The Supreme court has taken a partial decision in the travel ban.
The court has said it will hear arguments about the ban later this year, but in the meantime, the court decided that aspects of the travel ban can be enforced. The enforcement is limited to people from the six banned countries who do not have ties to people or entities in the USA (meaning close family ties or relationships with US entities such as job offers/college).
It is FAR TO SOON to know what that means for DV cases. The decision has just been announced and I don’t think even DHS Almost all immigrant cases have the relationships being exempted – i.e. the immigrants have family or employers petitioning for them, so those cases would remain unaffected. However, for refugees and DV cases the position is less clear. I don’t know whether they will accept arguments from DV winners who have family relationships in the US, or whether they will include DV winners in the ban because the reason for the immigrant visa application is not connected to USA based family member or entity. The point is I don’t know. It is too soon for anyone to know. We have to wait to hear clarification.
It is also too soon to guess what impacts this may have to DV2017 or DV2018 cases not affected by the ban. Again, we must wait to get clarification.
So – please don’t expect me to answer questions about what this means for any specific cases OR for VB progress, quotas and so on.
Some points to answer possible questions:
- This ONLY affects people from the 6 affected countries Iran, Libya, Somalia, Sudan, Syria and Yemen.
- This does not apply to existing Green Card holders.
- The ban previously did not affect people holding issued immigrant visas (i.e. after issued, before activation).
- We don’t know when exactly the ban will actually be implemented OR how long it will last.
- This does not cancel the selection of people from the affected countries, but it could complicate/delay their DV case processing.

Some things are not clear – but what is obvious is that someone on AP is subject to the terms of the ban – but that doesn’t mean we know how that ban will affect an individual case.

The ban has nothing to do with the DV lottery year. But a DV2017 case cannot be approved after September 30th 2017. So – if AP or the ban stops a case being approved before September 30th, that case will be finished.

No – my earlier reply means that if your case goes beyond September 30th (because of the ban or AP doesn’t complete) you will NOT get a visa – even if the ban is lifted later.

You can process her GC with your case – but then she would have only 6 months to enter the USA. After you have entered the USA, you could then sponsor her for a Green Card, but that will take 2 years.

I was watching a report produced by Alhora Chanel (American Channel in Arabic) about the 6 banned countries , the reporter said “even you have a valid Visa you will be denied to enter US unless you have the sort of ties imposed by the supreme court” questions are:
1- do you know if that this was clearly mentioned in the decision of the court or it was just his opinion?
2-. if yes it was mentioned, does that applied to DV visas???

Myself and should be others wanted to know to take proper actions. the involved authorities should issue something so that people stop taking any further steps to travel, deny entry at the US border without proper advance attention is unfair provision,
4- many people have spent a lot (time and cost over 2 years process) and get the visas as they considered qualified after certain cheeks ,some should have already sell their properties and buy the tickets??????!!!! obviously its unfair to treat them badly like this, At least America should say sorry and compensate them,is there any way to get compensated?????

3. The Supreme Court (SC) made the announcement on Monday. It is reasonable to expect it will take a few days for DHS to work out how to implement that policy – if that is even possible. So – in due course, things will be clarified. We all have to wait until that clarification is made.
4. Immigration is a privilege, not a right. The point of this decision was that people without ties have no rights in the USA whatsoever. So no, there is no way to get compensation.
By the way, I should point out that people from banned countries who had valid IMMIGRANT visas (like DV visas) *were* allowed entry when the ban was in force before. So – which is contrary to the opinion shared on Alhora chanel. I think that statement probably referred to non immigrant visas, which could easily be affected.

They say those who have been issued visa prior to June 29 are exempted even if they have not used their visas . Does it mean the whole case is exempted or what? I am a dv2018 winner and I’ve submitted my ds260 form already. I am currently a full time student & at the same time working a part time Job. But on my form i stated my current occupation as student and didn’t include my work status due to the fact that I don’t have some of my employment documents with me and am not sure whether I could actually get it by the time of my interview.

1) Is it wise to exclude it my work experience?
2) Is there anyway that the CO will figure out I am employed?

We are thinking go to US embassy in our birth country-Taiwan to do the DV interview when our visa bullet number is released. We have not fill out the DS260 yet. We are going back to Taiwan this Sep. to visit family. I feel our number is kind of high. Should we fill out DS260 as soon as possible(like now?) to get a higher chance to get DV? Or should we wait till we come back to US to avoid any problem(not sure if there are any) with the immigrant officer when we enter US? Thanks!

You don’t have to wait to submit since H1 is “dual intent”. But, if you delay your submission it won’t matter either since your number is quite high.
