OK – so we are past the point when we should have seen 2NLs for January interviews. We can assume, then, that we will not have January interviews. In the video below I explain when we might get interviews, what legal options are being worked to improve that, and I discuss the implications if we lose several more months.
Since the video above was produced the Judge has issued a ruling to deny the TRO, and instead suggested the lawyers switch to a preliminary injunction. So – I thought I should explain what that means, in a way we could all understand.
The ultimate goal of our lawsuit would be an injunction. That is a court order to permanently cease a behavior, such as the ban itself.
However, an injunction is only issued as a conclusion of a court case, after all the arguments have played out. That can take time – certainly weeks, often months or even years. In the meantime plaintiffs can try and obtain two types of orders from the court a TRO or a preliminary injunction.
A TRO (Temporary Restraining Order) is an immediate order stopping someone doing something. The idea being that the actions must be stopped immediately, it cannot wait for the arguments to be made. The standard that must be met for a TRO is quite high, and the the plaintiffs must show they are being caused irreparable harm. Irreparable meaning “cannot be repaired”.
If a case cannot get a TRO, then that case may be able to get a Preliminary Injunction. This will take a little longer than the TRO because the court case must have “started” where both sides have had the chance to gather their evidence, formally respond and so on.
In our case the TRO was to stop the ban, or the behavior that causes harm to the plaintiffs (which include DV2021 cases).
Judge Seeborg ruled that the plaintiffs had not showed any “immediate” harm (really referring to irreparable harm), because there are delays as we can all see, but it is harder to prove that the harm cannot be repaired. As I described in the video above, it is clear to me & you that we would run out of processing time, but we cannot be certain of that. It is speculation on my part, and perhaps the government could say they will increase the capacity of embassies to process these cases. So – given that, the Judge probably made a fair decision. He did note however that the lawyers had showed potential harm, and therefore suggested converting the request to a PI – which has a different standard of proof compared to the TRO, but is slower.
So a PI could still provide the same relief of stopping the behavior and could lead to a permanent injunction, but it just means the speed at which we get the decision will be slower. Maybe in December, possibly January.
I hope that explanation helps understand the legal moves and what it means.

1. I haven’t submitted my DS-260 till the day of writing this post. I am waiting to hear news about when interviews will start. Can I file my DS-260 at an Embassy, different than the one that I’ve filed during my application to the DV 2021?
2. Does it help to have a lawsuit through a US Lawyer to push the Gvmt to start the Interviews? or it would be a silly case?

1. No. You file the DS260 online. You will need to decide whether to submit your DS260 pretty soon – but wait and see what happens this week.

I don’t think that BGD Embassy will open anytime soon since its closed since Jan 1, 2020. I tried to send them many emails during the last 6 months and they did not respond to me. last time they stated it to me clearly that they will not be scheduling interviews for DV Applicants (few days before the rescission of PP10014). I am afraid that if I submit DS-260 and select it as the location for my Interview, I will get transferred to another Embassy (Doha, Ankara or Abu Dhabi). They might force me to go to Doha and the Visa to Qatar is hard to obtain for Iraqis and this could be simply the end of the journey for me. Ankara, on the other hand is more accessible for Iraqi. Foreign State Chargeability for my DV2021 selection case is IRAQ and the post is BAGHDAD, do you think it is a good Idea to select Ankara for my Interview Location?

I think it is too optimistic to assume March – and who knows really what will happen. But if it were April start, that is 6 months of interviews. In 6 months they could theoretically issue around 30k visas if they were operating normally. But will the embassies be operating normally? Will they give priority to DV cases? I don’t know. There is just too much speculation.
So, your number is not too bad, but I am not predicting anything right now.

This may be a hard question to answer, but thought I would to keep the dream alive. I am in Oceania region with DV21 case number OC29XX, quite high of a number.
Luckily in Australia we have handled the pandemic well and life is fairly back to normal with all offices open at the moment.
Question is, if other embassies stay closed but for instance Sydney is open and processing, could we see higher OC case numbers processed ahead of other regions to help fill quota if the other regions embassies are closed due to covid?

I’m curious as to why the visa numbers that are current is still going up every month when they’re not doing any interviews at the moment…they’re increasing the cases current every month even though none of the numbers that were current the previous month have been interviewed. Do you know if they’ll still do interviews by case number when they do start, ie if OC500 is current by the time interviews actually start, will they still start interviewing from the lowest cases first?

Well there are a couple of reasons.
First, AOS cases are processing. They are not banned.
Second, the first couple of months of bulletin are more or less preprogrammed. There is no feedback yet from the embassies.
Third, there is just not as tight a control from the visa office as you might think. They just don’t always make the best decisions…
Once cases are current, they are treated equally for scheduling, meaning a higher number coukld be interviewed before a lower number, assuming they were both current.

Question regarding the “immigrant intent.”
I currently work in Japan for an American company. This January they gave me the offer to transfer to the US, originally with the start date of May 2020, but obviously it’s been postponed due to COVID and Trump’s policies. Their plan was to petition for L-1 visa (which is banned by Trump’s PP).
Then my husband and I found out in June that he won the lottery, with the case number of AS 7000’s.
I am concerned about the interview being delayed, and with our case number I am not sure if we have a chance.
If we decide to move with L-1, then our case number becomes current (assuming 90 days have passed since entry), can we do AOS or would it be considered fraud because we entered the US with a winning lottery ticket?

An L-1 visa is in a special category of visas known as dual intent visas. H1 visas are like that too, which was the visa I had before the GC.
Basically there is no concern in your scenario – an L-1 visa holder can process their DV case at the same time, and don’t have to allow any time between entry to the USA and starting AOS.

The ban is all over the world, but yes I am aware of a very small number of visas issued by a small number of embassies. I believe these were unusual cases such as NIE exceptions, but I cannot be certain of the circumstances.

The number is available for “early filing” as soon as your number is shown in the VB.
For example, the last VB made OC region current for January interviews up to 600 (December was 450). So – if your number was OC575 (i.e. ANY number below 600) your number was “current for January.
Technically your number (OC575) is “available” from January. BUT, the early filing policy means you could file the I-485 package the moment that VB was published. Early filing is normally safe but should not be attempted prior to the start of the fiscal year.

As I understand, when they won the lawsuit for DV2020, named plaintiffs were prioritized for scheduling over everybody else. At the point when they won the lawsuit, however, all regions were already current. Right now, my case number is not current and probably won’t be for several more months. I was wondering if you think that being in this lawsuit will give me priority once my case number becomes current? A preliminary injunction (PI)is an order prohibiting an action, to preserve the status quo while the underlying court case is decided. It is issued at the request of a party who is concerned that the other party may take some action which would defeat the purpose of filing the lawsuit, such as selling or destroying disputed property. Preliminary injunctions generally last until the end of the lawsuit.
Permanent Injunctions: At the end of a court case, if the judge agrees that there is an ongoing threat, he or she may issue a permanent injunction prohibiting the threatened action indefinitely.

in a nutshell, let’s say 5 dv2021 winners are suing trump for not processing the visa’s. (in reality there are more plaintiffs) And the lawyers say, but this affects all dv2021 winners, the judge can order a class certification saying that the 5 plaintiffs represent all dv2021 winners. if the judge awards a PI all dv2021 winners will benefit from it, instead of only the 5 plaintiffs.

1. I don’t know why people overuse the term “good faith”. Specifically, the Judge told the government to process cases even if entry was banned. But that order only covered DV2020, so now the government need to be told that again because they are doing the same things as before. It’s not automatically applicable or enforceable to DV2021. Ideally the government should have changed their behavior – but that is/was the Trump administration.
