Expansion of Interview Waiver Eligibility
Last Updated: December 29, 2020
Secretary Pompeo, in consultation with the Department of Homeland Security, has temporarily expanded the ability of consular officers to waive the in-person interview requirement for individuals applying for a nonimmigrant visa in the same classification. Previously, only those applicants whose nonimmigrant visa expired within 12 months were eligible for an interview waiver. The Secretary has temporarily extended the expiration period to 24 months. This policy is in effect until March 31, 2021. This change will allow consular officers to continue processing certain nonimmigrant visa applications while limiting the number of applicants who must appear at a consular section, thereby reducing the risk of COVID-19 transmission to other applicants and consular staff. Travelers are encouraged to review the website of the nearest U.S. embassy or consulate for detailed information on what services are currently available as well as eligibility information and instructions on applying for a visa without an interview.

I wrote to CBP and below is their answer :
“The U.S. Department of State, through the Embassy or Consulate, has the authority to adjudicate Proclamation waiver requests.
Presidential Proclamations, Press Releases, and Notices related to DHS actions in protecting the American public from the coronavirus: https://www.dhs.gov/coronavirus/coronavirus-news-updates
Travelers who have questions about whether they are subject to, or exempted from, the Proclamation should refer to the Proclamation language, and consult with the U.S. Department of State and the air carrier, as appropriate, in advance of travel to avoid travel disruptions. The decision is up to the airline on whether or not to board a person. Air carriers are directed to contact the Regional Carrier Liaison Group (RCLG) for additional guidance.
Alternatively, travelers subject to a travel ban can go to a non-restricted country and wait the required 14 days before traveling.”

I am a 2020 DV winner and I have 2 questions.
1. I got the Visa on Sep 30. Can they take back/reverse my visa, since it was a result of the lawsuit.
2. If Trump extend the ban, let say till March 30 2021, and my visa expired March 16 2021. Am I done? Can I get an visa extension?
It’s really hard for me since I cant plan anything straight since last April 🙁

Judge Mehta set some deadlines to keep us on the path to final judgment. As you may remember, the government is not waiving their right to responsive pleading – which is an answer to the complaint’s allegations or motion to dismiss. Here, we know they plan to file a motion to dismiss. As such, Judge Mehta, like us, wants to get that part over with quickly. This is what he has ordered:
“Defendants’ responsive pleadings shall be due as follows:
(1) December 1, 2020 (Gomez);
(2) December 5, 2020 (Mohammed and Fonjong); and
(3) December 12, 2020 (Aker and Kennedy).
The court will consider a schedule for cross-motions for summary judgment, or a possible stay in light of Defendants’ cross-notice of appeal, after December 12, 2020.”

I noticed something let say “funny”. I went to the CBP website and typed in their search section “presidential proclamation 10014” and the result was “no result. I tried just “presidential proclamation ” and the result was information only on Presidential Proclamations 9984, 9992, 9993 and 9996. it appears that the PP 10014 is not under their radar at all and that the chances for visa holders to enter is very high. the only problem I see is the annotation which could make the CBP officer curious or if there is a special letter from the embassy inside those closed packets.
what do you think ? from the people you know that have attempted to travel what was the success entry rate ?

The “advantage” to non banned countries is that banned selectees cannot process their cases. Trump is likely to lose, and if he does, the bans will probably be removed.

He is showing his appreciation, LOL ?. If you don’t have any PP inscription on your visa, you are lucky one. It is still a risk to be turned around as it was issues after the proclamation (I suppose), but still you have higher chances to get through than rest of us. If I were in your shoes, and had some money to risk, I would try… Your choice… Maybe Brit has a different opinion about your situation… Good luck!

A guy from Tunis was in the same situation and he could travel to USA through Turkey. He writed his experience somewhere here in this blog. If I were you I would try, taking risk may cost money but it’s your life chance since we don’t know what will happen after december 31.

Well Stephane, Things can only get better after Dec 31, don’t you think?
By that I mean people are banned right now. Entry is blocked. Some people have tried and got lucky, others have been turned away. After Dec 31 the ban could be extended OR removed – right? If extended, that is no different to today – anyone could still attempt an entry then with the same chance of success or failure at that time.
So – on balance, I think it makes sense to wait. At least see who wins the election…

I would like to share my experience, it might help other people with similar case than me.
I am a dv2020 winner from Tunisia and I was in group 3 (interview in May cancelled). I got my visa on September 24th. The embassy agent told me that I could travel to the US as long as I go through Turkey or Qatar (not Europe).
I emailed the CBP to ask them if my case is allowed to enter the US and they were positive (I can forward their answer to your private email). So I booked a flight from Tunis to Chicago through Istanbul on October 18th. The procedure was smooth and I had no problem. They only asked me where I have been for the last 14 days. They never mentioned the Trump ban at all.
I believe dv2020 visa holders are allowed to enter the US even now as long as they don’t pass through a country mentioned in the ban (Schengen zone, Brazil, China, etc.)

Yes there is an annotation: exception under PP on risk to labor market. This means that I have been issued a visa despite the COVID-19 ban. That has nothing to do whether you can the US the us or not.

I think you were smart to ask CBP and I’m thrilled for you that you got in. However, I just want to add a dose of caution. When we started getting people being issued, I had stated my opinion that “some” people would get through because a) Airlines have no idea about the ban and b) CBP officers would not all understand that some people could hold visas, but still be affected by the ban.
Since then I have heard stories both ways – some cases that got turned away at the POE, and others that got through. There is certainly some risk, even if the CBP give you an email that suggests entry is OK. It is ultimately up to the CBP officer.
However, to be clear, I am 100% certain that the ban is *supposed* to stop someone entering the USA. But since we have created this “odd” situation – the “system” is not operating effectively which some people (such as yourself) will successfully exploit. But once in, there will be no further downsides.

On my visa is written **subject to PP100014** and the CO made it clear to me to not enter the US before 31.12.

I agree. the annotation on Mohammed’s visa is giving him an exception to the proclamation as opposed to others that are “subject to the proclamation.”

No, the exception’s annotation means that the visa is issued as an exception during the COVID-19 ban. It is not equivalent to the national interest exception

@Mohamed is correct. The annotation does NOT mean he was exempt from the ban. He was admitted because as far as “normal procedures” are concerned the CBP operate under the understanding that a valid visa means you can enter. That is exactly WHY the government had their no visa policy which the Judge found unlawful. They could not have changed their procedures overnight, and whilst some CBP officers would be aware of the ban restrictions they would not be expecting to turn away people holding visas. Only a very switched on officer would understand what was going on.
This chance (that some people would be able to enter) was predictable, and I had predicted it.

I’m DV-2020 winner from Ukraine. We got our visas renewed on September 20th. But in the principal applicant Visa we have notice “entry subject to pp 10014”. And our Ukrainian embassy of the USA replied us that we don’t have permission to enter the USA before pp10014 ixpired expiration date.
So could you please tell if there in your immigrant visa you have the same notice (entry subject to pp 10014)? Is there any chance to get from you a private mail with screenshot of your mailing with your local US embassy where they confirm that you can enter the USA(if yes, we will send it to our local US embassy in Ukraine)?

@Valetyn Your scenario is entirely different to the scenario Mohamed faced. In his case he should NOT have been able to enter, but was able to do so because the CBP are not well organized.
In your case if you hade a visa before April 23 you ARE entitled to enter before the end of the year, but the reply from CBP that Mohamed received would not directly prove that.
So – if you are in need of entering before the end of December – go ahead and try – as long as you understand the risk (wasted time and money).

I spoke with a CBP officer here in Dublin working in the pre clearance facility. He wasn’t sure about my case. He told me he will check with the embassy and call me back. He did call the embassy to check about my case and then told me later that I can’t enter

DV2020was affected by the pandemic, and the presidential proclamations. There were lawsuits challenging the bans, and we might see some more visas issued, even though the deadline is already passed. However, since your number is high, and it sounds like you did not get the ready for scheduling email, there is a low chance if any for you to get a visa.

The consular agent put us in PA and asked me to go fill the ds260 of the newborn and to come back later he gives us the visa what we did and we came back he gave us the visa except that by asking us to do it he unlocked my ds260 for me and created my son’s without unlocking my wife’s ds260.
