please.
August 28, 2021 at 00:54
You would have to tell KCC once processing restarts.
August 23, 2021 at 20:05
Hi dear sir brit ,
I am a dv 2020 lottery winner from Afghanistan and interview was cancelled due to Covid-19.
So my questions is,
1) when did dv 2020 lottery interview will start.?
2) what is means of groups (3,4,5)?
Thank you sir.
August 28, 2021 at 00:44
We don’t know.
Basically, are you ready for scheduling or not.
August 23, 2021 at 12:31
Hello sir, am also a DV2020 winner with an appointment in April back than but was cancelled.
1. Do u think I have a chance to obtain one of the visas from the 9095 visas?
2. My police clearance certificate exceeded 1year validity, should I get one now in case of anything?
Thanks sir.
August 28, 2021 at 00:39
1. Maybe
2. It’s valid for 2 years now, but if you want, update it.
August 23, 2021 at 07:15
Dear Brits, Happy we 9095 won! I would like to thank you for your service Sir. Here is my Question.
1.My Case is AF39*** the Kentucky Consular Center and are ready to be scheduled for an interview when your case number becomes current” will I have chance? if so can I update Police certificate?
2. I am in China.if I got chance for interview do i need to change address affidavit ? because the person dont want to send Tax document and social security form to me.
Grateful to you for your tireless voice for voiceless!! I am going to Send you Ethiopian Coffee my man.
August 26, 2021 at 23:32
1. Maybe – I can’t be sure. If the police cert is cheap/easy to update, do that.
2. I don’t think so.
August 22, 2021 at 23:30
Hello, Dear Brit.
My case number is AS167xx.
I received an email from KCC confirming my documents a long time ago before the 1000 cases of Corona Virus.
What do you think??
Is there any chance on getting of 9k visas and to be scheduled an interview????
Thanks a lot for your good work
August 24, 2021 at 23:41
Maybe.
August 22, 2021 at 22:39
2020EU444***, I did not find my case number in 2020 September 2NL list. If my case is “at NVC” and I haven’t received 2NL do I still have a chance to be interviewed?
August 24, 2021 at 23:41
Maybe.
August 22, 2021 at 22:14
Dear Mr.Brit Simon, My case number is 2020EU444*** from Bishkek, Kyrgyzstan. I have just checked DVcharts for DV2020 CEAC data for embassies and was really surprised to find out that there are two “issued” cases with case numbers one from 40001-44001 and one from 48001-52001.
Do you know why some cases with super BIG numbers were issued visas already? Maybe I missed something?
August 23, 2021 at 08:33
Dear Luna,
Where could be found the DV charts for DV 2020. I am also in the group with super BIG number?
August 26, 2021 at 23:46
https://dvcharts.xarthisius.xyz/ceacFY20.html
August 27, 2021 at 15:59
I read the whole Dv2020 chat ceac status but am not understanding anything britsimon please help me sir.
August 28, 2021 at 06:01
I can’t answer such a vague comment.
August 24, 2021 at 23:40
All case numbers are current – so case number does not matter. Cases are scheduled in the order in which they became DQ. Some high case numbers got DQ VERY early because there were no backlogs in the very early days of the year.
August 22, 2021 at 16:56
Dear Sir
I am 2020AS17XXX
I got my document qualifications and I was not scheduled for an interview in last year (group 03).
When I contact the KCC, they informed me that I was ready for scheduling for and interview and couldn’t schedule the interview due to PP.
1. Do we contact KCC or our embassy asking to schedule our interview with the recent Judge Mehta’s memorandum opinion?
2. What is the right time to contact them, should we contact KCC/Embassy now or wait until the Judge issue to final order
Kindly clarify.
Thank you very much for your contribution given to fulfill our dream
August 24, 2021 at 21:19
1. It would be KCC
2. Not yet! We don’t have the specifics yet – and KCC would tell you the year is over.
August 22, 2021 at 16:41
Dear sir,
I’m 2020 as13xxx winner and I was scheduled for an interview and got cancelled due to COVID am I included in 9095 visa
Regards
August 22, 2021 at 16:50
Maybe
August 22, 2021 at 14:52
Hello BritSimon I’m a dv2020 winner and I just want to ask a question about some ceac data that I saw in the form of .csv file the data was dated September 2020 and I read some data from October 1st and i saw that my case’s status was At NVC I understand what that means but problem is that I received an email last year mid-june from kcc saying that I am ready to be scedualed and that my documents and ds-260 have been processed so I was wondering if you can shed some light on the matter
August 22, 2021 at 16:36
What light? What question??
August 22, 2021 at 16:50
My question is were our cases deleted or ever really processed as kcc said in the emails ?
because I didn’t see any change in our status
August 24, 2021 at 21:19
All cases are shown as at NVC prior to being scheduled. Being ready for scheduling does not guarantee an interview.
August 23, 2021 at 08:08
My question is that is my case proceced as they said in the email and just didn’t change the status or not?
August 22, 2021 at 13:19
Hi Britsimon
I finally just received a travel exemption! I’ll have to fly out tomorrow night. My question is my dv20Visa was valid through 28th Sept – 15th mar. Has it already expired? Or will it expire Aug 24th? Six months on from when the proclamation was rescinded? I’ll be canceling flights if It’s expired! So I’d love your guidance please.
Thankyou!
August 22, 2021 at 13:41
For the sake of the cost of a plane ticket – get on the plane and try!
August 22, 2021 at 22:09
It’ll cost me around 12 grand to return travel and quarantine. It’s such a gamble. Hopefully they’re lenient with dates!
August 22, 2021 at 22:11
Well you are probably technically expired. But its your decision.
August 22, 2021 at 06:42
hi brit,
seeing the discussions I wonder if the 9095 visas can all cover all loan cases and up to group 5 ..
my case is at group 4 ready with CN55 *** plaintiff in gomez
Question
1-what should I do?
2-do I have a chance for an interview?
August 22, 2021 at 16:20
The 9095 visas will not cover all cases. All you can do is wait and see.

Please I was issued a white paper with a checked box stating the officer needs my medical report to issue my visa to me,my interview was on 21st Sept 2020 and the hospital sent it to them on the 22nd or 23rd Sept 2020 but the embassy later sent to me an email with PDF attachment that stating that dv2020 fiscal year is closed, on 2nd october 2020. So what am I to do now please?

Once DV2020 processing is restarted, contact your embassy and see if they will now process your case.

Dear sir, my case number is DV 2020 is AF 64*** . I have sent the documents and kcc send me the confirmation that they have received my documents. Can you let me know the probability I have . Thanks in advance

Realistically, very small. The priority will probably mean that lower numbers, and perhaps people already ready for scheduling get the first chance. So because you are not ready for scheduling and have a high case number, you probably have a low chance.

Dear sir if remaining cases of dv2020will process randomly than there are already 7kplus ready cases now then those people who have higher cases number from AS13k_15k will have a chance ? who have already receive document confirmation mail from KCC.
