OK – as you all know we won an order that helps DV2020 cases be processed. However, there is some confusion about the current position, so let me clarify that and at the end of this article I want to make clear the three different legal efforts still going on that you may want to participate in.
Scenario | Current status | Notes |
DV2020 Named plaintiffs | Government is prioritizing processing for these cases, but they could still be affected by the other bans (such as Schengen etc) | This means the 7 people on the AILA case, all the people named as plaintiffs on the Charles Kuck and Curtis Morrison cases |
DV2020 Group 1, 2 and 3 (previously issued, AP, and cancelled interviews) | Embassies control these cases and embassies are mostly working to accommodate these cases – but again could be affected by the other bans (such as Schengen etc) | Selectees should be contacting embassies directly and, arranging medicals etc. |
DV2020 Group 4 (ready for scheduling) | KCC are expected to move their attention to these cases once the named plaintiffs have been handled. However, it is likely there will not be time to help all of these cases by September 30th, 2020. The Judges order says the government should use “good faith” efforts to help DV2020 cases, that is NOT an order that they must process ALL cases by the deadline. It is likely that KCC process these cases in case number order since they need some way tom determine who they can help first. | Selectees should be contacting KCC mainly but may also get help from the embassies in a few cases. |
DV2020 Group 5 (not ready for scheduling) | These cases are considered “not documentarily qualified” – which means they are not ready to be scheduled. Given the other priorities and the lack of time, I do not believe any of these cases will be helped unless they are named plaintiffs. | The only hope for these cases is an extension of the deadline. |
DV2021 cases | The judges order does not block the immigrant ban at all and does not help DV2021 cases. If KCC continue processing as they have, they will not schedule any cases for interview until January (2NLs in November). That will leave 9 months remaining for processing. | |
People affected by the travel ban 3.0 (Muslim ban) | These bans have been challenged through the courts, right up to the Supreme Court, and allowed to remain in force. That means people from these countries cannot generally receive their visas, except for a few exceptions. | Includes nationals of: Iran, Libya, North Korea, Syria, Yemen, Somalia, Eritrea, Kyrgyzstan, Myanmar, Nigeria, Sudan, and Tanzania. Also certain gov officials from Venezuela. |
14 day restricted countries | As of today the government is denying issuance for anyone in these countries. This includes ALL groups above, including named plaintiffs. The lawyers are fighting that decision and there is a hearing taking place on Monday Sept 14. | Includes Schengen area (26 countries), UK/Ireland, China, Brazil |
People in countries where embassies are closed and travel to other countries is not possible | There are people in countries where for one reason or another the US embassy is closed, but travel restrictions mean it is not possible to go elsewhere to interview. The Judges order offered no solution for that, since the restrictions in this case is the responsibility of foreign governments. | These people can probably only be helped by an extension of the deadline. |
I hope the table above explains things in a simple way. Please study it carefully to figure out which notes apply to your case.
Lawsuits you may want to participate in:
Right now there are three efforts to gather more details to file additional lawsuits either to give information to the Judge on the September 21 hearing, with a goal to extend the Sept 30 deadline, or in the case of Curtis Morrison 3.0 case to file a new suit to try and get an extension of the deadline. I am not going to advise you which of the suits to participate in – that must be your choice.
The lawyers need as much information as possible on how the government is handling the Judges instructions. So – there are three ways you can take action if you feel it may benefit you.
- Complete the AILA form which is gathering information to present to the Judge, and perhaps to ask for an extension. The link is here
- Greg Siskind (a colleague of Charles Kuck) is gathering information from people to potentially join a lawsuit to ask for an extension. There is no fee to join this lawsuit. That link is here
- Curtis Morrison Case 3.0 is being filed very soon a lawsuit to extend the Sept 30th deadline. There is a deadline to participate in the lawsuit. There is a fee to participate. That link is here.
There is a difference in strategies between the suits 1 and 2 versus 3. The first two groups of lawyers have consistently tried to argue for all selectees, not just named plaintiffs. Curtis on the other hand has always been clear that his focus is on the plaintiffs he represents. We saw from the first order that the Judge prioritized named applicants, but that is not a guarantee that he won’t act for all cases. We can’t be sure.
Finally there is a hearing on Monday to try and resolve the difficulties being placed in the way of some cases – you can listen in to that hearing if you wish. The details are here.

I really understand there is very low time for dv2020 selectees and all layers are in this moment involved to obtain extension of any other solution that could give more opportunities to them but, what about dv2021? I cannot travel back during this time because in Cambodia the government restricts new arrivals 21 days quarantine due to coronavirus. Hello Simon and everyone- On a note about the medical exam- I will contact the Medical Centre tomorrow morning, as I have a scheduled exam this Tuesday, and see if I can have any required vaccinations done beforehand. I kinda cringe at the notion of 3 or so vaccinations done at once! (My dad is a medical doctor himself, so easier for me)On a technical note, ‘Pneumococcal’ has different types, so need to make sure. I’m a category 4 DV2020 winner (case number 45k) currently waiting for my 2NL I have contacted KCC and both my home country embassy and the U.S embassy in Vietnam where I currently reside. KCC replied to me yesterday saying they’re prioritizing plaintiffs and category 1 2 and 3 but the U.S embassy in Vietnam didn’t reply to my emails and they’re not answering the phone so I’m thinking to go in person even without an appointment. I’m trying to convince KCC and the embassy to change my interview location to Vietnam as soon as possible because Vietnam is not eligible for the DV program which make it the ideal embassy to schedule an interview. Besides the country is closed for months and it’s covid19 free so most probably I’m the only person with a DV Visa interview and It’s considered mission critical!
Do you think if they refuse to schedule an interview for me I can argue that it’s bad faith and unethical?
I received my confirmation last march and my case number is current since June

Hello sir, You didn’t include the type of other problems. They are of course very few but causing big trouble and financial hardship.
People who were on Medical Hold, Report was clear while waiting for interview on March their appointment was cancelled. Family and children travelled into the USA and their family is separated. Such froup need at least 58 days for medical report to be clear. Not given any priority in Interview now. Very unfortunate!

We’re in group 3, get our interview appointment on Sep 25 and have finished our medical on Sep 11, but one of our medical need 8-12 weeks time to check further more.
And we’ve decided to join Curtis’s DV 3.0 lawsuit because we’re not eligible for Greg’s lawsuit, and we really need & want to have an extension time.
I just asked the medical admin, they said that our medical won’t be sent to embassy until all of our medical are complete & ask us to tell the embassy before interview.
Questions:

The person whose medical need that long will not get a visa. If that person is the principal, the case is ended unless there is an extension. If it’s a derivativem, the others can be approved. Tell the embassy, and the delayed person should not attend the interview. Save the money.
It will take two years to bring the delayed person (again, unless the year is extended).

I spoke with our embassy in Bulgaria and they explain that they have enough slots/time to interview all of the winners until 30.9, and they cannot do anything else if KCC didnt scheduled me.

I am in your group 2 i am in AP 221g since February.(no other documents needed by CO but just a verfication). In fact I am clean in everything everything.
I have emailed called them twice a day for one week and i get an automatic reply that they have started working according to DOS instructions.My visa status check (ceac)has been updated three times .is this a good sign ?
I am afraid that they will neglect my case ..leaving me in AP till deadline .
I keep fighting as you advice but no result.
Do you suggest me to email to KCC ,to US ambasador here , to Aila,Kuck,Siskind ,Morrison,Judge Mehta, or to DOS i dont know , in order to push my embassy. or do i have to wait a bit. I think i am running out of time. I need your professional advice please i dont want to lose this life changing opportunity. I did my max to write to you shortly because i respect your precious time .

Brit according to your explanations in this article I am in group 3 and I filled d form from AILA as you requested us to do on your blog.
Now I have requested my US Embassy in Sierra Leone with three e-mails and they only responded once by telling me dat they received my e-mail and that the consular section is closed for routine services I should keep watching d US Website to know when they will be open to the public. I even called them they ask me for my details and said they will get back to me but since then nor call received from the US Embassy.
There was a letter sent to me by LAB that ask me for update to d way d embassy is responding to my case and which I have done but it seem they don’t want to give positive answer to my request. Also there was a form in d said letter requesting to know how d embassy are treating our cases so I have filled it and they respond to me dat I was represented by a lawyer so i should contact them to know my position. But hence I do belive AILA named plaintiffs are d ones that were represented but my name is not d names listed.
So pls I want you to help me with AILA e-mail so dat I will contact them. So far dis is my position.

I am from Sri Lanka, called the embassy and they noted my name /case number and contact number promising call me back about the interview status but didn’t . Seems they dragging the time till the expiry date arrive . Here is the reply from the embassy.

I called to KCC, she said : plaintiffs goes first … I asked , do we have any chances if we are not plaintiffs, she said I don’t know , because we have a lot of plaintiffs from countries where embassies working very slow or not working at all…
We have no chances ?
In my country last case number that went to interview is 22550, my case is very close to it … 🙁

As I have said, I do not expect KCC to schedule all group 4 cases. I don’t know if they will schedule ANY of them, and of course it depends on embassy availability. If your embassy has a large number of cancelled interviews, it might be that the embassy has said they cannot handle any new cases.

I’m from Nepal and I’m in group 4, fortunately USA embassy here in Nepal started interviewing people from today onwards. Hence, I called KCC today to request them if they can schedule my interview, but they completely deny, they said they can only schedule interviews for people who ware in lawsuits as the same has been instructed to them by DoS. So there no hope for us as “Britsimonsays”. Only Set aside of visa can help us.

I am in group 4 , case EU226**.
I called KCC and they said they would assign interviews only for the plaintiffs . I asked how quickly you will schedule an interview for plaintiffs, they told me that many embassies accept only few people because of the coronavirus and most of embassies are not open, so they don’t know.
So we don’t have a chance?

Hey Brit, my case number is AF48*** from Ethiopia. I emailed KCC and the Embassy In Ethiopia with the format you suggested and KCC replied saying they follow the prioritization scheme, as expected. But since embassies have different numbers of cases in hand, some embassies with few cases to work with can interview higher case numbers even though those cases are at the bottom of the prioritization scheme. i wanted to email KCC pointing out this idea and asking them to contact my embassy to check if they can interview me regardless of my case being in group 4. I just wanted to check with you first before sending the email. Thank you!

Could you please help me ,
I was in the States in 2012 “Work and travel”. The fact is that we wanted to change job a month after we started working, but employer refused to let us go. We called the Committee for work with complaints about exploitation. As a result, the Employer let us go, but we no longer worked , only traveled.
After that, one guy who was in the group of “Work and travel” participants was detained for theft , I had to go to the police station for him and gave my passport data so that they would let him go.
Can this be a problem for Green card , since I didn’t work any more, didnt pay taxes, called to the Committee and went to police station with my passport details ?-_-
