By the way – speaking of being patient, the ESC website will certainly have some performance problems for the first few hours. If that happens, you can get frustrated and keep trying OR try again after a few hours. I would take the second option!
The entry checking site will open at noon EDT today (May 8, 2021), and of course the site will be unbearably busy and unstable for a few hours because everyone will try and check at the same time. Happens every year.

Is the Presidential Proclamation on Health Care no. 9945, enforced or might be anytime soon?
It basically states that applicants for an immigrant visa need to establish financial ability to obtain health insurance within 30 days of entering the US during their embassy interview with specific instructions on how the interviewer will question the applicant about it.
I read about it being halted temporarily but not fully repealed.

My brother is married with no kids and moved to his wife’s country before they got married. His country of origin is eligible. However, he claimed eligibility based on his wife’s country of birth (where they both currently reside) and she will be accompanying him should they get a visa. Seeing that he is eligible through his country of birth but also through his accompanying spouse’s country of birth. Did he royally screw up on the application or no?, it’s worth mentioning that his country of chargeability on the letter is listed as his country of birth

You are a little confused in how you are saying this.
I think you mean he entered his birth country accurately, but in the next question chose his wife’s country of birth to charge to.

Upon reading on that sneaky cross charging, I realized that both countries belong to the same region and according to other repliers and your response, you mentioned that such selection or mistake doesn’t make a difference since you didn’t gain anything you are not entitled to in the first place.

I applied for dv2022 after thoroughly watching your videos last year.
I am a university graduate in computer engineering from Russia and have worked in United States as a Principal Cybersecurity Architect with no criminal record. I was born in Africa where I am eligible. But I am a Canadian citizen living here for the past 17 years and the only passport I have is Canadian. I included my wife and daughter as well.
I was not selected.
Could the photographs been the problem? I used a professional photographer who has a studio and knows very well about green card photo sizes.

It is a lottery – very few people are lucky enough to be selected – about 1 in 200.
So – you should not assume there was a problem – you probably just did not get selected – like 199 people out of each 200.

I’m a DV2022. I’m really concerned about something and wanted your opinion. More than 30 years ago as a juvenile (16-17 years of age), I got into trouble with the Police on three occassions. It was for minor stuff like throwing eggs at end of school celebrations as well as scratching a seat. All offences resulted in no convictions being recorded. As an adult, I have not had any negative interactions with police and have held high government security clearances etc. If these incidents from the late 1980’s are listed on my national police check, will I be automatically disqualified?

Hi, i applied to my Sudanese cousin who was born in Yemen. At the time of the application back in October Yemen was disqualfied from entry. So, we put Sudan as her country of eligability. Now that she won the DV of thsi May, we are asking about the chances of her getting the visa as her case is AF and not AS, knowing the following
1. she is a single mom with no Sudanese kids (will having minor kids excempt her from being disqulaified)
2. both of her parents are Sudanese who were residing in Yemen for a short duration of a few years and back to sudan afterwards.

It is a pity that you were advising your cousin. You got everything wrong. Yemen was NOT banned from the lottery, and neither of your points gave her the ability to apply as Sudanese. She will be disqualified, and there is no fix.

2. Can I still apply if I was not born in a qualifying country?
There are two circumstances in which you still might be eligible to apply. First, if your derivative spouse was born in an eligible country, you may claim chargeability to that country. As your eligibility is based on your spouse, you will only be issued an immigrant visa if your spouse is also eligible for and issued an immigrant visa. People are not generally considered residents of a country in which they were not born or legally naturalized, if they were only visiting, studying in the country temporarily, or stationed temporarily for business or professional reasons on behalf of a company or government of a country other than the one in which you were born.
If you claim alternate chargeability through either of the above, you must provide an explanation on the E-DV Entry Form, in question #6.

Yes I understand what it says in the instructions. However, the instructions don’t cover the precise wording of the law, nor the exact implementation. Yemen was not banned, so the exception listed about parents country does not apply.

When you complete the DS260 you complete it with up to date information at that time. So if you have a new passport, you use that, but send old and new passports when you send in documents or at the interview.

Every case it at risk right now because they clearly are not scheduling enough cases to issue enough visas. So – you can submit the DS260 if you want, as long as you understand the risks are high that you will not get a Greencard.

Then yes. You could submit after the birth, and make no difference to your interview date because the case number means you will be waiting anyway. So by that time you will know more about numbers and you can include the baby from the outset. Much simpler.

That being said, on filling ds260, there is no need to fill other names section. What I suppose to do is just to fill Surname and Given names as per letter. My thinking, on other names sections, I should fill in her original surname, First name and Middle name as per her birth certificate and schools certificates.
Please advise If I am correct.

The DS260 should have her current legal name AND the other names section should be used if needed. For instance, If she married and took your name, her birth cert and education documents would show her maiden name, but her current legal name should be the new married name (and that should be in the passport). KIn gthat case the new name is the legal name and the previous name should be in the other names section. So – make sure you are thinking about this correctly.
