I’m an LPR who activated my GC on 13 Feb 2019 (physical GC mailed late March 2019), departed the country on 20 Feb 2019, and will return to the USA on 16 Feb 2020.
I have not yet lived or worked in the USA. Should I have filled out a tax return? Will the IO expect me to have done so?

Yes you should file a tax return for the 2019 year. The IO won’t ask that, but not filing a return can imply you have abandoned your GC and can cause problems for naturalization.

Hi,
I received the 2nl today but my daughter which i didn’t filled the DS260 for her is also listed as beneficiaries because I put her name under my children name and her age is 21. she was not included in my original application.
Do you think i should request KCC to open the form so i can add her DS 260?
will they issue her visa without DS260 form?

actually she turned 21 on Feb 2019 and she is married but I include her name in my children list in DS260 form but marked that she is not living nor will immigrating to the US with me. and even i didn’t put her name in my original application because she was married but I don’t know why they added her name in my 2NL as beneficiary.
what do you suggest? will it effect my case although i didnt do anything wrong
or I should leave it as is and provide other children documents only for visa process and medical check up
obviously I can provide the hard copy of DS260 with the marks and original application hard copy in order to justify.

1. I have submitted documents in Nov 2019. In the Police clearance I just realized that they have issued the certificate favoring Sri Lanka Embassy in Washington DC instead of US Embassy Sri Lanka. Will this be an issue? Is it better to get a new certificate and send KCC?
When I inquired, they said if they will let me know if there is there issue during the doc processing. Better to wait?
2. In DS260 – There is question – Do you have documentation to establish that you have received vaccinations in accordance with U.S. law? Can I say that I will be be doing the required medical examination before the interview?

That’s not super clear when I don’t really know, and there’s so little info out there regarding E3 to AOS. I’m guessing my E3 remains as my work permit until it expires. Thanks for your help.

If you mean sponsor them to live in the USA as Green Card holders, no you can only do that once you are a citizen.

Just enter that an SSN is not required and once in the USA you can visit the SSA office to retrieve your SSN.

1. Totally normal. Even if you are current now, you only cleared documents processing in January meaning it was too late for January scheduling. The EARLIEST you could be scheduled is February (for April interview), and ONLY if you are current.

WASHINGTON—U.S. Citizenship and Immigration Services (USCIS) will implement the Inadmissibility on Public Charge Grounds final rule (“Final Rule”) on Feb. 24, 2020, except for in the State of Illinois where the rule remains enjoined by a federal court as of Jan. 30, 2020. Under the Final Rule, USCIS will look at the factors required under the law by Congress, like an alien’s age, health, income, education and skills, among others, in order to determine whether the alien is likely at any time to become a public charge.
The Final Rule, issued in August and originally scheduled to be effective in October, prescribes how DHS would determine whether an alien is inadmissible to the United States based on the alien’s likelihood of becoming a public charge at any time in the future, as set forth in the Immigration and Nationality Act. The Final Rule also addresses USCIS’ authority to issue public charge bonds in the context of applications for adjustment of status. Finally, the Final Rule includes a requirement that aliens seeking an extension or stay of change of status demonstrate that they have not received public benefits over the designated threshold since obtaining the nonimmigrant status they seek to extend or change.
“Self-sufficiency is a core American value and has been part of immigration law for centuries. President Trump has called for long-standing immigration law to be enforced, and U.S. Citizenship and Immigration Services is delivering on this promise to the American people,” said Ken Cuccinelli, the Senior Official Performing the Duties of the Deputy Secretary for DHS. “By requiring those seeking to come or stay in the United States to rely on their own resources, families and communities, we will encourage self-sufficiency, promote immigrant success and protect American taxpayers.”
Except for in the State of Illinois, USCIS will only apply the Final Rule to applications and petitions postmarked (or submitted electronically) on or after Feb. 24, 2020. For applications and petitions that are sent by commercial courier (e.g., UPS/FedEx/DHL), the postmark date is the date reflected on the courier receipt. The Final Rule prohibits DHS from considering an alien’s application for, certification or approval to receive, or receipt of certain non-cash public benefits before Oct. 15, 2019, when deciding whether the alien is likely at any time to become a public charge. In light of the duration of the recently-lifted nationwide injunctions and to promote clarity and fairness to the public, DHS will now treat this prohibition as applying to such public benefits received before Feb. 24, 2020. Similarly, the Final Rule prohibits DHS from considering the receipt of public benefits by applicants for extension of stay and change of status before Oct. 15, 2019 when determining whether the public benefits condition applies, and DHS will now treat this prohibition as applying to public benefits received on or after Feb. 24, 2020.
USCIS will post updated forms, submission instructions, and Policy Manual guidance on the USCIS website during the week of Feb. 3, 2020, to give applicants, petitioners, and others ample time to review updated procedures and adjust filing methods. After Feb. 24, 2020, everywhere except in the State of Illinois, USCIS will reject prior editions of forms if the form is postmarked on or after Feb. 24, 2020. If USCIS receives an application or petition for benefits using incorrect editions of the forms, USCIS will inform the applicant or petitioner of the need to submit a new application or petition using the correct forms.
USCIS will continue to release information through its website in the weeks leading to the rule’s implementation date, including in the event that the injunction in Illinois is lifted. This will include an update to the USCIS Policy Manual.
In the coming weeks, the agency is planning to hold a public engagement for immigration attorneys, industry representatives, and other relevant groups to discuss the final rule.
DHS remains enjoined from implementing the Final Rule in the State of Illinois. Should the injunction in Illinois be lifted, USCIS will provide additional public guidance.

Then stop saying you are “from Sudan”! You are a “native” of SA, and more likely to avoid the ban if you start describing yourself that way. As it is, the travel ban is reported as placing a ban specifically on DV immigrants from Sudan and Tanzania.

Hello,
I am a new immigrant by DV1 waiting for my greencard and ssn to be sent.
I have figured out that due to my age if I wanted to visit my home country during holidays I may not be able to leave it again until doing something called the obligatory military service which would take me a whole year and as far as I understand that would be considered as abandonment of my permanent residence here in the United States.
My question is: can I apply for the re-entry permit with this excuse to finish the obligatory military service and come back to the USA? because otherwise, I would have to stay for 5 years without visiting my country until I become a U.S citizen which would exempt me from the obligatory military service.
and the purpose of all of this is to be able to leave my home country again freely (as someone who finished his obligatory military service) If I ever visited during holidays until I become a U.S citizen.

I would like to know if our local consular gives an earlier date for interview. My interview date has been provided as 4th March but I have already completed my medical and have the reports and have collected all documents that are needed including I 134.
Do you think I can ask the embassy for an earlier interview date.

If your number was current for February, you could ask, but a change is unlikely.

I did read the FAQ.
I got this from their last email.
“Once an interview date has been scheduled, you will receive notification via email to check “dvlottery.state.gov.”
Also in your FAQ the email is from state.gov not from KCC and in the dvlottery.state.gov/ESC says that the scheduling is done by the embassy.
My reason for asking is that should I contact them(KCC) or even worth doing it since they are waiting for the embassy to schedule it.

Hi,
I have received the interview date for the 11th of February and have collected all the documents I need, including police reports from 3 different countries where I have lived (UK, UAE and Sri Lanka, currently living in the latter).
I was recently told by a friend that the police reports need to be certified by the embassy of UK and UAE in Sri Lanka in order for the police certificates to be deemed valid. Is this necessary?? Please advise, thank you.

I got an email from KCC to upload additional documents, birth certificate, marriage certificate, passport, etc via email.
I sent them the translated copies of these documents and will be taking original and translation to interview next week.
will this affect my interview outcome.

My question is related to the new travel band.
Am sponcering my wife and my baby with foriegn chargablity of Eritrea( spouse sponcering) they are living as refugees outside eritrea( Egypt). Thier case is currently with NVC and will be transferred to embassy of America after few weeks.( almost done with submitting the required papers).
Does this new rule affects them.
What options do have if so as they are refuges.

Yes they are affected, but you may be able to get a waiver. Discuss with your lawyer.
