I have had a number of questions and a suggestion for a FAQ about how to add a newborn child to the DV case. So – here are my tips for this situation.
There is no problem with this happy event – it happens all the time – but handling it the correct way is important. How to process the answer varies depending on timing of the birth in the DV process. .
Scenario 1: If the birth is before your case is current or scheduled.
In this scenario, as soon as possible after the birth do the following.
- Obtain the birth certificate and the passport for the child.
- Unlock the DS260’s of both parents (you need to include both parents details in the email to KCC). Add the child on each parents form.
- Create a DS260 for the child. If you have time to wait for the passport number, that’s ideal, if not put the passport number frokm one of the parents. If you have time to correct this before the interview that is ideal – if not you can correct that at the interview.
- The child will need to attend the medical appointment with the rest of the family and should attend the interview also. The interview and medical fee will be payable for the child.
Note, adding a child will not normally delay the case.
Scenario 2: If the birth is after you have been scheduled but before the interview.
In this scenario, you cannot unlock the DS260s so you need to contact the embassy and inform them that you will be bringing the child to the interview. So – as soon as possible after the birth do the following.
- Obtain the birth certificate and the passport for the child.
- Inform the embassy of the birth.
- It is a good idea to email KCC about the birth also (but not essential).
- The child will need to attend the medical appointment with the rest of the family and should attend the interview also. The interview and medical fee will be payable for the child.
The embassy may ask you to complete a DS260 manually or perhaps another form (DS230). Comply with their instructions. If you cannot obtain the passport or birth certificate in time, talk to the embassy at the interview to see how they can handle that situation.
Scenario 3: If the birth is after you have been approved but before initial entry to the USA.
This is actually very easy. There is a special process at the arrival airport (POE) for infants travelling with new immigrants. The child will be processed for a Green Card upon your arrival and inspection. However, airlines may not understand the rules and sometimes insist on seeing a travel authorization from the US embassy to allow the child to board the flight. Check with your airline to confirm that – and if in doubt obtain the travel authorization anyway.
- Obtain the birth certificate and the passport for the child.
- If your airline requires it, inform the embassy of the birth and request a travel authorization.
- Fly to the USA to activate all your cases including the child.
- In this scenario you do not have a medical or interverview for the child and therefore those fees are not paid. You will of course pay the $220 Green Card production fee for the child.
Scenario 4: If the birth is after you have entered the USA and activated your status but have in the meantime departed the USA for the birth.
There is a special process in place for Green Card holders who have a baby while abroad. The process is similar to scenario 3, but it is essential that the re-entry is happening for the first time since the birth. The child must be under two years old and accompanied by at least one parent with documentary evidence of the relationship to the parent.
- Obtain the birth certificate and the passport for the child.
- If your airline requires it, inform the embassy of the birth and request a travel authorization.
- Fly to the USA to re-enter the USA including the child.
- In this scenario you do not have a medical or interverview for the child and therefore those fees are not paid. You will of course pay the $220 Green Card production fee for the child.
Scenario 5: If you had a baby abroad after you became a Green Card holder BUT have returned to the USA since the birth without the baby or the baby is now over 2 years old.
In this scenario you must petition for the baby under family based sponsorship. This can take around 2 years.

Contact KCC immediately (Monday) and ask if you can unlock your form. You probably can’t but it is worth a try. If you can’t you will have to negotiate with the embassy.

In any scenario a birth certificate is proof – BUT it depends on how reliable that document is considered, based on the authority issuing the document. So – in some cases there might be a DNA request required.

If I and my wife enter the USA and activate our status in December but we departed the USA after a month because we are not ready to leave our country (collect receivable). Then after three months from the first entry (February) my wife births a baby aboard (out the USA). If at that time we have not gotten Green Card (delay for unknown reason). How can I bring my baby to USA? Does scenario 4 work in this case? will we expose to high risk because the baby born aboard? Is there problem with new immigrant in USA?

You should have unlocked as soon as the baby was born! If you have not added a DS260 you will have to contact the embassy and see how they can include the baby. You will need a passport for the child and a medical.

Hi Brit, I’m on Scenario 4 (Or I was). My baby will be born in february. We already had the interview yesterday, BUT The officer told us, that if we were going to have our baby before going to usa (How we intend to do it) they could not issue us visas, until we deliver the documents of the new baby. That really was like a blow to the stomach of us!.
Scenario 4 went to waste!!! (Don’t worry, I’m not blaming you for anything)
They told us that we should deliver the DS-260 form of the baby. I imagine that I have to request an unlock to be able to add the new baby to my case. I don´t know, really at this moment i’m lost!!!!

The embassy is not following the correct procedure. Contact them, and ask them to issue the visas. Scenario 3 is the standard way to do things.

There should be no need. Just contact the embassy and discuss it. Tell them you would like to travel sooner than their process will allow (since for travel you only need the birth cert and the passport).

Hi Brits,
My family and I were issued dv visas in december 2016. At the time i was pregnant so the consular told us to come back n inform the embassy when baby comes.
Well baby is here and we went to inform them about 2 weeks ago…they took photocopy of babys passport and his passport pictures but we still haven’t heard anything from them. Well they actually called hubby to verify the passport pictures of the baby. And maintained they will get back to us when the travel authorization is ready. I sent a mail 3 days ago and no response.
We r now anxious because we are scheduled to travel end of this month and our visa expires early May.
Is there any further steps we can take to facilitate a quicker response? We don’t have time.

If you have not yet entered the USA, you might be able to discuss that with the embassy – BUT most likely they will tell you to sponsor your spouse once you are living in the USA. That takes around 2 years.

If the baby is born before the interview, take the baby to the interview and discuss with the CO.
If the baby is born after the interview, it is easier, you simply process at the arrival airport.
Needless to say, in either case you need to act fast to obtain birth cert and passport, so make sure you are ready to do that immediately.

I’m a 2018 DV selectee and submitted my DS 260. I’m still waiting for the interview to be scheduled but in the meantime we plan to get pregnant. I intend to do so in a time plan (thanks to your articles on when cases become current) that will allow us to the interview here at home and move to US before the delivery. In that case, when we go to the interview and later on when we move I’d hopefully be pregnant. In this case, the delivery will be in US. Which scenario will apply? Or since the baby is born in US, will it be a citizen instead of a green card holder?

My scenario is neither of above. Our case no is 8XXX.
We live abroad. Our interview with the embassy is in February 2018. Our youngest baby was born here abroad and we filled a DS-260 form for him as well and we selected Travel document at the time for Passport no.
We can not get a passport from our embassy due to political reasons. The hospital here did not let us to have medical examinations for interview because our baby does not have a passport. We contacted the US embassy here and they told us that they can not help us and they will not issue visa for my baby without a passport.
Our baby has national ID card and birth certificate.
We do not know what to do. Our interview date is very soon.
What can you suggest?

I’m not really sure what the problem is. You add an applicant – and that makes a new derivative appear so you can create the DS260.

Hi Brit. I have a bit of a dilemma I’m hoping maybe you can help me with. I’m in scenario 1, with a week-old baby. I have an EU case number in the early 30000s. I know that, the way things are moving this year, if there’s still a chance a get an interview it will most definitely be in the last month of September. That means there’s no margin for delays or errors… the question is, should I unlock my DS260 (which is always the right course of action) with the risk of my case getting delayed and not getting interviewed? or do I show up at the embassy with the baby (with all documents ready)? in that case, I could get stuck in AP and maybe left out without the visas?… hence the dilemma. Thank you for detailing such a tedious process and answering to the public, I really appreciate it!! My current situation is: my husband got selected in 2018 DV program. We actually both live in USA under my husband’s working visa since 2015. So we: joined the lottery in Oct 2016; Selected in May 2017; Submitted our DS 260 in June 2017 and chose to do AOS. Our son was born in NY in Dec 2017 (so he is a US citizen).
Based on the Visa bulletin, our number is scheduled for interview in July. As we did not receive any notification from KCC about our AOS interview, we emailed KCC earlier this week to change from AOS to CP, and asked KCC to unlock our DS260 so we can add our son as our family member. KCC indicated that as my son is a US citizen, at this point we dont have to change our DS260. If we change our DS260 now we have to go to the back of the line again and it will delay our scheduling of interview. KCC said just bring our son to the interview and can ask them to change the DS260 there. But since he’s american citizen they prob don’t even need to change it b/c he doesn’t need green card.
My question is: is it true that we dont need to do any change to our DS260 before our interview because our son is an US citizen? Thank you for your reply in advance!!

Contact the airline and check if they will allow the baby to travel without the authorization. Don’t ask the airline in that way – say something like “Is the airline aware of the procedure that allows babies of immigrants to travel without a visa”. If that doesn’t work, you have no choice but to find someone senior in the embassy.

9 FAM 201.2-3 IMMIGRANT TRAVEL WITHOUT A VISA
(CT:VISA-554; 04-02-2018)
The regulations of the Department of Homeland Security contained in 8 CFR 211.1(b) relating to waivers of documentary requirements for immigrants provide for admission of certain aliens without visas. An unexpired immigrant visa (IV), reentry permit, or other valid entry document is required of an immigrant under INA 212(a)(7) except as indicated below.
(3) Certain Alien Children Not Required to Obtain Visas:
(a) The child born after the issuance of a visa to a parent, or a child under two years of age born of a Lawful Permanent Resident alien mother during a temporary visit abroad, is not required to have a visa if the child is:

I have so far spoken with Delta and south African Airline and they insisted on seeing a document . All my mails and call to the embassy were not answered. They rather called my wife and inform her that they can do something about the child’s visa after 30th September knowing very well their visa will expire on 24th Sept.
They have also asked my wife to tell me to go to immigration office here in USA again to fill a form called i824 which will be forwarded to them in Accra.
I am in shock over the whole thing because I dont think my case is the first one.
Leaving 3mths old baby who is on exclusive breast feeding is a painful.
please help me if you know somebody who can help at the embassy please sir.

I don’t know anyone at the embassy, but you need to do something to get them to see sense, and you need to get a move on! The process they are suggesting (the I-824) is a follow to join process, and that will not work after September 30th because the DV year will have ended.

You might want to hire a local immigration lawyer if you really don’t think you can contact them. DO NOT leave this too late. Do this immediately!

Hi sir, We should have gone interview in 2015. Due to lack of finance, We didn’t go for the interview. I played alone for 2020 dv because my wife and I divorced last year. If I win and carry the divorce papers, will the embassy have problem with me since our records are still them? Also sir I wanna know the age that is eligible for the dv process

If you selected divorced you will be fine.
People usually meet the requirements at about age 18.

I have patience but my husband official trip is coming end of this month.normally embassy returned passport within a week .if they refuse the visa even 2018 lottery has ended. How can is it possible they are not responding the email or even not returing the passport

Thanks. I read this. At the POE the paperwork from the embassy will be processed and your one time use visa will be endorsed (stamped). Once endorsed, the one time use visa is valid for travel for up to 12 months after entry. So – it is possible to enter the USA and leave immediately if you want.. so does this mean i may not wait for the green card to be delivered? Can i leave usa without waiting for the green card delivery? And i will not lose permanent resident status right?
