A friend, Matina K, has suggested that some might benefit from a post about how to handle the situation when you have entered as single and want to get married at various points along the DV process.
Firstly, I should explain that the marital status question in the eDV entry is one of the critical questions on the form – a mistake on your marital status can (and typically does) cause disqualification – even if the mistake was innocuous/innocent. Some people, for instance, choose “legally separated” when they are in fact, married, but separated. Unless a separation is legally recorded (typically by a court) then you cannot claim to be separated. Similarly, if you enter married because you plan/expect to be married before the results are announced, that can also cause disqualification. It is essential that you take this question seriously and literally.
OK so what do you do if you are planning to get married before the results are announced OR you are selected and then realize that you want to take your boyfriend/girlfriend/partner. The process depends on the exact timing, between the original entry/registration (October), result announcement (May 1), your interview date (after October, according to when you are current) and the end of the DV year (September 30).
By the way, these comments relate to opposite sex, or same sex relationships. Since the repeal of DOMA the federal government has recognized same sex couples have the same rights for immigration benefit as opposite sex couples. US immigration law therefore respects marriage based on the laws and customs that govern in the place where the marriage was performed. If a marriage is considered legal in the place where it was performed then US immigration law treats the marriage as lawful. I will refer to your boyfriend/girlfriend/partner/fiancé all as partner from now on in this article.
Entry of an unmarried couple in DV lottery
First of all, if you are unmarried you cannot list your partner as a spouse. You can of course both enter the lottery and if either one wins then they have the option of marrying to confer the benefit of a visa (and then Green Card) on the other. Just be aware that each principal selectee (winner) has to meet the requirements in their own right (regarding). Whilst married couples can benefit from cross charging to a spouse’s country (if their own country is ineligible) that option is NOT available to single entrants that later marry. If you are unmarried but have children then both entries should include the children as derivatives.
Scenario 1: Marriage after registration, but before the results are announced.
This one is “easy”. Life happens, you don’t put your life on hold simply because you entered the DV lottery. So – you got married, then you found out you were selected so you simply fill in the DS260 as a married couple. There will be some “normal” scrutiny of the marriage – even people who have been married years have been lightly questioned about the marriage in DV interviews. Marriage prior to selection may get similar interest – and if you want to be extra prepared then take some proof of the marriage as I will describe below.
Scenario 2: Marriage after registration, and after the results are announced, but prior to interview.
OK – there is nothing wrong with this if the relationship is real. In fact it is absolutely the sensible thing to do in some cases as I will describe shortly. However, winning the DV lottery is a huge opportunity and there are plenty of people that have tried to manipulate the system to obtain two Green Cards based on a “sham” marriage. It is therefore up to the couple to demonstrate the genuine nature of the marriage and, especially in countries where fraud is more common, the couple should be prepared for extensive and deep scrutiny of the marriage. People have been prosecuted for immigration fraud based on sham marriages – so please don’t even consider that!
If you have plans to marry shortly after the announcement of the results, you may decide to hold back submission of your DS260 until you have married, so that you can include your spouse on the first submission of the forms. However, if you have already submitted your DS260 and marry while you are waiting for interview, you can request KCC to unlock your form (email is best) and then modify your DS260 to include your new spouse (including modifying your own entry to reflect your new marital status). In the email requesting the form unlocking, I would suggest including a scan of the marriage certificate which will be added to your KCC file (later sent to the embassy or Field office if doing adjustment of status).
If the marriage happens after the case has been passed to the embassy for a scheduled interview, you should still inform KCC as a precaution BUT your actual approach is to handle the change direct with the embassy. Some embassies are relaxed about who attends the interviews, others are very UNrelaxed – so in some cases you will have to contact the embassy or ask KCC to contact them on your behalf to get your spouse added to the interview schedule.
Scenario 3: Marriage after interview, before entry to the USA, and before the end of the year.
OK – you like to live on the edge don’t ya! This is still technically possible, but unwise. The process involves approaching the embassy that handled your case. However, this is a highly risky strategy as the embassy may not understand the rules, you might time out, visas may be exhausted and so on. The MUCH more preferable option is to bring forward the date of your marriage before the interview.
Scenario 4: Marriage after interview, after entry into the USA but before the end of the DV year (September 30th).
OK – this is rare, so rare that I am not even sure this would be technically possible/legal. If you have created this mess you may be able to process a derivative case but this would be highly risky since they would rightly wonder why you hadn’t handled this earlier (i.e. causing them severe doubt that the relationship is real).
Scenario 5: Marriage after the end of the year
This one no longer falls under DV lottery rules – a normal immigration process would need to be followed which is slower and more expensive.
Proof of relationship.
How can you prove your relationship is genuine and not just a sham to take advantage of a DV lottery win. Basically this is a matter of demonstrating your life together and the big events with documentary evidence. This can include the following suggestions.:
- Photos/Emails/Joint bills from the period of time before the marriage.
- Photos or other evidence from the wedding ceremony itself.
- Joint financial documents such as shared bank accounts.
- Knowledge of each other, your extended families and so on.
Get your thinking cap on – the burden is on you to prove the marriage is real. If there is doubt in the mind of the CO he/she is entitled to deny your visa with no appeal process (in consular processing cases).

I’m a Swiss citizen and have been selected for the DV-2018. I got married last week in USA. I have already sent my DS-260 but will ask the KCC to unlock it so that my wife can fill it as soon as we receive the marriage certificate. My wife will take my family name but it can take up to 3 month to get the marriage recognized by the Swiss authorities.
Will it be an issue if she fills out the DS-260 with her current name but shows up at the interview with a passport with another name on it? Or would you recommend to hold back the submission until the marriage is recognized in Switzerland and she has all documents with her new name?

In my country, High school last 3 years , in my case from 2006 to 2009.
On filling the DS 260 I only put the last year (equivalent 12th grade).
– From 2006 to 2008 I did the first two years of High school in first high school
– From 2008 to 2009 I moved from where i lived to another city and finished my last year of High school in another school.
Now, my question is should I add another ‘institution’ in order to add the date from 2006 to 2008 (for the high school in Saint Martin) ? but in the section ‘degree, diploma or certificate received’ what should i put as it was the early years of high school ? because I didn’t graduate high school twice… it is just the continuing of the studies.

You list your spouse on your form, and then you create a whole new DS260 for the spouse. All the details for the spouse are on that form. It sounds like you haven’t created the extra DS260. Use the add applicant functionality to add your spouse.

You seem to be creating some sort of problem. Telling lies will get you disqualified. So – there is no problem adding YOUR children if they are yours. BUT if your girlfriend did NOT list her children on the original entry, she will be disqualified anyway.

Hello!
My boyfriend won the lottery and the visa is issued to him. He will enter US probably in November. We are not from the same country and there were some obstacles for us to marry earlier. So, as I understand, for us the only possible or reasonable way now is to get married and go through normal immigration process. My doubts are:
1. If we marry now before he enter US, will it cause any problem in issuing the green card to him once he entered US (since his status stated in visa is changed)?
2. If I apply for immigrant visa (as a wife of LPR), till I wait for the decision will I be allowed to travel and visit my husband since I already have issued B1/B2 visitor visa in my passport? (I have already traveled to US 6 years ago and the visa is valid for 4 years more)
3. Any other advice for us how to start living together in US as soon as possible?

This is our case. Both my girfriend and I entered the 2018 DV visa process.
I was not selected but she was!
The case number is 2018SA9XX, wich is good, based in your predictions in this year in South America.
We were planning to get married in december, but reading this post gave us the idea of doing that earlier, so we can unlock the DS260 before the new fiscal year.
I have a couple of questions.
1)When we unlock the 260, I will have to fill another one for me?
2) Would this change in the 260 change our case number? As I said I think the number my girlfriend has is good, making this changes can affect the case number?

It will be months before your case number is current, so once you get married, unlock invlude the new spouse.

Hey Britt,good day how are u and ur family? My fiancé just got back to the country so we have rescheduled our marriage to be this August then fill the ds260 after having our marriage certificate, do I need to create his own ds260?
1)will I need to scan our marriage certificate and submit to kcc?

Hope we get our interview early enough, cus I read from one of ur VB it shows that if u summit in August u will receive 2NL in Dec for January interview

It is very unwise to leave the marriage until then. Get married earlier – and once married, submit the DS260.

Hello Mr Brit am dv winner 2018(principal applicant) from Ghana i got married December 2016 my questions is as follows:
1. My wife name appeared on her passport, birth certificate and school certificate as Yakubu Alhassan Suraiya but on our marriage certificate it has been written as Suraiya Yakubu without the middle name appearing please will this cause for a denial?
2. Our marriage was done in a traditional way no pictures on that day, I want to wait for my wife to deliver before filling the ds260 please can I use our naming ceremony pictures as evidence when ask to do so?
3. Also I have a few pictures on my cell phone my wife and I took them together that was 2016 but I lent cell phones are not allowed to be send to the interview room so how can I show those pictures to the consular since cell phones are not allowed?

My husband and I got married after the interview. Is there a possibility now to inform the embassy about the updates and to hope that they will appoint the interview for me? Or it is too late for that. Do we risk my husband visa by doing it? I mean will his visa still be valid even if I not succeed to get appointment for the interview?

Before the interview after DS260 if one get divorced and within 1 month of getting divorced one marry again with another person. If the interview is at September (last month of the session) does is affect? If possible what documents need to submit?

The CO can handle the case how they want – and can ask for proof – so prepare well.
You need to decide for yourself the best way forward.

Hello Mr Simon from the initial entry I mistakely added my grandfather name to my names on the initial application which is not on my documents but on the ds260 I use my legal names without my grandfather name will this inconsistent about my name call for a denial

Thank you for sending me the Marital status dv lottery file, my case goes with scenario 2 which is i am single on the entry registration (October) then got engaged before the result announcement , i want to marry next month , i have not completed the DS 260 form yet ,my question is: shall i go through marriage next month then complete DS 260 form and write that iam married with the spouse information to get an interview appointment ,does this change in marital status make any problem or disqualification in my application in the consulate?

Thank you for your previous reply which helps me a lot, I want to ask you two extra question ,
Firstly, What is approximately the minimum time period between completing the DS 260 form after marriage next month online then sending it to the KCC center and the interview date in the Consulate, because knowing this period now will help me very much in arranging my dates and procedures in the next months.
Secondly, If my fiancee who will be my spouse after marriage does not want to join me now to the US and not to complete all his procedures in the consulate and all other issues, because he is busy in his work , he wants to delay all his procedures for two years to end his works in our country, does this act causes any problems or refusal for me in the first place .

1. Timing varies depending on processing times, backlog and your case number. I can’t predict it from what you have said – and wouldn’t want to anyway. Wait and see.
2. No problem – it just means going through the more expensive and complicated family based sponsorship process.

My wife have 19 years old and me 22 and she’s a DV2017 Winner and we did fellow all the steps of the Senario 2, we had the interview and they said you must provide us more evidence and we did for 4 times(mariage photographs, facebook, etc…) but they still ask us to provide them more , we don’t know what to do anymore, any Advices please , and what is hurting is when I see fake weddings and they got their visas 🙁 , and I think my wife is pregnant ( waiting for the test result) if she is is that good or bad , what we’ll do , thank you so much for your time sir

They will want proof that the relationship existed BEFORE the lottery selection. If you cannot find anything more – tell them that.
The pregnancy is no problem.
