To be clear on the current status for DV2020 people with visas (most likely due to expire in March).
Some people have travelled and entered since September. The airlines and even CBP were lax in understanding procedures. That seems to have changed where the pretravel system is telling airlines to not allow people to travel. CBP officers seem to be more clued up to stop cases slipping through. One case I know of was a person that entered the USA shortly after midnight (so early Jan 1), was processed through immigration and then called back to immigration whilst still at the airport. They were then sent back.
So – for now, the chances of entering the USA have pretty much gone, and I suggest that no one tries going through that hassle now. Of course that does NOT include people who had visas re-issued after their pre April 23 visas expired.
Biden will, I strongly believe, remove this extension very soon after inauguration. Why am I so sure? Well partly because he is pro immigration and a smart decent man. He knows unfairness when he sees it and has empathy, intelligence and good judgement. He also listens to advisers. That is all what we normally expect from a President that has been missing for 4 years. He also fundamentally knows that immigration is good to drive an economy. All the new arrivals will be looking for homes, cars, will need to get food, behave normally. They will search for jobs and take what they can get. All those things are good for an economy. He knows that – and will act accordingly.
However, you may not agree with some of my thoughts, so let me explain another way.
Biden has made public on numerous occasions that he plans to remove the Muslim ban on day 1. He is doing that for some of the reasons that I mention above, but mostly because it was an EO rooted in stupidity and bigotry. Biden will not let that be the way we handle the world.
Now if Biden removes the Muslim ban, but were to leave the new extension in place, then removing the Muslim ban would be pointless – right?
So – DV2020 cases with visas. WAIT. That’s all. Just wait.

So, i was thinking to try to be interview in another country. You wrote somewhere here that this is possible. I have couple of questions: 1) when should i decide where to be interviewed, ie should i better specify this in ds260 before submitting or this can easily be changed later? 2) do i need a reason to be interviewed in the country other than the country of my residency?

1. When you complete the DS260 you can request an embassy (you get one chance). However, KCC scheduled based on your current address. If an embassy is closed, there will be another embassy(or embassies_ designated to handle that worl.

It depends on the circumstances. For example if your case number is not current and not even close, it doesn’t make sense to change embassies now.

Indeed, for DV2020 it’s been quite a bumpy ride and now yet another hustle. I wanted to ask your opinion concerning the possible time frame for lifting the ban since you are quite familiar with the US legal procedures. How long, would you guess, it’ll take to revoke the extension?
The reason for asking is that we have our flights booked on January 31, so the chances the ban is lifted within 10 days after the inauguration are quite slim. So I was wondering if I shall consider changing the ticket already.
And one more question, if I may, do I understand correctly that in the worst-case scenario when applying for the visa re-issue we’ll have to pay the processing fee of ~300$ again?

This is just my honest opinion. Biden seems to be a good man. But its still possible for him to remove only the Muslim ban to show the world that he is not a racist like Trump and that he doesn’t have any grudge against Muslims. But the PP10014 applies to every country, every race and every religion. So he might still leave that in place for the same stupid labor market and covid crap that Trump pointed out.

Honestly, unless we are going through a serious crisis at home, I do not see why any of us would need to rush to enter the U.S. at the moment? Probably beyond the scope of what I can get into on my blog. I would say the common theme is that moving to a new country usually means stepping backwards in career progression for a while. I wanted you to comment on my thoughts. Dont take me wrong, I am trying to oppose what you think, quite opposite – as a late september issued DV2020 visa holder I wish that your vision comes true most definitely.
And thanks for keeping our hope alive.
So I am thinking that for mr Biden canceling the ban that protects the US labor market might be a very unpopular decision amongst the US citizens and LPRs, especially in the begining of his presidency term. By doing that he might get criticized a lot as unemployment rate in US nowdays has gone up. If he just waits till the ban expires itself and does not extend it I think that might better shot for him. And it is just 70 days for him to wait till the ban is gone. That way he does’t risk with any negativity from US society. Dont you think?
Although if mr Biden decides to remove the ban, he must act immediately, what’s the point to wait and cancel it in late February or March when there are some days left till the ban is gone itself, risking his reputation canceling it for just a few of days before ban expires? That way he also would help less people due to their visa expirations.

It will vary according to the status of each embassy. Most embassies are doing some work, but DV is not treated as mission critical, so that is why my petition calls for Biden to instruct the embassies to handle DV cases as mission critical.

But if the ban is not canceled, is there a chance of re-issuing visas, because the barrier for issuing visas not in the current fiscal year was overcome and about 9000 of the FY 2020 winners were allowed to issue visas in the FY 2021 ? And this is a very unfair situation !!! Anyone who had cases with smaller numbers and who were issued visas in September 2020 may lose their visas when 9000 participants with large numbers can receive them in 2021. It is also unfair that we and those who have a chance to lose their visas are stressed for the second time first in 2020 proclomation and second time now when PP1004 is prolonged.

Is it True that those who were given visas in September, after charge Mehta Ruling, can’t come into the USA? Someone was coming and got denied to continue from Ethiopia and was told that it is because Trump extended the ban. I never though the ban was ever towards those with valid visas (Except people living in some EU countries due to “covid exposures”).

What you are referring to is the Schengen Area Ban. However, the reason why there have been instances of people sent back home when trying to enter US was due to the Presidential Proclamation Suspending Entry of Aliens Who Present a Risk to the U.S. Labor Market Following the Coronavirus Outbreak, known as PP 10014. It is not a new thing, it was initially introduced on April 22nd 2020 and has now been extended to 31st March 2021.

I have a question related to the above.
I won the 2021 Diversity Visa Lottery and applied for consular processing in my home country. However with all the travel restrictions and Green Card issuing bans, I am now concerned I might not make it to my home country (where I am a citizen) or be able to come back after my interview (if I am approved for the Green Card visa).
My Case Number is just above 8,200 in Europe (which hopefully means I will be current for March, as the cut off currently is 8,200 for the EU). However I was watching one of your latest videos and you mentioned Adjustment of Status visas are being issued for Diversity Visa Lottery winners for 2021, is this correct?
If so, I am currently in the US employed and on a valid non-immigrant work visa. Would it make more sense for me to change to an adjustment of status, so I can get the Green Card issued sooner and here in the USA or keep my current consular processing application? I hope you can help me out with this question.

1. What other documents other than the birthcert, and Passport of the child in question will be required.
2. Will there be a need for the ID or passport or some sort of documentation from the ex-Mother of the child.

Whether or not President-elect Biden removes the PP10014 before my DV 2020 visa expires, I won’t be able to travel/enter the US because the government of my country has extended the travel ban on its citizens to March 31st.
My circumstance is very unfortunate. The only solution to my problem is an extension or re-issuance of the visa.
Nevertheless, I’m psychologically prepared to face undesirable outcomes in the near future.
