I hope DV2021 people are understanding how serious the situation is right now.
At the current pace of scheduling, there will be a massive “miss” in terms of visas issued. KCC already have more people “ready for scheduling” than they intend to schedule, so whilst they are still working on document processing, it is nowhere near the volume that it should be. That means for most cases, even those that are already ready for scheduling, there will not be a happy ending.
The Goh lawsuit seeks to preserve visas after the September 30 deadline as we saw happen in DV2020. However, thus far Judge Mehta has not given the go ahead to process the preserved visas, so we don’t know if that will be effective.
The Goh lawsuit is now closed for new participants, but Curtis Morrison is planning to file a new lawsuit early next month. So there is an opportunity to get on that lawsuit over the next 2 to 3 weeks. I recommend everyone seriously considers doing that. The initial cost for most people is “only” $500 and you pay the balance upon entry to the USA. Curtis and Rafael have set it up so that residents of Africa and a few other countries have an exception so they don’t even have to put down the $500 up front payment and will pay the full $1500 charge once they enter the USA (over 3 consecutive monthly payments). So that means it’s a no brainer to be on the lawsuit.
Now, what good can the lawsuit do – well there is no guarantee of course but since I expect less than 10k visas will be issued, for most of you by far the lawsuit is a chance where you basically have little or no chance right now.

It seems like you believe that a fairly large number of people will sign up for lawsuits, so not all plaintiffs might have enough time to be processed. You claimed in the video that the number of people who signed up for Curtis Morrison’s lawsuit could be as large as 20,000. Why do you think so many people would sign up for the lawsuit? Goh, for example, only had 600-700 before additional plaintiffs were added. Even now, as I understand, it’s under 1000 plaintiffs. Is there any data on how many people have already signed up for Curtis Morrison’s lawsuit?

I didn’t “claim” there would be 20K. I used that to make a point. There are around 2000 plaintiffs now. But frankly people would be idiots to not do it – hence why the number could go high.

1. The language- English is not for all countries
2. Limited access to internet.

What is sad Is that for DV2020 the lawyers fought for the winners pro-bono, asking and obtaining a classe action. Then they found out that desperate people would find a way to pay some thousand $ of fees to get a chance and DV2021’s just become a good business to make Money, thus no more pro-bono and of course no more class action. I understand and think it’s correct that they are paid for their job, but a smaller fee, equal for everyone, would have been fairer in my opinion.
Having said that, I really hope they’ll do their best to get those visas issued for at least all the plaintiffs and good luck to all the winners.

Had the same doubts. How would someone that cannot even afford $500 survive the first few months on their own in the USA? Given the current circumstances you wouldn’t be able to land a job that quick. Also remember some of these countries doesn’t even require an I-134. They will surely end up as a public charge.

Myself & my family living in Qatar for last 15 years & winner of DV 2021 (Case Number AS29XXX) & collected all the documents including Qatar police clearance for myself & my family, However cuz of I am a Sri Lankan citizen need to obtain Sri Lankan police clearance as well. Due to current prevailing condition couldn’t travel back to SL to obtain the police clearance.
However option being give to apply via online for myself & my spouse apply via online & not for the children’s above 16 & of those individuals left Sri Lanka before the age of 16 which required to apply via Embassy here & its really lengthy process & I have following questions :-

1. Varies. Just remember his suit is going to try and get cases processed and scheduled. So we don’t need to see some final judgement.

Mandamus lawsuits are designed to get the government to do something. So when the lawsuit hearings start, the government will have to produce a report showing status and progress on each named case. That in itself could be helpful – named plaintiffs won’t necessarily need a “judgement”. Now, as it is likely that there will still not be enough time/capacity even for named plaintiffs, that is where a judgment might be needed to preserve visas, but that is speculation at this point.

As someone originally from Africa I didn’t feel offended in any way, so I don’t understand your accusation. Please leave that judgement to actual Africans, it feels patronizing.
You are free to delete whatever you want of course, but my point is exactly the same as Peters, although my English is maybe a bit better. In the grand scheme of things this may help more people, but it hurts us, and it is because of our own lawyer. Morrison didn’t ask us whether we wanted to make such a sacrifice. We would have happily paid a suppletion to Morrison if money had been the issue.
Is that selfish? Is it selfish for you to take a vaccine knowing that in other parts of the world they need it more? Do you donate all your money to charity, or do you also enjoy it yourself? Is it selfish for Morrison to charge money or is he selfish? Mind you, also in Europe for some people 500eu is plenty of money. I am a selectee of DV 2021. My case Number is AF20XX. I received the READY FOR SCHEDULING email in September 2020 for October`s interview. With the lifting of the ban, I am yet to receive the 2NL. I believe this is happening because our embassy is not processing DV cases at the moment but rather it is processing other immigrant cases. I am seriously contemplating on joining the lawsuit.
1. Do I stand a good chance of my visa being issued if I joined the lawsuit even with the closure of the embassy?
2. Does this lawsuit have the authority or can it mandate the embassy to process DV cases?
3. We are hoping that the KCC and the embassy process cases before the deadline, if it is on the contrary, can the lawsuit request the embassy to preserve and issue the visas to named plaintiff after September 2021 just as it was done for DV 2022?
4. My son ages out by the end of July but with this prolonged delay, can the lawsuit help in this case with the provision of CSPA document to Consular, if interview is held, perhaps in August or September?
5. Is the lawsuit a good option to pursue taking into consideration the dilemma that we DV 2021 winners are presently faced with?

I am also from SL & same as you high case number. Just need your assistance on the police clearance for children’s above 16 which my kids let’s SL before age of 16, therefore cannot apply via online, should be submitted to embassy here in Doha, unfortunately embassy individuals doesn’t aware about such process.
If you can provide me your contact number will be highly appreciated where as I cannot travel to SL on this prevailing conditions.

I am a named DV2021 plaintiff in Curtis’ Jacob vs Biden.
1. Reading through the different exchanges above, I saw that someone referenced that you mention Curtis upcoming big lawsuit will be harmful for Jacob DV2021 plaintiffs, is this a true?
2. To increase my chances I signed again to join Curtis upcoming big DV lawsuit but I was informed that I’m already a DV plaintiff in Jacob, so I can’t join their new lawsuit. Why this?
3. The embassy in my country is interviewing all immigrants visa applications except DV2021, I contacted them about update and they said they are interviewing IV applications by Dept of State prioritization. I’m only concern about getting scheduled for interview, can Judge Chen grant Jacob DV plaintiffs relief? What’s your candid thoughts on Jacob DV plaintiffs success?
4. From last year ruling, Judge Mehta only granted class for DV2020 applicants and denied class for non-DV applicants in Gomez consolidated cases, can we expect this in Jacob v Biden? If this class certification is granted, what next for DV2021?

1. I don’t believe so.
2. You can only be on one lawsuit. You don’t need to be on a second one.
3. Lawsuits are usually helpful.
4. I prefer not to expect too much of myself in terms of predicting the future.

But in lottery form i did mistake. I was choose single. But i am married and i have one daughter, her age is one year and six months.
I did that mistake.
But All my documents are ready to prove the truth of the subject.
If in DV 260 from. Can i mention that i am married and i have one baby.
It is not make a problem to me and to my case?

Your mistake was very serious, and means you must be disqualified. There is no way to fix it, and if you tried to proceed without your spouse and daughter you would be committing immigration fraud. I strongly suggest you forget about your selection.

I think you are referring to the class action. The class certification (IF they get it) would mean a judgement obtained in that case could affect anyone in the same class as their plaintiffs (essentially any DV2021 selectee). However, it is by no means certain that they will get the class cert agreement, OR that they will win on behalf of the class.

1. My CN is 42xxx and do I need to wait to KCC to reply or should I apply to the Lawsuit?
