A friend, Matina K, has suggested that some might benefit from a post about how to handle the situation when you have entered as single and want to get married at various points along the DV process.
Firstly, I should explain that the marital status question in the eDV entry is one of the critical questions on the form – a mistake on your marital status can (and typically does) cause disqualification – even if the mistake was innocuous/innocent. Some people, for instance, choose “legally separated” when they are in fact, married, but separated. Unless a separation is legally recorded (typically by a court) then you cannot claim to be separated. Similarly, if you enter married because you plan/expect to be married before the results are announced, that can also cause disqualification. It is essential that you take this question seriously and literally.
OK so what do you do if you are planning to get married before the results are announced OR you are selected and then realize that you want to take your boyfriend/girlfriend/partner. The process depends on the exact timing, between the original entry/registration (October), result announcement (May 1), your interview date (after October, according to when you are current) and the end of the DV year (September 30).
By the way, these comments relate to opposite sex, or same sex relationships. Since the repeal of DOMA the federal government has recognized same sex couples have the same rights for immigration benefit as opposite sex couples. US immigration law therefore respects marriage based on the laws and customs that govern in the place where the marriage was performed. If a marriage is considered legal in the place where it was performed then US immigration law treats the marriage as lawful. I will refer to your boyfriend/girlfriend/partner/fiancé all as partner from now on in this article.
Entry of an unmarried couple in DV lottery
First of all, if you are unmarried you cannot list your partner as a spouse. You can of course both enter the lottery and if either one wins then they have the option of marrying to confer the benefit of a visa (and then Green Card) on the other. Just be aware that each principal selectee (winner) has to meet the requirements in their own right (regarding). Whilst married couples can benefit from cross charging to a spouse’s country (if their own country is ineligible) that option is NOT available to single entrants that later marry. If you are unmarried but have children then both entries should include the children as derivatives.
Scenario 1: Marriage after registration, but before the results are announced.
This one is “easy”. Life happens, you don’t put your life on hold simply because you entered the DV lottery. So – you got married, then you found out you were selected so you simply fill in the DS260 as a married couple. There will be some “normal” scrutiny of the marriage – even people who have been married years have been lightly questioned about the marriage in DV interviews. Marriage prior to selection may get similar interest – and if you want to be extra prepared then take some proof of the marriage as I will describe below.
Scenario 2: Marriage after registration, and after the results are announced, but prior to interview.
OK – there is nothing wrong with this if the relationship is real. In fact it is absolutely the sensible thing to do in some cases as I will describe shortly. However, winning the DV lottery is a huge opportunity and there are plenty of people that have tried to manipulate the system to obtain two Green Cards based on a “sham” marriage. It is therefore up to the couple to demonstrate the genuine nature of the marriage and, especially in countries where fraud is more common, the couple should be prepared for extensive and deep scrutiny of the marriage. People have been prosecuted for immigration fraud based on sham marriages – so please don’t even consider that!
If you have plans to marry shortly after the announcement of the results, you may decide to hold back submission of your DS260 until you have married, so that you can include your spouse on the first submission of the forms. However, if you have already submitted your DS260 and marry while you are waiting for interview, you can request KCC to unlock your form (email is best) and then modify your DS260 to include your new spouse (including modifying your own entry to reflect your new marital status). In the email requesting the form unlocking, I would suggest including a scan of the marriage certificate which will be added to your KCC file (later sent to the embassy or Field office if doing adjustment of status).
If the marriage happens after the case has been passed to the embassy for a scheduled interview, you should still inform KCC as a precaution BUT your actual approach is to handle the change direct with the embassy. Some embassies are relaxed about who attends the interviews, others are very UNrelaxed – so in some cases you will have to contact the embassy or ask KCC to contact them on your behalf to get your spouse added to the interview schedule.
Scenario 3: Marriage after interview, before entry to the USA, and before the end of the year.
OK – you like to live on the edge don’t ya! This is still technically possible, but unwise. The process involves approaching the embassy that handled your case. However, this is a highly risky strategy as the embassy may not understand the rules, you might time out, visas may be exhausted and so on. The MUCH more preferable option is to bring forward the date of your marriage before the interview.
Scenario 4: Marriage after interview, after entry into the USA but before the end of the DV year (September 30th).
OK – this is rare, so rare that I am not even sure this would be technically possible/legal. If you have created this mess you may be able to process a derivative case but this would be highly risky since they would rightly wonder why you hadn’t handled this earlier (i.e. causing them severe doubt that the relationship is real).
Scenario 5: Marriage after the end of the year
This one no longer falls under DV lottery rules – a normal immigration process would need to be followed which is slower and more expensive.
Proof of relationship.
How can you prove your relationship is genuine and not just a sham to take advantage of a DV lottery win. Basically this is a matter of demonstrating your life together and the big events with documentary evidence. This can include the following suggestions.:
- Photos/Emails/Joint bills from the period of time before the marriage.
- Photos or other evidence from the wedding ceremony itself.
- Joint financial documents such as shared bank accounts.
- Knowledge of each other, your extended families and so on.
Get your thinking cap on – the burden is on you to prove the marriage is real. If there is doubt in the mind of the CO he/she is entitled to deny your visa with no appeal process (in consular processing cases).

I have called KCC today regarding marriage after DV entry. I asked that ” I was single when i entered the program and our marriage was after the releasing date (May 15) of DV. I am the principle applicant and winner, and my husband is from one of the ineligible countries. So in this case is it not possible to add him on my DS 260?”

In your case, there is nothing wrong with adding a spouse you marry later – and they will be charged to your country (as the principal selectee).

I got selected for DV2019 ,but here is my question .
I was married traditionally when i completed the original draw .I used my own Surname as on my Passport,our kid with my surname ,then filled details of my wife with her own surname.
We intent to marry legally in court and then obviously my wife Will be officially using my Surname.
When we eventually submit DS260 do you think changing her surname will have an effect/ on our application ?

BritSimon I really appreciate all this great information but I still don’t have all the answers I need.
My girlfriend and I are both foreigners to the US but both have been in the US for 12 years with various VISAs. I am German and she is Chinese. I finally won in the DV and submitted my DS260 last summer and since my case number is pretty high, my interview won’t be until August most likely.
My girlfriend has a pending EB5 application which she found out might take another 2-3 years (she submitted summer of 2015) so we wanted to see if I could add her to my application.
From what I read it is possible to add a spouse to the winners application even after selection and even if the spouse is from a non-qualified country. Is that correct?
So I should still be able to update my DS260 and add her as spouse (ofc after I get married)? Do you see any issues there?

Your number is quite high. Unless EU gets more quota, you won’t get an interview. However, it takes time to add a new spouse, so you should have married already and updated your DS260 (which must be done prior to scheduling).
So – unless you marry immediately (I meant this week) and add her immediately, you probably have left this too late, and then you have the risk that EU cutoff is too low for your number. So – decide. But do it fast.

I know it is soy unwise and i think that if i change my DS260 in this moment its a risk to be descalified, but my question is this, “what about if we get married when i arrive at the usa and i know that he has to wait almost 2 years, but during those 2 years he can visit to me there and can i do the same ?? i mean, he can travel to USA normally during the petition is in process? he doesnt have a turist visa because he is from Germany.

There are reasons why your case could be complicated.
1. If the kids were born prior to the date of your DV entry, the kids should have been on your entry. Were they born at that time and were they listed?
2. You can only include a partner to whom you are legally married. This is easy enough to do – but you have left it very late. So – if you are going to add her – you had better get married and add her immediately (assuming Q1 is not a problem).

Basically I am engaged and have been since Oct 2016 however we have yet to marry which is why I did not put my fiance on the application when I applied as he was not considered a spouse. We have been together 7 years but our wedding is next year April 2019. Anyway I have been invited for the interview this July and I am wondering if my status will be viewed negatively if that makes sense. Do I need to disclose this (due to my engagement ring being an obvious indicator) I was shocked to receive this Visa Interview as I won the lottery last year May and it has been that long.

Thank you so much for doing what you do. Largely thanks to this blog, I went through the process 2 years ago and I am now happily living in the states. I am back with questions, as I am researching for a friend.
Have you had any posts / feedback / interview experiences about the 3rd option: Scenario 3: Marriage after interview, before entry to the USA, and before the end of the year. ?
Long story short: a friend boyfriend is selected. they want to get married and come here together. However, she’s just 18 and will be in the last year of high school this year. Due to local legislation, she cannot be legally married and attend high school at the same time, and while high school diploma is not a requirement for the derivative, she still wants to complete her education before she leaves for the states. So she will have to wait for next April to get married (and the case number is very, very low – 6XXX).
At this time they are planning to delay the DS 260 submission, then the boyfriend to submit as single declaring his intention to marry soon, then to get married later and attend another interview for her. It’s risky, but we do not see any other option, she does not want to be without a high school diploma. So I am searching for any interview experiences / feedback on how to go about this, what to watch out for and how to approach the matter at the embassy. Any pointers will be appreciated.

I would not recommend anyone deliberately base their hopes on scenario 3.
In your friends case, there is no need. They delay the submission of the DS260 until the marriage. The they submit as married, no problem.

Simon what happens if I get married just before my interview, call the consulate to add my wife etc., and then I show up alone at the interview saying that my wife became sick or something similar. Would that instantly disqualify me? I know that with other non DV lottery cases, it is possible. Reason I am asking is that my wife would risk not getting back into the US if she were to go to the interview with me and we for whatever reason get denied the GC. Also, she would first have to travel back to her home country before she could get a visa to my home country where the interview will take place.

So an old friend just call me that she has been playing for all of us and against all odds i have been selected.to my issue,she did some spelling errors on my name and actually put me as single not knowing since college i have been married(to a us citizen) we separated but never divorced(was thinking of getting annulment get caught up with life) and now have a 2nd baby on the way with my on and off fiance (we did our introduction dec17).we all went to college in US before moving back if you were to ask.
So shud i consider applying for us(daughter is 5 and us citizen no need)or just assume my entry is void because of the marital status error?

I used to work in Dubai since 2016 to 2018. I’ve completed my contract period on march 15/ 2018.I was deported from Dubai to Nepal on March 27/2018.
I had obtained police clearance certificate from Dubai police before I left Dubai it was on 11th march 2018. It has 3months validity and has expired on june 11/2018.
Recently; I’m in nepal.
Do I need to obtain the new pcc from dubai police or the old one works out?

A friend of mine won a dv lottery 2019. He applied as married including his fiance in the application. After a while they parted ways and the lady got married to another man. The man is the principal applicant and has not filled the ds260 yet. He has asked me this question but i honestly I don’t have an answer. can he fill the ds260 as single excluding the former fiance? can this bring him problems during interview now that the lady is no longer interested with the dv any more even though they applied together as a couple? they have no marriage certificate though.

Unfortunately me and my girlfriend couldn’t get married prior to my interview, because of some personal circumstances.

Pregnant women do have the medical. For the Xray, they are given a shield to protect the baby. If you decide you don’t want that – you can’t get the visa, unless the process can be delayed until after the birth (and then there is some risk caused by the delay).

This is so true. I went for my medicals yesterday and they kept asking me if I was pregnant. There was a couple that was just after us, the wife was 4/5 months pregnant. The receptionist was telling them that the woman’s visa may be denied cos if the pregnancy.

May be denied ***IF*** the woman decide not to have the Xray. My point is – if the woman can be offered the shield, the XRay is considered safe – but she may decide to delay the interview until later but that decision comes with risk.
The point is – it’s a choice for the woman – and that choice does not mean causing harm to the baby, since the Xray can be done safely.

BUT, I won’t ask are you sure, but why did the doctor tell us that the woman’s visa will be denied cos she’s pregnant ? She explained that they wouldn’t want her to have a child on the American soil without her getting the green card first. This is confusing.

Hi BritSimon , I want to understand this. My wife was not a high school graduate when I marriage her, after our marriage I later send her to school but she was carrying my surname in school till she became a high school graduate after her graduation she and I play DV as marriage and she is the principle applicant luckily for we where selected for further processing. But now all my wife educational documents is carrying my surname is there any problem with that in haven VISA?

Thank you for your help and patience, your clear explanations help a lot. I am a selectee for DV 2019, DS-260 has been submitted with the marital status single. My CN is EU9xxx, so I assume my interview will be scheduled March/April 2019.
A little background story, just to be clear. My boyfriend and I are living in a long distance relationship more than 2 years, he is from the same country as me, but he is living in the States currently, while I am here in Europe. Since I already submitted my DS-260 form as single, we can only go with scenario 2 obvoiusly.
Question 1: In your opinion, does it make a difference if we get married in the States or in Europe? I got that we should act as fast as we can, but it can’t happen before December when I will visit him, or if it is better in Europe, it is not going to happen before February, which is almost last minute before the interview, if I will be called in.
Question 2: I know that the partner does not have to meet the requirements, only the selected one. Is this mean that they don’t even check his DS-260 form as deeply as mine? I mean I know he wouldn’t be approved for a visa if it would be his individual application, not as my partner’s, but does it make any disadvantage to me? Can I be denied because of him?

2. Because he has overstayed. He meets all of the other requirements, except this one, and they will see it immediately of course. Do you think that it can cause a problem for us? I mean is it possible that I will get a visa, but they deny his, in spite of that he is my husband? If there is a risk to deny my application, maybe we should go with a total different option, the family based sponsorship, which I know is more difficult, expensive and longer. Any suggestions?

Once married, that child is your step child. So – get married, add your spouse, and if you want to take your step child (and your spouse has custody) you can do so.

AGAIN. Once married **YOU HAVE A CHILD**. You, not just your spouse. You list your spouse and child in your DS260. Only complete a DS260 for each person wanting a Green Card. Keep reading this reply until you understand.
