Late this evening Judge Mehta released an order that enjoins (blocks) the government from applying the policying of not issuing visas to selectees present within the countries affected by the regional 14 day bans. Those countries are Chine Brazil, Iran, UK, Ireland and the 26 countries in the Schengen area.
It will take a day or so for the embassies to start behaving that way since the Department of State will communicate this tomorrow.
But relief is coming!!

Please don’t confuse the issues. Iran is still the subject of a ban, just not the 14 day ban. And none of this order affects DV2021.

As we all can see, Trump’s behavior and caprices have put many people’s lives on the stressful edge.
As we also now know, 43,000 or 40.000 people could not be interviewed (whatever) in two weeks, That is IMPOSSIBLE.
The main question now for the courageous Judge Mehta is: Will he have the muscles and the rights to EXTEND the September-30 DV deadline, and get it applied ?
Anything else could help. perhaps, but not much.

I am a named plaintiff in Group 5. I contacted KCC last week (Curtis’s team did, too) and no reply last week. However, as following your advice, I also contacted the American Consulate in Naha, Japan to let them know that my case was a mission-critical. After a short while, the Consulate set up my interview, even though I had not received the 2NL. They even asked KCC to transfer my case to the Consulate. Then, finally, I received my 2NL this morning! I’ve already done with my medical check yesterday (it was gambling, of course, but I just wanted to do everything I could do), so I hope I will be able to make it. I am so grateful for your advice.

Hi Brit. With utmost and deepest gratitude, my family and I would love to extend our gratefulness for your unwavering support to DV winners all over the world.
It has been rather a long and exhausting year since we started on this journey. I found out I was selected on the 21 October 2019 (long after the selection was done in May, with my letter sitting on the entrant status check). When I got the news on my email, I was rather ecstatic and anxious, as I did not expect to have made it through. We moved forward to get together documents, which was rather exhausting, time consuming and required us to be patient. We filled in our DS-260 for all of us (Me and three derivatives) in November, we had to add our youngest daughter as a derivative as she was not born yet when I initially entered the lottery, and after that we stumbled upon this amazing Blog. We read all your tips, advises and took all the positive comments to heart, and I must say that is what has kept us going till now.
Fast forward to last week, after judge Mehta’s verdict, we wrote to the Consular requesting to rescheduled as ordered by the judge. it took a few days, the embassy finally got back to us with an appointment for the 16th September (Today). Without wasting time we called the Physician for medicals, we were lucky to be booked for the next day (10 September). We gathered all the required documents and went through for medicals.
Interview:
Our interview was scheduled to be at 9:15. We got at the embassy at 8:47 and waited to be cleared by security. We was escorted inside at told to wait. Kindly note that we had to make payment a day before the interview as cashiers are not working on Wednesdays. At 9:35 we was called to submit documents and they took finger prints.
Documents for main applicant: ALL ORIGINALS and COPIES (Passport, Police Clearances, Birth Certificate, Marriage Certificate, High school diploma (SAQA), Highest qualification, pictures, affidavit of support and DS-260 Confirmation)
Derivatives: (Birth certificate, police clearance, and pics)
Notably, our youngest daughter was added after the selection and two days before the interview, we were informed that her DS-260 was not completed, we liaisoned with the embassy and sent them a copy of the DS-260 confirmation and the bar-code as they requested.
Consular Questions:
Took the oath and the questioning started.
CO:have you been married before?
ME:
CO: do have any other kids
ME;
CO: have you guys lived anywhere else than in this country?
ME:
CO: Who is your sponsor
ME:
CO: How do you know him?
Me:
CO:What does he do?
ME:

NB: She continues to type as we answer all her questions.
Asking to be excused, she closed the glass and intercom, and started to talk to a guy who has been standing and observing as the interview commences. It took more than a minute, she got back to us and said I must go sit a little bit further she needs to talk to my wife.
CO: When was your daughter born?
Wife:
CO: Which hospital?
Wife:
CO: For how long where you in labor?
WIFE:
CO: What time was she born?
WIFE:
CO: On your first entry did you know you where pregnant?
WIFE:
CO: When you got selected had you given birth?
WIFE:
The CO was rather looking for something tangible, or some sort of proof that she is our daughter, she then asked my wife to bring her closer so she can see her. Because we went ready and prepared for this, my wife told the consular that we actually brought pictures (family album). Together with the “observer” they where rather pleased as they went through the album that had sustainable evidence that she is our daughter.
I was then called back and my wife sat down:
CO: When was your daughter born?
ME:
CO: Which hospital?
ME:
CO: How long was your wife in labor?
ME:
That was the end of the questioning, she called my wife back and with a pleasant smile and a nod from the observer, she said ” Congratulations, your visas are approved you have to enter the USA before the 10th of March 2021. The Visas will be in your Passport this afternoon and will be couriered to you via DHL. Wishing you all the best”.

Lessons learned: Be patient, be ready, prepare and above all be HONEST AND TRUTHFUL.

The sentence that is destroying everything right now “good-faith effort “. Seeing people that are in group 1,2 and 3 struggling to get an interview, what do you expect from us that are in group 4. The sentence “good-faith effort ” is used in the best way from the KCC, Embassy and State. Actually, that sentence in making them to work as slow as they can. Called KCC and like always prioritizing plaintiffs, the embassy in our country (Kosovo) said they haven’t received nothing from State Department how to proceed, even though I send the link with update, but they give same answer like copy -paste. For two weeks our embassy hasn’t proceed any case, and now asking KCC to forward them base on that sentence ” good-faith effort ”. We are a country only 260 winners, and still they do not proceed. Actually, based on what I see, and even though I am part of Curtis 3.0 now, is kind hard seeing the judge extend after 09/30.But, as most people saying, hoping for the best but expecting the worse. Hi Simon, if the interviewer requires an extra document or clarification or whatever and provides the courier/drop off method of submitting after the interview:
How long would such process take to review/make decision after the embassy receives the submitted document?
We have an interview scheduled but the medical examination doctor said the full report won’t be ready until a day or so after our interview slot next week. We still received a sealed medical envelope from the doctor to give (not sure what is in it). The Consulate email with interview date and instructions specifically addressed non-ready medical exams situations, advising to still keep interview date regardless should the medical not be ready.
If we receive the medical next day and submit it on the same day or drop it off in person. Will it be processed in priority before the Sept 30 deadline? Thanks dude!

Could you please clarify one question for me? Yesterday, during the interview in a U.S. embassy, when I asked consul if we still need to wait till the end of December to travel to the U.S., she told me that “as DV is an exception from the proclamation about labor market protection, we can travel to the U.S. as soon as we get our visas”. From my point of view it looks like it’s not correct according to PP 100014.

It’s frustrating that you keep repeating the question rather than just reading the instructions. I tell you to read the instructions so that you learn and don’t miss anything.
The instructions say you need police certs if you were over 16 and in any previous country or countries of residence if residing there for more than 12 months.

how many people (named “plaintifs”) are on the Curtis and Morris lawsuit?
2) On July 16, there was another lawsuit (Civil Action # 20-1926) filled in the District of Columbia court with 75 plaintifs. Are those plaintifs being cared by the KCC or simply ignored since they are not parts of Curtis and Morris lawsuit ?
3) If the extension is obtained next week by judge Mehta (hopefully), who would benefit from it ?

1. I don’t have the precise number to hand. It’s high hundreds.

3. It would depend on what the Judge decides. He might benefit (extend) for all, or some, or none.

I contacted the embassy in Belgrade(Serbia)few days ago. They call my wife (unfortunately because I left her phone number in email, she is the principal applicant but not so familiar with the process etc. and I was at the office,working) and said that they don’t even have enough time for named plaintiffs, and I should forget about DV2020 because they usually process the numbers around 25k? What? Are you kidding me? Do they know what current means? Do they know what mission critical means? They didn’t wanted to call me because I know everything about the process. I don’t know what to do. We have only 250 selectees! Group 4 non-plaintiff. Received the same email from KCC like everyone else:

Trump, the Department of State is making a good-faith effort to adjudicate as many Diversity Visa applications as possible notwithstanding Presidential Proclamation 10014. The Department expects that, due to resource constraints, limitations due to the COVID-19 pandemic, and country conditions, we will not be able to adjudicate applications for all Diversity Visa selectees by that expiration date.
As ordered by the court, we are prioritizing individual named plaintiffs in the court case Gomez v. Trump and its companion cases who are applying for Diversity Visas. Beyond that, we have established priorities based on statutory standards and categories of cases most likely to result in timely issuances for eligible applicants. Accordingly, we are prioritizing applicants who have already been interviewed and who either have been determined eligible for a visa or may be determined eligible for a visa with additional information. We will also prioritize applicants with appointments that were cancelled in March, April, or May due to the COVID-19 pandemic and worldwide suspension of routine processing. Diversity Visa Selectees who have heard from the Kentucky Consular Center (KCC) that they are documentarily qualified, but awaiting an interview date, will be scheduled in accordance with their rank order and post’s capacity, consistent with our standard processes. What should I do? Should I just wait and see what will happen? I sign up for Curtis 3.0 lawsuit. 🙁 It’s so unfair. I see some embassies are doing a great job but not ours. So unfair!

You have to keep pushing, but the reality is that there is not enough time to process every case. That is why the extension is important.

Sort of. People from banned countries won’t get visas (in general) which leaves more for higher numbers. If Biden wins and removes the bans, it will be more risk for higher case numbers in the region.

I have 2questions because I am a little confused…
1. If judge Mehta decide to extend for 1 or 2 month (nobody knows) and if lawsuit 3.0 for extension for 1 year gets NO as an answer what happens ? Does we (category 5) profit from the decision of judge Mehta or not? ( i was not part of first lawsuit but for 3.0)
2. And if extension happens for 3.0 and jugde mehta still decides to extend… is it possible?

Hi Simon,
We had our interview originally scheduled for April that was COVID cancelled but we suddenly received an email to come in early next week. The email instruction stated that supporting document (police) needs to be issued within a year of the visa appointment, our reports were valid for the inital April interview but count as expired since the year period ended just only a few weeks ago.
We have no possible way of receiving an original from another country in a few days with such a sudden short period of time and before Sept 30.
Do you know if certification dates are a hard line at the moment? or anything about such a situation?

I don’t know whether they will be firm on the 1 year validity on the police cert – apart from if that is a country that you have not returned to (and then they will accept the police cert over 1 year old).

They (Schengen Area Consulate) weren’t firm on that in my case (I am group 1 and need visa re-issuance). They said they only require an updated police certificate from my current country of residence.
