A friend, Matina K, has suggested that some might benefit from a post about how to handle the situation when you have entered as single and want to get married at various points along the DV process.
Firstly, I should explain that the marital status question in the eDV entry is one of the critical questions on the form – a mistake on your marital status can (and typically does) cause disqualification – even if the mistake was innocuous/innocent. Some people, for instance, choose “legally separated” when they are in fact, married, but separated. Unless a separation is legally recorded (typically by a court) then you cannot claim to be separated. Similarly, if you enter married because you plan/expect to be married before the results are announced, that can also cause disqualification. It is essential that you take this question seriously and literally.
OK so what do you do if you are planning to get married before the results are announced OR you are selected and then realize that you want to take your boyfriend/girlfriend/partner. The process depends on the exact timing, between the original entry/registration (October), result announcement (May 1), your interview date (after October, according to when you are current) and the end of the DV year (September 30).
By the way, these comments relate to opposite sex, or same sex relationships. Since the repeal of DOMA the federal government has recognized same sex couples have the same rights for immigration benefit as opposite sex couples. US immigration law therefore respects marriage based on the laws and customs that govern in the place where the marriage was performed. If a marriage is considered legal in the place where it was performed then US immigration law treats the marriage as lawful. I will refer to your boyfriend/girlfriend/partner/fiancé all as partner from now on in this article.
Entry of an unmarried couple in DV lottery
First of all, if you are unmarried you cannot list your partner as a spouse. You can of course both enter the lottery and if either one wins then they have the option of marrying to confer the benefit of a visa (and then Green Card) on the other. Just be aware that each principal selectee (winner) has to meet the requirements in their own right (regarding). Whilst married couples can benefit from cross charging to a spouse’s country (if their own country is ineligible) that option is NOT available to single entrants that later marry. If you are unmarried but have children then both entries should include the children as derivatives.
Scenario 1: Marriage after registration, but before the results are announced.
This one is “easy”. Life happens, you don’t put your life on hold simply because you entered the DV lottery. So – you got married, then you found out you were selected so you simply fill in the DS260 as a married couple. There will be some “normal” scrutiny of the marriage – even people who have been married years have been lightly questioned about the marriage in DV interviews. Marriage prior to selection may get similar interest – and if you want to be extra prepared then take some proof of the marriage as I will describe below.
Scenario 2: Marriage after registration, and after the results are announced, but prior to interview.
OK – there is nothing wrong with this if the relationship is real. In fact it is absolutely the sensible thing to do in some cases as I will describe shortly. However, winning the DV lottery is a huge opportunity and there are plenty of people that have tried to manipulate the system to obtain two Green Cards based on a “sham” marriage. It is therefore up to the couple to demonstrate the genuine nature of the marriage and, especially in countries where fraud is more common, the couple should be prepared for extensive and deep scrutiny of the marriage. People have been prosecuted for immigration fraud based on sham marriages – so please don’t even consider that!
If you have plans to marry shortly after the announcement of the results, you may decide to hold back submission of your DS260 until you have married, so that you can include your spouse on the first submission of the forms. However, if you have already submitted your DS260 and marry while you are waiting for interview, you can request KCC to unlock your form (email is best) and then modify your DS260 to include your new spouse (including modifying your own entry to reflect your new marital status). In the email requesting the form unlocking, I would suggest including a scan of the marriage certificate which will be added to your KCC file (later sent to the embassy or Field office if doing adjustment of status).
If the marriage happens after the case has been passed to the embassy for a scheduled interview, you should still inform KCC as a precaution BUT your actual approach is to handle the change direct with the embassy. Some embassies are relaxed about who attends the interviews, others are very UNrelaxed – so in some cases you will have to contact the embassy or ask KCC to contact them on your behalf to get your spouse added to the interview schedule.
Scenario 3: Marriage after interview, before entry to the USA, and before the end of the year.
OK – you like to live on the edge don’t ya! This is still technically possible, but unwise. The process involves approaching the embassy that handled your case. However, this is a highly risky strategy as the embassy may not understand the rules, you might time out, visas may be exhausted and so on. The MUCH more preferable option is to bring forward the date of your marriage before the interview.
Scenario 4: Marriage after interview, after entry into the USA but before the end of the DV year (September 30th).
OK – this is rare, so rare that I am not even sure this would be technically possible/legal. If you have created this mess you may be able to process a derivative case but this would be highly risky since they would rightly wonder why you hadn’t handled this earlier (i.e. causing them severe doubt that the relationship is real).
Scenario 5: Marriage after the end of the year
This one no longer falls under DV lottery rules – a normal immigration process would need to be followed which is slower and more expensive.
Proof of relationship.
How can you prove your relationship is genuine and not just a sham to take advantage of a DV lottery win. Basically this is a matter of demonstrating your life together and the big events with documentary evidence. This can include the following suggestions.:
- Photos/Emails/Joint bills from the period of time before the marriage.
- Photos or other evidence from the wedding ceremony itself.
- Joint financial documents such as shared bank accounts.
- Knowledge of each other, your extended families and so on.
Get your thinking cap on – the burden is on you to prove the marriage is real. If there is doubt in the mind of the CO he/she is entitled to deny your visa with no appeal process (in consular processing cases).

If my wedding as the principal applicant is after submitting my own DS-260, and also we haven’t been living together as she is still studying in my country while I’m currently a student on F1 in the US…I know we will need to offer some kind of proof our relationship is real. I’ve already started planning what I’ll submit for that, but my concern is that if my interview is late (OC14XX) and they push the case to Administrative Processing, that would push us past sep 30 to get it all approved. Especially since due to timing with my studies and the wedding I was considering postponing the interview to September. Is this kind of thing likely to go to Administrative Processing or would they make a decision either way on the spot?

They would often (not always)decide that case on the spot, but it would be extremely unwise to push the interview until September based on an assumption that no AP was going to be needed.
It sounds like you are planning CP processing, but FYI, AOS was also an option with Follow to Join (I-824) for your wife.

My understanding is that due to the lengthy processing times for field offices, listed on the USCIS website (https://egov.uscis.gov/cris/processTimesDisplayInit.do), an AOS is not realistic. For instance, my local field office (Los Angeles) is listed as processing I-485 applications as of July 30, 2016, almost 9 months ago, so it seems like filing an AOS with them at this stage would not be an option for me, or at least, would at least risk not being completed by September 30.
Is that correct?

No. AOS for DV moves much faster than other cases. PLus you get the early filing so you could already have filed your I-485. Then once your case is approved, you can submit the I-824. But – this all supposes you have got married. So when is the marriage??

It would be nice to know about the pathway. But it seems there are a limited number of circumstances where this would work for us because:
1) If I became a LPR and then we got married, she couldn’t FTJ;
2) If I left the US to get married in New Zealand, and then came back on my F1 to file on AOS, this may violate my status if I’m considered to have immigrant intent;
3) If she came to the US on a tourist visa and we got married here, then whether she stays in the US to do AOS, or returns to NZ to FTJ via I-824, she may be considered to have immigrant intent at the time she comes to the US on a tourist visa, breaching her status which would cause problems at the time of her application.
Or have I misunderstood what would count as a breach of status?

Yes, I understand it could appear that way. I never thought that we’d practically find a way to be together, since I was intent on being here in the US. So…though we’ve known each other for years, we only started discussing a serious and permanent relationship late last year. If you marry that person after your DV process, you could then sponsor that person which takes around 2 years. Whether they can stay in the USA during that time or not is not something I know about.

i told the lady that i heard first year LPR can travel up to one year without an issue,
she told me yes you can any year travel out side the USA without exceeding 12 month and you’ll be fine, just you need to prove when you departure the US last time and its not exceeding 12 month absence from the US,
i don’t know if she didn’t understand my question or they change the rule to be each year?!

Does the US not recognise de facto type relationships that are pretty much exactly the same as a married couple? My partner and I have been in a de facto relationship or 17 years and are having a child together, would that mean our application would be disqualified because we don’t have a marriage certificate?

I have seen 2 cases where de facto relationships were used for entry (i.e. claiming to be married). In both cases the selectees realized they would have to get legally married, they did that and then the mistake of claiming married status was forgiven.

Thanks for the info. I’m assuming we would have to provide proof of our prior relationship to show that the marriage is not just for convenience. Would it come across better to do this before any kind of interview or wait till an interview (if we get one) and then have that discussion then. I’ve been selected for the edv 2018. I have a partner I would like to include in my DV260. My question is how much we can delay to submit the form. We intend marry asap, however in Australia you must give at least one calendar months notice in order to get married. Would it be too late wait until we’re legally married in June or July then submit the form?
Secondly, I have 2 dui offences, one in 2010 which was not recorded as a conviction and another one in 2014 which was a recorded conviction, there were no jail times for both, just suspension and a fine. (I know this is very stupid, I wish I never made these mistakes. After the last offence I completed the traffic offenders program voluntarily and have been involved with volunteering activities regularly) As I said, I wish it never happened, but would it be still worth for me to try applying with this background?

Hello I won the green card my number is 2xxx. I have been told my number is really short. I wonder when my interview would be approximately ?
Also, I submitted my DS 260, and have been in a relationship with my girlfriend with another nationality since the end of 2014 (I have proof of travels tickets bought and kept me visitng her and her visiting me 3 times per year, photos with dates on facebook, events we attended together, trips and also trips in the US).
We plan to get married during the month of july, we are gathering all the documents together.
We didn’t get married before as she was studying and will graduate this year. My concern is, is this doable ?? and what other proof should we provide ?
Should we prepare all the documents and send them by email to the KCC once married or keep them and present the ‘proofs’ if they ask for them at the interview ??

You don’t mention your region – but personally I would have waited to submit the DS260. As soon as you marry, unlock your DS260 and add your spouse. You present proof at the interview – and you have the right idea about what proof to provide.

1. As you are currently married you list him on your DS260, but don’t create a DS260 for him.
2. That is fine *IF* you have a legal separation document (usually from a court).
Just be aware that some COs have refused visas where a spouse was taking a child abroad without the applicant presenting proof of permission from the other parent.

The USA recognizes same sex marriage if that is legal in the place where the marriage is performed. Civil unions are normally not considered the same way UNLESS the country treats the civil union as *identical* to marriage. I don’t think that is the case in Italy. So – my advise would be to get married in a country that allows same sex marriage, and once you have done that – submit the DS260 as a married couple.

Do you think that this may cause some sort of issue? It is necessary to put first spouse in previous spouse or if we didn’t put previous spouse what will be the problem.

Hi Brit,
If the main applicant won the lottery and dont want to take the spouse, is it possible to leave him/her out of the application.
He included all their names in the application and when he won it he doesn’t want to include spouse and adopted kids in his ds260….
Is there anything we can do or is it primarily up to the main applicant??

I am a female selected for dv2018 lottery. I entered as married applicant because my fiancee had paid my dowry which signifies am married in my culture. Here is my question ..1) while filling the entering for lottery last year I used my full name(given name and surname) and also filled in my spouse full name. Now we about to go and legalise our marriage and this means my surname will automatically change to my husbands surname. Hope this wont b a problem? Thank you Brits!

I have a complex situation. And need your opinion about what we should do.
My wife (my Fiancée at that time) submitted EB2/NIW petition in April’17. Then, we learned that I won the DV lottery 2018 in May. Then, we got married in May’17.
1) I will include her in my DS-260 submission. Will it have any negative impact on her EB2/NIW application?
2) If her application is approved before our interview date, can we submit I-485 together through her application? Will it create any confusion?
3) Do you have any recommendation for me?

I submitted DS260 in June for both myself and my wife. My case number is around EU15XXX. As I mentioned in my question, my wife had also NIW/EB2 application. She submitted it before we learned I won the diversity visa lottery.
Last week we learned that her EB2 application (I-140) was approved. We decided to go with her application and apply for adjustment of status (I-485). Should we withdraw my DS260 submission? can we do that? Do you have any suggestion for our situation.

You cannot withdraw the DS260 – and that demonstrates immigrant intent, which could create a risk if you enter the USA with intention to adjust status.

You unlock your DS260 and change your own status. If NOT applying for the new spouse you don’t complete a new DS260 for the spouse. However, you should understand that sponsoring the spouse later will cost more and take around 2 years.
