Over the last few days I have been asked to clarify the importance of Marital status and the DV lottery. This point should be simple, but rules vary from country to country – so there is some potential for mistakes which (on marital status) are extremely important to the case. Even though the entry period is over for DV2016, this is important information to clarify to make sure you have not made a crucial mistake.
On the eDV registration (the original entry) you have to indicate your marital status. Making a mistake on these can end your DV lottery dream instantly – so it is critical to get these right! The choices are
- Unmarrried
- Married
- Divorced
- Widowed
- Legally Separated
So – what do those choice mean – here you go…
Unmarried
This means single at the time of the eDV entry and never previously married. This could also mean engaged (because engaged to be married is not married). If you select unmarried and are discovered to have been previously married or married at the time of the entry you will be disqualified.
Married
This means married (in which case you must list your spouse on the eDV entry). If you are separated from your spouse (but that separation is not documented by a court) or estranged or just grumpy with your spouse on the day you enter the lottery then you are married.
So – what do you do if you are married but haven’t seen your spouse in 10 years. Well you still list your spouse, including a photo that meets the requirements if needed. If you win, you simply don’t submit an application (DS260) for your spouse.
How about if you plan to be married shortly after the eDV entry, should you save time and enter married. NO, NO, NO! If you are not married on the day you enter the lottery do not enter as married. If you marry later (during the DV process) there are ways to include your new spouse (as described here) , so don’t make the mistake of claiming marital status without being married – there is no need to risk that (as the risk is disqualification) .
Just a point about “marriage”. The US government recognizes the various forms of marriage around the world. The rough rule is that if the marriage is recognized by the civil authorities in the area where the marriage is performed, and that recognition confers typical rights and privileges of marriage on the couple, then the US government will recognize that marriage for immigration purposes. That applies to any form of legal marriage including same sex marriages.
Divorced
This means you were married previously, got a divorce (legally recorded through a divorce court) and have not yet remarried – you are currently single. You will need to supply your marriage and divorce documents. If you cannot show the divorce documents you might be assumed to be still married, and in that case you could be disqualified.
Widowed
This means you were married, your spouse died and you are not currently remarried. You will be asked for proof of the marriage (marriage cert) and the death (death cert).
Legally Separated
This is rarely used so you should only select this option if you are certain you are LEGALLY separated. Under this option of the eDV form is the following text:-
“Legal separation means that a court has formally declared that you and your spouse are legally separated. Legal separation means that your spouse would not be eligible to immigrate as your derivative.”
This means you have gone to court and had a separation agreement accepted by the court. This happens when people do not want to divorce yet but need a formal agreement covering things such as who pays for the shared expenses during the separation, access and custody to any children and so on. You will need to show the legal separation document during your interview.
This is not the right option if you have simply separated from your spouse but have not yet divorced. It is my belief that choosing this option when you are not actually legally separated will result in disqualification (because you omit your spouse who should have been on the form.
But I won and my marital situation has changed – is that a problem?
No – life goes on after the eDV entry. You may have got married, divorced, or whatever – so when you submit your DS260 you will do that with your new marital status. However, they will look to prove that you correctly entered your marital status at the time of registration, so you need to make sure your documents are available for the interview and establish the correct timeline.

My names are marie and i was randomly selected in dv 201 7 lottery.I was disqualified bse i didnt include my husband at the time because we has separated though not officially. I didnt read ya advice prior to filling in my DS260. I mentioned him later in D260 and we went with him to Nairobi for the Interview though we are living separately. I literally begged him to give me a picture and he refused so i entered as legally separated. We missed that chance after paying so much money and getting those vaccinations, and bse its me who paid for us and our three kids. I thank you for all the advice and time taken to respond to us all. I was hurt but am not blaming anyone bse it is in black and white when u leave out a family you are disqualified. Am asking can i apply again

Hello, my sister was selected as a winner of the lottery.. but at the the time she was filling the forms for the lottery, she was married to a man and after she was randomly selected, she had divorced with the man and married a different man. The problem now is he used her ex husband name to fill the forms before winning and now they are divorced and she’s with this new man. THat is no problem. She would complete the DS260 with the new husband, and make sure she takes all documentation of wedding certificates for both marriages and divorce papers for the first marriage.

He does not have to wait 3 years for his Green Card. That is incorrect. It should have arrived after 3 months, but if he was a DV lottery winner he is already a permanent resident and has no restrictions.

I was married at the time of my DV 2018 application and I submitted my application in full compliance. However 2 months later, I got divorced. My ex-spouse is now from within the list of banned muslim countries for visa as of the beginning of this week.
Now I’m concerned this would adversely affect my DV application although my own country of origin and residence is still eligible.

I have applied for the dv lottery through the official government website, but yesterday I received a phone call from someone in new York (not Kentucky) asking to verify the information in my application. They asked me to pay 500 dollars to complete my application and provide services such as renew my application for 4 years, arranging the interview in the embassy and help me get a job and so on. She also asked for my visa card number and security code which I definitely didn’t give. After I talked to her for a while I felt she is scammer so i refused to pay. She said: ok, we will cancel your application. I replied: go ahead!
My question is: should I expect any phone calls or emails from the dv lottery before or even after I am selected?

They applied to the cord but, at Turkey you cant divorce before 12 months. (he dont knew it) anyway now they will go to cord on 16 July(12 months done) to divorced. Your friend will be disqualified, because at the time of entry he was married and therefore had to include his spouse. Disqualification is certain, even if he now gets divorced.There is no way to fix it.

Please Sir, my wife has won the DV lottery and scheduled for interview June,2017 this month. My name is listed as beneficiary but when filling the DS 260 form, we agreed to answer “no and yes” to the questions ” is your spouse immigrating to the U.S. with you and is your spouse immigrating to the to the U.S. at a later date to join you” respectively Due to this, i did not fill my side of the DS 260 form. Thank you very much Sir. The actual interview date is 13th June, 2017 at 9;30am. I am very worried about my ignorance.
We made the decision based on the statement on the travel.state.gov website that
” I would like my spouse and/or children to follow me to the United States after I immigrate. Can they do that? – Yes, but remember that all diversity visas for a fiscal year must be issued by September 30. Available visas for some countries and regions may be used up prior to that date. If your spouse and children delay obtaining their visas, they may lose their opportunity to immigrate on the basis of their DV applications. If this happens, you will need to file a petition to bring your family to the United States at a later date. If they do not obtain diversity visas prior to September 30, your spouse and/or children may have to wait several years to join you.”
Due to this decision, we decided that I will renew my passport after her interview and later fill the form and start my process so that I would finish my exams before I leave.
Please is it possible to pass through the process before 13th June. Please what should I do.

That is no problem. BUT if you were married to your current husband prior to the DV entry your present husband was *required* to list your son. If he did not do that, he should be disqualified.

The operator made a mistake on my original entry. Instead of marking legally separated as my spouse and I were on separation (legal) prior to playing the DV, he marked unmarried. With this, is there any chance for me if I correct same on the ds-260 by marking legally separated

That is a serious mistake. It might cause denial, because theoretically your wife could become eligible for a Green Card if you reunite. However, I am not certain of the outcome at interview. In any case, tell the truth in the D260

Simon, Just I as indicated above, I have been to the US on two different occasions on a visiting visa with the status of a legal married man which the embassy is aware of. I was just unfortunate that my wife and I was on separation (legal) prior to playing the lottery and worst of it the operator (filling the entries for over one hundred applicants as it was the day to the deadline) mistakenly marked unmarried instead of legal separated as he was told. With the intervention of the church and relatives, my wife and I are in court presently trying to settle our differences and reunite as husband and wife. As things work out which I believe has already happened because of our reconciliation, I want to complete the DS-260 with the status married instead of legal separation as earlier stated because this is the correction information as we speak now. With this I plan to list her name but will not create a form for her. I have all the necessary papers from the court. Kindly advise me. thank you

Hello..I will be claiming the country where my mother was born as my country because I was born in an illegible country. But the issue is our surname that is ,family name is slightly different in terms of spellings but still the same thing . I added a prefix to mine as a Muslim which is spell as ABUBAKARE and my mother as BAKARE .The difference there is the ABU which I added to mine .would there be any issue against that .

Hi, I currently registered for dv 2019. My problems now is that, after reading through your posts and comments I realised I havw made mistakes; I have a son with my boyfriend,(broken). but later got a customary married to a Nigerian with no child. Sir my issue is that in filling edv form, I entered unmarried, bcos am having problem with my Nigeria husband. And I didn’t include my son also bcos he is far from me at this time.
Sir. My question is would I be disqualified incase I am selected?

Hello sir, we still want to enter for dv 2019, so I was thinking of entering as an individual while indicating that am.marriedI and providing her details and my son’s, while she also enters as an.individual and accepting she is married and providing my details as well and that of my son’s, so do.u think this will increase our chances or disqualify us sir.
