First of all I would like to thank you for adding a tremendous value to so many people!
Here is my question following the situation I’m in:
1) I lost my F1 status in January 2016 and applied for asylum in June 2016 and currently live in the US.
2) I lost my passport which has expired in 2018.
3) I haven’t applied for a new one through the local embassy in DC, because of the recommendations my lawyer has given me. {She said it wouldn’t be good for my country to know I have applied for an asylum}
My two questions:
1) Can I apply for a DV lottery 2022 without a valid passport and put one of the check marks that allows to apply without a passport?
2) If I can apply and if I win a lottery would I be able to change my status {I currently don’t have any status} to a green card?

I have used consultation ms from different lawyers, and asked them similar questions I asked my lawyer. Sometimes their responses are different.
Would you be able to tell me:
1) Does it matter or not if I apply for a new passport though the local embassy?
2) If I apply for a travel document and get approved to travel overseas, is there a chance for me not to enter back to the US? I don’t have any criminal records and I paid all of the taxes if that’s important to know.

For this year dv 2022 I have been trying to submit my application since 10 days now.
Each day I try morning afternoon and night so about 30 times so far still unable to receive the confirmation number.
I tryed Android device and Windows device.
I used Chrome, IE, Edge, Opera, incognito mode
I resize my picture from 178 kb to 78 kb
Still nothing works for me.
I am only aplicant no wife or children.
I am in Europe with good Internet connection and speed.
I manage to reach only page 2 where I need to check my information and when I click to submit my application and receive the confirmation number the site Always crashes.
Any suggestions?

1. You don’t need a new card or number from the DV process. You can visit the SSA once you are there.

Since I have proper documents from the goverment body’s internet page in Turkish, do I need to translate it in English to send KCC or Should it be enough to I take to the original one to the Consuler Staff?

Hi Brit Simon,
My case number is OC25XX, and you advised me few months ago that my case number is on the higher side( and hence chances are less).
I had already submitted my DS-260 and have been asked to submit docs,one of the doc required is date of birth certificate.
For both of us (me and my wife) when we were born, birth Certificate was not issued in our countries so it has become difficult for us to gather it. In one of your videos, you advised we could also provide affidavit for date of birth.
Is there any particular sample required for affidavit? Or , any guidance on how we could prepare our affidavits please?

1. Is there any template for affidavit of birth certificate that Would be acceptable to KCC?this is do that I can prepare it accordingly.
2. Also, I m currently an Australian citizen(so Australian passport holder) but I was born in Nepal so while preparing affidavit do I have to get it attested in Nepal or Australia? Basically should I prepare it and make it look Australian or Nepalese affidavit?

Actually, you have revealed a far more serious, actually fatal, problem with your case. You said you (and I assume your wife) were born in Nepal. BUT you have an OC case number which means you claimed an OC country as country of eligibility. You were not entitled to do that. Nepal is your place of birth (and for your spouse), so you could ONLY have chosen Nepal. You are 100% certain to be disqualified. There is no possible fix or CO discretion over this. Sorry – but at least you know not to waste any more time or money on the process.

Hi, My Brother won the lottery but didn’t have the high school certification because he was sick during the time of final exams for 2 year with partial stroke, after he got better he decided to attend the university prelim program to have entrance to university. Now he graduated with first degree and he is now doing his masters degree also. Is it possible to present his first degree and master qualification for DV interview?, he has the prelim certificate which is equivalent to high school certificate.

The prelim certificate is something like the GED – which does NOT meet the requirement. However, there is a chance that the CO sees the higher level education and uses discretion. But there is some risk of denial.

If Trump decides to extend the ban on entry, then we’d definitely know before the 31st of Dec right?
Now what happens if he decides to extend on the 1st of January? Some of us would already be on air etc Because of the date and time difference.
For eg, where i reside we’re 16hrs ahead of Washington DC.
What would you suggest?

I’m just in the process of submitting an entry for DV2022. I just noticed the ‘not to wear a uniform’ in the photo requirements. In my 9yo son’s photo he is wearing a Dallas Cowboys jersey. When they say ‘uniform’ do they mean military/police etc or do you think this would also extend to the wearing of a sports jersey? Thanks

Hello Brit, I recently noted that I made a mistake at the DS-260, my mother date of birth, we put 24 January instead of 23 January, and at the office that helped me told me that is not necessary to change it at this point, we can say at last minute that was a mistake made by the person who completed it. What do you suggest please? My CN is EU36*** and at this point I’m affraid it’s too late to unlock and make modifications at DS-260, because a friend of mine with CN EU35*** already got an email requesting the documents.

Simon, I have an existential problem and I know I’m being a fool but I need your valuable acumen so I don’t make a mistake. I’m planning on entering DV22 and I have a photo that was made in March so it’s 7 months old but the limit is 6 months. Problem is I look absolutely fantastic in it and it’s extremely rare for me to look photogenic and like such a beauty queen in pictures – there are higher chances of discovering life on other planets than me taking a good, charismatic photo. So can I use it? How do they even know how old pictures are?
I also took a new picture a few days ago but I look like the usual sad, grumpy human being that I am. Also the background was off-white, really gray-ish and I don’t know if that’s okay, I did tweak it to be white and it looks fine to me but I am being paranoid. Sorry for wasting your time with silly things. Thanks.

May my spouse and I each submit a separate entry?
According to the INSTRUCTIONS FOR THE 2022 DIVERSITY IMMIGRANT VISA PROGRAM, the answer is:
“Yes, each spouse may each submit one entry if each meets the eligibility requirements. If either spouse is selected, the other is entitled to apply as a derivative dependent. ”
However, my derived question is whether this in the process, or later, could be considered as a double application and be ineligible for that reason.

On Friday, January 31, President Trump signed a proclamation suspending entry into the United States of aliens who were physically present in the People’s Republic of China, excluding the Special Administrative Regions of Hong Kong and Macau, within the 14 days preceding entry or attempted entry into the United States. The proclamation took effect Sunday, February 2. This action followed the declaration of a public health emergency in the United States related to the novel coronavirus outbreak in Wuhan, China.
On Saturday, February 29, President Trump signed a second proclamation suspending entry into the United States of aliens who were physically present in Iran within the 14 days preceding entry or attempted entry into the United States. This proclamation took effect as of Monday, March 2.
On Thursday, March 11, President Trump signed a third proclamation suspending entry into the United States of aliens who were physically present in any of the 26 countries that make up the Schengen Area within the 14 days preceding their entry or attempted entry into the United States. The Schengen Area consists of Austria, Belgium, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Iceland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Netherlands, Norway, Poland, Portugal, Slovakia, Slovenia, Spain, Sweden, and Switzerland. This proclamation is in effect as of 11:59 p.m., March 13, 2020.
On March 14, President Trump signed a fourth proclamation that restricts travel to the United States of foreign nationals who were physically present in the United Kingdom and Ireland within the 14 days preceding their entry or attempted entry into the United States. On Sunday, May 24, President Trump signed a fifth proclamation suspending entry into the United States of foreign nationals who were physically present in the Federative Republic of Brazil within 14 days preceding their entry or attempted entry into the United States. This proclamation is in effect as of 11:59 p.m. eastern daylight time on May 26, 2020.
On Monday, June 22, President Trump signed a proclamation suspending entry into the United States of certain immigrants and nonimmigrants who present a risk to the U.S. labor market following the coronavirus outbreak. Effective immediately, the proclamation extends the suspension of entry for certain immigrants (Presidential Proclamation 10014) through December 31, 2020. Some exceptions include, but are not limited to: foreign diplomats traveling to the United States on A or G visas and certain family members of U.S. citizens or lawful permanent residents including; spouses, children (under the age of 21), parents (provided that his/her U.S. citizen or lawful permanent resident child is unmarried and under the age of 21), and siblings (provided that both the sibling and the U.S. citizen or lawful permanent resident are unmarried and under the age of 21). There is also an exception for air and sea crew traveling to the United States on C, D or C1/D visas. For the full list of exceptions please refer to the proclamations.
