A number of you are stuck in a difficult position because you may be residing in a country affected by the 14 day travel restrictions.
You may be a named plaintiff, and you might be easily helped because you are in group 1, 2 or 3, but you are stuck because the embassies have been told not to issue visas to people in the affected countries.
The legal team are looking into that and are asking for affected people. They have a sign up sheet which is here
By all means enter your info there. BUT I also wanted to explain that if I were in your position, particularly those people who are named plaintiffs, I would immediately travel to a different non banned country. The clock is working against you and the 14 days requirement will leave almost no time. You would need to be out of the banned area for 14 days before you could be issued. So – given the date today you have literally a few days left in order to leave some time before the deadline ends.
If the legal team are successful you could come back home – but to give yourself the best chance, leave now.
Get documents together (and consider translations), and make sure you get proof of entering the other country to prove you have been there. Then – KCC can schedule you in the non banned country. This would work best for named plaintiffs because KCC are helping as much as they can, but if you are not a named plaintiff you may want to do that anyway for to see what happens in the next few days.

– I am group 3. I am in the US now and running to fly back to attend the interview. There are flights through Schengen area. For example through Poland or France. Do you think the Embassy in my home country would make a problem that I have traveled via these countries to get to my home country?
– When I was in the US, I prepared for AOS, but haven’t applied. I have my I-693 medical forms to adjust status in close envelops. Do you think the embassy could accept those, or do I need to make another checkup in my homecountry?
– Do I need to translate documents (birth certificate, etc.) into English to present to the Embassy?

1. Yes that is a problem.
2. No, you need a medical in the physician listed by the interviewing embassy.

If you cannot get a clear medical by September 30th, then you will lose your chance, UNLESS the Judge extends processing (which is unlikely).

Hi Simon, I’ve contacted all embassies in non-Schengen coutries but they even don’t reply or saying that they will not take and cases transfered from Schengen. I only need my visa to be reissued…. So where can we go ?

Hi Julia, I am exactly in the same position, also just need re-issuance and live in Schengen. I have contacted my consulate in the Schengen country again to ask whether just leaving Schengen for 14-days would be enough (I am retaking my medical on Monday), as DoS news bulletin says that “… applicants who have been physically present in the affected region during the preceding 14-day period will not be issued an immigrant visa, unless excepted under the relevant proclamation or until they have been outside the affected region for 14 days.”
I plan to leave Schengen anyway on Tuesday following Simon’s guidance.

I’m from Iraq the embassy is closed, I contacted KCC twice but their is no response. I also contacted three neighbor embassies but no response.
I tried to make an appointment for medical exam but they said that they need an interview appointment with embassy to do the medical test.
Please Mr. Brit what shall I do in this situation? I am nearly to disappointed!

I am a Cameroonian living in France. My wife and I are in AP because our 3 weeks old daughter did not have a passport when we interviewed. If my daughter and I get our visas in Cameroon (following a transfer), is it possible to preserve my wife’s visa through Lawsuit 3.0? Or it will ne over for her?

But for some of us it is difficult to leave the country on a short time like this (specially if we have a stable job) and not knowing what the outcome will be like. We can’t gamble everything we have without something on the table, so our only hope is the Judge taking a decision on this.

This is utter nonsense. They are supposed to prove good faith by facilitating the process not us by wandering continents. I doubt that many of the plaintiffs will be successful before 21st. How they expect families to suddenly travel with very short notice to a foreign country and stay their for 14 days with no glimpse of an appointment scheduled. Then we are supposed to plead for a Consulate willing to accommodate us not necessarily in that same country , meaning another travel and more costs. I don’t know what will be the Judge’s opinion. But I think both routes have very low chances add to that the financial loss in entertaining their interpretation of the travel ban order.

There is now an emergency hearing on Monday to discuss it – but that is the 14th – so if the 14 days is still needed that means almost no time left after 14 days elsewhere. You might find it ridiculous, but I would say a few days away now is a good gamble. Come back Monday night if it goes well on Monday.

I’ve just called our embassy in Schengen area and the lady said they can’t do anything as long as judge makes a decision to treat people equally no matter where they are. She said that it’d be tough without the extension or the judge would have to make a quick decision about banned areas. Hope it’s going to be clarified soon.

I have expired visa and I have already done my medical examination (result will be ready about next Tuesday). I live in Schengen. Is it possible to go outside of Schengen and send my documents back to the original embassy in Schengen while I am outside? I would be out of Schengen for 14 days so theoretically it makes sense. For us the situation is really tough because we have to go quarantine for 14 days if we come back to our country.

Interesting thought. I don’t know if they would accept proof that you were outside the Schengen area since in your case you don’t need to be there for an interview.

To my understanding as of now people can get interviewed and processed but not issued the visa until being out of affected area for 14 days?
Example: People can have their interview after 10 days (can be any day) of being out of Schengen, this can be processed but will be held on AP until you meet the 14 days for the visa to be issued?
In other words it’s not that you have to stay 14 days out of Schengen to technically buy yourself and interview.
Is my understanding correct?

That is yet to be tested. But on the present implementation people who are in Schengen (etc) or have been there in the previous 14 days are ineligible for entry. The government have chosen to again say that means they cannot be issued – so in theory your scenario would not work. BUT as I said – who knows.
Now this is also going to be challenged on Monday as you mention, and I have high hopes too, but I would still have left Schengen this weekend.

Hi,
I had an appointment on April in Frankfurt. It was canceled.
After the order, I have contacted embassy and they gave me an appointment this week but they clearly stated that there is no way to issue a visa even though visa is approved until 30th September because of PP 9993.
I ve contacted 5 different embassies outside Schengen, none of them accepted my request.
We are five person and medical and visa costs almost 3500 usd.
I was so happy about the order but now I am totally confused. What shall I do?
