OK, so I am getting overwhelmed with a flood of 2017 selectees with very basic questions. Let me try and address the most frequent ones here in the hope that people will read this. If you ask a question and I give you a link to this page, it is to indicate that your question can be answered by reading this page and using some common sense.
By the way. VERY IMPORTANT. If you have to ask me more than one question – please NUMBER the questions to make my work easier.
Is there a deadline to submit my DS260?
There is no official deadline to submit your DS260. People will continue to submit DS260s for DV2017 cases well into 2017. Submissions as late as April or perhaps even May of next year will still get processed in time.
How long does it take to process the DS260?
Based on the past 2 years (since the DS260 was introduced), we can be pretty confident in the following info.
The actual processing time of the DS260 is quite short – probably 3 to 4 weeks. However, because of the volume of DS260s that are received starting at the beginning of May, a backlog builds up very quickly. You can think of this as a queue. In the two past years, that queue or backlog has meant that DS260s were taking 4 to 5 months to process (obviously most of that time being spent waiting). So – for those that submit their DS260 in the first week or two after the initial draw, the processing time will be quite short. Then a backlog will build and processing times will build up to 4 or 5 month delay. Then, early next year, processing times will reduce again to being a few weeks.
Does every DS260 take the same time to process?
No. There is some background checks required on each case that vary according to the situation of the selectees. The precise details of the checks are not published, but we can guess they are mainly about ensuring security of the USA. That means they communicate with agencies and foreign governments about the details you provide on the DS260. Some countries co-operate with the USA, some don’t. In countries that don’t co-operate you can expect DS260 will take longer. So, some cases are very simple, and some not so simple. If a selectee was raised in Western Europe, works in an office and has never travelled to certain high risk countries we can expect the DS260 processing (once the case is ACTUALLY processed, not queued) to be quick. If on the other hand someone has travel history around certain countries in the middle East or lists their work as “Nuclear weapons specialist”, well they can expect the US government to take longer over those checks.
So – never assume that all DS260s submitted on the same day will complete processing on the same day. There will be variations.
When will I be interviewed? Is my number safe?
OK, first of all. Processing timing is mainly based on your case number, and where that number is ranked within each region. So – if you are case number 900 in OC region for example (where the highest case number will probably be around 1000) you are near the back of the line and can expect a long wait before being interviewed. However, that same number in AF region (where the highest case number could be 50,000 to 60000) would be very low. A low number means the case could be interviewed earlier.
HOWEVER, if a selectee with a low case number submits their DS260 late, it is possible their case will not be scheduled until a later month than their case number would suggest. No case will be scheduled unless the DS260 has been processed. However, in the case of someone with a low number who missed their “current” month because of DS260 backlogs, their case will be scheduled once the DS260 is processed. In some cases people might actually want to use this delay to cause a later interview (for instance if someone wants to get married prior to interview).
When will KCC send the first 2NLs?
The first 2NLs (the interview notification) for DV2017 will go out in late August. That will be for cases that have been processed AND are current for October. Then 2NLs will come in a monthly schedule, also late in each month. So – late in September for November interviews and so on.
When are the visa bulletins published?
The visa bulletins are published around the 8th to the 15th of each month. If you call KCC they will always respond that it is released on the 15th. They are not “late” until the 16th. Usually I get people lamenting “the sky is falling” and “why are they so late” around the 10th or 11th. That will happen every month – and no matter how many times I explain, people are impatient.
How do KCC schedule the cases?
Roughly speaking all interviews are spread out over the year, starting in October and ending the following September. KCC release numbers via the visa bulletin to say which case numbers can be interviewed. Check out this article to understand how to read the visa bulletin.
KCC will increase the number made current on each region at a pace that ensures they have enough interviews to match the embassy capacity during each month.
So – to take an example. If OC had a highest case number of 1000, we could roughly expect to see that number increase by 100 each month. However, due to DS260 backlogs (remember no case can be scheduled UNTIL the DS260 is processed), KCC might release a higher number to start with (for October and November for instance) and slow down later. So – we might see OC start at 200 in October, be 350 in November and then increase by 50 to 75 each month for a while.
The same thing will happen in each region. This effect is going to be particularly pronounced in AF region where selectees typically take a long time to submit their forms. So – AF will start with a high VB number. Many will rejoice and say how fast things are moving and then those same people will be confused when the pace decreases later on. I have tried to explain this many times, but people just don’t seem to understand the point. It ends up being mysterious and frustrating. So – people need to be ready to be patient.
You can look at the historical visa bulletin numbers from previous years to get an idea how things work. However, every year is different, so I would suggest only taking a look at DV2016 or DV2015 to try and anticipate when your number will be scheduled for interview. Please do that rather than asking me to predict your interview date. Use some judgment and common sense to allow me to spend my time on people that need help with more critical questions.
To encourage people to look for themselves I have taken the 2015 and 2016 numbers and plotted them onto charts. So – look for your number in your region and you can guess roughly when your case will be ready for interview.

If you are not in status in the USA, you cannot process inside the USA – so you would have to leave. If you have overstayed your visa for too long you will be barred for 3 to 10 years – so that means you cannot process a DV lottery win.

Hi Briit ,my question is regarding police certificate.
I grad schoold in india for two years but know I am back in my country and working. The reciprocity for India says that “indian police certificates are not available for foreign(non indian ) nationals applying outside India” .I left india without police certificate but with a valid RP document from FRRO.Am I still expected to present police certificate from india ?

My wife and I were lawfully married but due to certain differences that developed between she and I rendering it undesirable to continue to live together as husband and wife, we agreed to live separate and then later on entered into a legal agreement two months prior to playing the DV, to legitimize our separation.
With said legal separation and realizing the need to respect and adhere to the terms and conditions therein to avoid any unforeseeable problem that may have risen thereof, I was constrained, compelled and thus played the DV as an individual without including my spouse
.
However, through the counsel of the church and our own inner convictions, we decided to and subsequently reconciled our differences this year, We are now living together as husband and wife as it used to be prior to our separation.
Now that I have been randomly selected for further processing for the fiscal year 2018 and with the situation indicated above, what do I need to do in this stead? Can I include her on DS-260 form? Kindly advise.
I have in my possession, all the legal documentations-Agreements of Separation and Reconciliation, to substantiate these claims.

If you have a child that is above 21 and because of his age, you did not include him on the original entry, How will you answer the question on the DS-260 form that says do you a child? Should it be “YES” even though the child was not included on the original entry or “N0 ?

The visas issued have an expiry date that cannot be extended. THat date is set as 6 months after the medical – so NO the derivatives would have to enter the USA earlier than the 1 year you mention.

Hi just need a little insight, I am a DVC applicant from the Oceania region. I got my interview rescheduled from the US embassy in Auckland to one in America. Seeing how I would be in America for 4 months, they told me to apply for D260 and pay $330. I’ve done that, paid the necessary fees for i-485 application (May23rd, they received it May 30th) and biometrics fee, have had my medical done and just got done with biometrics appointment yesterday. How long do you think it will be til I hear from USCIS on my application?

Update: So I was wondering why I haven’t gotten an interview date yet. I called the USCIS to check on my status and found out my field office is processing i-485’s from Oct. 2016.
I called the KCC to enquire on why I haven’t gotten an interview date yet and they said I have to contact the field office directly that is handling my case and have them request for my file. The deadline is almost up, but I’m hopeful as I made an appointment with my field office (no direct phone or email contact) for the 22nd of this month. Hopefully I can get it done in time and get a favourable response.

Wow – you left this too long to book an infopass. If you can find an earlier infopass that would be better. Make CERTAIN you are properly prepared for the infopass. Go to that meeting prepared to have the interview. Your case MUST NOT be allowed to go past September 30. You have to make sure the FO understands that.

Yep – that is normal. However, there is now a serious problem. Several AoS cases have been informed that visas have run out. Perhaps they allocated visas to your case already, but if they haven’t, you may not be able to adjust.

I have all docs ready with me except a police cert for my stay in the Netherlands for a year and half while i was in a post grad study. This was over 9 years ago. I have applied for the certificate online from the concerned Dutch office. I really don’t know if I will have the doc ready with me before my interview and don’t want to take the risk of pushing my interview date (it is already September). I travelled to the U.S earlier in August and received the stamp from the USCBP officer after spending 4 days with family in the U.S, I returned to Canada. I’m still packing up my things and tying up loose ends. It’s been 3 weeks to the day since my visa was activated. I called family in the U.S and they said my Social Security Number has not arrived yet. I already understand the actual Green Card will still take more time to arrive at their address. Also not able to find any info on who to contact for a status.
I recall clearly on the DS-260 that I answered “yes” to being issued an SSN number and have it mailed to my family’s address. I’m still in Canada for a short while longer and jobs I’ve applied to in the U.S are now asking for my SSN.
My questions are:
1. Should I have gone to the SSA office for an SSN number even though I was recently stamped?
2. How would I find out the status of my SSN when I’m out-of-state?
3. When I make my permanent trip to the U.S will I run into any issues?

My husband won 2018 dv lottery in which he filled me and our children on the initial form. And I came to USA 6 months ago and filed asylum(I-589). My husband and our children are back home.
1. Does it make the case complicated?
2. Do you think, Is there a possibility to included me in this process? If yes what is the proceedure?

2. I have no idea how you will sort that out. The normal procedure is to process with your husband. Talk to your lawyer.

Dear Brit, I talked with my lawyer and he was not sure as well. So, what we did was, we filled DS160 mentioning our current situation and indicate the place of the interview for my husband and our kids at US Embassy in Addis Ababa and mine here in USA. Do you think it will delay their visa?

Your case is going to be complicated. Your husband and child should process and get the DV visa. You will not get a DV visa unless you attend the interview with them (which I presume you won’t). Therefore your husband will have to come to the USA and file for a family sponsored case for you, which can happen at the same time as your asylum case. The family sponsored case will take 2 years.

after interview me and my child were eligble for visa but my husband got AP.
i told officer that we want to get it all together he said thats ok.
now after long time and many updates of our cases suddenly my case number is deletet but my husband and chid is.
what does it mean?
cause they wanted to give me visa but i said i will wait till my husband get.so why they deleted it?
what should i do?

There is no chance of getting the visas now. You left this FAR too long – I told you what to do in December of last year! DV2017 is finished.
