OK – the new Visa bulletin has been published. The naming convention of the bulletins are odd – because this one is being published in August, is named, the “September” Visa Bulletin and gives the numbers for October interviews. That is a standard pattern regarding the naming convention, but I tend to focus on the interview date availability rather than anything else.
OK – so here are the numbers for October interviews. Remembering that the immigrant ban means no interviews will be held in October unless the ban is blocked.

Now – in a normal month those people that are current (meaning their case number is below the number shown for their region), and have forms processed early enough, would expect their 2NL in about 1 to 2 weeks from now. This is the same every month. VB is normally published from the 8th to the 15th of each month (although more recently it has been published a few days later – around the 17th/18th), and 2NLs in the second half of the month.
However, this month will be different, and because the court case will not be heard until the end of August, I think it is very likely we will not see ANY 2NLs sent out this month at all, and therefore no interviews scheduled for October. None.
To those new to looking at VBs, let me explain what the “except” XXX country means. Some countries have been called out as “exceptions” meaning that selectees chargeable to those two countries (regardless of where they will interview) are subject to a lower VB number for the month than the rest of the region. This is done to slow down processing for countries with a high number of selectees to spread out the workload over a longer time. Please read this linked article on how to read the visa bulletin.
OK – with all that being said, there is a FAR more important piece of information in this Visa Bulletin. As I have been telling people to expect, the number of selectees per country are published in this bulletin. That allows us to calculate how many selectees are chosen overall, and to understand whether this is an under selected or over selected year.
So – the news is not a pleasant, but also not unexpected surprise. There are 132,404 selected applicants from around the world, that number includes principal selectees and derivatives. By normal standards that is an OVER selected year. As I explained a few days ago that happens about half the years – where they select more selectees than they think they will need. This leads to a year of concerns for people, particularly those people with high case numbers. Why high case numbers – well, processing order gives low case numbers the first chance for interview, so as the year progresses, those people with high case numbers have to wait to see if their number ever gets a chance. It is a long, and sometimes unhappy wait. In recent years we have seen cutoffs in place at the end of the year, meaning people with case numbers higher than the final cutoff don’t get an interview.
Other interesting info in the VB is that the selectees were chosen from only 6.7 million qualified entries, which was about 11.8 million people including derivatives. That is about HALF of the typical number of entries, and I would guess that is almost entirely the impact of the new passport rule. As I had explained last year -DV2021 offered the best chance of being selected that we have seen for many years – because less entries increases the chance of selection. The VB also confirms there could be up to 54750 visas available.
Now these are the facts. Now we have to start some analysis of the selectee numbers to figure out where each case lies within the case number ranges. I will be working on that today and will post in the next day or so. But be warned, this year is not going to be easy to predict. We go a hugely important piece of information today, but there is still much we don’t know – so it is too early to be certain how the year will go. The current bans in place may remain, may be expanded, who knows. The court challenges could block at least the immigrant bans. The pandemic could continue to have impact. This is an election year, so with any luck Trump will lose the election then the new administration might remove some or all the ridiculous bans that Trump put in place.
So many factors are in play, so I am going to recommend everyone should remain cautious about predictions and so on because we just don’t know what will happen over the coming months.

First – I have never said ” cases below 50,000 have chance” – because that would be dopey. Case numbers are region specific – your AS 32XXX is not the same as AF32XXX.

I have some questions and will be very grateful for your answer.
1.I would like to ask if you have statistics about the number of selected included derivatives for the previous 3 years, 2018, 2019 and 2020.
2. Do you think that they over selected this year because they think because of passport requirements,travel ban for some countries and the public charge requirements most of selected will not get the visa?
3. I see some countries like Sudan, Morocco, Egypt, Iran,Russia, Ukraine,Nepal…have a lot of selected. If we consider that each country cannot get more than 7% of the total visas (55.000), that means no more than 3.700 for each country,is that means regardless of the number of selected only the first 3.700 selected with their derivatives can get the visa?

.In 2017: 83,910 entrants selected
.In 2016: 91,563 selected
.In 2015: 125,514 selected
.In 2014: 140,660 selected
.In 2013: 105,628 selected
.In 2012: 100,021 selected
.In 2011: 100,600 selected
So there is still hope for even the high case number for this year.

Unfortunately this year is different because of lots of factors. Like Brit said we already lost the month of October and if we cannot get the TRO this month, November and December will be lost too.
Also don’t forget the pandemic, even if the ban is lifted embassies in some countries could still be closed and applicants from such countries could loose their chance of an interview.

I really hope that the process will go smooth but for the experience of the first ban no 2NL was issue before 23 June and therefore following the logic no 2NL will be issued until the ban will be over only by the President.

Dear Brit, I’m a 2021 selectee with EU39xxx. Do you see any chance to be interviewed or shall I just forget the whole thing and try to move on? I got the idea of the gap, but still, I’m in a deep place emotionally right now. We’ve been registering in the lottery in the last 8 yrs. I was so happy when I saw I’ve been selected, but as time passed I started feeling anxiety and sadness rather than happiness not just because of the things around us (ban, pandemic, closed embassies) but also because my CN. Honestly, I never expected that I will be sick of being selected… I am sure there are people out there with the same feelings. I would appreciate your words about my number. It is still better not to hope and stay realistic than being positive and finally not to be in the cut-off. Anyways, I will be donating to you because I already got more information from this blog than I ever got from immigration lawyers. Frankly, I had many meetings with them already. I am working on some videos to explain this better, but there are many factors in play this year. The pandemic, politics and new passport rule – all factors which could change what would “normally” happen to response rates and so on.
So – at first look, there are too many EU selectees (45k with less than 20k visas available), so a cutoff is likely, but we won’t know for sure for several months. Your number isn’t low enough to be considered “safe” but not high enough to be hopeless. So – the reality is you will wait a long time with no good answer. I know this can be a difficult, so you really should step back fior a few months and don’t try to look for clear predictions, because that won’t be possible.

The number of selectees in Asia is approximately 25000 , so it is a very critical year for us , usually the number of issued visas for Asia is about let’s say 8000 . The highest case number in Asia for this year is about AS36000 so if from case number AS00000001 till AS00011000 let’s say we have 8000 selectees ,that’s mean it will be over for other cases , over than AS11001 ,
1- is it logic?
2- do they aim for something we don’t know about taking until this high case number (AS36000)?
3- could be a lot of gaps that ‘s why the highest case number in Asia for example is 36000?

I received an email advising to submit all necessary documents last week. The problem I have is with the police clearance certificate which I have to submit from the countries of residence since the age of 16. I lived in three foreign countries (in each for more than 12 months). Since I can not go back to these countries now, it is quite difficult to get the certificates from these countries. My question is, is it Okay if I submit the police certificate only from the country I am currently living in?

No don’t do that. Obtain the police certs first, then send the documents. You don’t normally have to go to the country to get a police cert – the reciprocity page (part of the instructions) has all the info on how to do that.

If me and all my family have tourist visa (B1/B2) and flight to USA, do we have a chance to apply adjustment of status there? I mean continue our ds260 procedure there or start a new one ds260 from beginning. Note, we have 2 DV2021, separately (me and my wife).

THat is a risky choice. You could be accused of entering the USA with intent to adjust status (as you clearly do) and that is considered fraud.

Good day. My wife is a selectee of DV 2021. She graduated from high school and hold an associate degree in education administration. On the DV entry, she put high school as the highest level of education obtained as there was no provision on the entry for associate degree. She is thinking of showing or presenting her associate diploma in the event where the CO asks for highest level of education despite the fact that it is not reflected in the DS-260 but rather high school graduate. I want to know:
1. Will it pose a problem or affect her chance if she does that?
2. Is it a must that the derivative be a high school graduate and also has work experience?

It is too early to know – although you are mistaken in comparing your number to the 55,000 number. Your number is in Africa only – but there are many holes before your number.

Section 212(a)(6) E is far more serious than you seem to understand. It means you tried to help someone commit immigration fraud. That is extremely serious, and I don’t know what that means for future applications.

Numbers are by region, and I cannot tell where your number sits in your country, but it doesn’t matter. Algeria will not hit the cap. So, your number is ok. You just need some patience.

my mom is Syrian and DV 2021 winner, her case number AS 35XXX ,do u suggest to me to fill her DS260 ?
1- what I know that it takes about 3 months to process the DS260 file , so am afraid if KCC done processing the file by January and Pres- Biden did not remove the travel ban yet , may they cancel her 2NL ? or this won’t happen till her case number is available for 2NL later after January ?
2- She will use her current passport to fill DS260 , but she needs a new one by next April is that ok ?
3- she needs High School Diploma and she will provide , does my Dad (her spouse) also need to provide a High School Diploma ? (he lost his Diploma document it is too old 1965 and he needs a long process to get a new one ).
