Well no. There is lots of activity going on. KCC are working fast to accomodate named plaintiffs. Many people have been scheduled/contacted in groups 1, 2 and 3 by the embassies. So you cannot say there is no good faith effort being made. However, there are some embassies not working hard, there are the 14 day bans blocking some people, and of course there is not enough time to do everything. So – things are moving – but we need some things clarified by the Judge.

One aspect of public charge is suspended, not all of it. So – plan on having an I-134. Complete the DS5540, but you should not need health insurance quotes etc.

Hi Simon, I’m located in Germany and due to work I won’t be able to move to a non-Schengen country before next Monday. I’m in group 5 though and am still waiting for my confirmation from KCC.
1. I’ve submitted the form to join Morrison’s 3.0 case but so response so far. I feel a little lost and hope you can help me: does it make sense to join the case as a group 5 person (waiting for KCC confirmation)? It’s a lot is money for me.
2. How does Morrison’s case 1 and lawsuit 3.0 differ from one another? I know that for 3.0 they will request to move the deadline to sep 2021 for the named plaintiffs but is there anything else other than that? I know you can’t predict anything but you’re an expert in the field: is it generally possible to do such thing?

Well its not that easy.
1. KCC are prioritizing named plaintiffs, as the order instructs.
2. As they get capacity to do anything at all for non named cases, they have said they will prioritize in case number order.
3. If KCC have not previously completed processing of your documents, they may or may not be able to do that.

I am from group 5 and I still do not have any answer from KCC.
I sent my documents on 1.25.2020. On May 8, I asked for my documents and received an automatic answer. On September 7, I asked again but I have no answer.
Our embassy in Bulgaria (outside Schengen) replied that they would send schedules with dates to KCC with possible dates for interviews and KCC would schedule the interviews. In Bulgaria, the winners of DV2020 are a little over 300 and I think that the embassy has the capacity to deal with this.
I ask for your advice.
1. Although I am group 5 I do not lose hope, can I do something else?
2. Should I call KCC for information about my case (I think they are in a reduced staff and are quite busy working for us)?
3. What do you think I should do to be sure that I have done everything possible?

ds260 last March. Last April when I called them they said that my documents are in another department and did not tell me if my documents are OK. Some selectee of 5 group called KCC and they surprised that KCC can not see their documents. I think they deleted our case numbers.

I think we’ve established that an extension is too tall of an order given that it’s a law that sets program expiry with the government’s fiscal year, its also been highlighted by the DoS in their update and initial statement.
Also in previous years I recall you mentioned that a judge issued an order to extend for some of the applicants but the government never acted on it since it’s a law.
What’s your take on this one as well, are you able to get legal advise on this from the AILA team?

It’s difficult to get a blanket extension that covers everyone. Still difficult, but easier is an extension that covers some named cases. We will have to see what the judge decides.

what serious-ness?! I had issues with my parents and I had school tuition pending. I wanted to avoid any risks with the embassy and i want to be fully prepared financially because I will only have 6 months left when i take the visa. so rather buying time i was selling time accidentally. I didn’t know that trump has updated that restriction up to December until mid July! and I don’t know about your whole website thing until mid July. In a normal year, you would have ruined your own chances because the final September interviews would have been decided in early July. So – since you waited over a year to submit documents, you would have blown it anyway. Perhaps you didn’t understand that. But that means you didn’t bother to learn about the process, follow the instructions and so on. As I said, you were not serious.

Sent email to Sydney consulate. Took 3 days to reply.
Have been playing tag with emails ever since for 4 more days as they won’t converse on the phone.

WA State borders are closed and even though we have a US embassy in our state , they are stating that we have to travel to Sydney – on the other side of Australia( which we can’t, as the borders are legally closed ) to interview.
Why can’t they interview at the embassy in Perth? Definitely not trying to demonstrate a fair and reasonable effort to process us.
Nearly out of options – have asked for a third time for an escalation and reconsideration of our case. Still fighting..
Will be completing the form to update the lawyers on our experience tonight.

The staff in Perth are not authorized to issue DV visas. I doubt that can be overcome easily. Sydney are normally very responsive by email.
Is there no way you can get permission to travel? Have they literally closed the roads as well as airports? I fully realize it’s a hell of a drive – but that is what I would do if I were in your shoes.

Whether I was serious or not serious, or missing the deadline or not, you did not have to say things to make me feel worse and blame myself. But I won’t blame myself anyway because you are not in my position and you don’t know the whole story that I am in right now. Revise and ask yourself why did you tell me that I was not serious. You deserve nothing but rudeness after you said that to me… you do not know what the people are going through! If Judge Mehta grants us an extension, I wonder if you will be happy for us. And I just checked your first post. July 19th. Two days after you found out about the lawsuit you sent the documents, meaning you only did something once prompted by the lawsuit. And you called me an asshole!

This is what I said “tell me that i am not serious and you are just an asshole like your president” I did not directly call you an asshole but in case you gonna tell me I was not serious again then yes, you are!
Yes, it took me two days to do it because once I tried to submit my DS-260 form, it didn’t work. I emailed them and it was because I had to delete the numbers in the middle or in the beginning of the case number which I wasn’t aware of. I was trying to submit it even earlier than that.
Anyway, I lived 3 years in Florida and before that I lived 18 years in Saudi Arabia. Now I live in Jordan. I truly know the big difference between US and Jordan! There is no one wants this Visa as much as me. I’m suicidal because of this opportunity is flying away from me.

Why some of us are behaving very bad in here? Let’s try to be calm and cool. We understand things isn’t moving they way we want and expect it to be. But we just have to be patient and speak politely to one another. The Almighty Allaah is with us and there’s a success along the struggle for us all.
