A very common question that comes up about the DV lottery is about the requirement to prove you will not become a public charge (i.e. be in need of financial assistance from the government). Many people have a hard time accepting that is even a requirement. Well it is. For sure. Everywhere, for everyone. Got that? OK – let me explain…
For DV lottery there is a set of rules that frequently refer to the Immigration and Nationality Act. Essentially the DV lottery is operated within a framework of immigration law and there are standard aspects of the laws that apply to all immigration cases. The public charge requirement is one such example. The instructions for the DV lottery include information about this in their FAQ (Question 37 in DV2015 and DV2016 instructions). The notes say:-
37. If I receive a visa through the DV program, will the U.S. government pay for my airfare to the United States, help me find housing and employment, and/or provide healthcare or any subsidies until I am fully settled?
No. The U.S. government will not provide any of these services to you if you receive a visa through the DV program. If you are selected to apply for a DV, you will need to demonstrate that you will not become a public charge in the United States before being issued a visa. This evidence may be in the form of a combination of your personal assets, an Affidavit of Support (Form I-134) submitted by a relative or friend residing in the United States, an offer of employment from an employer in the United States, or other evidence.
OK, so it is required. OK???
So how do you prove that you will not become a public charge. The simplest way is to demonstrate that you have enough money/assets to support yourself. This can be in various ways, for example:-
- Bank/other financial statements
- Real Estate/Property
- Stocks/Bonds
- Income from business investments
The CO will be far more interested in “liquid” assets (such as savings in a bank account) than other non liquid assets.
If you intend to show the above you will need to show around $10,000 for each adult, and a bit less for children (for example $25,000 for a family of four, $10,000 for a single person). This can be from a combination of the above.
If you cannot show that level of personal finance a job offer can help, and of course someone already working in the USA on a temporary visa can show existing salary (payslips, tax records, job confirmation letters and so on).
If the selectee cannot provide the above, they may be advised obtaining an “affidavit of support” from a family member or friend already in the USA. The affidavit of support should be in the form of the I-134 which must be filled out by a US legal resident and supported by tax filing records, payslips and so on. The instructions for the I-134 are clear and helpful.
The selectee only needs to provide one I-134 to cover their case (it covers the principal and all derivatives). The income of the person filling out the I-134 should be greater than that shown on the Federal Poverty Guidelines for total number of family members for the sponsor/family AND the selectee/derivatives.
The original (or now scanned/emailed) signed I-134 plus supporting documents is presented by the selectee at the interview IF requested. Not all embassies request it as a matter of course, and some hardly ever request it. However, not providing it if requested can lead to AP/disqualification.
Supporting documents for the I-134 are the sponsors:
- 1040 (annual tax report – most recent copy)
- W2 (annual employee earnings statement if employed – most recent copy)
- Recent Payslips
- Photo ID
The I-134 should be sent to you prior to the interview by mail or scanned and the supporting documents can be photocopies or sent by email.
There are several African countries where the “host” system serves to satisfy the requirements. If the selectee is planning to stay with a host, they could be asked what is the relationship between host and selectee. If there is a good relationship (family, or close friend) the Consular Officer is allowed to use their discretion to take that as evidence that the selectee will not become a public charge.

10000 Euros won’t last long, but the CO will weigh up all the factors, such as your other assets, employment prospects, and family in the USA. Take as much proof as possible.

I had my dv interview on 03/11/2015.
The CO asked me to send the IRS transcript of 2014 of my financial sponsor.I presented the Affidavit of Support i-134 , form 1040 tax return of the my sponsor at the interview. But it was not enought. I have to submit the IRS transcript of the my sponsor.
The problem is my sponsor days he can not give IRS due to his personal reason.
Can I change my sponsor?
I got another friend of mine who has got all the required financial documents to sponsor me.
What would happen if I can change the sponsor?

They can (depending on their visa and work status) but it is slightly riskier, because the obvious question is how long will that sponsor be there to support you if needed.

Hi i went for my interview yesterday in Accra. The CO denied me visa. Reason given was that i did not follow dv rules. My crime was that i unlocked the ds 260 forms and made changes. The change was as follows. I changed my third child birth date from 05 may to 04 may 2015. It was an error when i completed the ds 260 for the first time. Again i had made a change of name about 10 years ago, so name on my sssce certificate is different to all my other documents. It is a legal change done in the court and published in the newspapers. She again had issues with that. It this enough reason to denied me. Can i appeal

No you cannot appeal, the decision of the CO is final. I’m sorry it ended that way.
The changing of the childs’ birthdate cannot have caused the denial, but having education documents which don’t match your name probably created suspicion that the documents are not yours. In that case, Accra tend to deny cases that are suspicious.

Hi Simon, I do have a question regarding the I 134. I left US in August to do CP in my home country. My dear friend and roomate filled out a form and gave me her tax return for this year, plus bank statements from each bank, papers showing the value of her homes and her business. The net worth is not important, but income statements (W2, Payslips and so on) are important. Without that, the affidavit is worthless.

First, thank you for what you do for us. I started reading you since 2013 on immigration forum.
I already told you in forum that i was selected for DV2014, but with a big CN (AF116XXX). This year, i have been selected with a CN “smallest” than the old but still as big lol (AF48XXX). I would like to submit you my concern.
I had an accident last year, but thanks to God everything is just fine now. The problem is that I still continue to walk with a crutch (“canne anglaise” in french lol), with a single, not the pair. and I would probably walk with until september 2016. There is no need of affidavit of sponsor in my country, 2 of my close friends won and the affidavit was not asked last year. I also learned that on several forums since my first selection, the only think is asked is the adress of the person that will l host you. I plan to continue studies there and I will live with the big sister of a close friend.
Based on these informations, i would like to know if form I-134 could be asked to me because am walking with a crutch or for something else. Could i need to prouve that i will not become an public charge ? could i be bored during the medical visit ?

Wow – its been quite a journey in the last 3 years for you, huh. It feels like you were meant to win the DV lottery.
In countries where the host system is used, the I-134 is rarely asked for but can be. Given your case number I expect you to be interviewed in the final batch – probably September. So because of that I would recommend you get the I-134 anyway. If they ask for the I-134 in an interview in March – that is no problem as there is plenty of time to get it, but *IF* they ask for one in September, you won’t have enough time to get it.
For the medical, yes there could be an aspect that increases your public charge concern, really depending on the work you do. If it is something physical – that might be more impacted than a desk job. That aspect could be raised by the doctor in a report – and the CO would decide.

There was an error in my 3rd child date of birth. Initially i typed 4 may 2015 instead of 5 may 2015. Again i initially answered yes to coming to US to perform skilled labour, i changed that to no and finally i initially answered no to not having documents to prove of vaccination as per US law, i changed that to yes. Please would you be so kind to provide me with answers on my following concerns:
1. My wife (beneficiary) is 6 month pregnant (second child), and yesterday 07.10 we had our medical examination (country: Kosovo) prior to our visa interview during October. Because of the pregnancy, we refused to do the chest x-ray, following also the consultation with ob-gyn and private well-known pulmonologist. My wife signed a document declaring refusal of x-ray test and of course the letter will be part of the sealed documentation by the panel physician. On the other side, am quite confident that this is the only thing that would be missing out of the entire documentation prepared for our interview.
Please, what is your opinion or advice on this matter?. I am really concerned what would be the response of the immigration consular office (Macedonia). How much it can hinder our case? Are there any exemption, alternatives/recommendations to this? Similar cases?
2. My father provided a substantial amount of money for immigration to US. Do I need any written statement or a bank transfer letter would be enough?

Tirana mishandle the public charge requirements, as well as other requirements.

They use I-134, but will expect your sponsors spouse to complete a second form. The I-864 is NOT to be used for DV cases.
They will apply the poverty guidelines at 125% level which for the combined family of 8 will be $51112. Normally that would be based on the sponsors joint income BUT with Tirana it would be better if the main sponsor were in excess of that number.

In almost all embassies in the world, only one form is expected. The only embassy that expects 2 forms is Tirana, let me know if you are interviewing there as they have odd requirements.

With the host system the I-134 is almost never asked for. If you are interviewing at the beginning of the year, I would not bother getting it. The downside of not having it is AP – but you have plenty of time to resolve the AP by providing the I-134 IF they request it (which I doubt).

Typically, yes. Try and make sure you are well prepared though. Accra have a high level of fraudulent cases – so they are quite accustomed to refusing cases if there is any doubt about documents etc.

It is a shame you did not have an I-134 available. Having money is useful – but what to accept is at the discretion of the CO. The CO asked for an I-134 – so that is what you should have presented. As to what will happen now – I don’t know – it is hard for me to guess based on what you have said.

Next, let me introduce myself to you.
I’m Sumit, a DV 2016 selectee from Nepal. I know, there’s a whole bunch of Facebook groups related to DV for Nepalese seelctees, but my situation is a unique one, hence I’m reaching out to you.
My problem is that I’ve been living in India for the past several years. As a result, I’ve selected my DV post as Mumbai rather than Kathmandu (like most Nepalese). Well, after researching on the Internet and your site in particular, I’ve figured out most parts of the puzzle. However, the only part that I’m not very sure about is the I-134 form.
I know for a fact that the Kathmandu embassy does not ask for this document and relies solely on the questions : “Where in the United States will you stay ?” and “Do you have a welcome letter from your sponsor ?”. However, as India is not one of the countries eligible for the DV, and processes a lower number of Diversity Visas, I believe that both visa posts, New Delhi and Mumbai would follow the rules a bit more strictly and ask for the I-134.
The question that I wanted to ask you was, based upon your observation and experience of New Delhi and Mumbai, how likely is it that they’ll ask for it ?
As a side-note, I work for a US based software company in India and can probably get myself “transferred” to the US. However, the I-134 seems to be something that a “friend” or a “relative” has to fill in. In that case, I’m not sure, who’d be able to fill it in for me. Do you know any cases where the visa candidate himself has filled up the I-134? In case you’re not sure, could you please redirect me to the right US government body that’d be able to help.
PS: My case number is 41** for Asia meaning probably I’ve time until March/April (?) 🙂

Any US embassy could ask for the I-134. Nairobi is similarly one that does not usually ask for it – but I became of a case the other day where it was requested – causing AP. So – KDU does not normally ask for it but they could. Embassies in India are more likely to ask for it.
It cannot be completed by yourself it has to be completed by a US resident/taxpayer.

Two more questions please
1) can the sponsor of I134 be someone else than the one you are going to live at for instance i am going to my sister but i want to request a sponsorship from my brother in another state, they are both american citizens
2) in case i dont do number one above, i can personnally show my bank statement with more than 10k (it is usually up to 6 months), the question is besides the bank statement am i suppose to show payslip etc if yes please let me know what document could help.

1. Yes that is fine.
2. If you have savings in a bank account that is all you need show. They don’t care about payslips from the job you are quitting!

3)i want you to confirm the sponsor should send the I134 SIGNED plus W2, 1040 tax forms and a copy of passport via email, which obviously means after scanning them.

1. Not that I have heard.
2. You misread the article. The $10k is the number the selectee should show to avoid public charge concerns without needing an I-134. Regarding the income for the sponsor – you have to add up your family, with the sponsors family and check the link for the appropriate income for that combined family size.
3. The I-134 should be MAILED – the other documents can be emailed.
