The Trump administration has extended the April 22nd ban until the end of 2020. This represents a huge blow to DV2020 applicants and could also affect DV2021.
- It does not affect people already in LPR status (Green Card holders)
- It does not affect anyone already holding a DV visa from before April 22 (and extensions should still be possible as I have previously explained).
- It does not affect DV cases doing adjustment of status in the USA
- It does affect DV2020 cases (unless the order is successfully challenged).
- It affects DV2020 cases who were on 221(g) AP and waiting for the resolution of their cases.
- It will affect DV2021 cases, delaying the start of the process (unless the order is successfully challenged)

Thank you for your reply. Yes, the visa ban effect would have been the same, regardless of location. Another angle would be that supposedly, had he stayed in Saudi Arabia instead of returning to Egypt, he possibly would have still kept in his job, S.A. visa, etc. Regarding my other query still ‘awaiting moderation’- I will simply contact my U.S. consulate here in HK with my case number, etc. Interesting, they mention under Diversity Visa that the DV2021 processing will go ahead as planned in October, so perhaps they may not have updated the website, etc. Thank you again!

Hi Simon, thank you again for all your time and effort in giving practical advice and support regarding the Diversity Visa application process. I am in the same boat as other DV2020 winners in that I was initially scheduled for a May 2020 visa interview; however, it was suddenly cancelled in latter March, having taken all the correct prior steps to get to that stage. As per the article, the interview was cancelled 5 days after returning to Egypt- he was fired from his Saudi job for leaving, and his S.A. visa was also cancelled. What a horrible shame. However, I am puzzled as to why he didn’t request for the visa interview to take place in S.A.? Perhaps he wasn’t aware that he could request a change in location? I had a somewhat similar situation in that I anticipated that I could have been living in another country other than my place of birth when the potential interview call-up may have taken place. I simply contacted my U.S. consulate to clarify and was told that the interview location could be changed insofar as one requests BEFORE an appointment location and date is stipulated by KCC/local U.S. consulate. My heart goes out to the Egyptian guy, though, and all those whose lives have been upended due to the coronavirus and all its repercussions.

Yes it is heartbreaking. I think the reporter described a part of the story that was not so important. Yes the applicant could have been interviewed in any location based on current residence. BUT the embassies were all closed centrally by central order, so the effect would have been the same. The location itself was not important to the unfair outcome.

My Friend won the DV2021. He works for the government; eventhough, he is not a higher official, and he has a service/official passport. He is from an Eastern African country. There are couple of question regarding that.
1. Can a government official with a service passport be granted an immigrant visa (That is not clear on the State Department Website)?

If the ban remains in place but is not further extended we will have lost 3 months out of 12. That could be impactful – but we don’t know how many winners have been selected, so we don’t know what will happen. It is not possible to give you solid answers right now.

So far we seem to have Bulgaria and Slovakia taking an approach that visas can be reissued during the ban, and DoS “hinting” that may be possible, whilst a number of other embassies are saying it is not possible. Over the next few days I hope we will get more clarity.
What we need is someone who had a visa that is now expired can re-ask their embassy with another request – quoting the published info from Sofia embassy, and asking them to comment/check since the policy might have “changed”.

Happy for the hope of visa extension for those in that case, I hope all embassies accept to renew expired/ expiring visas.
Now I want to ask about people who entered the US then left for a year. I already got my green card mailed to the US address I put. I have three months left before the one year expires. And there is no way I can fly to the US.
1. What should I and people in my case do? Since we do not have visas? What should we ask the embassy for an extension of the year?

I am reaching to the 2019 and 2018 winners. Anyone in my case. Entered the US in 2019 (in my case November 2019) for a week. Then I left back to my country of residence. I have to travel to settle in the US before November. I was hoping to do so in October but with the second wave of Corona in September and the crazy ban following Brit Simon s advice I m not going to gamble and decided to travel in August. Have been trying to organize things for my departure but in vain. If any of you could help me with advice especially those who are already there.
1) do I need the actual green card in my hands at the time of traveling? ( due to covid makl from us to my country is suspended)
2) Brit Simon keeps advising me to file for taxes I tried but have no clue how. I tried using turbo tax but I don t have a W2 and pay slips. I spent in the US only a week and I m not working in my country. So I am unemployed and most youtube videos say I do not have to file. For those in my case how did you file your taxes.
3) again following Brit Simon’s advice to stick with obama care health plan for health insurance ( I m pregnant) currently looking into them. If any of you had a good experience with a health insurance covering pregnancy and kids please share if you don t mind.

Hi Brit,
I won DV Lottery 2021 and my case number is AS14xxx. I am in the US with F1 visa and am going to graduate from school around March 2021. I am planning to file I-485 instead of consular processing because of extension of immigrant ban. If I file I-485 now, can I estimate when I get interview and green card? Also this immigrant ban affects AOS process as well? Do you think I can get green care earlier with filing I-485 under this situation? since consular processing starts next year at earliest.
I might need to apply for OPT after finishing school so that I can maintain the legal status while I am waiting for the green card though.

AOS cases are exempt from the ban. However, you cannot file until your case number is current – so get ready to wait.

She is a DV2021 case. The ban does affect the first three months of DV2021 processing, and could be extended, but that does not necessarily mean she will lose her chance. It is too soon to be sure.
