Sir while filling the DS260 Iam confused with this question ” Do you seek to enter the US for the purpose of performing skilled or unskilled labor but have not yet been certified by the Secretary of labor? ” Do i answer yes or no. I don’t know what secretary of labor is and what it means by skilled or unskilled labor. I will of course be working there.
Sir this question is amongst the question where all the answers are “n”o so I don’t know what to write.

I m 2018 the winning lottery tune by my wife (the main winner), but unfortunately, we discovered late when the ds260 was filling that there were some errors like:
1- My mother’s date of birth is wrong, it fielld 1974 instead of 1947
2 – For this section (work/education/training information) we fill the educational information in the work section, but we have written the education and work information after that is correctly
3. The question of the vaccination we field it by (we do not know) .
but all another information is correct. so please this wrongs will effect for our case.
note: we are 5 persons in this case me,my wife, 3 children.

I have two questions. I was looking for answers from internet but I couldn’t find anything satisfying. That’s why let me ask from you!
The case:
My friend had interview with US consulate. Unfortunately, they refused to issue him and his family visa.
The reason:
He has been playing/participating in DC lottery for several years, but the details were different each year. Like: misspelling names, address and so on.
However, my friend says it was the fail of the middle person who entered his info.
My questions are
1. “can it be a serious reason for refusal?” 2. And “is there any hope to change their decision?”

1. Yes. They obviously suspect (or know) that your friend has been entering multiple times each year with various versions of names and addresses. It is not surprising that they chose to deny him a visa. Regardless of WHO entered for him, HE is responsible.

Thank you for all the information you provide, it’s a real help. I am in the DV2018 process at the moment and mine will be an adjustment of status. I spoke to KCC about a query and they randomly volunteered this information – as an adjustment of status applicant, when my number goes current I can schedule my interview rather than wait for a letter. My natural question to them was, did I have to wait the 2 months like other applicants not filing for an adjustment of status, or if my paperwork is in order can I schedule the first available appointment? They couldn’t answer this. An immigration lawyer wasn’t familiar with the fact that AOS applicants could schedule their own interviews and I wanted to see if you could shed light on whether I can schedule it myself and, if so, can I go for the first available appointment or have to wait the 2 months?

You don’t schedule your own interview. You submit the I-485 to the Chicago lockbox, that is then processed and sent to the relevant Field Office. The FO schedules the biometric, orders background checks and reviews the case. Once they are ready they schedule the interview if they decide an interview is needed (Most, not all AOS cases are interviewed).
All this would be more clear to you if you understood the process. If you take some time to understand the process you can handle everything yourself, no lawyer needed.

is it must to fill passport number in the DS260 form or can I submitt the passport at the visa interview with out filling the number in DS260 before interview.

I am DV2018 winner my case number not scheduled yet(23xxx).My citizenship is Ethiopian but I came to Italy to study my masters last year.Here in Italy they give a resident permit valid for a year and I have to renew it again.Mine expires in December 31 so I applied for a new one and gave my finger print but unfortunately the process to get the permit can take 8 months.Until then In Italy I am recognized by the recipient they gave me after I gave my finger prints .
1.If my interview is scheduled before my resident permit has arrived would that cause a denial?2.Can I show the recipient that I use here for the interview along with the expired permit?do you think that would be okay?
3.If not can you tell me what options I have?

hello brit I’m from venezuela south america and I was selected in dv 2018. I went to the interview. I want to tell you that thanks to Good and your good advice and guidance, the embassy granted me a residency visa. I plan to move to the United States in February of next year. I have my girlfriend 2 years ago and I want to take her to the United States, I wanted to ask you:
1 Should I marry her before or after entering the United States?
2 How long after entering the United States can I file a petition with the immigration service for my girl friend?
.I did not marry her before they granted me the visa because I did not want to risk the process because I applied as a divorce and thought that if I got married, the embassy official might think it was a marriage for convenience.

1. It doesn’t matter.
2. Once you are stable and have an income as you will need to show you can support her. Once you apply it will take around 2 years for her to join you. Marrying her before the DV interview would have been a lot simpler/cheaper/faster.

My mobile carrier declared bankruptcy and has notified all costumers that their numbers will be terminated on 31/12/2017 with no possibility of mobile number portability to another carrier, so bottom line my number (indicated as contact on ds260) will no longer work. Hello Sir Brit,
“ABC” told me he knows of some who entered the lottery as single with no children and submitted his DS260 as single with no children meanwhile he was married and had children before the entry. His visa was approved and he traveled and after a couple of years, he brought his family over to the US.
1- Is this really true, is it possible in any way?
2- “ABC” also said once you get your visa and travel and want to bring your family to the US, they will not check or know if u initially travel through DV Lottery or ….. So you wil just have to file in for your family to get an immigrant visa just like you. Is this also possible?
3- Can one really successfully Beat the system at all, like lie about his family and successful travel and later bring his family to the US?

I need a little bit of help. I read about traveling to us with i551 stamp. I got my DV endorsed in July and I am traveling back to us. I have been outside of the US for 5 months. As I know I am know a LPR now. WIll I face any problem with CBP.? I heard they might detain to verify that the stamp is genuine. I am also a citizen of one of the travel ban countries but I am not worried about that because the order clearly specifies that it does not apply to LPRs. But I am just concerned. They even already emailed the actual green cards to the address we gave to them after we left US. So Can I still use my I 551 stamp to enter the us.

hi brit,i had my interview today,everything went on well untill when the consular asked me if i have ever applied for a student visa,i said yes(i actually applied for a student visa and scheduled an interview with the embassy last year but didnt show up due to some financial reasons and absence of some documents).his next question was did u come here for the demand of student visa,i replied no..he said ok and put me on AP,he retained my passport and say he will contact me in two weeks time.pls is this a good sign that i will get my visa?..and i was totally truthful in all my answers.

Dear britsimon I am the main applicant of dv ,my all the documents are okay but my spouse who is dependent applicant has a problem that her date of birth convert got wrong in citizenship card in AD but BS according to nepali date is same with educational documents and we mentioned the AD date in passport and in ds 260 form too unknowingly even there is wrong. Now the problem is when we convert nepali date belonging to educational doc into AD it is date of 3 but it has been 5 in passport and ds 260 , what to do in this situation ?
And my interview is within 3 days.

Had an interview in London, was very tough, lots of questions and digging in the past as I previously stayed in US illegally 17 years ago, but since then been living in the UK and left voluntarily, never been caught or deported.I have US citizens brother and sister, also my daughter is US citizen, but they don’t really matter. Just an advise to anyone who have previously been in USA ilegally, it will be very hard and testing interview, be well Over prepared and get as much documentation as possible even what is not on the list. I was put on 221g which is denial , but can be overturned provided I get additional documents required and background checks are good. I have never done anything wrong in my life, clean records, healthy, US family, financially stable, but previous one illegal entry and that makes things difficult and all your life is investigated.I am married, but wife kept her maiden name , never used my surname so those who are in this position will very likely require police certificate for wife with your surname even though she never used it, it’s what we need. For those who were in the military like myself, I got a confirmation of my military service and what rank I was plus when I was in the service. It is not sufficient, you will need actual discharge letter confirming you are not part of the military any more and in some countries it is really hard to get, because although you left army, you are considered army reserve which means you are not discharged! I didn’t know that so make sure be prepared. I am main applicant with wife and child so 3 members and I have $50k in savings account, but I was asked to prove I have more than that as it didn’t seem to be enough, luckily I have a mortgage and I had my statement ready as well as valuation of the house handy which embassy kept so in total I was well over $100k. Perhaps it was just me , becasue of previous illegal stay, but my wife and daughter left interview in tears, it was really tough and took around 20-25mins.
I got a slip 221g with additional documents to supply, but it’s not marked for AP, seems like only couple of documents which are not on the list that they want from me.
Question I have I guess is, what do you think Simon, what are my chances?
I am not subject to 3 or 10 year bar as been outside of US for over 10 years and all my documents are perfect,original, clean certificates,healthy,family US citizens and even my current employer is US company where I could potentially get transferred. I guess it just matters who gets to make the decison and in order to be denied they surely must have concrete evidence against me to deny me for some reason don’t they?

I can’t guess your chances. They don’t need “concrete evidence” to deny you – the Green Card is a privilege, not a right. All you can do now is wait and see what they decide.

My husband applied for a spousal visa to the US from New Zealand. His case number ACK2017ZZZZZZ and the DS 260 was submitted on Nov 21st 2017. We started our application in September of 2017. I am due for our second baby in the end of June 2018 and really concerned of the timeline ans him being here. It will be 18 months since we applied in March 2018. We have applied through an attorney but she has not been very helpful.

Hi Brit, We went to US to activate our green cards in April this year which we received in about 3 weeks and then we returned immediately back beacuse of my job and also because of the kids’ school..Now after 8 months we are going back for another 3 weeks and intent to wind up everthing here and move permanently in the summer of 2018 because of kids’ School and other commitments meanwhile I continuously applying to get a job there…My parents and brothers are already US citizen and we live with them when we go there..my question is that is it fine to tell the CBP officer about my intent to move permenatly in the summer of 2018 meanwhile we will be moving back and forth to finalize everything “if he asks us about it” also we will be filing our taxes in Jan..Moreover will we have any issues when we enter US this month as we were outside since 8 months?

I have written to the US embassy my country cote d’ivore to inform them of this and to allow me to go first to US and later my wife and the baby will join me, after the interview. They replied in this :” if you want to travel with all the family members you need to fill out the ds-260 for the whole family and follow all the process.” What does it mean ? Hi BritSimon,my CN is EU92xx and I think we will be scheduled for February interview but I just realised I made some mistakes on the DS260(submitted may 2017):
1)I misspelled the state my mother lives in as “Wasinhgton” ,compared to “Washington” (extremely small mistake)
2)I didn’t carefully read the question if I used other names in the past so I didnt list the name I was born with-maiden name(the one before I got married). (important-ish information?)
If I unlock my DS260 is it going to cause any delay in interview scheduling OR if i correct it at the interview ,will it make it awkward for the overall flow of the interview?

Here’s the situation:
I’ve won the DV2018, my number is AS35xx so I expect the interview to be on February.
I’m a 23 years old web developer, working for a big global company for the last year. I expect to immigrant to the US with my wife (we don’t have kids). The thing is that I am a bit anxious about getting refusal. We can’t get anyone as a sponsor because we don’t know anyone in the US, we have $30K in savings and we know for sure that the embassy requires evidence of independent resources (savings, investments etc.). Can they really reject us for not having enough money? Is there really a different bar for each embassy? Of course, we don’t have any criminal records, we are young and healthy and meet all other requirements (12 years education equivalent to the US high-school, no degree though). Do I have a reason to be anxious about getting declined? Should I be worried? Is there really a possibility to reject our visa based on our situation?

Hey Brit sorry for bothering you this much please i have another question to ask I’ve got five names eg Sandra Atamja Lois Ann Mary that’s how it appears in my passport and birth certificate but when i played i realised it came as Sandra Lois Atamja Ann Mary and my main concern is that some documents have the 2 middle names mixed up like my university degree have Sandra Lois Atamja Ann Mary but the beginning and last are same please i want to know if it’s a serious problem i have cus I’m waiting for the interview in few days.thanks in advance for your reply

I’m reading your blog since may and that time I read also your article about public charge. You mentioned 20k for family of two is enough. Well me and my wife have 21k and I do have a US job offer so I thought that we are safe. But today Im reading other comments and it looks like experiences from embassies are different. People mention 30k or 50k and more for family of two. Its crazy, my interview is in two days and I’m stressed out that they are gonna ask for 50k or more. So my question is: the bar was really set higher ? Thank you

Calm down. Like you said – all embassies are different. Also, every case is different. So – in your interview you can discuss your plans.

Quick question – my DS260 asks about previously serving in the military but does not show the questions about contributions to charities, specialised skills or other languages. My spouse, the primary applicant, had these on his form. Is this normal for them to be missing?

Me and my husband won the DV2018 ,while we live on an E2 visa(investor) in USA since almost 3 years.
As you know most of the health insurance companies the last day to enroll is around 15 th of December.We will have our interview date in February (our number EU82xx) which will be to late to enroll.
Just checked the coveredca.com plans and came across this :
Purchasing Insurance through Covered California and Receiving Financial Assistance to Pay for the Insurance Does Not Make an Individual a “Public Charge”
In general, applying for health insurance coverage through Covered California and receiving financial assistance for a Covered California health plan or receiving low- or no-cost coverage through Medi-Cal, will not make an individual a “public charge.” It will not affect the consumer’s immigration status, their chances of becoming a lawful permanent resident or their chances of becoming a naturalized citizen. The exceptions are if the individual receives long-term care in a nursing home or other facility paid for by the government through the Medi-Cal program or does not tell the truth on their application for health coverage.
So my question is :
Receiving financial assistance is a PUBLIC CHARGE OR NOT ? i read in some of your quotes before saying that it may be consider a public charge.Just wanted to check with you one more time.

Applying for a health care plan doesn’t make you a public charge. But as you are here on an E2 visa you should be able to show enough income to avoid concerns anyway.

I received my appointment for the interview in the embassy of Madrid, we have to register before the appointment, when I am doing I create a group and I start to put all our data, but when I go to put my daughter tells me that the user is already created it turns out that I put my passport number that is equal to her just change a number, so I delete it, and I give to continue thinking that I could put it later when I try not let me add it to the group, so I deleted myself and my husband from the group to create another new group with the three, but in the new group he does not leave me because he says that we already exist.

He can make his own decision – but a 4 to 5 month “stay” in a country doesn’t necessarily mean “residence”.

Ticket doesn’t matter.
You can unlock and correct the address if not already scheduled, otherwise update at the interview.
