The government have modified the page that was originally the announcement of the DV pause. This should be closely followed by guidance to the embassies to allow them to start issuing visas on the 221g cases – although we may need to wait a day or so before the embassies give corrected feedback.
For those that need to renew medicals, you should hear from the consulates about that in due course, but if I were you I would start reaching out to the physicians and embassies to get that part moving. Remember, in some places medical appointments may become a backlog situation.
Of course the other part is what is happening with the training pause. This was raised today in the CLINIC case, but in that case the Judge was not convinced that the training pause was in itself evidence of non compliance with her order, but she instead pushed heavily on the 221g cases, making it clear that no training pause was a factor in those cases because the 75 country public charge policy could not be reapplied to those cases. So – she ordered the government to provide a status report on September 8, and warned that the report should be accurate “on penalty of perjury”. In other words she wants clear measurable facts about how many issuances there have been. It cannot be “none”.
So – this is good news, but the battle is still complex since the cancellations need to be resolved and the deadline is in 30 days. So – we are not out of the woods yet.

Hi Uncle Brit,
Hi please read this and give me best advice.I would appreciate if you provide me an answer by today because I have to submit by September 28th that means by September 27th in US please uncle. Please 🥺
I would really appreciate your advice on my DV-2026 case from Sri Lanka.
My case number is 2026AS13290. I had my original interview at the U.S. Embassy Colombo on March 11, 2026, and was placed on 221(g). At that interview, the CO asked for my A/L results sheet and also asked detailed questions about my teaching employment, including my working hours and computer use. I submitted the requested documents.
After the DV issuance pause was lifted, the Embassy contacted me and scheduled a re-interview. I attended the re-interview on September 25 and completed a new medical examination.
Unfortunately, I was given another 221(g). However, this time the CO specifically asked me to submit the following on Monday along with my new medical and passport:
1. A detailed U.S. job plan — what job I plan to seek, where I will work, expected salary, and how I will support myself.
2. Income, savings and expenses — including how I will manage my finances after arriving.
3. Research about U.S. medical insurance.
4. The CO also told me to try to convince him that I can establish myself financially in the U.S.
My current financial resources are approximately LKR 2 million in savings, I have an I-134, and my U.S. sponsor is a family friend who lives in New York and is willing to let me share his accommodation initially.
My proposed plan is:
– Initially travel to New York and stay with my sponsor.
– Spend approximately six months establishing myself and working.
– My first employment target would be ESL/English teaching, tutoring, language-school or other education-related work based on my existing teaching experience and qualifications.
– If I cannot obtain an education-related job because a particular position requires qualifications I do not yet have, I would take other suitable employment while continuing to seek education-related work.
– During those six months, I plan to manage my expenses carefully and aim to save approximately $5,000–$7,000 additionally.
– I would establish my U.S. banking and health-insurance arrangements during this period.
– After approximately six months, I plan to move to Chicago, where I have friends willing to share accommodation with me.
– Initially, I would seek full-time employment in Chicago and become financially stable before starting university.
– I then plan to pursue a bachelor’s degree in Education/related field and investigate transfer credit for my existing HND/Diploma coursework.
– Once I begin university, I plan to continue working part-time while studying.
– I would also apply for scholarships/financial assistance, but I am not relying on receiving a scholarship as the basis of my financial plan.
– My parents could provide additional support if an unexpected financial need arises.
My questions:
1. Does this sound like a sufficiently realistic financial/employment plan for a DV applicant who is being questioned about public charge?
2. Is it reasonable to present $5,000–$7,000 as a six-month savings TARGET, rather than claiming that I will definitely save that amount?
3. Would you recommend making ESL/English teaching my primary employment plan, with general employment as a backup, given that I have teaching experience but do not yet have a U.S. bachelor’s degree or U.S. teaching license?
4. Do you think I should emphasize my LKR 2 million existing savings + I-134 + sponsor accommodation + future employment income as four separate sources of financial support?
5. Since the CO specifically requested research on U.S. medical insurance, what level of detail would you recommend including? Should I research actual Marketplace premiums for New York and Illinois, or is explaining the insurance options and my plan to obtain coverage sufficient?
6. Finally, since my DV-2026 case has now reached a second 221(g) and the fiscal-year deadline is September 30, is there anything particularly important you think I should do or emphasize in this final submission on Monday?
Thank you for your continued work helping DV applicants understand these complicated cases.
September 26, 2026 at 14:16
This is frustrating to read. You were supposed to explain all this at your interview on the 25th. It seems like you did not have this plan ready to explain. Now you have put your case more at risk because time is short and you missed your best chance to explain.
As for your plan, it sounds OK but it isn’t important what I think. The CO is who matters. Do whatever you can to get your information back to the embassy, and hope they have time to reexamine your case before the deadline.
September 27, 2026 at 04:01
Okay Thanks Brit 🤗 I’ll go to Embassy tomorrow and I gonna submit these
1.My arrival plan in US and short term plan about New York and Long term plan about Chicago
2.My job plan I searched Several Jobs in LinkedIn and I’ll add them to it
3.A reasearch document about Medical insurance including the cost
4.A research document about university in Chicago and living cost and tution fee
And Hope for best

Did you get your visa issued?
September 25, 2026 at 22:39
I am from Indonesia, I got reinterview at 23 september, I don’t have any assets then they asked me for housing sponsor statement and job offer/job plan, I told them that I will live in friend’s house and she is dv winner as well, I sent them all to email, but two days later I got replied now they ask for job offer, how can I get job offer when I am still in Indonesia and do not have any valid visa 🤣 I think they are just looking for reason to refuse my visa 😭
September 26, 2026 at 10:08
Yes – they are being FAR too harsh in the decisions. Unfortunately, they are somewhat entitled to set the standard, but some of the refusals I have seen have been absurd.
September 24, 2026 at 21:13
Did anyone get a GC since the pause was lifted?
September 24, 2026 at 22:58
Yes
September 24, 2026 at 20:59
Hi Simon,
I have a friend who had his interview before the visa pause in Sri Lanka. After the pause was lifted, they called him for another interview and asked him to submit a new medical clearance.
He has scheduled his medical examination for September 28. They also asked him to provide proof of how he plans to obtain medical insurance and how he will cover his medical expenses.
Could you please let me know what will happen if he submits the new medical clearance and the required documents before September 30? Will they be able to issue his visa before September 30, or would his visa be affected or automatically canceled if it goes past September 30 and reaches October 1?
September 24, 2026 at 22:58
I can’t predict what will happen. The deadline is September 30th – so he must be approved by then or he will lose his chance.
September 18, 2026 at 20:58
Hi Simon,
We had our re-interview yesterday in Lima. The officer kept all passports again and gave us a yellow 221(g) sheet indicating administrative processing. CEAC initially showed the long administrative processing refusal message, but today it changed to the shorter: “Please see the letter you received at the interview.” Have you seen similar cases where a 221(g) AP case changed from the long text to the short one? Thanks.
September 19, 2026 at 08:59
Yes – and normally I would assume that is a final refusal, but in reality we don’t know what they are planning.
September 20, 2026 at 16:29
Hi Karla, we are in the same situation at the U.S. Embassy in San José, CR. Our re-interview was also on Thursday, September 17. CEAC initially displayed the long “Refused” text and then changed to the shorter wording, while the Embassy kept all our passports.
On Friday, September 18, we emailed the Embassy asking for clarification. They normally respond within one business day, so we hope to hear from them on Monday, September 21. We will let you know exactly what they tell us.
Given how quickly everything is changing, we are choosing to remain extremely positive. We sincerely hope this change turns out to be something positive for you as well. Please keep us updated if you hear anything from Lima!
September 21, 2026 at 10:02
Hi, thank you so much for sharing this information. It is very reassuring to know that another DV family is experiencing the exact same sequence after the second interview. We truly appreciate your message. Please keep us posted if you receive any response from the Embassy, and we will do the same if we hear anything from Lima. Wishing the best outcome for both of our families!
September 15, 2026 at 21:05
Hi Simon, I really appreciate the time you dedicate to this blog, it has been a great help throughout this whole process, so thank you.
I have a question about the “Case Last Updated” date on CEAC. I was interviewed in Peru and refused under Section 221(g) solely due to the pause in diversity visa issuance. That date sat unchanged at August 24, 2026 for several weeks, but today it changed to September 15, 2026 — while the status still shows “Refused,” with the same generic 221(g)/administrative-processing text (no new wording, no mention of a specific ground of ineligibility).
I had also emailed the embassy a few weeks ago asking for a status update, so I’m not sure whether today’s date change simply reflects them touching the case to respond to my inquiry, or whether it means someone actually reviewed it post-Medani order. If it’s the latter, does the fact that it still shows “Refused” after the hold was lifted mean they looked at it and it’s now effectively a final rejection — or could a “last updated” change like this, with the status text unchanged, just mean the case was reassessed and is still sitting in the same processing queue, with no substantive decision yet?
And more generally: how can I know for sure if a 221(g) refusal has become final?
Thanks so much in advance for any insight you can share.
September 16, 2026 at 08:49
The last updated date will change sometimes, but we don’t have any way to know why – so it is best to ignore the date.
A final refusal has a different wording in the text box on CEAC.
September 12, 2026 at 10:01
Hi Brit, I’d appreciate your view on two practical points from the Sept. 10 DOS cable.
I’m a DV-2026 selectee who was interviewed at a third-country post in late December 2025 and was placed in 221(g) solely because of the DV issuance pause. My medical has now expired.
The cable says posts should immediately begin reviewing pause-refused cases, prioritize their reconsideration, and work through them chronologically starting from Dec. 20, 2025. But it also separately says that, when allocating immigrant visa appointment capacity, posts should prioritize DV-2026 applicants whose Aug. 23–Sept. 30 interviews were rescheduled.
Do you read this as two parallel priorities — old 221(g) cases being reconsidered chronologically while rescheduled applicants receive priority for interview slots — or could the rescheduled applicants effectively be processed ahead of already-interviewed 221(g) cases?
My second concern is timing. Because there are now less than three weeks left in the fiscal year, I am considering travelling back to the post before they contact me, completing a new medical with the approved panel physician, and staying there so I can immediately submit my passport or attend a re-interview if requested.
Would you consider that a reasonable calculated risk at this stage, or would you strongly advise waiting for the embassy to specifically request a new medical first? What would you see as the main risk of doing the medical in advance?
September 12, 2026 at 16:55
Hopefully you watched my live video today that explained much more.
As for what to do next – I’m sure the embassy will issue instructions early this week – so perhaps wait for that.
September 12, 2026 at 20:14
Thanks for the answer. I’ve decided to try to update my medical examination and plan a trip to the country where I had my interview, so I can continue the process from there, as I’m worried about the time I have left. I decided to take this risk.
September 11, 2026 at 09:21
It is frustrating that embassies still decline to respond to our emails and questions. We are also running out of time. Maybe we went.
September 7, 2026 at 03:15
Hi again Simon, hope you’re doing fine mate.
Finally we received our NL, and the interview is scheduled for September 11; however, just like the others, we’ve got the email regarding cancellation and rescheduling. We have kept sending emails to the embassy to push them for clarifications, no replies so far. We also had a phone call with their operator and he said we need to wait for an update. This is while the CEAC website is still showing us to attend the appointment.
Do you think there is a way to find an answer from the embassy? Or could you please advise me on this?
September 7, 2026 at 12:46
You will need rescheduling. Once the embassies get the cable, you can then nag for rescheduling.
September 10, 2026 at 06:22
The issue that I just checked the CEAC website, it is showing Case Last Updated: 10-Sep-2026 & Attend Appointment on Sep 11 … so confusing, isn’t it?
September 10, 2026 at 11:38
Not that confusing, no.
September 7, 2026 at 02:03
Hi Brit, I’d like to ask about my specific situation.
I’m a DV-2026 selectee from Sri Lanka. I had my interview at the U.S. Embassy Colombo on August 10 and was placed under 221(g). My passport is still being held by the Embassy.
My medical examination also expired on August 10. I contacted my panel physician recently, and they said I can undergo a new medical examination, but they have not received any instruction from the Embassy yet. They also said that neither the physician nor the Embassy would be responsible if I choose to do the medical without an Embassy request. The physician also normally requires my passport, but my passport is currently at the Embassy.
With the September 30 DV-2026 deadline approaching, would you recommend that I go ahead and do the new medical without waiting for instructions from the Embassy? Or is it better to wait until Colombo officially instructs me to renew the medical?
I’m worried about losing time if I wait, but I also don’t want to spend money on a medical that may not be accepted.
What’s your best advice in my situation ?
September 7, 2026 at 12:41
It’s your decision. But understand that if things open up, many people will be fighting for limited medical appointments.
September 5, 2026 at 01:00
They have just updated the web, but acactions yet 🥺
https://www.uscis.gov/newsroom/alerts/court-order-on-diversity-immigrant-visa-program-hold-policy
September 5, 2026 at 07:15
USCIS has begun approving cases.
September 5, 2026 at 14:59
What about DOS?
September 5, 2026 at 21:00
Not yet.
September 5, 2026 at 23:35
I understand that DOS and USCIS are independent but do you think USCIS movement gives good chances DOS will move as well? Do they send one cable to both DOS and USCIS and then each department handles it themselves?
September 6, 2026 at 09:08
Two cables. Totally different organizations. However, both have admitted that they lost the lawsuit and both will comply. Dos are just being slow.
September 7, 2026 at 04:12
Are you sure they will start processing cases soon? I feel like they are not complying with the way they dont respond to emails or giving out any information
September 7, 2026 at 12:48
No one can be 100% sure, but I am confident that they will do “something”. But which cases get lucky, we will have to see.
September 6, 2026 at 21:25
Hi Simon if u try to check ur visa status and it’s saying ur search did not return any data wat does its means
September 6, 2026 at 22:04
It means you did not correctly fill in the passport and name field. Sometimes the passport field is that of a derivative
September 5, 2026 at 00:07
Do you think judge Leon waits for the Tuesday status report before issuing motion to enforce? Do you think he may change his attitude a bit once he sees the government is not complying with him?
September 5, 2026 at 07:15
Yes and yes.
September 3, 2026 at 16:35
Hello Simon,I had my Adjustment of Status (AOS) interview on September 1st. The officer kept all of my documents, but he explained that they are still working through how to handle DV cases following the pause.
Even though I presented the court document from the Madani case, he told me that he was not able to approve my case yet because they are still waiting for guidance on how to proceed. He said that USCIS would contact me once they know how these cases should be handled. What would you recommend that I do in this situation? Is there anything I should do now to follow up with USCIS or protect my case before the September 30th DV deadline?
September 3, 2026 at 17:27
Frustrating. Others have been approved in the last couple of days.
I think you just wait for a few days and hopefully the FO will review this and approve your case.
September 2, 2026 at 11:56
I had a DV interview originally scheduled for 1 September in Ldn (medical and embassy pre-screening completed).
I received an email late on 30 August saying the appointment is cancelled and will be rescheduled. The online embassy visa portal was still showing the appointed as “active” for 1 September, so I decided to try my luck and went to the embassy yesterday. I was turned away and told the appointment is cancelled and I need to wait for a new appointment notification via email.
I spent the day today speaking to several people on the immigrant visa booking phone number about rebooking my appointment, and the revised guidance – they all said that nothing has been received by the embassy yet, and they can’t help me until I get a new appointment date from the “The GDIT Visa Appointment and Information Service Team”.
Very frustrating!!
September 2, 2026 at 13:19
That is frustrating I’m sure, but keep pushing.
September 18, 2026 at 13:11
At very short notice we were scheduled for an interview, which we had today. Case been placed in to 221(g)… so let’s see.
September 18, 2026 at 14:34
Fingers crossed!
September 25, 2026 at 12:20
What a roller coaster! Visa issued today.
September 25, 2026 at 15:50
Great news!
September 2, 2026 at 11:29
There has been zero movement from the government so far. Even the embassies haven’t responded to our emails, including basic questions about the current situation. When do you think we can realistically expect to hear something? Do you have any guess or estimate? Or why this happens?
September 2, 2026 at 13:15
I’m thinking we will be seeing approvals before the end of the week – but it’s just a guess.
September 2, 2026 at 16:09
Fair enough, nobody can see the future. Thanks for the answer.
September 2, 2026 at 23:04
Do you believe that government will start doing any work before the motion to enforce is in place? Why do you think end of week? Because of the status reports due next Tuesday?
September 3, 2026 at 09:24
Yes I think they will start doing some work, and yes the status reports are normally “Persuasive”.
September 4, 2026 at 07:18
I have also not gotten any replies or emails as of yet
September 2, 2026 at 09:24
Hey Simon,
I have checked in Google and it’s telling me that on 28th august dv was lifted and also on 31st August dv lottery was paused again.
So I would be happy if you clear my doubt sir
September 2, 2026 at 10:14
You misunderstood what you read. The OLD announcement was updated – so the new notice is in a blue box at the top of the poage that shows the OLD policy information.
The pause is lifted.
September 4, 2026 at 16:05
While I originally would have agreed with this, I now believe the brazen government acknowledged the order, and then announced their defiant new pause (albeit the identical wording).
September 4, 2026 at 17:45
Well, you are clearly incorrect in that case.
September 2, 2026 at 08:26
Am I right in saying it’s probably too late to get it all done if you haven’t already had the medical/document check. I had an interview booked for September 12th but haven’t done the medical / document check review as I didn’t see it opening. I had the reschedule email. Is the medical being 2 weeks before interview an absolute necessity? Or can it be less time. I don’t know if I should reschedule the interview for end of September and try to get it all in. (I have an E2 visa application in and I worry that pushing for the DV will result in a decline in the e2 due to immigrant intent)
September 2, 2026 at 09:07
Whatever “damage” you did with immigrant intent happened the day you filed the DS260. So don’t worry about that.
There is enough time for medicals and so on, so keep pushing to get processed.
September 2, 2026 at 10:11
Thanks! What do you make of the current global immigrant visa pause for training? Is this likely to be lifted or is it the same as the dv pause before but under a different guise.
September 1, 2026 at 22:51
Do you know if anything has been agreed with the government during their 2PM meeting with their lawyers? Especisally related to 221gs (Ivanov plantiffs got informed about the meeting via email)
September 2, 2026 at 08:29
I don’t know the details other than the meeting seemed productive.
September 1, 2026 at 17:38
What does it mean for the next DV lottery?
September 1, 2026 at 17:47
This concerns DV2026.
September 1, 2026 at 17:13
Haven’t started anything yet as I was afraid on my student visa. Should I try AOS quickly now or no chance?
September 1, 2026 at 17:23
It’s VERY late. I can’t quite say it would be impossible to file, but I suspect you are not even ready with the payment receipt, the I-485 package, the medical and so on. So – as a practical matter, you probably left it too late.
September 1, 2026 at 17:02
“This was raised today in the CLINIC case, but in that case the Judge was not convinced that the training pause was in itself evidence of non compliance with her order, but she instead pushed heavily on the 221g cases, making it clear that no training pause was a factor in those cases because the 75 country public charge policy could not be reapplied to those cases.”
So this outcome might set a bad example for other cases or judges as well right? They might not push gov. for September interview cancellations before time runs out on 30th of September and give all energy to 221g cases? I don’t personally think or mean one is more important than the other rather trying to understand their point of view?
September 1, 2026 at 17:21
I wouldn’t jump to the same conclusion. Let’s wait and see.
September 1, 2026 at 13:45
This is good news.
Should we email the embassy for renewing medical examination, or just wait one or two days?
September 1, 2026 at 13:53
You might have to do both. So – email, and then it might take some days before it gets sorted out.
September 1, 2026 at 11:21
Hey Simon, I noticed that the updated guidelines mention the DV visa issuance pause from December 2025. Does this mean they have started pausing DV visa issuance again as of August 31, 2026?
September 1, 2026 at 13:39
No. I really don’t understand what is confusing people.
The December policy was already published. The update (in a blue block) was made to that same notice – so *obviously* the old text of the policy is shown still, but the blue box says that policy is no longer being applied.
September 1, 2026 at 09:46
I was a plaintiff in the Saito case, and I had my interview and was placed on 221(g) due to the pause. Should I still email the embassy where I was interviewed, or should I just wait, now that the government has updated the status and lifted the pause?
September 1, 2026 at 09:59
I think you will need to push for your own case. Obviously there is still a delay while the government communicates with the embassies, but over the next few days we should see some movement.
September 1, 2026 at 06:34
Do we know in any way or form how they will process the 221g cases? For example lower case numbers/month or do you think they would just issue visas for all 221g cases caused by the dv pause? I assume printing would only take a couple minutes
September 1, 2026 at 08:34
No we don’t know the process.
September 1, 2026 at 05:18
Do you know if any discussions continue between our lawyers & government laywers in regards to issuing 221g cases?
September 1, 2026 at 08:33
Discussions are happening in multiple lawsuits.
September 1, 2026 at 03:41
Just received an email, less then 24h before the appointment (of course had to change plans, and hotel booking is lost..) . They said ” You will receive email confirmation
of your new appointment date and time. and i still didnt receive this email yet, should I reply to request this? or just wait few days?
September 1, 2026 at 08:32
Request, but be prepared to wait a few days since they may rely on guidance from DoS
September 1, 2026 at 10:17
How come you request if it’s a no-reply email?
September 1, 2026 at 13:37
Use your own judgement.
September 1, 2026 at 01:38
We received an email Sunday from the automated reschedule email of our appt in London from sept 8th .. still states attend appointment on the visa registration form… Have emailed embassy no replies as of yet (London)…. Our medicals & doc check all complete just the final interview 🤞🏼 have liaised with Immpact also (plaintiff) no further news as of yet…so conflicting info a auto non personal email saying rescheduled but our appt still shows as active…
September 1, 2026 at 08:31
Thanks. Keep pushing. Ideally you would want that interview slot reinstated.
September 2, 2026 at 00:17
Which email are you using to message the US Embassy in London?
September 2, 2026 at 13:42
Was via the visa navigator you go through (they haven’t replied to one and I’ve sent 3 emails!) if anyone knows of a different email address to contact London Embassy or if they have had a reply from them. please do let me know.
September 2, 2026 at 15:49
Same here, we’ve sent about 3 emails and not had a response to any either from the London embassy
September 1, 2026 at 01:35
Thank you for the information and time, dear Simon. I sent an email to the embassy in Lima today regarding my 221(g) case; specifically, I requested guidance on the new medical exams, as no specific documents had been requested. I hope to receive a prompt response from the embassy. Best regards.
September 1, 2026 at 08:30
Let me know if they say anything interesting. It might take a little time to get guidance.
September 1, 2026 at 01:19
Will the embassy start issuing visas from this week
September 1, 2026 at 08:30
I hope so.
August 31, 2026 at 23:36
I received an email saying my interview was being rescheduled and to not attend, so I emailed the embassy asking if it was because of the training pause, and they said no its still confirmed in Sydney 15 September. OC2308.
August 31, 2026 at 23:41
That’s good to hear – thanks!
September 1, 2026 at 00:01
Amazing news!
I’m receiving the same templated response when I’ve asked about our interview. In usvisascheduling it states we’re confirmed for the original date, and their templated emails say it’s been rescheduled but provide no new date. Nightmare!
But, you’ve give me more hope! Will keep trying, and perhaps mention “training pause” or “global dv pause” as neither should be impacting these scheduled interviews now
September 1, 2026 at 00:17
Hey mate, which address did you email? Been trying to contact them for a few days now to no avail.
TIA
August 31, 2026 at 23:35
My brother case has been in 221g since March 2025. Should he hope any on this juge update, at least a call from the consulate?
August 31, 2026 at 23:41
Hopefully soon. He needs to think about the medical.
