OK – so let’s talk about DV2021.
Unless you have been living under a rock you will have heard me saying for some months now that the revocation is not the only hurdle we will have. There are many more concerns for DV2021. So – first let’s lay those concerns out there so that everyone is clear.
- PP10014 was the reason that many embassies were using in responses to applicants to say they were not interviewing any cases. So – their standard replies will change now that is no longer an issue.
- The embassies are in various states of reopening according to the Diplomacy Strong plan implemented by the Department of State. The Diplomacy Strong plan set out the conditions that should exist for each of three levels of reopening. The three levels determined the level of resources at the embassy (Level 1 up to 40% staff, Level 2 40 to 80% staff, and Level 3 80%+). The link I just gave shows what conditions should be in place in the country where the embassy is located, in order to decide which level the embassy should be in. Based on the resources (staffing) the embassy would prioritize which types of cases they would take on. In November, the DoS announced it would now be up to the embassy themselves to decide what cases they would take on. So – they might take some immigrant cases, but perhaps not all immigrant cases. Therefore the embassy opening is going to be different, embassy by embassy.
- The Schengen and similar geographic restrictions remain in force. Hopefully, they will be removed once more effective/sensible measures are in place. But the countries themselves are not helping. The UK for instance is leading the world in its vaccination program, and is seeing a large reduction in new cases as a result. The rest of Europe is not doing as well. While large numbers of cases, or new strains are being seen, the US government would be unwise to remove restrictions without very powerful measures being enforced (mandatory in USA quarantine periods for instance). So – DV2021 applicants will have to consider these restrictions for a while yet.
- Some Embassies are now informing people in some locations that they will not conduct interviews for people affected by the Schengen bans. That is arguably as bad (not legal) as the previous behavior to not issue visas that could not be used. However, as I have said before the 14 day restrictions are less overtly wrong, and couple with the Diplomacy Strong framework and embassy decision making ability described above, I suspect it will be hard to counter their behavior. The lawyers will try, but there is a possibility the restrictions will remain. I have said before many times, no Judge can order embassies to put their staff in danger. So the embassies will retain discretion. They could, however, be asked to find other ways to interview people that would then spend a 14 day quarantine period in a non restricted country.
- KCC is the bottleneck through which all DV cases have to pass. We know that their previous procedures with the documents have been extremely badly implemented and will confuse and confound the situation. But even if that were resolved, KCC have lost a lot of time to do their work, since they reduced their staffing levels during the last few months. Unless KCC increase the workforce dramatically and quickly and/or change their procedures, there is no doubt in my mind they would not have enough time to process and schedule all the cases needed to fill the 55K quota. They work with contract staff, so I am hoping the Anunciato case results in an order that they gear up their staffing to appropriate levels to handle a higher monthly volume of cases than they have ever handled before.
- I have mentioned before the Muslim ban effect. Of the 130k+ selectees this year, 15K were barred by the Muslim ban, now revoked. That adds to the pressure on the system (the system being KCC, background checking agencies, physicians, and the embassies themselves).
- The DV2020 Gomez case continues. If that case is finally won, at least 9095 visas will need to be processed – meaning about 4500 cases. Some of those cases were already moved to the embassies, but still there would be an impact of that win on the embassy capacity. Of course there is a chance that the lawyers manage to secure more visas for issuance to DV2020 cases, and that would add additional strain on the capacity problems.
- If the Gomez case is won, the DV2020 cases previously refused for the sake of the Muslim ban will have a chance to reopen their cases. These are “refused” cases, already at the embassies. Again, that will be additional strain on the system.
- DV2022 will be going ahead as planned. Unless the government delay the announcement of winners (as they did in DV2021) there will be the usual flood of DS260s into KCC during May. I hope they push back the announcement date.
- There are too many selectees in DV2021. Even without any of the above concerns and without having lost half of the year, this was likely going to be a year where we see cutoffs in place at the end of the year – meaning regions don’t go current. Remember we see overselection (therefore cutoff numbers) about half the time. Out of the last 6 years, 3 have been over selected, 3 were underselected. DV2021 would make the 7 year total 4-3. The right number of selectees is around 100k, DV2014 had 140K selectees and was over selected with cutoffs, DV2015 had 125K selectees and again cutoffs. DV2021 is between those two years (although we have a slightly higher quota now, and a more rigorous rule in the passport rule that will likely block many cases). But I think it is still too many.
- Outside of DV there is a HUGE backlog of cases waiting at the embassies. We can’t assume that embassies will only focus on DV cases.
As you can see there are a lot of factors that are looming for DV2021. The lawyers are well aware of all of these points, and are working behind the scenes on some of these issues. They have been clear they cannot reveal their discussions so we have to remain in wait and see mode. But I want people to understand the realistic position. I have been explaining this for months, so this should not be a surprise.
How can this be fixed? Well a preservation of visas (or more processing time) at the end of the year may be the only way forward. But that is not easy. The lawyers are asking for that in the Anunciato case, but the outcome on that decision (the preservation bit, not the whole case) may be months away.
There is no doubt a lot of damage has been done. The legal work done for DV2020 will be enormously helpful for DV2021. The lawyers we have are good and they have been getting good practice at winning these cases. But legal remedies don’t always get us everyone we want. Just because we want something “really badly” doesn’t mean we will get it. We must remain positive and hopeful, but as adults we must also be aware of how difficult this situation remains.
Covid sucks. It caused problems. That would have been bad in any situation, but it was made worse by the previous administration. I hope things will be better going forward.

Hi Brit, I have a friend with a high but (we hope!) not hopeless EU number (31xxx) who hopes to be applying from a non-Schengen European country with a COVID situation that has remained under control, an embassy that has continued to function okay, and which has remained open for travel to and from the US for virtually the entire pandemic. I suspect my question might be unanswerable, in that you might not to even hazard a guess, but I will ask anyway, in case I’m wrong. Is there any possibility that non-Schengen applicants with high numbers might eventually “jump the line” and get interviews scheduled in advance of Schengen applicants with lower numbers, should the ban continue? Do you think this is possible? Likely?

Take two cases as an example. Case A is EU2000. Case B is EU25000. Assume both cases are current (i.e. under the VB number for the region), but case A cannot be scheduled because of the embassy closure, bans or whatever. Case B can be issued, yes. If there are lots of Case Bs, Case A could eventually miss out entirely. Case B cannot be interviewed without being current though.

I have a finance related question because I’ll be moving from the UK to the US and I know you did exactly that, so I though maybe you’ll have some knowledge in that area.
I have some ISA investments in Vanguard. If I leave them as they are and then start withdrawing at retirement will I be taxed in the US? Also what about pension money, will those be taxed as well?

I’m not a tax expert, but here is what I did.
You probably already know that US taxes worldwide income.
I looked at what the tax implication would be for each type of account. I believed at the time that pension accounts would be considered tax free as there is a direct comparison to a US investment product. So – I left UK pension accounts intact.
I could not see a direct comparison for ISAs (still don’t), and as far as I could tell, they would have become taxable by US standards. That might not be a big deal, but for simplification purposes I simply liquidated ISA accounts before I moved here. Your mileage may vary though – as I said, I am not a tax expert.
As for good sources, no – no particular recommendations.

I’ve got a friend from Sierra Leone (AF regio with CN 11***) who did not play with passport. We met on facebook and He said he received message for sending documents from KCC and he did it. He sent his documents with a passport issued after he’s been selected. Now KCC said that he would received a message for his interview soo.
He says he does not what to do now because he did not play with passport at the beginning.
1- He wants to know why KCC wants to schedule him for interview despite the fact he played without passport.
2- He says: Does it mean that he will attend the interview because he submitted a new passport in his ds260?
3- If he disqualified at the interview. Will be paid back his fees? He wants to know.

KCC doesnt has autority to not issue the visa, the consul has. Your friend will go to interview and he will probably get denied without any refund.
State department is very clear about that, if you didint entered with a valid passport, dont continue the process, don’t fill the DS-260. Your friend didint follow the rule. He is probably wasting time and money to finally be disqualified.

I am DV-2021 winner from Afghanistan (2021AS71xx). I am holding a short-term Turkish residence permit and I have selected the US Embassy in Ankara for our DV interview. I sent an email to US Embassy in Ankara and below are some parts of the response I got.
For all visa categories we are temporarily unable to provide immigrant visa services to non-Turkish citizens/non-Turkish residents.

My wihe has 2021EU36xx case number, we already have the “ready for schedule” email from KCC.
It seems like our embassy is working on a low level that only emergency US cases are handled, but no visas at all.What I don’t understand is the “preserve the 55K bit” and how that would work. Our number is already current in the bulletin, but let’s say our embassy won’t open until October (let’s hope not, but let assume). In this case other DVs will be processed in other countries, but not in ours.
Is it possible that in the mentioned scenario we lose our chance even with a relative low number such as this or the “preserve” bit could somehow save us? Or this can’t be predicted?

The passport rule will block thousand of cases in AF region. There is a lot of dv2021 winners who enter without a valid passport. So some high case numbers (with valid passport) might have chance to proceed.

For what it’s worth this was the exact situation I was in. I emailed them and asked whether I should wait for a second email asking me to submit my documents, or whether I should submit them straight away. They gave me the go ahead to submit 🙂 they only took 2 days to respond to my email, and my documents were processed in 2 weeks. Email them and ask! Good luck! 🙂

I am a dv 2021AS77@$, the vb shows my interview in April. The thing is, I have submitted all the required documents in Aug 2020, and still I haven’t received the confirmation, that my case is ready for the interview. I also contacted the Kcc 3 times for this reason, each time their response were vague, and not clear, replying me my ds is processed, I have to wait for their action.

What are you suggesting sir, I should do at this moment, where i live Afghanistan the embassy is processing all immigrants case but with limited capacity.

It sounds like you may not have sent the documents correctly. Check them very well, I made a video about that very recently.

after going to your videos, and all other information, and cross checking more than 10 time (i am going nuts about this),
the only thing i found different is the subject of my email when i sent the documents.
In my email, in the subject line i wrote this (2021AS000077@%, Further DV documents, My complete name).
Do you think it is one of the reasons they think i have not submitted the docs.
And do you think it will be better to resubmit the docs, this time only my case number (2021AS000077%@) at the subject. Not anything more……

the same situation has happened to me. I sent my documents in late August and got no reply from KCC. Then in December I had to unlock my ds-260 due to marriage. Everything went smooth with fast response from KCC. I updated ds-260 and we submitted my wife’s ds-260 then resubmitted all required documents for both of us. Everything seems to be fine with my documents according to your guidelines, however I haven’t heard from KCC since their automatic response in December. Which worries me because in their response there is 3-6 weeks processing period mentioned. My case number is relatively low EU8XXX. All documents are in polish and I’ve got quite specific situation regarding my birth certificate since there there is different surname at front page than I’m using currently and on other page there are annotations about surname changed. I don’t know if that can be source of an issue. Is there something I can do to get know what is wrong? KCC answers with email mentioned by Mustafa so there is no useful information from them.

If are certain you have sent the correct documents, you might just want to wait. KCC reduced staffing before and I assume they are now reverting to full staffing. So – perhaps they will deal with your case then.

Thank you Brit! I’ve got one more question to you. I believe that a source of the problem with my documents can be my old surname used on front page of the birth certificate. I’ve forgotten to provide this old surname in ds-260 since it was only used when I was a baby and then this surname was replaced in all of my documents instead of this full version of birth certificate. Old surname is used there but there are also annotations that it was changed to my current surname. Do you think that this missing information on the ds-260 form can be a critical thing? Should I request to unlock the ds-260 and provide old surname as answer to the question regarding other surnames that I used to use?

I wonder what would happen when it came to issue the 9095 (or more) visas for DV 2020 cases that are under the Schengen (and related) bans. As we can see embassies in Europe (for example in Poland) refuse to conduct interviews for everyone in DV 2021 that is under pp 10143 as long as this proclamation is valid. I think it’d be a good idea to raise that problem before judge Mehta issues his final decision. That would be pretty much the same situation as we had after September 4th when the State Department interpreted the order differently than what judge Mehta wanted them to do and we lost 10 days to change it. What do you think?

Simon, as always it’s great to hear your thoughts on the current situation ?
As someone with a very low number (2021EU3xx) living in the UK, I am wondering if it would be a good idea to get in touch with the Embassy in London some time in March and check with them if they have plans to resume DV processing. And if not, to maybe start considering other non-Schengen European embassies that are willing to take my case.
What I find really bizarre is that they will make people travel around (to foreign embassies) and potentially distribute dangerous new variants of the virus while they can easily implement a compulsory PCR test for all applicants attending interviews. And of course additional pressure will be put on the embassies that work in good faith and work in accordance with the guidance.
