A special hearing has been set for today at 4pm for the parties to review the report provided by the government regarding progress.
The time will be 4pm Eastern USA timezone.
If you want to listen in you can do so. Members of the public or media who wish to access the hearing may dial the court’s toll-free public access line: (877) 848-7030, access code 321-8747
Notes from the hearing – I will be listening in and adding notes as we go. Keep refreshing the page for updates. Times in my time zone – Pacific time.
1:05. All parties represented. Judge joined the call.
Judge says he has a chance to review the report. Now says “where do we go from here”.
Judge says that plaintiffs don’t find the numbers very satisfying – and will no doubt still want some relief.
James Wen (government) adding a note that USCIS have also awarded some 700 more (through AOS), but of course they were never blocked. Judge seeking clarification why USCIS were involved and asks if any of those were named plaintiffs. Wen guesses 1 case (plucked from the sky).
Judge asking for a guess of how many visas will be adjudicated by the end of the month. Wen responds it is a fluid situation, so no guess.
Judge asks Charles Kuck for input. CK immediately disputes the numbers provided by the government – taking plaintiff cases as a measurement of overall progress.
Judge talking through his interpretation of the governments report. Clarifying that each person is one of the 55000 visas – so a family of 4 is 4 from the 55000.
Judge trying to assess the effort in respect of the named plaintiffs.
Rafael Urena also adding his perspective that the governments report is confusing and inaccurate.
Judge telling the lawyers to talk to each other.
Wen says this was really hard.
Wen will be Kuckslapped in the next few seconds. It’s hard because they threw away 140+ days!
… and there it is. BAM.
Judge is explaining the rationale that he is considering for saying how many visas could be set aside if he were to extend the deadline. Kuck and Urena are describing the period of unlawful behavior as what they want as a timeline for additional relief. Judge wants some “real world” calculation to take into account the other factors that slowed down issuance.
Jesse Bless making the point that the class action should be considered, to avoid the extension ONLY going for named plaintiffs.
Judge mentions the June 15th date to make the point that March to June could be considered as lost for OTHER reasons.
Judge asking for input by Friday for additional relief and in particular how many visas should be set aside. It should be less than the 55,000.
Judge again encourages the lawyers to talk to each other. Sheesh. Tell the government that!
Judge is asking for additional briefing on Friday and sets hearing for 2pm hearing on Monday.
Judge raising two more issues:
Medicals – did they raise that with CDC?
Wen says he asked State/CDC and waffled an answer. I’m not sure he even asked.
Judge then turns to CM 3.0 checking filing status. Gov has not been served they say – making a technical point. Judge responds he doesn’t need their technical niceties to have happened to issue a TRO! LOL
Judge says he has questions about the appropriateness of relief on the CM 3.0 case – Judge wants to talk about that tomorrow he is setting a time at 4:30 tomorrow.
James Wen asks what is expected for the Friday brief – Judge clarifies it is for positions regarding “relief” (meaning extension).
Urena now raising the issue of people being denied under 212(f) because of the travel bans.
Now discussing a spreadsheet on how to handle the communication between parties to address on Friday.
Hearing draws to a close.

Hello Ana, i have send email to KCC (just asked politely to check my status , and explained that Kosovo is a small country and little number of selectees) , my Case Number is EU32XXX. i don’t know if this email helped me or not , but i thought there is nothing to loose anyway.
September 22, 2020 at 18:14
yesterday I did my interview in Lomé and by the grace of God I succeeded. the consular officer gave me a piece of paper that says “Immigrant visa receipt” and he told me to come on Friday to withdraw my visa with my passport at 08:00 AM T.U.
I have a concern, when I consulted my CEAC representative I saw “Administrative processing”.
Sir, can you explain to me a bit what that means?
thank you !
September 23, 2020 at 00:16
They are doing the work behind the scenes to print your visa.

September 22, 2020 at 18:33
Hi Brit, I hope you are doing well! I would like to thank you for your continuous support for us. I had the interview and the visa was approved (Tunisia Embassy). The Consular Officer mentioned to me that I can travel but not through Europe and the person who gave me my passport with the visa said the same thing that I can travel now and I said, I cannot because of the ban and I have to wait till 2021 but he said , he is aware about that but for DV 2020 can still travel now. I know, I ‘m not in Schengen area, can I travel now? I’m worried if the ban will be extended in 2021 or the boarders of my country will be closed because the corona cases are rising now. I’m not sure what to do.
September 22, 2020 at 18:58
You should check, but I believe you could with no major problems travel now from Tunis to the US via Turkey with Turkish airlines.
September 25, 2020 at 11:29
Ostost81, are you from Tunisia? Can I have your email address if you don’t mind? do you know who traveled now with DV visa ?
September 23, 2020 at 00:18
No you cannot travel now. The ban is still in force until Dec 31

How the government, telling the TRUTH, will handle more than 30,000 DV-2020 cases in less than 8 days ?
Can one tell us how?
Lawless actions lead to the true mess. Covid-19 pandemic has been a “good lethal” justification.
September 23, 2020 at 00:19
No they can’t do that of course.

Brits, Wen have no idea seriously and I think judge already give Clue that March – June which was slow down process as relief for two parties?? Here is rally what I don’t get it about Jessy “ Jesse Bless making the point that the class action should be considered, to avoid the extension ONLY going for named plaintiffs.” what exactly she mean?
Thanks brits
September 23, 2020 at 01:18
I explained this in the video above.
September 22, 2020 at 23:04
Quick question, I don’t even sign up for being a plaintiff anyhow if judge extend the period will that make me qualified also ? Thanks Brit
September 23, 2020 at 01:16
We have to see the terms of an extension to know the answer.
September 22, 2020 at 23:32
Hi brit ,I am plaintiff at 3.0 kennedy case, can you explain what judge said about 3.0 ?if we get a TRO tomorrow can our cases be processed immediately starting from tomorrow?
September 23, 2020 at 01:15
There is a hearing tomorrow – no clues on the outcome.
September 23, 2020 at 00:52
Hi Mr.Brit, thank you for your update.
If Judge Mehta give time extension, could we get a reschedule beyond Sep 30 if our appointment was cancelled because we need more time to get the medical result?
Thank you
September 23, 2020 at 01:15
We have to see the terms of an extension to know the answer.
September 23, 2020 at 02:26
I guess is it better for us to not attend the interview and wait for the court’s results first sir?
To know our chance better and not waste money?
September 23, 2020 at 16:49
You must decide for yourself. An extension is not certain.
September 23, 2020 at 01:36
Thank you, Brit, really! You do an incredible job!
September 23, 2020 at 02:22
I am not a named plaintiff in the case Gomez v Trump case or the combined cases.

On September 18, 2020 I sent email to [email protected] and [email protected] again to send additional documents and request for interview appointment.
They saying They will help who were the plaintiff in this case.the will follow the caurt order.
I sent my declaration to
[email protected] on 19/20/2020
Please help me.
September 23, 2020 at 16:48
At this point you should hope we get an extension.
September 23, 2020 at 03:55
If DV2020 get an attention , does it mean that group #5 still have a change or extension will be only till group #4?
September 23, 2020 at 16:51
We don’t know.
September 23, 2020 at 06:13
Hi,britt
AS888x,nepal I was called by embassy but told i’m medical hold case though my extensive medical about chest was clear at august after 8 weeks thats valid till nov 20.they told me we have ho time for your reschudule because my re medical might take same time and same procedure.I’m curious if my medical was clear how can i repeat same procedure that embassy was so sure of.I mailed them i like to be resudule and do medical and take all the chance i got but they aren’t responding.bad luck. I cant do remedical because without interview appointment says medical centre. If extension happens is it i would be hold as same medical hold case.
Whats your thoughts.how can i move ahead
September 23, 2020 at 16:55
You could ask the doctor if you can get an immediate clear medical report.
September 23, 2020 at 06:41
Brit, the moment of salvation is coming now, but us as Sierra Leonean can’t benefit from it because we’ve already kicked/suspended out of the USA immigration system both for immigrant and non immigrant Visa on the 19/9/2020 by the USA ambassador. The reason being, our government failed to honour a request from the USA immigration department to take back their citizens who have committed serious crime deemed to be deported.
I wish the rest of the DV 2020 applicants a successful result with a visa on their passport.
September 23, 2020 at 16:58
You could ask to transfer your case to another embassy.
September 23, 2020 at 07:13
Thank you for your email regarding the scheduling of a Diversity Immigrant Visa interview appointment.
Consistent with the court order in Gomez v. Trump, the Department of State is making a good-faith effort to adjudicate as many Diversity Visa applications as possible notwithstanding Presidential Proclamation 10014. Please note, however, the DV-2020 Program expires on September 30, 2020 and, in accordance with law, diversity visas may no longer be issued after that date. The Department expects that, due to resource constraints, limitations due to the COVID-19 pandemic, and country conditions, we will not be able to adjudicate applications for all Diversity Visa selectees by that expiration date.
As ordered by the court, we are prioritizing individual named plaintiffs in the court case Gomez v. Trump and its companion cases who are applying for Diversity Visas. Beyond that, we have established priorities based on statutory standards and categories of cases most likely to result in timely issuances for eligible applicants. Accordingly, we are prioritizing applicants who have already been interviewed and who either have been determined eligible for a visa or may be determined eligible for a visa with additional information. We will also prioritize applicants with appointments that were cancelled in March, April, or May due to the COVID-19 pandemic and worldwide suspension of routine processing. Diversity Visa Selectees who have heard from the Kentucky Consular Center (KCC) that they are documentarily qualified, but awaiting an interview date, will be scheduled in accordance with their rank order and post’s capacity, consistent with our standard processes. For more details, see https://travel.state.gov/content/travel/en/News/visas-news/
What menes in this forme
September 23, 2020 at 16:58
It is just a standard reply.
September 23, 2020 at 07:37
Hello sir,
I am in group 4 DV2020 (have received the 2nl from KCC).
My Consulate (Albania) has many DV2020 winners to process because of the large number of winners (nearly 3600, the largest in Europe). They have proceeded with plaintiffs and till now with many cancelled interviews.
Considering that our neighbor Consulates (Kosovo) is processing with group 4 (because they have low winners numbers), should i ask to Kosovo Consulate or KCC to schedule my interview there?
If not, what should I do (considering my group number and consulate condition)?
Thank you in advance
September 23, 2020 at 17:01
You could try – but there is almost no time left, unless we get an extension.
September 23, 2020 at 09:30
I got notified late last night for an interview today! 2020EU30XXX, group 4, C3.0 participant but not a previous named plaintiff. Keep fighting, after several emails of increasing urgency my embassy (small European country, less then 100 winners overall) requested and finally got approval from KCC!
September 23, 2020 at 09:36
good luck my brother
September 23, 2020 at 17:37
Great!
September 24, 2020 at 00:19
Hello Nahini2020
in which country are you?
September 23, 2020 at 11:25
HI,
Do we pay the dv fees before or after the interview with consular officer?
I have an H1B visa and I am supposed to travel on 30/09.
I have an appointment for DV interview tomorrow and I am not sure If they will let me travel before 31/12. Therefore I want to ask the consular officer if I can get a permission to travel as planned. I am not sure if they will help , probably not. But in that case I will withdraw by DV application because it will have consequences on my job over there. I just don’t want to pay the fees to know at the end they will not let me travel. So dose anyone recently had an interview can help me with that. Do you pay fees before or after the interview?
September 23, 2020 at 17:42
You will not be able to enter until after the Dec 31 timeline.
September 23, 2020 at 11:58
Hi i just wanna see if anyone from group 5 has recevied an email for the documents approval? I eamiled them again and i’m hoping for the best.
September 23, 2020 at 13:02
no
no one from group 5 had the interview
I am also in this group
pray for an extension.
Thanks you brit
September 23, 2020 at 13:10
Great job sir
September 23, 2020 at 14:09
hey simon I’m DV2020 Winner I Have Submitted documents and i was waiting for confirmation email before the pandemic. i have not recieved any email still.
Is there anyone who have not recieved confirmation email after submitting documents
September 23, 2020 at 17:46
So you are group 5 and will only have a chance if we are granted an extension.
September 23, 2020 at 16:15
Hello brit so its a total nightmare from kcc and now the US embassy in Dakar
here is what they had to say
The Department expects that, due to resource constraints, limitations due to the COVID-19 pandemic, and country conditions, it will be unable to accommodate all DV applicants before September 30, 2020. U.S. Embassy Dakar does not anticipate being able to accommodate DV applicants who have not already been interviewed or DV applicants who were refused 221g for additional evidence. An applicant may request a transfer to another post. Applicants can request a transfer by contacting the desired post directly; however, we will not be able to accommodate all transfer requests.
If U.S. Embassy Dakar is able to complete your DV case, you will be contacted by us directly.
Thank you for your understanding and we apologize for the inconvenience this has caused you.
Consular Dakar
September 23, 2020 at 17:50
It’s not unreasonable.
September 23, 2020 at 16:50
Hi BritSimon,
I asked a question in one of your recent live-streams but I think you misinterpreted my question, therefore I am trying again :).
I am one of the lucky people that recently got their diversity visa (named plaintiff in Mohammed vs. Trump) -> Many thanks to you, and the whole legal team !
As I am sure you are aware, there are several national interest exceptions defined for PP100014 and PP10052:
https://travel.state.gov/content/travel/en/News/visas-news/exceptions-to-p-p-10014-10052-suspending-entry-of-immigrants-non-immigrants-presenting-risk-to-us-labor-market-during-economic-recovery.html
However, there is no exception for DV defined. As our lawsuits are still ongoing, can anything be done in this regard ? Could Judge Mehta provide the same exceptions for DV as for other categories of visas or is this not in his power ? If not, at the very least this should serve as an extra argument that DV winners are being unfairly treated.
I am asking this because I have no reason to believe that this PP won’t be extended if Trump gets re-elected and in that case entering the US under one of these exceptions seems to me to be the only possibility to activate our green-cards and finish the immigration process.
September 23, 2020 at 17:52
Brit just to clarify one thing. If after my interview my visa is approved, can i travel to usa? Our country Kosovo is not part of any ban and we can travel easly through Turkey. Some family members that are in usa ( us citizien) has travel to Kosovo for vacation even during covid-19.
September 23, 2020 at 18:46
Newly issued visas cannot be used while the ban is in force.
September 26, 2020 at 18:28
Brit, we got married after I won green card and one of the girl that took our documents asked about our marrige and if it needs to sens evidence, can u send us but only id consular ask you. We are in relationship more than 7 years, consular just said that u got married after u won green card, and I just yes but didnt asked me more. Should i send any evidence on monday because on monday we gonna send medicals at embassy?
September 27, 2020 at 04:45
No – no need to answer a question not asked.
September 23, 2020 at 18:18
Hi Brit, how are you?
I am writing to tell you about a peculiarity of my case. I sent DS 260 and documents in May. In June I called the KCC and they told me that they couldn’t give me any information and that the person who was calling me didn’t have access to see how my status or documents were doing.
Today, after several e-mails to the embassy, I am told that the KCC informed them that I did not send the documents.
I sent the email with all my documents twice, once on May 10th and once on September 11th, in both cases I received the automatic email saying that my documents had been received and that in 3 weeks I would get a reply.
Today we sent the documents again from two different e-mails, receiving the automatic one. However, we called again and they keep saying that they do not have any documents registered with us, they only have the D.
We are the only case of SA that we know that this has happened to them in spite of knowing several people who sent them days nearby.
What can we do? We have already lost all hope because we do not know why this happened to us.
I wrote back to the KCC showing all the evidence but still no answer.
We lost the opportunity, didn’t we?
Thank you and Greetings
Laura
September 23, 2020 at 18:45
It sounds like you are falling into one of the following traps:
Documents missing from the package.
The email or the documents not being identified correctly.
Wrong email address.
Filesize being too large for their server or somehow not attached.
At this point, your chance is gone, unless there is an extension.
September 23, 2020 at 18:54
We send the requested documents to : [email protected]
We send: birth certificates, passports, marriage certificates, studies and criminal certificates. We name them as follows:
2020SA00003xxx_Laura_Gonzalez_Police_Certificate_Country_Chile_Renewed
I put my case number in the subject and in the text our data.
Then I will not send them again?
September 23, 2020 at 23:03
If there is an extension you will need to send them again. Without the extension its pointless. Did you check the file size though on the emails you sent?
September 23, 2020 at 18:37
hi Simon, I wanted to ask you, we are the winners of DV2020, category 2, we were interviewed and honey. examination but we do not have time to submit medical documents to the embassy, because the results of medical examinations require more time, what should we do?
September 23, 2020 at 23:29
Unless there is an extension you have a deadline to meet. If you cannot provide the medicals in time your case will not be approved.
September 23, 2020 at 18:42

September 23, 2020 at 23:30
The embassy where you interview will have a list of physicians they approve. It must be one of those.
September 23, 2020 at 19:15
My brother case number is 2020AF38185 kinshasa. Which groups in he on, please?. People who are receiving interviews date did you contact the embassy or not. I contacted ours for my boyfriend but they are telling us just to wait. He missed his interview on April 30th due to covid.
September 23, 2020 at 23:34
Group 3 because he already had an interview. You must push the embassy.
September 23, 2020 at 20:30
Hi, Brit!
Can you help me clarify some points, please?
1. I am DV 2020, 34ххх I sent the DC-260 in April. I have never received help or somme charity from the state before, so I indicated it in the DC-260. later I received help from the state twice, because my business was considered the most affected by the quarantine.I am an individual entrepreneur. If there is an extension, do I need to indicate this in the DC-260 (unlock it and enter this data)? I am in the fifth group, my documents have not been verified yet.
2. I heard that government assistance in connection with quarantine is not considered social assistance, is it? I want to understand, if at an interview or in some other questionnaires I am asked whether I received assistance from the state, should I answer “yes”?
Thank you for your help!

1. No
2. I don’t know what you received, but it is UNLIKELY to be considered “public assistance”.

Please reach out to KCC for additional information.

Hi Brit, I am in group 5 praying for an extension. I relocated to the Netherlands from Kenya 2 months ago and i would like to change my interview location from Nairobi to Amsterdam if we get an extension. Will it delay the processing of my case and is it advisable to do so at this time.
September 24, 2020 at 18:54
You should do that, yes.

Hi Simon,
FYI.
My wife is DV2020 selectee from Indonesia (2020AS20XXX). Today, my wife called KCC and our CN is on-scheduling. The KCC Officer told they dont know how long to be waiting as they dont under scheduling division.
Please advise Simon, this is mention to the capacity on embassy or waiting in the rank CN in KCC? Do I need to call our embassy?
Thanks in advance.

Hello brit i have filled my ds260 and sent documents early this year and no one contacted me about the documents so i was group 5 even tho i have sent them email once to process my documents and no response then 2 days ago i sent another email and they responeded witg this
Thank you for your inquiry.
Your DS-260 has been processed. You should have received an email from the Kentucky Consular Center giving you instructions to complete in order for your case to continue processing. Please follow the instructions in the email. Interviews are scheduled based on their selection order and the number of cases that are complete and have completed processing, and the availability of appointments. Please refer to the visa bulletin at travel.state.gov to locate the current numbers being processed. This bulletin is updated after the 15th day of each month. Once an interview date has been scheduled, you will receive notification via email to check dvlottery.state.gov.
My case number is AS30XXX. What does it mean should i send my documents again? Or what do they need? I hope u can respond fast thnx

Hello Simon,
I submitted my DS 260 on July 16 2020. My Case#2021XXX2056. I did not get any interview date yet. Is interviews are on hold because of Corona or this is normal process time?
Have wonderful day
September 26, 2020 at 23:48
Interviews are on hold because of Corona virus and the bans.

Hi brit ,
Thanks for the great job , i have a simple question that I hope your answer, my interview will be in another country abroad, and of course my documents are not in their language neither in English , should I translate all of them in English or in the other country’s language?
Regards!
