So I, like many of you I’m sure, didn’t sleep much last night. I am dissapointed that Biden did not remove 10014/10052. He should have done so – and I believe there was some sort of reversal in the days before the announcement. Just days ago, people within the administration were signaling the bans would be removed.
So the way forward is through legal action and the lawyers immediately took action yesterday in the Gomez and Anunciato cases, informing the Judges of Biden’s failure to remedy 10014 and pressing for immediate relief. We will watch that play out.
So for many of you that is all of this article you need to read. Some of you are angry and frustrated anyway, so just believe that Biden is as bad as Trump. I don’t agree, but you won’t change your minds until you see something different. That’s understandable.
But I did want to capture some thoughts on what might have happened – and why Biden did what he did yesterday. So – if you’re interested, read on. Understanding doesn’t help with the immediate problems, but I at least want to make some sense of it, and would be interested in your opinions.
First I want to pick up and expand on a couple of things I said on my livestream yesterday.
Biden is not a God. He is not a movie star. He will not always please me in the way he acts, I expect to disagree with things he does and will call him out when he does so. That is important, because it shows that he is just a man that happens to be in charge right now, but that’s all. He knows that role, and I think it is important to him. It’s part of the character that I recognize as being important.
Trump created an environment where he demanded absolute loyalty. His followers are fanatical, they wear hats and other clothing with Trumps photo and name. It’s like they are following some sports team. They would blindly agree with him, no matter how obviously wrong his decisions or statements are. They were taught to believe the media was fake, because Trump knew the media would call out his nonsense. People actually believed he was sent by god to reclaim America for whatever BS they wanted to believe. There was even a subculture based around all sorts of conspiracy theory nonsense – the QAnon crap. This elevation of Trump to king like, and perhaps even god like status. People actually believed that the election was rigged, and then once that was disproven there were all sorts of dates when various things would happen to reinstall Trump on his newly fashioned throne.
This was all much more serious and dangerous than some of us might realize. Trump badly handled the COVID response, to the extent that now over 450,000 Americans are dead. Our death rate is TWICE that of Germany. Only the UK appears to have handled the pandemic worse than us, although the UK is at least doing well with the vaccination program. Biden has ramped up our vaccination program massively, but Trump had done nothing. So if we had only achieved the same control that Germany did, we could have saved over 200k lives. That blood is on Trump’s hands. Biden cannot afford to handle the crisis the same way, and he won’t.
Now, if you watched Biden’s signing yesterday you will have noticed he referenced the criticism he has been under in signing so many EOs since he became President. He said:
“And I want to make it clear — there’s a lot of talk, with good reason, about the number of executive orders that I have signed — I’m not making new law; I’m eliminating bad policy. What I’m doing is taking on the issues that — 99 percent of them — that the President — the last President of the United States issued executive orders I felt were very counterproductive to our security, counterproductive to who we are as a country, particularly in — in the area of immigration.”
Now as we know, the lawyers are having enormous success attacking the EOs of the last administration. It’s a frustratingly slow process and TROs or PIs are only possible in certain circumstances, but time and time again we have seen the lawyers pull apart the executive orders and show how they were not well conceived or written.
I the recent Anunciato hearing, the lawyers clearly argued that Trump’s decision on 10014 was to be blocked because the order (unlike the Hawaii case) gave no evidence of the central theme of the order, that immigrants would make the post COVID job situation worse. That is an absolutely KEY piece of the argument to take down 10014/10052. The President is given broad authority on policy to block entry of immigrants as was argued in Hawaii v Trump. The Supreme court accepted that decision, because there was (after two failed orders) some “fact based” reasoning in the order. That is exactly why the disgusting Muslim bans stayed in place until Biden revoked them – and the damage that order did is unrecoverable for thousands of people.
So – the lesson here that Biden, I believe, has learned is that executive orders should be used sparingly, and only when good reason can be demonstrated. That reason should not be based on his own whims as we saw with Trump. There should be evidence, there should be a process.
So I think Biden was stuck between wanting to remove the bans and not wanting to do it without process and evidence. The Muslim ban had to go. It was obviously wrong on ethical grounds, even though it had been tested and found to be legal. As I explained yesterday the DSchengen restrictions are at the other end of a scale. Whilst they are a nuisance, there is at least some logic to them. 10014 and 10052 are somewhere between those two cases. Not as overtly immoral as the Muslim bans, but not as justifiable as the Schengen restrictions.
So how do you handle that middle case? Well I believe what Biden wanted to do was setup Mayorkas to provide the background evidence and reasoning to justify the revocation of the bans, along with many other actions that are impacting immigration currently. Mayorkas would then ask the President to take certain actions based on his findings. That would be a more proper procedure, rather than kinglike decrees coming down without justification.
There is some evidence of that exact approach with Sec Blinken as I retweeted this am.

So I think that’s the plan, but I don’t know the timeline. We don’t have 90 days to wait as mentioned in the order for a report, but Mayorkas doesn’t have to act slowly. So, how quickly can that happen is the unknown, and whether 10014/10052 will be struck down by the courts in the meantime.
Anyway, that’s my perspective. As I said, in the end it may not matter. The lawyers are working to get the bans revoked and they are all very confident they can do so, BUT it’s a good thing to continue the fight on various fronts.

As far as the embassies and KCC are concerned the case is closed. That is normal. However, as you should already know, the Gomez case is ongoing and we would hope to hear the final outcome of that case in late March.

It’s always been human nature to find excuse for the people we like/love and I feel you trying to find reasons explaining the unrealistic things Biden did. Biden tweeted against Trump when sign the EO bans, I agree with you when you said Biden is not a god so let us all agree what he was telling about immigration all for his campaign, if you look at it noting changed in immigration laws since he came, he promotions remove Muslim ban and he did same as Trump did in his campaign, he promise people to block Muslim from entering US. It’s all about winning the election, even you mentioned that before removing Muslim ban without removing immigrants bans make no sense.
Immigration nothing more than a tool to be used by politicians to get to their goals, they don’t care about people suffering or anything else.
This is how I read what happened and what is going to happen with all of people putting their dreams in hands of politicians. Being realistic and putting hopes in the right way is the right thing to do, I believe waiting for lawsuits outcome will make more sense to me rather than having false dreams.
This is my thoughts, I could be wrong put all based on facts and realities.

Thank you so much Simon for your updates and reflections regarding PP10014 and President Biden’s approach- both yourself and Curtis Morrison have done a brilliant job of covering the political and legal updates, unlike the rather uninformative site ‘boundless.com.’ As you mentioned, we will just have to let the legal process run its course as well as wait and see whether Biden will take further action.
Personally, my brown U.S. Immigrant Visa packet is right by my side in my bedroom with the March 17th expiry date. However,(and I will get slightly philosophical here), I believe it would be best for all of us to hold down the fort at home, take hold what we can control each and every day, tackle each daily challenge and continue to live productive lives. Above all, let’s stay safe and healthy- my relative recently passed away, and that helped me put things into more perspective.
If PP10014 is eventually revoked, we will be in the best position to move smoothly as well as successfully to America and hopefully land a decent job. The logistics of it is challenging enough as it is, so as I mentioned before, best be well prepared for it all, no? Best of luck to all!

In addition, I think there was particular date in every month that department of labour and homeland security to submit the report on the travel (pp10014) and recommend President.
I feel that by mid of February this report will be submitted to Biden suggesting to remove the ban as the unemployment rate is fallen from 14% to 6.7%.
Biden, can simply revoke this ban with similar statement as Trump did for regional ban before he left the office.

I really don’t believe the unemployment rate was ever a consideration. Immigrants are consumers. They work hard and have to find homes, cars and so on. They drive the economy. So – only looking at one side of the balance sheet is not the way to make policy.

Thanks for the words of encouragement. I think you are correct that 10014 is rapidly becoming less of an issue for DV2021. Assuming it were not to be extended (which would be a STUNNING shock if it were), then that barrier is removed from April. However, embassies being closed for DV interviews is rapidly becoming the biggest threat. We may need the Judge to order the GOV to hold the interviews just as Mehta did for DV2020.

Yes there is a risk because we are losing time, but don’t misunderstand, it’s not just about the ban, it’s about embassies being open for DV cases.

Basically you are banned by proclamation 10014 from entering with your visa UNLESS it was a re-issued visa from before April 23rd of last year. Lawyers are working on removing the ban now, but you can read some of my recent articles to get up to speed.

I encourage you all to keep faith and trust in God. I was a Dv 2020 winner from AF. I got my visa and 2days later, a ban was imposed in my country (imagine my life). With all the struggle and all that went on, We succeeded to travel a day before Visa expiration. In fact, we landed on the American soil the day our visas was to expire.
We had those who felt all was lost because theirs had already expired but unexpectedly they started receiving calls for extentions.
Do not loose hope for you never know

Yes – 10014 is being challenged in several suits, Gomez, Aker, Anunciato, Jacob (which I believe they want to make a class). None are open, but Gomez is already a certified class and Anunciato is seeking class cert.

Thank you Sir for all the assistance and intervention . Just as Judge Mehta did in the case of DV 2020 that witnessed the opening of embassies and processing of visas in the wake of the ban in place in September 2020, Judge Steeborg needs to do similar thing, that is to request the government to order KCC to commence the processing of cases for DV 2021 and the embassies to process, issue and re-issue visas for both DV 2020 & 2021.
Let back up plan for re-issue be put in place to handle the expiration of visas while the government is studying the situation about rescinding the ban. According to President Biden, he favors immigration, so he needs to give credence to this so that the visas will not go in thin air. I believe if the lawyers consistently engage the courts and the government on this, something positive will unfold not in the non-distant future in this endeavor.
Let cases be processed, 2NL given out and visa issued and or re-issued while we await the revoking of the ban. Let`s us (DV winners) remain prayerful and optimistic and the let lawyers continue to push for this

My DV visa issued before 23rd April 2020 and reissued on the 30th September 2020. There is no annotation (subject to pp. 10014) on my passport.But US embassy had given me a letter saying that if travel ban continues I can not travel to the USA. I want to clear that whether I’m exempted by the travel ban or not.

You are exempt from the ban. Speak to the embassy and see if they understand that, and if they do, then ask them for something that you can show the airline to make sure you are allowed to travel.

If your visa was previously issued before April 23, then you are NOT subject to the ban. YOu can contact the airline to see if they understand that (show proof), but you might need to get confirmation from the embassy to convince the airline. THere is no special method – you just push all parties.

There is no other hearing scheduled at this time – the lawyers are hoping for a decision, at least for a preliminary injunction. There is no timeline – but the lawyers are hoping to hear something within a few days.

There is an article on NY Times saying that currently 380,000 interviews/various visa cases are on hold at the US Embassies in the world. Staff shortage and quarantine restrictions also affect.

But the longer it takes the new Administration to solve the matter, the bigger the bubble of work to be processed becomes. DV-2022 selectees are arriving in May-June 2011. How will KCC handIe such an enormous job? Isn’t it in the interest of Homeland Security Department to make a decision soon? How do you think?

Yes the backlogs are a huge concern. That is why I have been asking the lawyers to ensure that DV cases are treated as mission critical cases, which would allow DV interviews to start with even partially open embassies.
In terms of is it in there interest – well few visa types have the same deadline concerns that DV have – so for MOST cases putting urgency over safety would not be considered. But for DV the issue should be seen differently, unless we can get more time beyond September 30th.

Your number is VERY high, so you will not be contacted for documents for a long time, and there is a large risk that your number will be too high to get an interview at all. All you can do is wait and see.

I went to Curtis website and it look like the judge on Young case already order the government to issue visa for only the plaintiffs and some of them enter the usa already. They did not ask the judge to certify the case as class suit. A really selfish action.
Now they are permanently destroying the dream of dv2020 visa holders with this last minute action. So sad

The Young case had a very narrow focus. It would be wrong to try to pull Anunciato into Chen because Seeborg has already heard/read the full picture on a much broader range of issues. We don’t want to have to go through all that with Chen.

i’m positive Charles would’ve seen this through before even starting the Anunciato Lawsuit. I believe the case will not be transferred. Plus, the Young case was for Family Visas or something like that. It had nothing to do with Dv’s.

I see people calling out Curtis and other lawyers and I don’t understand why people are getting upset at all with lawyers. Some of them didn’t ask cash to be a plaintiff some did. Those who did, of course will do what they can to help the plaintiffs. It’s just the job. Thinking that every body would dedicate so much time for no gain is quite frankly naive.
I’m not putting words on Simon’s mouth but from the beginning it was clear which lawyers understood what DV means.
What’s not right is the fact that named plaintiffs, purely because of money, get to have advantages. From a judge perspective I believe they are not taking the meaning of DV into consideration. If you think about it, who are these plaintiffs? Do they represent DV or they are mostly from Europe? Or they are mostly people with enough means that are not looking to move to US because it would change their lives and for generations to come but because US is a great country?
Another thing is, Biden did not put this ban in place, yes he has the power to remove than bu we have to understand that right now Americans in general don’t want to hear about immigration. Thay need food, jobs, health, etc, and that’s Biden’s main concern as it should be. I was confident that he would remove the bans on Tuesday but clearly something happen behind the scenes that made him not change his mind but his plans.
We already have “All NO” possible so that’s enough negativity. Let’s try and do everything we can to bring awareness to the injustice being done. Negativity will do no good.
Before people call me out for what I said, I’m a 2021 DV winner seeing my dream sleep away but for as long as it’s not done/finished I will have hope.

Then i suggest you don’t get mad at people who are Frustrated already from waiting bc you don’t know their stories. Most people who are against what Curtis had tweeted are Dv2020 visa holders, whose visas will be expiring soon. These people had waited so long to get an interview, they paid all the fees to get through their interviews and granted a visa. But now they may be losing that chance, we don’t know. But you CAN NOT understand what we are going thru bc you’re just a dv2021 selectee who happened to have won the lottery but there’s nothing that you have lost yet. I understand that you’re entitled to your own opinion and here is mine.

Hi Jose, you are totally right. I’,ve said in other comments that I can only imagine, what’s like to have quit your job, take kids out of school, telling families you are going US, everything else and be stuck having to deal with this and the prospect of having to search for jobs and put your kids beck to the same school that they just said goodbye to. It suck (I want to say more than sucks but Simon would probably block it).
What I was trying to say is that, has a lawyer as soon as you take a client, he becomes the primary and only concern, if inhelping your client you can help others thats awesome but thats just a bonus. From the first time I saw that a lawyer was charging for a service, regardless of “how much” its profit and per my calculations they can make a lot of money (desperate people will pay anything).
So I don’t know what you are going through, I can only imagine and yes I’ve not lost anything. But at the same time saying that because I’m a selectee I should be chilling and unconcern about DV’s status is not something I agree with.
I really hope we win the case ASAP. Let’s find positive ways to contribute and win this “war”.

If you are a FY2020 Diversity Visa Selectee who did not receive a diversity visa on or before April 23, 2020, you are a class member in the certified Gomez class.
We are writing to provide an update on the Gomez case and recent developments that may affect the class.
On Tuesday, President Biden signed an Executive Order directing a review of agency actions that are inconsistent with the administration’s policy that “immigration processes and other benefits are delivered effectively and efficiently.” However, neither this Executive Order nor others signed by President Biden this week rescind or make any explicit reference to the immigrant visa ban (Presidential Proclamation 10014) or nonimmigrant visa ban (Presidential Proclamation 10052). These Proclamations thus remain in effect and continue to prevent certain immigrants (including DV-2020 selectees) from entering the United States through March 31, 2021. This means that, for now, DV-2020 selectees are still not allowed to travel to and enter the United States.
We do not know if the Biden administration will rescind the Proclamations before the expiration dates of DV-2020 visas that were issued in September 2020 pursuant to the Judge Mehta’s September 4 order. Gomez class counsel will thus be taking appropriate steps to seek to preserve the validity of these visas and to preserve the relief granted by the court. If you are a Gomez class member who was issued a diversity visa and your visa has already expired, or your visa is scheduled to expire before March 10, 2021, please contact class counsel through this link.
Meanwhile, briefing for summary judgment continues before Judge Mehta in the Gomez case. On January 20, the government filed its Motion for Partial Summary Judgment. Yesterday, Gomez class counsel filed Plaintiffs’ opposition to the government’s motion, along with our own summary judgment motion. You can read our filing here. The government now has until February 17, 2021, to oppose and reply to Plaintiffs’ filing, and Plaintiffs have until March 3, 2021 to reply to the government’s opposition. At the same time, Gomez Plaintiffs continue to pursue their appeal of the district court’s decision that the Proclamations are not unlawful. Gomez class counsel argued this appeal before the D.C. You are misreading it.
A “noncitizen national” is a LPR (Greencard)
and ix has further definitions (a and b).
