Please read below the statement from AILA about the current situation. Basically, it means we are going to have to wait until the litigation is entirely finished, which could take weeks or months. Until then, the Judge’s order protected EVERYONE as a class in the AILA Gomez lawsuit (EVERYONE meaning named or not), and the 9095 visas are to be reserved until they are ready to be issued after the final determination.
Dear Gomez Class Members,
We write to update you on the status of the Gomez case. As you may have heard, on Wednesday the federal court issued an order certifying a class of 2020 Diversity Visa Selectees and requiring the State Department to reserve 9,095 diversity visas for processing once we win our case on behalf of the class. The court also appointed the lawyers at the American Immigration Lawyers Association, Justice Action Center, and Innovation Law Lab as class counsel. Please read the court’s order here.
We are disappointed that the court did not order the State Department to reserve the full 30,000 visas that we had requested. The court’s order reserving only 9,095 visas means that more than half of all DV-2020 Selectees will not receive a diversity visa. If we win our case, we assume, but cannot be sure, that the State Department will process and issue the 9,095 reserved visas in numerical order based on diversity visa confirmation number.
You are automatically a member of the certified class if you are a DV-2020 Selectee but have not yet received your 2020 Diversity Visa as of April 23, 2020. You do not need to take any additional steps to become a member of the class, and you will not receive any documentation from the court or counsel of your membership.
Please note that the diversity visas that the court ordered the State Department to reserve will not be processed or issued immediately. We must continue litigating the case in federal court. If we win, the State Department will be required to process and issue the reserved visas.

Hello Brit, we are the winners of DV2020 – (2 categories), we passed the interview on January 16, but we did not get a visa for the proclamation, we re-passed the medical examination on September 15, but my husband was found sputum, my medical envelope and the son was sent to the embassy, and the husband will be sent after the analysis. Most of those cases should have been processed by 9/30. If not, it suggests your embassy wasn’t open or your AP did not clear. So – depending on that answer you can imagine your chances for the reserved visas.

In his latest live video Charles Kuck mentioned that if Biden wins they would fight with a different DOJ and ask to the Congress to allocate all of the dv2020 visas. Brit, in general there is quota for the regions and counties inside. Will there be the same to those 9095 visas? Like, in my country there is no one in AP and all the people to the group 4 have received their visas too. So, if my country gets even just 50 visas, I’m covered. But, if Europe gets amount of visas despite of country quota I guess Russia will take it all, because they put everyone on AP and those will be the first people to get visas from Europe, and they have a much more winner then other countries in EU. What is your thoughts? Will every country get their 7% quota from this 9095 visas?

There is NOT a quota per country. The 7% is a CAP, not a quota. So – your chance is within the region, not your country.

Dear Brit,
I’m in a dilemma for making travel plans since we are in the Shengen area. The visa reissued will expire on 21 March 2021. As of now the travel and immigrant bans are still in place till end-2020 (with possibility of extension beyond that date). I have to give notice in good time to the employer, to the landlord and to many other service providers (eg. electricity, telephone, membership with tenant association, etc. etc.). Without knowing when we can actually travel to USA, it is rather risky to give notice to the relevant entitles. What would you advise? Thanks.

Thanks Brit. I prefer to wait until end-2020 but I’m afraid my visa will expire if I don’t leave by mid-February. By activation, I presume travelling to US via a third country, stay there for 14 days before entering US, and after arriving US stay there for a short period and returning to current country of residence. Is it possible to leave US before getting a green card and re-enter again? (I learned that now it takes 3 to 5 months to get the green card after entering the country).

Ah, this DV2020 are so sadistic honestly, I am one of 17! selectees in Denmark (EU, 47xxx) and I had to wait for one year just to get nothing. I even suspended my immigration to Germany, my studies, language and everything because I wanted not to lose this chance. Wasted year.
And now we got a 9k visas, to wait an X-time (maybe up to year again) with no guarantee at all, because we do not know YET how are they going to proceed everything. Honestly, i’ve hoped that that they just say in April: “Corona, Game over dv2020-guys, relax and forget” but no, sadism continued even after deadline, haha.
Will I get my 1of 9095 visa or not, I don’t know. No one knows) I hope that we get an information ASAP. Do not want to waste another year, seriously.

Now we all know that the 9095 being reserved has no deadline yet and the judge pressed the pause botton. Use this time to go back to everything you re supposed to know about your case, the I134 form, DS5540 and what not.
I’m sorry to say that some of us are very lazy to find answers for ourselves when it comes to DV related issues. Brits blog is practically an encyclopedia all you have to do is use the search botton?
